DECLARATION
Federal Ministry of the Interior
of 10 March 1977
which gives more detailed regulations to the Matrix Act
The Federal Ministry of the Interior provides, pursuant to § 21 (1) and § 28 of Act No. 268 / 1949 Coll., on Matrices (hereinafter referred to as "the Act"):
ORGANISATION
Jurisdiction in Matrix cases
(1) Matrices are maintained and the tasks related thereto are provided by local (urban) national committees (hereinafter referred to as "local" national committees).
(2) Responsible for the registration of birth, death and marriage is the local national committee in whose district a person was born or died or married.
Matrix circuit
The District National Committee may entrust the local national committee with the exercise of a matrix competence for the perimeter of another local national committee (Section 5 of the Act), after all participating local national committees have been expressed. A single marriage book shall be kept for the matrix district of all these local national committees; the birth and death books shall be kept by the national committee responsible for each municipality.
Matricide
(1) For the management of the matrix, the local national committee carrying out the matrices shall determine the matrices and its representatives.
(2) A national citizen of the Czech Republic may be appointed as a matrix (representative), who
(a) is mature;
(b) is civil,
(c) has demonstrated knowledge of the management of the matrix by passing the examination with the directly superior national committee.
(3) The Registrar (representative) takes the following oath in the hands of the chairman of the local national committee:
"I promise to be faithful to the Czech Republic. I will uphold her laws and perform all duties associated with leading the mantle to the best of my knowledge. I will remain silent about all the facts that I will learn from my official activities.
(4) As a general rule, the matricide (representative) shall be established by the competent staff of the local national committee exercising the functions of the matrix. For local national committees which have no administrative staff, another competent person shall be appointed by the matrix (representative) in accordance with the rules governing work agreements outside the employment relationship.
(1) In the performance of the matrix activity, the matricist (representative) is subordinate to the chairman of the local national committee. When mandating the local national committee to lead the matrix for the perimeter of other local national committees (Section 5 of the Act), the matricist (representative) shall be subordinate to the chairman of the local national committee responsible for the management of the matrix.
(2) The Matrix (representative) has the status of a public official.
(1) The representative of the matrix holder shall carry out a matrix activity, in particular if the matrix holder is absent (for sickness, leave, etc.) or if there is doubt about his bias. 1)
(2) If neither the matricide nor its representative are able to perform the matrix activities, the immediately superior national committee shall take the necessary measures to ensure the proper management of the matrix, which may, in particular, order for the period of the necessary matricide (representative) of another local national committee exercising the matrices, following the comments of the local national committee concerned. The so-called Matrix shall be subordinate to the Chairman of the Local National Committee, who shall temporarily serve as Matrix.
Supervision of the management of the matrix
(1) National higher-level committees are responsible for the management of the scheme. The immediately superior national committee shall, as appropriate, at least once a year, carry out a check on the management and administration of the manuals according to the collections of documents and take appropriate measures to remedy the defects detected.
(2) The Ministry of the Interior of the Czech Republic oversees the performance of the matrices.
GENERAL PRINCIPLES FOR MOTHER LEADER
Purpose of the matrix
The information relevant for the identification and verification of personal status shall be entered in the matrix. Matrix and official extracts are public documents.
Matrix content
Matrix is divided into a book of birth, a book of marriage and a book of death (hereinafter referred to as "matrix books").
Matrix Book
(1) The matrix book is kept on the prescribed form.
(2) On the first page, which is not numbered, the directly superior national committee shall attach a verification clause indicating the number of numbered pages in the book, signed, official seal, date and place of issue. The book shall be drawn through a line which shall be sealed on the front of the official seal of the directly superior national committee.
(3) The second and the other sides are numbered in such a way that the two sides facing each other have the same number (the matrix side).
(4) Each book has a label on the front plate with a type of book on it. The label shall indicate the local national committee for whose circumference the book is kept, the serial number of the volume and the initial and final date of registration. The back of the book shall bear the type of book, the serial number of the volume and the initial and final date of the entry.
(5) The matrix book will remain in the custody of the local national committee (Section 7 (2) of the Act).
Implementation of entries in the matrix book
(1) Matrix books shall record the birth, marriage and death of the current year. The notes of facts in the following years shall be continued unless the whole book is described. The entries in each year are numbered separately. At the end of the year, a reasonable number of pages shall be left for any additional entries.
