The Czech Mining Office provides pursuant to § 5 (3) and § 6 (6) (a) of the Czech National Council Act No. 61 / 1988 Coll., on Mining Activities, Explosives and on State Mining Administration:

GENERAL PROVISIONS

Preliminary provisions

§ 1

The Decree sets out, in accordance with the law of the European Community1 (b), requirements to ensure the safety and health of workers and of operations (hereinafter referred to as "labour and traffic safety ') in mining activity (1) in the underground and in mining of non-reserved minerals (1a) in the underground, including objects and equipment on the surface related to these activities. This Decree was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on information society services, as amended by Directive 98 / 48 / EC.

§ 2

Interpretation of terms

(1) For the purposes of this decree, it shall be considered as:

(a) a mobile (mobile) machine such a machine which, in its work, moves from place to place;

(b) a long load of an article exceeding the loading area of the vehicle in the longitudinal direction so that an auxiliary coupling device (towing, chain, etc.) must be used to connect the vehicle to the next vehicle;

(c) a mine operating unit which, as a general rule, constitutes a separate technical unit from the point of view of ventilation, whatever it is called by the organisation,

(d) the mining work of the underground area created by mining activities; a mine work is also considered as a ventilation, drainage, mining and rescue well and other wells which perform the function of the mine work. A search and reconnaissance well is not considered a mining work,

(e) a mine fire of undesirable and uncontrolled burning; a self-ignition process is considered to be a mine fire, from a stage where its residues are capable of endangering the health or lives of humans or where the temperature of the flammable material could cause an explosion;

(f) a sign of prohibition, warning, order or information expressed in terms of sound, light, mark, sign or sign according to its position, movement or colour;

(g) protective equipment of a technical or other device to prevent accidents, accidents or failures of a technical device; protective equipment shall also be considered as a locking device for the recharging machine;

(h) the protective distance from the source of danger, the distance between the protective device and the source threatening the life or health of workers (rotating, moving or hot parts of machinery, parts of electrical equipment under voltage, etc.),

(ch) open fire of deliberate and controlled burning; an open fire shall also be considered to be the development of heat energy or sparkle resulting from deliberately induced physical or chemical processes or processes or processes and could cause a fire or explosion;

(i) underground work of underground space created by activities carried out in a mining manner;

(j) a semi-stringed composite, or part thereof, having a inclination of 22 to 60 ° from the horizontal plane;

(k) only wall break; other bearing mining workplaces are rigs,

(l) the work associated with increased danger, such work where the worker is at increased risk of injury. It is the work provided for by this decree, the work under which permanent supervision is ordered and the work decided by the organisation,

(m) the workplace of the premises designated for the worker to carry out the work, including the technical facilities in that area, related to the designated work activities;

(n) an establishment constructed or otherwise enclosed in a space in which machinery or electrical equipment is incorporated or which is intended for the weaning of mobile machinery;

(o) an operating safety system of a set of measuring and control elements, including the necessary controls and, where appropriate, other parts of the equipment, which continuously or at specified intervals check the safe operation of the installation and ensure that it is switched off under predetermined conditions or in a condition where damage to the installation could occur due to overstep or, where appropriate, substigation of the specified values;

(p) separate wind separation of the mine works system, through which mining winds are carried out from the place where unused mining winds are separated from the connected or main draught wind currents to the place where they are connected to other air winds or outdoor atmosphere after use in the workplace. In so doing, no account shall be taken of the use of winds for the ventilation of openings and similar mining works, which are produced from a combined traction or exhaust wind current,

(q) permanent surveillance of the continuous monitoring of the work of workers and of the status of the workplace in which the worker designated by the organisation must not be removed from the workers and must not be employed by other than supervision;

(r) a steep seam, or part thereof, having a inclination of more than 60 ° from the horizontal plane;

(s) shafts of deep mining or underground work of circular cross-section with diameter up to 2,2 m or rectangular cross-section up to 3,75 m2 with a maximum depth of 40 m; a deep well is considered to be a shaft,

(t) maintenance of the equipment shall be carried out in order to maintain the equipment in an operational and safe state. The maintenance of the equipment shall also include inspections, tests, inspections, revisions and repairs of the equipment, as well as the installation and dismantling of parts of the equipment to the extent necessary to carry out inspections, tests, inspections, revisions or repairs of the equipment,

