DECLARATION
of 17 July 2007
amending Decree No. 136 / 2004 Coll., laying down details of the marking and registration of animals and of their holdings and persons provided for by the Breeding Act
The Ministry of Agriculture provides, pursuant to Article 33 of Act No. 154 / 2000 Coll., on the breeding, breeding and registration of livestock and on the amendment of certain related laws (Breeding Act), as amended by Act No. 282 / 2003 Coll. and Act No. 130 / 2006 Coll., ("the Act ') for the implementation of § 22 (13), § 23 (5), § 23a (4), § 23b (8), § 23c (4) and § 24 (11) of the Act:
Čl. I
Decree No. 136 / 2004 Coll., laying down the details of the marking of the animals and their registration and registration of the holdings and persons provided for by the Breeding Act, is hereby amended as follows:
1. footnote 1 shall read:
"(1) Council Directive 92 / 102 / EEC of 27 November 1992 on the identification and registration of animals. Commission Directive 2002 / 4 / EC of 30 January 2002 on the registration of establishments for laying hens provided for in Council Directive 1999 / 74 / EC. Commission Directive 2006 / 83 / EC of 23 October 2006 adapting Directive 2002 / 4 / EC on the registration of establishments for laying hens provided for in Council Directive 1999 / 74 / EC by reason of the accession of Bulgaria and Romania. Council Directive 93 / 53 / EEC of 24 June 1993 introducing minimum Community measures for the control of certain fish diseases. '
2. footnote 4 is replaced by the following:
"4) § 2 (o) of Act No. 154 / 2000 Coll., as amended by Act No. 282 / 2003 Coll. and Act No. 130 / 2006 Coll. '.
3. In Section 2 (c), the introductory part of the provision, including footnotes 5 to 8, reads:
"(c) the registration number of a maximum of 14-digit alphanumeric code enabling the identification of a particular holding, bee-keeper, slaughterhouse, hatchery, assembly centre (5), business6), userfacilities (7) or establishment (8) containing:

footnote 8 shall be renumbered footnote 8a.
4. Paragraph 2 (d), including footnote 8a, is deleted.
Points (e) to (g) shall be renumbered (d) to (f).
5. in Article 2 (e):
"(e) flock - a group of poultry of one species and one category kept on one holding,"
6. In Article 2, at the end of point (f), the dot is replaced by a comma and the following points (g) and (h) are added:
'(g) temporary holding - holding on which the ovine or caprine animal has been moved for domestic slaughter and slaughtered within 7 days,
(h) the person carrying out the marking of horses - the authorised person or recognised breeding association which carry out the marking of horses under Article 22 (3) and (4) of the Act. ';
7. In Article 4, at the end of point (f), the dot is replaced by a comma and the following points (g) and (h) are added:
"(g) electronic identification11a), only in ovine and caprine animals;
(h) a sign for brick11a), only in goats.

