GOVERNMENT REGULATION
of 25 July 2007
amending Government Regulation No 205 / 2004 Coll., laying down, within the framework of the common organisation of the market in milk and milk products, detailed conditions for the granting of support and national support for the consumption of milk and milk products to pupils carrying out compulsory schooling in schools included in the school network, as amended
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll. and Act No. 441 / 2005 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll.:
Government Regulation No. 205 / 2004 Coll., laying down, within the framework of the common organisation of the market in milk and milk products, detailed conditions for the granting of support and national support for the consumption of milk and milk products by pupils who have completed compulsory schooling in schools included in the school network, as amended by Government Regulation No. 128 / 2005 Coll., Government Regulation No. 371 / 2005 Coll. and Government Regulation No. 339 / 2006 Coll., are amended as follows:
1. in Paragraph 2 (2) (b), the words "points 7 to 10" are replaced by the words "points 7 to 11."
2. in Article 3 (2) (b):
"(b) an entity which supplies to pupils supported milk products on behalf of a person performing school or school meals facilities or on behalf of a school or school food establishment."
3. In Article 3 (4), at the end of the text in point 2, the words "and copies of the relevant document in force concerning the establishment and operation of school or school catering facilities' shall be added.
4. In Article 3, the following paragraph 8 is added:
"(8) The body whose application for approval has already been granted shall, before the beginning of the relevant period referred to in Article 4 (1), submit to the Fund, using the form issued by the Fund, information on the method of distribution of the supported milk products referred to in Annex 2 to this Regulation in the relevant period."
5. in Article 4 (3) (a):
(a) an overall overview of the different types of milk products supplied and the quantity of such products, including the price of such products, of the data identifying the person operating the school or school catering establishment to the extent provided for in Section 37 (2) of the Administrative Regulation, the number of pupils for whom aid is requested or national aid in the relevant period, the distribution of the milk products supported; such data shall be presented both in paper form and in electronic form, ';
6. in Paragraph 4 (3) (c):
"(c) the originals of declarations by persons carrying out school or school meals 9) according to the regulations of the European Community17a) on forms issued by the Fund;"
7. In Article 4, at the end of paragraph 3, the dot is replaced by a comma and the following points (d) to (e) are added:
"(d) a copy of the contracts for the supply of supported milk products concluded between the applicant for aid and the person operating the school or school catering establishment, in force during the relevant period covered by the aid application and, where applicable, the national aid, and a copy of the relevant document in force on the establishment and operation of the school or school establishment;
(e) an inventory of the invoices which were paid on the date on which the application for or national aid was lodged. "
8. In Article 4, the following paragraph 6 is inserted after paragraph 5:
"(6) Where the contract for the supply of supported milk products is concluded between the body whose application for approval pursuant to Article 3 has been granted and the person carrying out the school or school meals activity is terminated, that body shall notify the Fund of that fact no later than 30 days after the end of the contract. ';
Paragraph 6 shall become paragraph 7.
9. In Article 4, paragraph 8 is added:
"(8) Where the person operating a school or a school catering establishment is not an approved body for the supply of supported milk products, he may, during one relevant period covered by an application for aid or, where appropriate, national aid, withdraw the supported milk products from only one body approved under § 3. ';
10. Annex 2 shall read as follows:

Explanatory notes:
*) The inclusion of dairy products in the groups referred to in Annex I to Commission Regulation (EC) No 2707 / 2000, as amended by Commission Regulation (EC) No 816 / 2004.
For milk products included in the groups referred to in the Annex Also on Commission Regulation (EC) No 2707 / 2000, as amended by Commission Regulation (EC) No 816 / 2004, the rate of aid from the European Communities' financial resources shall be fixed for the period from 1.9.2007 to 30.6.2008 in Annex II (E) thereto.
* *) For milk products not included in the groups referred to in Annex I to Commission Regulation (EC) No 2707 / 2000, as amended by Commission Regulation (EC) No 816 / 2004, support shall not be granted from the financial resources of the European Communities.
* * *) Providing the declared temperature indicated on the milk product packaging, i.e. from 4 ° C to 8 ° C (§ 5 (2) of Decree No 77 / 2003 Coll., laying down requirements for milk and milk products, frozen creams and edible fats and oils, as amended). '
Transitional provision
Legal relationships arising before the date of entry into force of this Regulation shall be assessed in accordance with existing legislation.
Efficacy
This Regulation shall enter into force on 1 September 2007.
