DECLARATION
of 9 January 2012
amending Decree No. 268 / 2009 Coll., on technical requirements for construction
According to § 194 (a) of Act No. 183 / 2006 Coll., on Territorial Planning and Construction Regulations (Construction Act):
Čl. I
This Decree was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and rules and of rules on information society services, as amended by Directive 98 / 48 / EC.
Čl. II
Decree No. 268 / 2009 Coll., on Technical Requirements for Construction, is amended as follows:
1. In Article 3 (f) (1), the words "with the exception of buildings and equipment for bees and fish 'are deleted.
2. in § 3 (f) (4):
"4. construction for mineral fertiliser storage,"
3. in Article 3 (f), the following points 5 and 6 are added:
'5. Construction for storage of plant protection products and products;
6. a manual warehouse, construction, part of construction or separate room intended for storage of plant protection products and products with a maximum permissible weight of up to 1 000 kg of plant protection products and products, ';
4. In Article 3, at the end of point (k), the dot is replaced by a comma and the following point (l) is added:
"(l) an emergency tank - a tank, a container or a tank, intended to contain defective substances which have been escaped or released from, or seduced by, the tanks, containers, packaging, or, where appropriate, a technological device with a capacity of at least the largest tank capacity in it."
5. Paragraph 11 (3) to (5) reads as follows:
"(3) The living rooms shall be provided with adequate ventilation by outdoor air and heating in accordance with standard values, with the possibility of regulating indoor temperature.
(4) In the accommodation rooms, daily, artificial and, where appropriate, combined lighting shall be designed depending on their functional use and the length of stay of the persons in accordance with standard values.
(5) Staying rooms shall be provided with sufficient natural or forced ventilation and shall be sufficiently heated to control internal temperature. For ventilation of accommodation rooms, the minimum amount of outdoor air exchanged shall be 25 m3 / h per person at the time of residence or the minimum ventilation intensity 0,5 1 / h. Carbon dioxide shall be used as an indicator of the quality of the internal environment, the concentration of which in the internal air shall not exceed 1 500 ppm. ';
6. In Article 11, the following paragraphs 6 and 7 are inserted after paragraph 5:
"(6) In rooms where fuel appliances are installed, an outdoor air supply shall always be provided equal to at least the combustion air flow for nominal output and the type of appliance.
(7) Toilets, personal hygiene spaces and cooking spaces shall have artificial lighting in accordance with standard values, shall be effectively ventilated in accordance with standard values and shall be sufficiently heated to control internal temperature. '
Paragraphs 6 and 7 shall be renumbered paragraphs 8 and 9.
7. In Paragraph 13 (1), the words "living rooms' are replaced by the words" all apartments'.
8. In Paragraph 13 (2), the first sentence is deleted.
9. In Article 14 (3), the words "and partitions' are replaced by", partitions and ceilings'.
10.Paragraph 20 (2) reads as follows:
"(2) The ceilings, together with the floors and surfaces, are satisfactory in terms of sound insulation if their airtight sound and step-tight noise meet the minimum requirements given by standard values."
11. in Paragraph 26 (1), the words "Filling construction" are replaced by the words "Filling."
12. in Article 26 (2) and (3):
"(2) The aperture filler shall meet the requirements for thermal technical characteristics at steady state in accordance with standard values.
(3) The filling of openings must meet the requirements for acoustic characteristics in accordance with standard values to ensure sufficient noise protection in all protected indoor constructions10). '
13. In Article 34 (2) of the Introductory Part of the provision, the words "in accordance with standard values' shall be inserted after the words" comply '.
14. In Paragraph 34, the sentence "Minimum equipment of the flat by electrical equipment and apparatus shall be added at the end of paragraph 7. ';
15. Paragraph 43 (5) reads:
"(5) The guest room hall shall have a minimum pass width of 900 mm; for rooms intended for accommodation of persons with reduced mobility, the pass width of the hall shall be at least 1 500 mm and a length of at least 2 200 mm; it may not be separated from the guest room by a door. '
16. In Paragraph 44 (3), the first sentence is replaced by the sentence "The accommodation unit in accommodation facilities to class three to five stars must have sanitary facilities."
17. in Article 47 (5), the words "and the risk of explosion" shall be inserted after the word "par."
18. in Paragraph 50 (5) (a), the words "with these" shall be replaced by the words "with defective."
19. In Article 53, the words "and plant protection products' are deleted from the title.
20. Paragraph 53 (6) is deleted.
21. The following Section 53a is inserted after Section 53, including the title and footnote 30:
„§ 53a
Construction works for the storage of plant protection products and products
(1) Basic building security must prevent spontaneous penetration of water quality substances from construction into the surrounding terrain and subsoil and then into surface and groundwater
(a) the impermeability of surfaces and structures which come into contact with the defective substances;
(b) sewerage and, where appropriate, building modifications to prevent the leakage of substances from the construction by draining, overflow or flushing.
(2) The structures must be subdivided into:
(a) the section of reception and removal of plant protection products and plant protection products with an overarching handling area with a ramp and a containment area;
(b) the storage section of products and plant protection products for the separate storage of each species, empty contaminated packaging for re-sampling (30), the compartment must be separately ventilated with the possibility of tempering and monitoring air temperature;
(c) a section of auxiliary and sanitary operations separately ventilated with the possibility of tempering, in particular washing rooms, toilets and dressing rooms.
(3) The floor must be impermeable to liquids, resistant to the chemical effects of stored products, with a surface allowing easy cleaning and put into a separate emergency pit.
(4) The sewerage system must be treated as separate for waste water, sewage and sewage contaminated products.
(5) The construction for the storage of products and plant protection products must be equipped with an emergency pit which must have a surface resistant to the chemical effects of the stored products and must be secured against the influx of precipitation water from surrounding areas and against the penetration of groundwater. It shall be dimensioned to at least 10% of the total volume of stored liquids, but at least to the full volume of the largest container or container.
(6) The floor of the hand warehouse shall be impermeable to liquids, resistant to the chemical effects of the stored products and plant protection products, provided with an increased plinth around the walls, including the door threshold, as a replacement for the emergency tank. The manual warehouse must be separately ventilated with the possibility of tempering and monitoring the temperature of the air, the technical and disposition solution must allow the storage of plant protection products and products clearly and separately according to the nature of the hazards in the transport packaging, containers and containers, separate storage of contaminated packages30), personal protective equipment and clothing, while respecting hygiene, safety and health at work. Paragraphs 1 to 5 shall not apply to a hand warehouse.

Čl. III
Transitional provision
The construction works for which the project documentation was processed before the decree was effective shall be treated in accordance with the existing legislation.
Čl. IV
Efficacy
This Decree shall take effect on 1 February 2012.
