implementing the hunting law
The Ministry of Agriculture and Nutrition of the Czech Socialist Republic provides, in agreement with the Federal Ministry of National Defence, the Ministry of Finance of the Czech Socialist Republic, the Ministry of Education of the Czech Socialist Republic, the Ministry of Culture of the Czech Socialist Republic, the Ministry of Interior of the Czech Socialist Republic and the Ministry of Forestry and Water Management of the Czech Socialist Republic and after discussion with the Czech Hunting Union pursuant to § 44 (2) of Act No. 23 / 1962 Coll., on hunting (hereinafter referred to as "the Act"):

ČÁST PRVÁ

Honitby, disciplines, pheasants, the classification of honitebes and the payment for the assignment of the exercise of hunting rights
§ 1
The Socialist Organisation, which is responsible for hunting law, shall notify the Regional National Committee and the Regional Committee of the Czech Hunting Association by 30 June each year of the cases where the contract for the assignment of the exercise of hunting rights expires by the end of the calendar year and the existing state organisation or hunting association which exercises hunting rights in hunting, hereinafter referred to as "the user of the hunt," no new contract is concluded; is also obliged to report cases of early termination of the contract for the transfer of the exercise of hunting rights under the provisions of § 16 (4) (b) to (f) of the Act.
§ 2
The request for recognition of a chase shall be accompanied by the following documents:
(a) 2 situation sketches of a scale of 1: 25 000 showing the hunting grounds and adjacent non-hunting grounds, the communication network and the watercourses;
(b) data on the size of the hunting grounds which the socialist organisation has in its management, use or ownership (hereinafter referred to as "user of the hunting grounds"), taken according to the property records statement issued by the competent authority of geodesy and cartography.
§ 3
Only affluent parcels which meet their natural conditions are recognised as subject to the provisions of Section 7 of the Act as subject to intensive breeding of a specified species of game.
§ 4
(1) In the application for the recognition of a pheasant, the user of the chase shall indicate the location and details of the afforestation on which the recognised pheasant is to be established, its proposed area and the grounds for its establishment.
(2) In the decision to recognise a pheasant, the district national committee shall determine the district of a recognised pheasant, its size and the conditions under which the pheasant is recognised.
(3) The user of the hunt marks the circuit of a recognised pheasant in appropriate places with tables. In the period from 1 April to 30 June and from 1 August to 15 October, entry into a recognised pheasant shall be prohibited, except for designated routes; the prohibition shall not apply to persons employed in a recognised pheasant, to persons supervising and controlling a recognised pheasant, to members of the respective hunting association, as well as to users of land situated in a recognised pheasant district.
(4) The user of a chase containing a recognised pheasant shall be obliged to release at least 500 pieces of pheasant chickens per year. The measure of a recognised pheasant generally amounts to more than 100 ha, of which at least 25% of the land covered by trees or bushes. A recognised pheasant cannot be established on hunting grounds within 1000 metres of the border of a single pheasant.
(5) Paragraphs 2, 3 and 4 apply mutatis mutandis to separate pheasants (Section 8 of the Act).
§ 5
(1) In the decision on recognition of hunting, disciplines and separate pheasants, the district national committee shall indicate the name of the socialist organisation, which belongs in the pursuit of hunting law, the partynumbers of the parcels which it has recognised as hunting, their size and the type of culture and the names of their owners, managers or users; the Annex to the Decision is a description of the hunting boundaries corresponding to the data in the property register.
(2) The County National Committee shall keep a record of the hunting, field, separate and recognised pheasants, and an overview of the socialist organisations which enjoy the right of hunting in hunting, and an overview of the validity of the contracts for the exercise of hunting rights.
§ 6
(1) For the purposes of sound hunting farming, in particular for planning and achieving optimal production of game of use, district national hunting committees shall include at least 4 quality classes per game species.
(2) The inclusion of a chase in a quality class shall be an evaluation of the hunt with regard to the quality of the environment, the living conditions for animal husbandry, the maintenance of hunting and the damage caused by animals and game, and the determination of the number of game in accordance with agricultural and forest production and long-term hunting plans; in the case of cloven-hoofed game, they are not exceeded when they are included in the class of numbers intended for the county by a long-term hunting plan.