(2) If the book is described before the end of the current year, further books shall be used and the numbering of the entries shall be continued. The individual volumes of the same matrix book (birth, marriage, death) shall be marked successively with an Arabic number.
(1) The entry in the matrix book is made by completing the relevant columns and marked with a serial number. The number shall only be marked when the registration is carried out.
(2) The column which cannot be completed for the failure to know the facts in question shall be crossed out; However, the column marked "additional records and changes' may never be crossed.
(3) If some of the information to be completed in the column remains unknown even after the procedure to detect it, the indication "unknown 'or" not detected' in the column marked "additional records and changes' shall be completed.
(1) The birth records shall be made on the basis of written or oral notification, the death records on the basis of written notification by the doctor responsible for examining the dead; the conclusion of the marriage shall be registered on the basis of the registration of the marriage.
(2) The completion of the registration on the basis of a written notification shall be indicated in the column for entries and changes prior to signature.
(1) At the time of the oral notification of birth, the notifier shall, unless known to the Registry, prove his identity by means of either a citizen's card or evidence of his replacement or a credible witness.
(2) If the notifier is mute or deaf-mute, or if he makes a notification in a language not controlled by the matrix, an interpreter shall be added; as an interpreter, it is possible to specify 2) a family member or another trusted person. If it is not an interpreter appointed by the Minister of Justice or by the President of the Regional Court, he must take the oath prescribed by the special legislature.3) The provisions of the interpreter shall be indicated in the birth book in the column for entries and changes before signature.
Entries in the matrix are required by the matrician to perform usually by hand. If, for a serious reason, the registration has been made by another person, the Registrar shall sign it by hand.
Entries may only be carried out in manuscript and ink; the font must be neat, clean and legible to avoid any doubt or misinterpretation.
omission of the matrix party
If one or more matrix pages are accidentally omitted, the blank matrix side shall be crossed out by two lines across and marked with the "accidentally omitted" clause to which the matrix holder attaches his signature.
Repeal of registration
(1) An error started or, for any reason, not completed (signed), the registration shall be cancelled by crossing the beginning of the entry across two lines and in the column for additional entries and changes shall be noted that the entry is considered to be cancelled. The serial number of the cancelled registration shall also be deemed not to have been used if the cancelled registration has not yet been completed.
(2) The same procedure shall apply when the complete minutes are deleted.
Place of registration
The place of registration shall be the official room of the relevant local national committee.
Date of registration
Each entry, additional entry or additional entry or amendment shall be accompanied by the date on which the entry was made.
Indication of the place of residence, age, occupation, date of the matrix case and surname
(1) The place of permanent residence (residence) shall be entered in the register by the official name of the municipality and, where appropriate, parts thereof and the descriptive number; in municipalities where also indicative numbering is introduced, the name of the quarter, street and indicative number.
(2) Age shall be recorded on the date of birth, not the number of years. A 24-hour period is used to determine the hours.
(3) The profession is marked precisely by the field of work.
(4) The date of birth, conclusion of marriage and death shall be expressed in figures and words in the first fall.
(5) The parents of the person whose birth, marriage or death is registered shall be registered with the surname which they have at the time of registration and, if they have already married, with the surname which they have been free.
(6) When writing the surname of women, the shapes corresponding to the rules of Czech spelling are used.
Shortcuts
The abbreviation can only be used in matrix entries if it is common and does not affect the completeness and clarity of the written entry. However, it is not possible to shorten the designation of months and family status as well as the valid names of municipalities.
Complement missing data
If the person with a reporting obligation does not notify all the information necessary for the registration of birth or death, or if the documentary evidence for registration is missing, the Registrar shall immediately take action to identify missing data or to present documentary evidence, in particular by calling a member of the family of the person born or deceased.
Errors in the record
(1) The errors or errors identified in the minutes before their signature shall be corrected in the column marked "records and changes prior to signature."
(2) It is not permissible to remove errors or errors by erasing, scraping, using chemical means, crossing or writing between lines. The incorrect or incorrect entry in the entry is undercut. However, an incorrect serial number in the entry shall be crossed out in such a way that it remains legible and the correct number shall be written over the wrong number.
Signature of registration, additional entry and changes
(1) The Registrar (representative) shall sign the completed minutes by means of a legible signature. This concludes the registration and no changes can be made.
(2) If the registration was made on the basis of an oral notification, the registration shall also be signed by the notifier upon reading by the Registry.
(3) If the notifier cannot write, instead of signing, the notifier shall make a sign of the hand to which the Registrar shall attach the name and surname of the notifier.