(u) a narrowly guided wind current such as that conducted in the mine, whose general inclination from the horizontal plane downwards exceeds 2 cm.m-1;

(v) the management of mining works the process of creating or disposing of mining works. Includes stamping, reinforcement, maintenance, reconstruction, creation, securing and disposal of mining or underground works and mining of exclusive bearings,

(2) For the purposes of this Order, it shall also be considered as:

(a) the burden of excessive weight on an article weighing more than 4000 kg;

(b) the burden of excessive dimensions of an object whose transport or handling is not possible to meet the road gaps laid down in this Decree;

(c) the burden of a non-storage item requiring special security to maintain it in a stable position for its safe loading and transport on a means of transport in terms of stability;

(d) the burden of the special burden of excessive weight, the burden of excessive dimensions or the burden of non-storage;

(e) transport by land road to the load by a transport platform or self-propelled transport chassis situated on the transport line and anchored in the beginning of a mine with a safety against derailment or overturning of the means of transport;

(f) transport by shear to the load on the rock ground either on or without the transport platform or on the transport platform following a special line placed and anchored on the ground of the mine, using a door or other machinery;

(g) the principal ground line by the ground line from the machined grounder to the mine station and the transformation stations;

h) cable hinge for supporting cable attachment on reinforcement or wall of mine works,

(i) tilting moment the sum of the momentary component of the vehicle's gravity and the tangential component of the load relative to the tilting point;

(j) non-ignition electrical circuit electrical circuit which, under normal operating conditions, does not produce sparks or thermal effects which would be capable of igniting the explosive gaseous atmosphere;

k) Current protection over-current (short-circuit), two-stage (time-dependent) or inverse (anti-overload) and ground protection

(l) special transport by transport and handling of a special load using rail, suspension or ground track transport and transport of any load by skid when using devices with a towing force greater than 45 kN;

(m) the stabilised position of the object at which the stabilising moment is greater than the tilting moment;

(n) stabilising moment the sum of the moments of the normal component of the vehicle and of the moments of the normal component of the load relative to the tilting point;

(o) the grounding system a set of connections and elements necessary for the separate or joint grounding of electrical equipment;

(p) a power contactor over 1 kV of an electrical device with one resting position that is not manually operated and is capable of switching on, transmitting and disabling currents under normal conditions, including service overloads;

q) a power switch over 1 kV electrical equipment designed to connect and disconnect electrical circuits, lines or devices, even at full load voltage and also in fault states.

§ 3

Responsibility for compliance with the Order

The responsibility of the staff at the various stages of the proceedings for carrying out the duties laid down in this Decree shall be detailed in the organisational rules of the organisation.

Objects, workplaces and equipment

§ 4

Entry to objects and to workplaces

(1) The surface objects of the workplace and equipment must be fenced or otherwise secured against the entry of unauthorised persons.

(2) The mouth of the mine to the surface shall be secured against the entry of unauthorised persons so as not to prevent workers from leaving the mine at risk.

(3) The openings, deeps, sinkholes and other places where there is a risk of persons falling must be covered, fenced or buried.

(4) The organisation shall determine the means of securing the places referred to in paragraphs 1 and 2 against the entry of unauthorised persons and their time limits.

(5) The prohibition of the entry of unauthorised persons into the places referred to in paragraphs 1 and 2 must be marked with a safety mark (3) at all entrances, access and travel.

(6) Entry into mining works marked with a ban on entry (safety mark, bar cross, etc.) or from non-accessible shall be prohibited. If necessary, they may only be entered on a written order in which the organisation identifies measures to ensure the safety of entry workers. Entry shall be allowed only after verification of the composition of the mining air and in the presence of a worker intended for continuous measurement of the expected pollutants.

(7) Persons under the influence of alcohol or other narcotic drugs may not enter the premises and the workplace; 4) carry out random checks on compliance with this prohibition and their extent and method shall be determined by the factory mine or by its authorised worker.

(8) Access to the workplace shall be permitted only to personnel assigned to work, control or supervision at the workplace; other persons only accompanied by a designated worker.