§ 7
(1) The amount of the remuneration for the assignment of the exercise of the right of hunting in hunting shall be laid down in the contract for the assignment of the exercise of the right of hunting, not exceeding 0,30 CZK for each hectare of hunting areas.
(2) The annual remuneration is payable within one month of the approval of the contract for the transfer of the right of hunting by the District National Committee (Section 16 (1) of the Act) and in subsequent years until 1 February of the current year.
(3) The remuneration for the transfer of the right of hunting for hunting grounds which have been incorporated into another hunting ground (Section 12 of the Law) is due within one month of their inclusion and in subsequent years by 1 March of the current year.
(4) The agreement on the amount of remuneration provided for in the contracts for the transfer of the exercise of the right of hunting concluded before the entry into force of this decree shall remain unaffected.

§ 8
(1) A Czechoslovak citizen who has a valid hunting ticket may be appointed as a hunting licence by the hunting operator to prove that he has had a hunting ticket for at least 5 years and has normally passed higher professional hunting trials (§ 49).
(2) In particular, it is for the Thessaloniki economy to prepare and ensure an annual plan for hunting and hunting, to carry out further tasks under this decree and to ensure that hunting rights are exercised in accordance with generally binding hunting legislation and the principles of sound hunting management.
(3) If the district national committee does not approve the proposed hunting operator or if the hunting operator ceases to perform the function, the user of the hunt shall be obliged to propose within 30 days to the district national committee for approval of the new hunting operator.

Protection of hunting
§ 9
(1) Only a member of the Czech Hunting Union, who has a valid hunting ticket and has proved to the county national committee in whose district there is a chase, knowledge of the rights and obligations of hunting guards under the law, can be appointed by the hunting guard pursuant to Article 20 (2) of the Act.
(2) The Myslivovka Guard shall make a promise to the Regional National Committee on the following text: "I promise to be faithful to the Czechoslovak Socialist Republic and to the cause of socialism, to exercise the protection of hunting with the utmost care, to report any damage to the protected property I find immediately and to not exceed my privileges."
(3) After the oath has been made, the Regional National Committee shall issue the hunting guard with a certificate of the provision of hunting guards and a service badge. The certificate shall indicate the chase for which the hunting guard has been designated. In the performance of their duties, the hunting guard must carry with him a service badge and a certificate to prove upon request.
(4) The Regional National Committee shall keep a list of hunting guards listing the name and surname, residence of hunting guards, the date of the composition of the promise, the hunting ground for which the hunting ground was established and the hunting ground user.
(5) The hunting guard's service badge is made of white metal and has the shape of an ellipse. In the middle of the ellipse is the state emblem of the Czechoslovak Socialist Republic, the height is 5 cm and the width is 3.7 cm. In the upper part of the circumference belt is the inscription "Myslivka guard." It's worn on the left side of the chest.
(6) The user is obliged to notify the district national committee that the hunting guard has ceased to perform his duties in the designated chase.
(7) The hunting guard, who has ceased his duties, is required to submit a certificate and a service badge to the Regional National Committee without delay.
(8) The Regional National Committee, when providing for a forest guard (1) for the hunting circuit used by the forestry organisation, will simultaneously approve these persons as hunting guards.
§ 10
(1) Users of hunting grounds are obliged to ensure that all kinds of game are preserved in nature in their management.
(2) In order to prevent damage caused to game in the management of mountainous land, they are required to:
(a) users of hunting grounds notify the user of the time and place of the farm work at night at least 3 days in advance, and of the implementation of the hay, forage and use of plant protection chemicals during the day;
(b) users and operators of forage grinders shall use efficient game scavengers and carry out harvesting operations so that the game is pushed from the centre of the harvested parcel to the edge;
(c) users and operators of silage pits and crackers, together with hunting users, to implement measures against unwanted animal access;
(d) users of the hunting grounds shall, upon notification of the users of the hunting grounds referred to in point (a), implement measures to save game.