(4) Each additional entry or change shall be signed by the Registrar (representative) and shall indicate the date on which it was taken.
Amendment of registration
(1) If it is found, after the registration has been closed, that any entry or the whole entry is incorrect or incomplete or if the entry is changed, the entry (correction, addition) shall be amended in the column marked "additional entries and changes'.
(2) The amendment shall be made on the basis of official or at the request of a person, on the basis of an authentic instrument.
(3) At the request of a person whose name or surname of Czech origin is entered in the matrix incorrectly, an amendment to the registration shall be made in accordance with the rules of the Czech spelling.
Additional Minutes
(1) The birth, conclusion of marriage and death which was not registered at the time specified for that purpose shall be registered retrospectively.
(2) The additional registration shall be carried out on the basis of an official or at the request of a person on the basis of an authentic instrument and the outcome of the procedure in place, in which an investigation shall be carried out to establish in full the information required for the registration.
(3) An official registration shall be carried out as soon as the Registrar becomes aware that the birth, marriage or death has not been registered. If the Registrar is not competent to register, he shall immediately notify the relevant Registry.
(4) An application for an additional registration may be submitted orally by a person or made in writing to the local national registration committee responsible or to the local national committee responsible for carrying out the matrices in which he or she resides. The Registrar responsible for the place of permanent (temporary) residence shall forward the application to the Registry responsible for carrying out the registration. A report shall be drawn up on the oral application.
(5) Additional entries shall be subject to the provisions applicable to normal entries.
(1) The paper supporting the supplementary registration is an official file on the outcome of the procedure.
(2) An additional entry shall be made in the year of the matrix book corresponding to the time when the birth, marriage or death occurred. The status of the data entry is as it was at this time.
(3) Additional entries on facts before 1 January 1950 which cannot be made in each relevant year for lack of free parties are to be made at the end of the year 1949.
Amendments and records made with the agreement of the directly superior national committee
Records and changes prior to signature, additional records and changes, as well as additional entries, shall be carried out by the matrix in its own capacity, unless they are recorded by the foreign authorities and courts, which shall be carried out only as directed by the directly superior national committee, in addition to the records carried out by the special matrix (§ 61 (1)).
Index
(1) Any registration of birth, marriage or death shall be indicated in the alphabetical index at the same time; the name index is kept separately for each type of matrix book. The page and the serial number of the entry of the relevant matrix book shall also be entered in the index.
(2) If sub-matrix books are kept, a common index for all such books may be established; in that case, the entry shall be marked in this index.
Matrix extract
(1) The Matrix issues an extract from the Matrix and allows, in the presence of his or her official or official of the Local National Committee, to look at the Matrix and to make an extract to the person who so requests and to prove that:
(a) registration concerning his or her family members;
(b) official enquiries;
(c) arrangements for supporting documents serving study, scientific or literary purposes;
(d) carrying out statistical surveys (4)
(2) Excerpts from the register may be requested in writing or orally.
(3) The extract from the matrix may be issued to the applicant in person if he proves his identity; otherwise it will be sent to him on delivery in his own hands.
(4) For official use, an extract from the register shall be issued to the public authorities, courts or public notaries when requested.
(1) The extract from the matrix is complete or literal.
(2) The complete extract shall contain all information on the facts recorded by status at the date of issue of the extract. This extract is referred to as the birth, marriage or death certificate.
(3) The verbatim statement shall contain all the entries entered in the original and amended version.
(4) The extract from the matrix shall be signed by the chairman of the local national committee or by the matricist (representative).
(5) The extract from the matrix is issued on the prescribed form.
(1) Matrix statements are issued in the Czech language even if the matrices are in another language.
(2) At the request of a person other than a Czech national whose name is registered in the matrix by 1 October 1959 in the Czech or Slovak language, the extract of the matrix shall state the name in its native language; This is marked in the matrix.
At the request of the person or, where appropriate, for the needs of the authorities of the administration, courts or notaries, a certificate shall be issued stating that the information on a particular fact is or is not contained in the matrix.
The administrative fees and their metering for acts under this Decree shall be laid down in a separate provision. 5)

Jurisdiction to register birth
(1) The competent national committee responsible for the registration of birth shall be responsible for maintaining the matrices in which the child was born or, failing to know where the child was born, the local national committee responsible for conducting the matrices in which the child was found.
(2) Where a child is born while riding in a means of transport, the competence of the local national committee shall be governed by the place where the child is born from the means of transport.