(9) Any person entering a mine shall have a mine personal luminaire, a self-rescue device, a protective helmet and other necessary personal protective equipment; 5) when deepening pits, digging shafts up to 15 m and when working in a mining manner shall have a self-rescue device only if the organisation and the mine personal luminaire so determine only if the workplace is not sufficiently lit by daylight.

(10) On the surface, the protective helmet shall be fitted with anyone entering places with the risk of falling objects.

§ 4a

Self-rescue apparatus

(1) Only insulating-type self-rescue devices may be used in coal mines. On the other mines, on the basis of a favourable risk assessment and evaluation (a), a filter self-rescue device may be used instead of a self-rescue device of the insulating type.

(2) Only one type of self-rescue device can be used on one mine.

(3) Self-rescue apparatus may be issued for use only provided that the apparatus has a clearly marked diagram of the method of use.

(4) A self-rescue device may only be postponed at a mine within a distance of a maximum of 5 metres from each other at the workplace.

(5) The organisation will clearly identify and practice employees in the use of a self-rescue device before its first assignment. Practical training shall be repeated at least once a year.

(6) For practical staff exercises, the organisation shall ensure that the number of self-rescue exercises can be carried out within the specified time limits. It is also possible to use discarded self-rescue devices for practical exercises.

§ 4b

Object requirements

(1) Floors in places where people are walking or where people are staying shall have no inequalities, bulges, holes or dangerous inclination; shall be safe for walking and against slipping.

(2) The surface area (base), height and volume of the working space must be designed so that workers can carry out their work without affecting their safety, health or good working well-being.

(3) The space available to the staff member at the workplace must be such that the staff member has sufficient freedom of movement in his activity and can carry out his tasks safely.

(4) Windows, skylights and ventilation equipment which may be opened, closed, rebuilt and secured should be designed to ensure safe handling. It shall allow safe cleaning. In the open state it shall not constitute a danger to workers.

(5) Transparent or translucent walls, bulkheads in or near the transport routes, doors and doors shall be clearly marked at eye level and shall be made of safety materials or reliably protected in order to prevent injury to workers if they are broken.

(6) Access to roofs from materials which do not have adequate load resistance shall be prohibited unless there is a device in place that allows the appropriate operation to be performed safely.

(7) The location, number and dimensions of doors and doors and the materials for their manufacture must be chosen according to the characteristics and manner of use of premises and workplaces.

(8) Doors and doors must meet the following requirements:

(a) the shuttle doors and doors must be transparent or have a transparent window;

b) the sliding door shall be secured against ejection and falling out;

(d) the emergency doors shall be opened outwards, marked, their structures shall be capable of being opened at any time even from the inside without any means of assistance and shall not be locked;

(e) the door on the road with traffic, if its passage for pedestrians is not safe, shall be equipped with other well-visible and still accessible doors for passage;

(f) a door and door operated by mechanical force shall not endanger the staff by moving it, shall be equipped with a clear, well-recognizable and easily accessible emergency switch-off device and, except in the case of failure of the power supply, shall allow manual opening;

(g) where access to a site is restricted by chains or similar devices, such chains or similar devices shall be clearly visible and marked with appropriate signs of prohibition or warning.

(9) Auxiliary operating objects, such as workshop, office, warehouse or rest room, must be located in an area without risk of explosion.

(10) If the measuring and control devices to which the gas is supplied are installed in the operating facility, their exhaust pipe shall be removed from the facility so that the gas cannot return, even diluted.

(11) Operating objects must be marked with the object name.

§ 5

Operational documentation

(1) Before the work or activity for which it is provided for by this decree is initiated, the relevant operational documentation must be drawn up, namely the technological procedure, the working procedure, the transport rules, the operating rules or the instructions for use77).

(2) The operational documentation shall determine the continuity and, where appropriate, the simultaneous nature of the operations, the conditions for the safe performance of the work, the places at risk and the way in which they are marked, the means and the instrumentation to ensure the safety of the work and the operation, and the measures to ensure the workplace for as long as it is not operated.

(3) (6) the technical conditions of the manufacturer or supplier of the equipment or the construction and maintenance instructions of the manufacturer.