(3) Users of hunting grounds and hunting sites shall proceed with the use of chemical plant protection products in accordance with specific regulation.2)

Planning of hunting and hunting
§ 11
(1) The basic planning unit is a chase. The user of the hunt draws up annual plans for hunting and hunting, approved by the district national committee. In reserved hunting, the annual hunting and hunting plans are approved by the central authority of the state administration, whose field of competence is the state organisation responsible for exercising hunting rights in the reserved hunting. The annual plans concerning the breeding and hunting of rare game species in restricted hunting, are approved by the Ministry of Agriculture and Nutrition of the Czech Socialist Republic (hereinafter referred to as the Ministry). The annual plans for hunting and hunting by hunting associations are expressed in advance by the Regional Committee of the Czech Hunting Association and in the case of hunting, which include more than 200 hectares of forest land, also the relevant forest management organisation.
(2) By approval, the plans become binding on the user of the chase.
§ 12
(1) The Ministry, in cooperation with the central government and the Czech Hunting Association, is working on long-term hunting plans for the territory of the Czech Socialist Republic.
(2) Long-term hunting plans are also drawn up by the Regional and Regional National Committees for their territorial districts, and the Regional National Committees are based on plans drawn up by the Ministry and the Regional National Committees on plans drawn up by the respective Regional National Committee.
(3) When drawing up long-term hunting plans, the national committees cooperate with the competent authorities of the state economic management of agriculture, forest management organisations and the authorities of the Czech Hunting Union.
(4) The approved long-term hunting plans are based on the use of hunts in the processing of annual hunting and hunting plans.
§ 13
State organisations in charge of the exercise of hunting rights in reserved hunts process and submit to the Ministry for approval long-term hunting and five-year hunting plans for these hunts.

ČÁST PÁTÁ

Animal husbandry areas
§ 14
(1) In order to further develop hunting, areas are established for the breeding of certain species of game whose successful breeding requires greater territorial units.
(2) The area of game farming is established in a continuous territorial unit with appropriate conditions for the breeding of a species of game on which a whole or a substantial part of the local population of that species (subspecies, geographical race) of game lives. Areas for wild boar breeding cannot be established where pheasants are.
(3) The game area shall include hunts throughout the area.
(4) One chase may be included in two or more areas for the breeding of different species of game.
(5) Animal husbandry areas shall be established either for the existing local animal populations or for game restocking by a new species of game. When restocking, the final area of the game farming area is determined only after the stabilisation of the newly established breeding.
(6) Proposals for the establishment of areas for game rearing, changes and modifications to the areas already established for game rearing, are submitted by the Regional National Committees to the Ministry by 31 December each year, based on proposals from individual regional national committees.
(7) The proposal to establish an area for game farming shall include:
(a) a brief justification of the intention;
(b) the intended breeding objective;
(c) a list of the hunting sites included in the area, indicating their users;
(d) a description of the boundaries of the areas for game farming;
(e) total area, of which particularly forest area,
(f) the classification of hunting animals in the game farming area in a quality class;
(g) the standard and spring actual stocks of game species for which the area is intended;
h) draw up on the map 1: 200 000,
(i) the opinion of the relevant forestry organisation and agricultural organisation.
(8) The Ministry sets out areas for animal husbandry after discussion with the Ministry of Culture of the Czech Socialist Republic and the Ministry of Forestry and Water Management of the Czech Socialist Republic and the Czech Hunting Union, or also the Federal Ministry of National Defence until 31 March of the following year. The establishment of areas for game farming shall be notified by the Ministry in the Ministry Bulletin.
(9) When determining the area for game farming, indicate which regional national committee will manage the area for game farming.
(10) The areas for the breeding of feral pigs and deer are managed by the competent national district committee.
(11) The plans for the breeding and hunting of game and the management of game other than wild boar and venison deer are approved by the Regional National Committees for the hunting areas; they are based on long-term hunting plans (§ 12).
(12) In the field of animal husbandry, where the Ministry has reserved for the exercise of hunting rights (Section 18 (1) of the Act) or for hunting rights to state organisations in the field of the Federal Ministry of National Defence, the Regional National Committee assesses the area of game husbandry as a whole and recommends to the Ministry, within the meaning of Section 38 (3) of the Act, the amount of game hunting for such hunts for approval.

§ 15
(1) The list of animals referred to in Section 19 (1) (a) of the Act is amended as follows:
(a) are removed from the game from the game of the horticultural capra ibex L. and from the game of the feathered pheasants (members of the genus Chrysolophus and Gennaeus),
(b) is added to feathered game of orebic species (genus Alectoris).