Time limit for notification
(1) The birth of the child must be notified to the Registry within seven days. The period shall begin on the day following birth. If this period ends on the day of work, the last day of the period shall be the closest to the next working day.
(2) The birth of a dead child should be notified no later than the following working day.
(3) The mother may continue to fulfil the notification obligation after these time limits as soon as she is able to make the notification.
Persons required by notification
(1) The birth shall be notified by the doctor or midwife, or by another person who was present at birth.
(2) If none of the persons referred to in the preceding paragraph are present, one of the parents shall be obliged to make a notification.
(3) Birth in a hospital, hospital or other hospital, barracks or other military accommodation facilities is required to notify the designated worker or master no later than the following working day.
Forms of notification
(1) Birth may be notified orally and in writing; birth in a medical institution or in a military accommodation facility and birth outside a medical institution in the presence of a doctor or midwife shall be notified only in writing. The registry of the oral notification shall be drawn up by the Registry with the notifier.
(2) The notification shall specify all the facts to be entered in the register. The name and surname of the child shall be typed or in block letters.
Writing into the birth book
(1) The registration in the birth book shall be carried out by the Matrix on the basis of the notification and, where appropriate, the findings in the birth book.
(2) In column 1, the serial number of the entry shall be entered, in column 2, day, month, year, place of birth and birth number, 6) in column 3, the name and surname of the child, his sex and citizenship. The day, month and year of birth shall also be written in the first fall.
(1) The name of the child shall be entered in accordance with the parent's consent declaration. When a child is born in a medical or military accommodation facility or when he is born outside a medical facility in the presence of a doctor or midwife, his co-signatures shall be made in writing for the parent's consent. If the parents' declarations are not in agreement, the matrix holder shall indicate it in column 3 and shall notify the competent court without delay.
(2) Only one name may be entered. A child who is a foreign national can be registered with more names at the request of his parents, who are also foreign citizens. The registration of names of charmed, small or domestic cannot be allowed. It is also not permissible for a male person to be given the name of a woman and vice versa, or to be given as a name to a child a non-personal name (i.e. the designation of things, days, etc.) or a name to be used as a surname, or a name to be given as a living sibling.
(1) If parents have a common surname, the surname of the child shall be registered according to the parent's surname.
(2) If parents have different surnames, the surname on which the parents, if married together, have agreed upon when the marriage is concluded shall be recorded.
(3) The parent of the unmarried shall bear the name of the child as agreed by the parent. If the parents have not yet agreed on the child's surname at the time of registration, the matricorn shall register the mother's surname and make a notice to the court. A change to the child's registered name shall be made and indicated in column 6 if the parents have agreed on the child's surname before the legal authority of the court or if the court so decides in the event of a disagreement between the parents.
(4) If the father of the child is not known, the surname of the mother who has the child at the time of birth shall be entered.
(5) If none of the parents are known, the surname that the court has appointed will be registered.
(6) If the surname (s) of parents (parents) of Czech origin is registered in the matrix by association or spelling, the surname of the child shall be registered on the proposal of the parents in accordance with the rules of Czech spelling.
(1) In column 4, names and surnames, date, month, year and place of birth, occupation and place of permanent (temporary) residence of parents and the names and surnames of grandparents shall be entered.
(2) As the father of the child, the spouse of the mother of the child shall be registered, if the child is born between the time of the marriage and the third day after the death of the marriage or its declaration of invalidity.
(3) If a child is reborn to a woman remarried, the spouse shall be registered as the father later, even if the child was born before the expiry of the third day after her former marriage had ceased or was declared invalid. Otherwise, as a father, a man whose paternity was determined by a parent's consent statement before a local national committee in charge of the matrices or before a court.
(4) If the paternity is not determined by the parent's consent, the father shall be registered as the man whose paternity has been determined by judgment.
(1) In particular, the parent's name agreement shall be entered in column 5.
(2) In column 6, changes to the recorded facts shall be recorded in accordance with final decisions of the court or other State body, in particular the change of name or surname, the entry for adoption, the death declaration, the determination of paternity, the denial of paternity, as well as the parents' declaration of choice of citizenship of their children.
Writing of twins
At birth of twins, triplets, etc., each child must be recorded separately in the matrix, so that the order of registration coincides with the time of birth of the children. In column 5 it is also indicated that it is a twin, triplet, etc., and under which serial number is the sibling entry.
