Loyalty Regulation for miners

Government Regulation
of 3 June 1952
on the loyalty allowance of miners.
The Government of the Czechoslovak Republic, with the agreement of the President of the Republic pursuant to § 42 (1) of Act No. 241 / 1948 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the Five-Year Plan):
§ 1.
In recognition of the loyalty of the mining profession and the merits of the economic construction of the state, workers in mining, leading socialist builders, are granted a loyalty allowance.
§ 2.
(1) Loyalty allowance is payable to workers in mining establishments and to their superior bodies and pupils of mining professional schools and training schools (hereinafter referred to as "pupils of schools and schools") under other provisions.
(2) A staff member who goes to another mining plant without any important reason loses his entitlement to the loyalty allowance and will be recounted for the duration of his employment.
§ 3.
(1) The basis for calculating the loyalty allowance is the amount calculated from the basic wage rate and the number of hours worked. Loyalty allowance shall be graduated according to the types of work and duration of employment in the same mining plant for technical staff who are in the authorities superior to mining plants in the same production sector as follows:
(a) staff members and pupils of schools and schools working in deep-sea mines are entitled to an employment relationship (teaching time)

(b) staff and school pupils working on shelters and quarries, in the case of roasted coal and ore plants, and in the case of magnesite, refractory clays, dandruff and quartz kilns, and in the case of special drilling and mining work, where the work of such workers is subject to mining pension insurance, it is for the duration of employment (teaching period)

(c) staff and school pupils working in facilities, sorting rooms, laundry and briquettes and on certain surface work (including workshops at factories) directly related to mining, as well as technical staff in the authorities of the mining establishments, if the duration of the employment period (teaching period)

the basis for calculating the loyalty allowance.
(2) The loyalty allowance is reduced by half for each working shift, missed without a proper excuse in the quarter for which payment of the loyalty allowance is made (hereinafter referred to as "the relevant quarter"); if the staff member fails in the relevant quarter without a proper excuse for two working shifts, he loses his entitlement to the loyalty allowance for that quarter.
§ 4.
(1) The condition for entitlement to the loyalty allowance provided for in § 3 is continuous employment in the same establishment, for technical staff who are in the authorities of the mining plants, in the same sector of production.
(2) Technical staff in the authorities superior to mining plants are responsible for the loyalty allowance after five years of continuous employment in mining operations prior to the immediate employment of those bodies.
(3) Until the period applicable to the entitlement to the loyalty allowance and the amount thereof, the duration of mining work carried out by employees as members of the voluntary working brigades or military units assigned to mining work shall be taken into account if, immediately after the end of the brigade or military active service, they move to permanent employment in mining.
§ 5.
(1) The full payment of the loyalty allowance is subject to 100% of the production (production) of the plant in the relevant quarter; if the plan is not fulfilled, the calculated loyalty allowance shall be reduced by one third. This provision shall not apply to pupils of schools and schools.
(2) In the case of technical staff of establishments (national undertakings), regional and regional directorates, companies and ministries, payment of the loyalty allowance shall be subject in full to the condition referred to in paragraph 1 and to the fulfilment of the preparation and opening plan. If this condition is not met, the loyalty allowance shall be reduced by a further third.
(3) Compliance with the conditions referred to in paragraphs 1 and 2 shall be established for each relevant quarter.
§ 6.
(1) Loyalty allowance shall be paid to eligible persons, on a quarterly basis, upon entitlement.
(2) The cost of the loyalty allowance is borne by the State budget.
§ 7.
Loyalty allowance shall not be included in the amount applicable to the determination of benefits during the period of leave for the recovery and in the assessment basis under the national insurance rules and shall be exempt from payroll tax.
§ 8.
The Ministry of Fuel and Energy, the metallurgical industry and the ore mines, the construction industry and the labour force shall, in agreement with the Unified Trade Union Organisation, issue detailed rules for the implementation of this Regulation, in particular defining the range of persons to whom the loyalty allowance is due and providing for exceptions to the conditions of continuous employment and the method of calculation, reduction and payment of the loyalty allowance.
§ 9.
Act No. 248 / 1949 Coll., on the loyalty allowance of miners, and the provisions issued pursuant to it are deleted.
§ 10.
This Regulation shall enter into force on 30 July 1951. They shall be implemented by fuel and energy ministers, the metallurgical industry and the ore mines, the construction industry, the labour force and the finance in agreement with the participating members of the government.