(2) The list of animals referred to in § 19 (1) (b) of the Act is amended as follows:
(a) it is removed from the game by the sea otter (Lutra lutra L.),
(b) shall be added to the feathered game of the raven (Corvus corax L.).
§ 16
(1) In order to maintain the gene pool of game, it is prohibited to:
(a) the release into the hunting grounds of animals and animals obtained by crossing between species and subspecies of animals and between animals and related species of domestic animals and poultry;
(b) to release into or close to a particular animal species (within the range of migration) game (s) of another species or subspecies and to leave free-released domestic animals and poultry known to be routinely interbreeding with those animals;
(c) import game from outside the Czechoslovak Socialist Republic without prior approval of the Ministry of Hunting in the Czech Socialist Republic; the prohibition concerns live animals and their development stages (e.g. eggs),
(d) introduce, contrary to long-term hunting plans, other types of game in the chase without prior permission of the Ministry.
(2) Animal husbandry outside the species of wild animals 2b) Socialist organisations which do not exercise the right of hunting and the release of game from such breeding to hunting is approved by the Ministry in agreement with the Ministry of Culture of the Czech Socialist Republic.
§ 17
(1) Hájeny are throughout the year the following species of game: elk European, marsh mountain, bear brute, wolf, lynx island, wild cat, badger forest, squirrel, weasel colchava, weasel fissure, orebic, drop big, thistle deaf, tetrich, crane forest, meadow forest, bekasina otavní, pigeon doves, wild dove, squid, bernees, cormoran big, hermit ash, hornfish understanding, clover pilich, sea bass, sea bass, sea bass, sea bass, sea bass, sea bass, sea bass
(2) The Regional National Committee may, on the basis of a duly substantiated request from the user of the hunt, authorise the fishing for redfish between 16.3 and 15.4., common tetrage - rooster from 16.4 to 15.5., dachshund in the period 1.8. to 30.11., field raven between 1.10. to 31.3., bluefin tuna in the period 1.7. to 31.3., soya in the period 1.10. to 31.3., and the capture of a large brood-off stock which does not fall, provided that, within seven days of the catch, the zoological garden. In reserved hunting, the Ministry authorises hunting these species of game in agreement with the Ministry of Culture of the Czech Socialist Republic.
(3) The following species of game are not protected: fox, raccoon, skewer, dark scabbardfish, crow (black and grey), stripe, piglet and longline.
(4) Exemptions from the provisions of Paragraph 17 (1) may be authorised by the Ministry of Culture in agreement with the Ministry of the Czech Socialist Republic; the exemption from the provisions of Sections 17 (3) and 18 may be authorised by the Ministry.
§ 18
(1) The fishing time for the following species of game shall be as follows:
(a) European deer, deer and goat deer from 1.8. to 31.12.1990; temporarily until 31.12.1990, deer and deer deer from 15.1.1990, deer from I. age class and goat to 31.1.
(b) deer sika, deer and goat deer sika from 1.8. to 31.12.12., temporarily until 31.12.1990 deer and deer deer sika until 15.1., deer I. age class and goat until 31.1.
(c) deer, deer and kid, from 1 September to 31 December;
(d) spotted, tanned and tanned from 1 September to 31 December,
(e) deer from 16 May to 30 September, deer and deer from 1 September to 31 December,
(f) muflon, muflonka and muflonče from 1.8. to 31.12.12, transitional until 31.12.1990 muflon of the 1st age class and muflonče of the 31.1.
(g) mountain camels, camels, camels from 1.10 to 30.11;
(h) goat without oar, goat, goat, goat from 1 September to 31 December,
(i) wild boar, bull and bass, from 1.8. to 15.1. with the exception referred to in § 19 (2) and (4),
(j) the field hare from 1.11. to 31.12.12. with the exception referred to in § 23 (1);
(k) wild rabbit from 1.8. to 31.12.12. except as referred to in § 23 (1);
(l) pheasant, rooster and hen
1. in pheasants from 16 October to 31 January,
2. in hunts which are not adjacent to pheasants and in which more than 500 pheasants have been released, from 16 October to 31 December, subject to the condition of Paragraph 19 (1),
3. in any other chase, from 1 November to 31 December, subject to the condition of Paragraph 19 (1),
m) Royal pheasant - rooster from 16. 10 to 15. 3., hen only in pheasants from 16. 10 to 31. 1.,
(n) wild turkey and turkey from 1.10 to 31.12.12, wild turkey from 16.3 to 30.4,
(o) field partridges from 1.9. to 30.9. if the condition of § 19 (1) is fulfilled,
(p) wild duck, cervix, blue cervix, blue spoonful, nettle, pollack, pollack and black lyke from 1.9. to 15.12; on ponds on which at least 100 pieces of the optional wild ducks were released, from 16.8. to 15.12.