(4) For similar activities, type operational documentation adapted to local conditions may be used.

(5) The operational documentation shall be adapted without delay when the conditions are changed.

(6) Workers must be familiar with the operational documentation to the extent that they are concerned before work begins.

(7) The operational documentation shall be stored in a designated place accessible to workers who are obliged to comply.

(8) The operational documentation shall be kept at least one year after the completion of the work. Where a mass, severe or fatal accident has occurred during the work, the operational documentation shall be kept for at least 5 years after the accident.

§ 6

Equipment

(1) Only workplaces, machines, equipment, apparatus, equipment, equipment, objects and materials that comply with the rules for safety and safety at work and for safety of operations may be operated and used in the activities covered by this Decree. Only products, 79) which meet the safety product requirements by design, design and technical condition may be put into use. 80)

(2) The use of machinery, equipment, apparatus, aids and materials shall comply with the manufacturer's instructions or technical conditions, instructions and conditions laid down in their approval or authorisation.

(3) Equipment, as well as other means and tools which serve the operation and its safety and, where appropriate, the protection of the life and health of workers, must be kept in a safe and usable condition. Devices may only be put into operation or used by personnel designated to operate them. Equipment may be used for the operations for which it is intended; other operations only under the conditions of designated organisations.

(4) Where protective equipment is damaged or temporarily deactivated for urgent reasons, it shall be replaced or put into good condition as soon as possible. Until then, safety of work and operation shall be ensured by appropriate safety measures.

(5) The safety of workers at work at a height above 1,5 m in underground workplaces must be addressed by operational documentation.

(6) In the vicinity of breakdowns, quarts and embossed mining works, other than shafts, underground works and underground structures, a telecommunications device connected to the dispatching unit or another designated location shall be located.

(7) The organisation shall provide inspections of steel and wood structures and structures at least once a year if they are exposed to moisture or aggressive substances.

(8) The inspection referred to in paragraph 7 shall also determine whether the cover sheets or grill grids of platform floors are secured against accidental displacement, rollover and oblique position and whether the cover sheets or grids are hardwired. For platforms, external defects are detected visually and by tap. In the case of platforms which have welded structures, the condition of the welds of their carrier parts shall also be checked for external defects. When external welds defects are detected, they shall be checked using a defectoscopy (e.g. capillary method) to see if welds show cracks.

(9) The cover sheets shall have a minimum thickness of 5 mm unless the project determines a higher value. The surface of the sheets shall be grooved or otherwise crushed.

§ 7

Workplaces tours

(1) Unless otherwise provided for in this Decree or in specific provisions, the Institute shall be obliged to examine:

(a) an exchange technique in a coal mine at least once in each half of the shift, in other mines at least once per shift and on the surface of deep-sea mines at least once a day; on non-working days, the organisation may refrain from surface inspections,

(b) a technician directly superior to an exchange technician or his representative in a coal mine at least twice a week, in other mines and on the surface of deep mines at least once a week.

(2) In designated remote and scattered surface workplaces with simple operating conditions (shafts, drilling, etc.), the workplace is obliged to examine

(a) an exchange technique at least once a week;

(b) the technician directly superior to the exchange technician or his representative at least every two weeks;

(c) the foreman or, where appropriate, the head of the group (hereinafter referred to as "foreman") in each shift in which the inspection referred to in (a) or (b) is not carried out.

(3) The foreman intended to conduct inspections of the workplaces referred to in paragraph 2 (c) shall:

(a) have at least three years' experience in carrying out similar work;

(b) take part in training and pass an examination of the relevant regulations to ensure safety of work and operation to the extent required for the exchange technician;

(c) obtain from the organisation a written mandate to exercise oversight with a definition of rights and obligations. This mandate shall be indicated in the operational documentation for the relevant workplace including a description of the control activities of the foreman.

(4) The inspection of the workplace referred to in paragraph 2 (a) and (b) shall also check the possession and safety of explosives, the records of explosives, and, where appropriate, the preparation and, where appropriate, the execution of the shredding work.

