DECLARATION
of 25 April 2006
amending the Order of the Czech Mining Office No. 99 / 1995 Coll., on the Storage of Explosives, as amended by Decree No. 342 / 2001 Coll.
Pursuant to § 6 (6) (b), § 29 (4) and § 32 (7) of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and State Mining Administration, as amended by Act No. 542 / 1991 Coll.:
Čl. I
Decree No. 99 / 1995 Coll., on the Storage of Explosives, as amended by Decree No. 342 / 2001 Coll., is amended as follows:
1. At the end of Paragraph 1, the sentence "This Order has been notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and rules and of rules for information society services, as amended by Directive 98 / 48 / EC 'is added.
2. In Article 7 (3), the second sentence is replaced by the following: "This condition is met if the requirements of the relevant Czech technical standard (3) or equivalent technical standard of a Member State of the European Union, a State of the European Free Trade Association which is a Contracting Party to the Agreement on the European Economic Area, or Turkey, provided that it guarantees at least an equivalent level of health and safety protection."
Footnote 3:
"3) ČSN 74 77 31 Doors more resistant to burglary."
3. In Article 8 (1), the second sentence is replaced by the following: "In the case of the use of wood, its degree of flammable capacity must be reduced to stage B; this condition is fulfilled if the requirements of the relevant Czech technical standard (4) or the equivalent technical standard of a Member State of the European Union, of the European Free Trade Association which is a Contracting Party to the Agreement on the European Economic Area, or of Turkey, provided that it guarantees at least an equivalent level of health and safety protection."

4. Paragraph 14 (1), including footnote 6, reads:
"(1) Electrical equipment shall be set up in its design for potentially explosive atmospheres. This condition is met if the requirements of the relevant Czech Technical Standard (6) or equivalent technical standard of a Member State of the European Union, a State of the European Free Trade Association which is a Contracting Party to the Agreement on the European Economic Area, or Turkey, are met, provided that it guarantees at least an equivalent level of health and safety protection. '
footnote 6:
"6) ČSN 33 23 40 Electrical equipment in environments with a risk of fire or explosion of explosives."
5. in Article 22 (m):
"(m) special storage explosives under the surface (" explosives storage "), a special container (crate, mining wagon, container, etc.) close to the place of consumption in which it is permitted to store explosives intended for use for a short period of not more than 24 hours."
Čl. II
This decree shall take effect on the day of its publication.