(r) geese from 1.9. to 15.12.
s) pigeon dogfish from 1.8. to 15.10.,
t) Garden dove from 1 August to the end of February,
(u) hunk of forest, hunk of rock from 1 November to the end of February except as referred to in § 19 (2) and (4);
(v) musk ondatra from 1.11 to 31.3 (by catch only),
(w) Cheeky seagull from 1 July to 31 December except as referred to in § 19 (2) to (4).
(2) If the first day of the fixed fishing period is the closest day to the day following the days of work leave or rest, the fishing period shall begin on those days.
(3) The provisions of the preceding paragraphs shall not apply in respect of the species of game for which breeding is intended.
§ 19
(1) Hunting for pheasant hens may be approved by the Regional National Committee (Section 24 (2) of the Law) only in the hunting grounds in which the planned status of pheasant from the wild population is ensured. field partridges may only be allowed in hunting areas where the planned partridges are reached, their tame or semi-wild breeding is introduced and the reared chickens are released into the chase.
(2) All year round may be fished
(a) in the separate and recognised pheasants of the forestry and rock kuna, the badger, the weasel, the mallard, the hawk, the field raven, the colt, the sea bass and the seagulls, and in the separate pheasants, the wild boar, the mallard and the big howler, which may only be fished by means of catch-nets which do not take effect, provided that, within seven days of the catch, the zoo is passed;
(b) in and around the airports, the seagulls are laughing.
(3) A laughing seagull may be caught all year round on dreary ponds and extracts and on intensive duck ponds.
(4) In the hunting grounds, nesting sites and discharging sites, the district national committee may approve the hunting of the wild kuna, the kuna, the badger, the fissure, the jasper, the forest hawk, the wild boar, the laughing seagulls and the wild boar throughout the year, including a large brew, which can only be fished by means of catch-nets which do not defeat the bream, with the delivery of a zoological garden within seven days of the catch.
(5) The County National Committee may, at the request of the user of the chase, approve the selection of one cub from one or more nest of a hawk, a kestrel and a redfish, provided that there are more than one cub in those nests.

ČÁST SEDMÁ

Conditions and method of fishing and restrictions
§ 20
(1) Honitebes' users are required to carry out animal censuses each year according to the instructions of the Regional National Committee.
(2) It shall be prohibited to fish for game subject to hunting planning, the breeding and hunting of which has not been planned in hunting; by 31 December 1990, it is possible to fish for deer, deer and deer, even outside their breeding areas, regardless of their breeding value.
§ 21
(1) Small game fishing may be carried out by hunting predators.
(2) Hunting predators are the hawks of the forest, the redfish, the kestrel or other predators, provided that their use to falconry is permitted by the Ministry in agreement with the Ministry of Culture of the Czech Socialist Republic.
(3) Individual hunting of game by hunting predators can only be carried out by the holders of a hunting ticket, who are members of the Club of Sokolers of the Czech Hunting Union and who have a permit from the user of hunting. The hunted game is included in the implementation of hunting and hunting plans. Only members of the Club of Sokolers of the Czech Hunting Union can breed hunting predators.
(4) Users of hunting and hunting predators are obliged to notify the Central Committee of the Czech Hunting Union within 30 days of any catch of hunting predators (§ 19 (5)) or their acquisition otherwise, as well as their mortality, loss, sale, etc. Hunting predators must be registered by the Czech Hunting Union.