(5) The exchange technician, the technician directly superior to the exchange technician and his representative (hereinafter referred to as the "supervisory authorities") and other technicians are required to check compliance with the relevant operational documentation, the state of the safety equipment and the mine with the risk of methane (hereinafter referred to as the "flowing mine") and the concentration of methane in the mining air and to ensure that the defects detected are corrected. If the defects identified cannot be remedied and the workers appear and are in imminent danger, the supervisory authorities and other technicians shall be obliged to stop work and arrange for workers to go to a safe place. This measure shall be immediately notified to the dispatcher or inspection service who shall also notify the health and safety inspector at the work of the social inspection body.

(6) The results of the inspections and the measures identified must be recorded [Paragraph 23 (1) (g)].

(7) The supervisory authorities are obliged to carry with them the relevant part of the mine map with the marking of all wind (Sections 92 and 129) and rescue (Sections 291 (8)) routes.

§ 8

Preliminary inspections of mining works

(1) The safety status of all underground workplaces where no work has been carried out for the period laid down in paragraphs 2, 3 and 4, including all access to them, must be verified by preliminary inspection before reoccupying the workplaces. Preliminary inspections must also be carried out at places where workers will be present. Preliminary inspections shall be carried out by a pair of workers designated by the race mine or by its authorised worker. At the same time, workplaces must be designated for each pair to check, access to them and the deadlines and reporting points for the inspection service.

(2) The preliminary inspections must be carried out on the fluent mines if the workplace has not been occupied by 2 or more shifts. At workplaces checked with a passing wind current which can be expected to be gasified, inspections may be carried out after 3 or more unbusy shifts. Preliminary examinations shall not be carried out more than 3 hours before the occupancy of the workplaces.

(3) Separately ventilated mining works in which an increased concentration of methane is permitted in accordance with Paragraph 83 (5), and non-penetrated mining works and their divergent mining works in the flowing mine must be provisionally inspected after no more than 3 hours. The results of these inspections must also be noted by the workers who carried them out on a table which will be transferred from the front to a suitable point at the entrance to the mine in the transit wind current. If, in these mining works, the concentration of methane measured by continuous analysers placed under the legislation regulating separate ventilation in continuous doll80a) does not exceed 0,8% during the period of non-occupancy of the mine, it shall be sufficient if these works are provisionally inspected after no longer than 2 shifts.

(4) In a non-methane mine ("non-flowing mine '), where no work was carried out during the period determined by the race mine, preliminary inspections shall not be carried out less than 6 hours before the occupation.

(5) For preliminary inspections, in particular the concentration of carbon monoxide and carbon dioxide shall be determined, as well as the concentration of methane in the mining air and in the coal mine, in the fluent mine, and the destruction of coal dust. On the fluent hazard class II mines [§ 79 (4) (a)] and on the fluent mine-shock mines [§ 73 (1) (b)], preliminary inspection personnel shall also be equipped with portable continuous methane analysers or carbon dioxide with signaling.

(6) The results of the preliminary examinations must be reported to the dispatcher or inspection service before the job is occupied, in the workplace according to § 7 (2) to the foreman, and recorded.

§ 9

Personnel records

(1) The precise and uniform records of workers must be kept from their entry into work until the end of their shift.

(2) The staff responsible for keeping records and the supervisory authorities shall be required to check that all staff have left their posts or have been entered into the register of the following shift no later than one hour after the end of the shift. In the case of underground workers, they are obliged to check whether they have come out of the mine.

(3) Double independent records must be kept of all persons staying underground. In mining activities where fewer than 10 persons are present in the most occupied underground shift, one record is sufficient.

(4) If there's a missing person, a search must be initiated immediately.

§ 10

Inspection service

(1) In all working and non-working shifts, an inspection service shall be provided whose organisation and tasks shall be determined by the racing mines. This service can only be entrusted to a worker who is competent to manage the damage. 7)

(2) The inspection service may perform its functions outside the mine for more than one mine with simple conditions, especially in ventilation.

(a) telecommunications link between the mine and the inspection service;

(b) informing inspection services of the situation at the mine;

(c) the removal of workers from the underground and the introduction of an inspection service to the mine in the event of an accident;

(d) urgent transport of the inspection service to the mine in the event of an accident.

(3) If there is no working in the underground of a non-coal mine, the racing mine may refrain from providing an inspection service.