§ 22
(1) In addition to the prohibited fishing methods referred to in Paragraph 30 (1) of the Act, the following shall be prohibited:
(a) to fish for game from motor vehicles, using motor vehicles and agricultural machinery;
(b) to fish for game during the simultaneous harvest of agricultural crops;
(c) to fish for game in irons;
d) shoot animals on nests and shoot nests,
(e) to fish for game with a single shot for shotgun, other than wild boar, when fishing with a catch, catch or catch; to fish for wild boar at night without the use of appropriate observation and shooting optics,
(f) to fish for game with a weapon other than a hunting weapon (ball or shotgun);
(g) to fish for feathered game,
(h) to fish for herring by means of a dog;
(i) to fish for cloven-hoofed game with the exception of:
1. wild pig,
2. the deer of the canine, the deer and the deer of the European deer as well as the deer of the seabream occurring outside the areas for rearing deer (§ 14); in deer farming areas, such game may only be fished with a catch, catch or catch with the permission of the District National Committee,
(j) to shoot productive game in catch and acclimatisation facilities, with the exception of game injured and unintended;
k) shoot male cloven-hoofed game in winter-over-winter buildings except for canine deer and muflon deer up to one year old.
§ 23
(1) The removal of hares, pheasants and wild turkey may be carried out only on common hunting grounds; shooting ducks, black lynx and geese on the common hunt or move. The joint hunting and hunting of these species of game shall be carried out with the participation of at least 3 shooters, only by a shotgun with a round round. In mountain hunting or parts thereof with a rare occurrence of hare causing damage to forest cultures, the district national committee may, at the request of the user of the hunt, allow a year-round shooting of hare and a lonely way of hunting. In fenced vineyards, fruit orchards and nurseries, a rabbit and rabbit may be hunted throughout the year; hunting on such areas, if they are part of a hunting hunt as hunting ground, may only be carried out by hunters designated by the hunting user, even in a lonely way.
(2) Hunting of the royal pheasant (except for the hen) and wild turkey may also be carried out in a lonely way.
(3) Musk fishing is carried out by catch on the basis of a fishing permit.
(4) Ducks, black lasses and geese can also be fired on the move, only on Saturday.
§ 24
(1) On working days, only tax hunts may be held for foreigners, hunts in hunts reserved (Section 18 (1) of the Act) and hunts in hunts in which a state organisation exercises the right of hunting for its own account. The practice of other small-scale game hunts on working days can only exceptionally be authorised by the district national committee.
(2) Two hunts may be held simultaneously in hunts above 1500 ha of hunting ground on one calendar day.
(3) The user is obliged to submit a hunting plan to the district national committee (hunting association via the district committee of the Czech hunting association) no later than 30 days before the specified hunting time. Plans shall be deemed to have been approved unless the approval is refused by a written communication received not later than 5 days before the hunt. Changes in the dates of each hunt shall be reported in the same way by the user no later than 5 days before the date on which the hunt was originally planned. The hunting plan shall not be submitted for duck and goose hunting and joint hunting of wild boars and foxes.
(4) Hunts in which the exercise of the right of hunting has been transferred to the animal research institutes shall not be subject to the provisions of paragraphs 1 and 3; reserved hunts (Paragraph 18 (1) of the Act) shall not be subject to the provisions of paragraph 3.
§ 25
(1) The employer is obliged to ensure the proper conduct of the hunt. In particular, he shall:
a) see if all participating shooters have valid hunting tickets,
(b) when the hunting ticket is found invalid, invite the shooter to leave the hunt and notify the National Security Corps authority of the case;
(c) draw the attention of the hunting participants to ensure that safety rules are taken into account when using hunting weapons and to suspend the hunt in breach of those rules;
(d) exclude persons under the influence of alcohol or other toxic substances, persons under the influence of 15 years of age and persons who have been grossly in breach of security rules during the hunt.
(2) For the first three shooters and for each additional counted ten shooters each joint hunt must be at least one hunting fit dog (§ 31 (2)). That goes for duck and goose hunting.
(3) Each but not less than the end of the load and each hunt, properly carried out by the stock stock stock.
(4) No later than the day following the end of the hunt, a joint search shall be carried out involving hunters authorised by the user of the hunt using hunting-fit dogs (§ 31 (2)). The animals shall be counted against the result of the last hunt.
(5) The hunting operator or hunter is responsible for presenting trophies for breeding shows with trophies and exhibitions if the trophy is left to him. For game caught by foreign hunters, photographs and scoring tables shall be presented instead of trophies.