§ 12

Meeting of workers with safety regulations

(1) The organisation is required to inform workers who design, manage, control and implement the work, with this decree or, where appropriate, with the specific provisions referred to in this decree, with other regulations to ensure the safety of the work and the operation (8) and with decisions of the State Mining Authority, at least to the extent necessary for the performance of their duties. The periods of re-familiarisation of workers with these regulations shall be determined by the racing mine. The organisation shall allow workers to consult these rules and provide them with the necessary explanations on their request.

(2) The organisation is required to identify the activities for which it issues the rules, 8) and transmit them to the workers concerned.

(3) Newly recruited workers must be trained, both theoretically and practically, according to the curriculum issued by the race mine and tested. Theoretical training of workers who are to work underground and who have not yet worked underground or who have interrupted such work for more than 2 years shall take at least 24 teaching hours for surface workers at least 8 teaching hours.

§ 13

Special protection for students working underground

In the underground, pupils of secondary vocational training may only work at workplaces approved for this purpose by the organisation. This also applies to pupils of secondary vocational schools and university listeners under 18 years of age.

§ 14

Allocation of work

(1) A worker may only be assigned to work (function) and workstation if his medical fitness has been assessed in advance, (9) the theoretical and practical knowledge has been verified and he has been familiar with the relevant rules to ensure safety of work and operation.

(2) Prior to inclusion in workplaces at risk of rock, coal and gas bursts, mining shocks or water and mud streams (waterborne rocks), the organisation is obliged to instruct workers about these hazards, their symptoms and how they should act when they are detected.

(3) A worker not familiar with local conditions must be brought to the workplace at least on the first shift by a worker who knows them well.

(4) Only skilled workers can work with increased danger. In order to carry out such work, operational documentation must be drawn up and work carried out under constant supervision.

(5) Work to eliminate the obvious and immediate threat may only be carried out after the execution order has been issued and permanent supervision has been determined.

(6) The organisation shall decide whether the work referred to in paragraph 4 or 5 is concerned.

§ 15

Separate performance

(1) The organisation may only entrust a worker who has completed 18 years of age with a specific training in which he has worked under the supervision of a designated qualified worker and has passed an examination of the relevant expertise and regulations to ensure safety of work and operations.

(2) The syllabus of training, its length and the method of testing shall determine the racing mines according to the type of work, unless such requirements are laid down by regulations to ensure the safety of work and operation or by specific regulations.

(3) Training and examination may be waived by the organisation to workers who are trained in the field in which they are to work and graduates of secondary vocational and higher education institutions in the relevant direction.

§ 16

Occupation of workplaces

There shall be at least two workers at the workplace from which it is not possible to call or report by telephone or other means. There may be one worker at the other workplaces; In such a case, the organisation shall determine the manner and time of the call or notification or shorter periods of inspections by the supervisory authorities.

§ 17

Obligations of staff

(1) Workers are required to verify the safety of the workplace before and during work. In the event of a threat, they must stop the work, notify the foreman and proceed in accordance with Paragraph 18. They can continue their work as soon as the threat has passed.

(2) Except in the cases referred to in § 14 (5), § 45 (5), § 61, 63, 64, 65 and 71, workers may not enter, stay in, and remove any signs thereof.

(3) Workers are required to use assigned personal protective equipment, to follow operational documentation and regulations to ensure safety of work and to choose such working procedures that are in accordance with the principles of safe work. They shall not change anything without an order to operate, safety, fire, sanitation or other facilities. Only the machines, equipment, tools and tools intended for their work can be used and operated.

(4) Workers shall not leave their place of work without the consent of the foreman or leave them early without the approval of the supervisory authority, except for urgent reasons (nausea, sudden illness, injury, etc.). The departure for urgent reasons shall be notified as soon as possible to the foreman and supervisory authority or dispatcher.

(5) Workers shall comply with the instructions resulting from safety markings, warning signals and warnings. They are also obliged to follow the instructions of patrols securing the security circuit (during shredding, etc.).

(6) In places with increased fire hazard on the surface, workers shall not use open fire and smoke. In exceptional cases, they may use open fire only on written orders from the organisation. 10)