8. in Article 5 (1) (d), the words "except for optional particulars" shall be added after the words "it is inadmissible."
9. In Article 7 (1), at the end of point (c), the comma is replaced by a dot and point (d) is deleted.
10. In Article 7 (2) of the Introductory Part of the provision, the words "the structure moved from another Member State or imported from a third country 'are replaced by the words" used for the labelling of animals, sheep and goats moved from another Member State or imported from a third country'.
11. in Article 7 (2), the comma at the end of point (c) shall be replaced by a dot and point (d) shall be deleted;
12. In Article 7, the words "including the alphanumeric code of the holding in which the pigs were born 'shall be added at the end of the text of paragraph 3.
13. in Paragraph 9 (4), the word "pairs" shall be deleted;
14. In Section 9, paragraph 6 is added:
"(6) In the cases referred to in Articles 10 (5) and 22 (4) and (5), ear tags for that animal by the person authorised to do so shall be transmitted at each movement. ';
15. in Article 10 (1), the word "identical" shall be deleted;
16. in Paragraph 10 (2), the word "identical" shall be deleted;
17. In Article 10, the following paragraph 5 is added:
"(5) If the tissues cannot be marked with an ear tag due to damage, inflammation, or deformation of the hearing bolts, they shall be marked in an alternative manner so as to avoid confusion with other tissues. This means of identification shall be entered immediately by the breeder in the stable register. ';
18.Paragraph 11 (1) reads as follows:
"(1) Plastic ear tags of type A or a combination of type A and type B. The plastic ear tag consists of two parts which are connected by a permanently lockable thorn which is part of one part; the two parts shall be at least 45 mm high, at least 55 mm wide and the height of the alphanumeric characters on them shall be at least 5 mm high. ';
19. in Paragraph 11 (2), the words "each part" shall be replaced by the words "both parts."
20. In Paragraph 11, the following paragraphs 3 to 5 are inserted after paragraph 2:
"(3) The identification of one ear shall always be accompanied by a type A plastic ear tag containing only the particulars referred to in paragraph 2; the marking by other or handwritten alphanumeric characters is inadmissible.
(4) A plastic ear tag of type A or type B shall be used for marking the second ear.
(5) The ear tags used on the label of the other ear may include, in addition to the particulars referred to in paragraph 2, the breeder's records on both the face and the reverse, provided that the legibility of the data referred to in paragraph 2 is not infringed. ';
Paragraphs 3 and 4 shall be renumbered paragraphs 6 and 7.
21. in Article 11 (6), the word "bulls" shall be replaced by "males" and the word "heifers" shall be replaced by "females."
22. In Article 11 (6), the words "the numerical indication of the region in which the animal was born and 'are replaced by the words" digits'.
23. in Article 11 (7), the word "parts" shall be inserted after the word "the model" and the words "used for the labelling of tubers" shall be replaced by "type A and type B";
24. Footnote 12 reads:
"12) § 14 (1) (e) of Decree No. 448 / 2006 Coll., on the implementation of certain provisions of the Breeding Act."
25. In Article 13, paragraphs 5 and 6 are added:
"(5) The person carrying out the marking of horses shall designate a horse, donkey or their cross-breed within 28 days of the date on which the owner was invited to do so.
(6) Horses, donkeys or their cross-breeds who have a horse identification with a word and graphic description drawn up in accordance with the provisions directly applicable in the European Communities shall be deemed to have been identified in accordance with this Regulation. "
26. in Paragraph 14 (2), the words "front and rear" are replaced by the words "thoracic and pelvic."
27. In Paragraph 14, the following paragraph 3 is inserted after paragraph 2:
"(3) A verbal and graphic description of the horse, donkey or cross-breed shall be provided by the owner to the person carrying out the marking of the horses.";
Paragraphs 3 and 4 shall be renumbered paragraphs 4 and 5.
28. In Article 14 (4), the words "which, for the relevant recognised breeders' association or authorised person (4), carry out the marking of horses (hereinafter referred to as" the person carrying out the marking of horses') 'are replaced by the words "carrying out the marking of horses'.
29. Paragraph 14 (5) is deleted.
30. In Paragraph 15, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The identification of the horse shall be provided by the owner to the person carrying out the identification of the horse, who shall record it in the registration book of the horse and on the admission note or on the registration report of the horse. ';
31. in Article 17 (1), the words "transfer from other Member States" shall be deleted;
32. In Article 17 (1), the words "the end of their isolation period 'are replaced by the words" 28 days from the date of their import'.
33.In Article 17 (1) (c):
"(c) a word and graphic description, if they are already marked by a numerical stroke confirming their identity."
34. In Article 17 (2), the words "the end of their isolation period 'are replaced by the words" 28 days from the date of their transfer';
35. in Paragraph 17 (3), the words "the end of their isolation" shall be replaced by the words "28 days from the date of their transfer or import."
36. In Article 17 (4), the words "the end of their isolation period 'are replaced by the words" 28 days from the date of their transfer'.
37. In Paragraph 18 (2), the comma after the word "weaning" shall be replaced by a dot and the words "at the latest before leaving the holding in which he was born" shall be replaced by the words "In the case of the transfer of piglets to another holding, piglets shall be designated before leaving the holding in which he was born."

„§ 21
Means and dates for the labelling of pigs moved from other Member States or imported from third countries
(1) Pigs moved from other Member States or imported from third countries directly to the slaughterhouse shall be kept the original mark if the animal is slaughtered within 30 days of the date of border veterinary inspection.
(2) Pigs moved from other Member States or imported from third countries which remain on the territory of the Czech Republic for more than 30 days from the date of border veterinary checks and which are marked in accordance with the provisions directly applicable to the European Communities shall be considered as pigs labelled in accordance with this Regulation. If they are not so marked, they shall be marked within 7 days of arrival at the place of destination in accordance with § 18 and 20.
(3) Pigs moved from other Member States or imported from third countries to participate in the diversion shall be left with the original marking. Where they are further moved, those pigs shall be marked as referred to in paragraph 2. ';
39. Paragraph 22 (1) is deleted.
Paragraphs 2 and 3 shall be renumbered paragraphs 1 and 2.
40. Paragraph 22 (1) reads as follows:
"(1) Each ovine or caprine animal must, within 2 months of birth, be marked with two plastic ear tags separately in each ear. If within 2 months of age the animal is moved from the holding where it was born, it must be marked before it is moved. In the case of lambs or kids intended for slaughter up to 12 months of age which are not intended to be moved to another Member State or for export to third countries, the lamb or kid shall bear at least one plastic ear tag which has been provided for that method by the authorised person. ';
41. In Article 22, paragraphs 3 to 6 are added:
"(3) Before the permanent marking referred to in paragraphs 1 and 2, ovine and caprine animals shall be marked with the initial marking within 24 hours of birth. It is a temporary marking which will allow the identification of individual ovine and caprine animals and their mother until their permanent designation.
(4) Sheep and goats without earplugs or with very short earache are marked on the lower coat of the uncultivated part of the tail by a tattoo which contains the identification number of the animal without alphabetical indication of the country of origin (CZ) and without the last three digits.
(5) If ovine or caprine animals cannot be marked with an ear tag due to damage, inflammation or deformation of the hearing bolts, they shall be marked in a alternative manner so as to avoid confusion with other animals. This means of identification shall be recorded immediately in the stable register.
(6) The ovine and caprine animals are identified before being moved to another Member State in a manner specified directly by the applicable European Community11a. "
42.Paragraph 23 (1) reads as follows:
"(1) For the marking of ovine and caprine animals, plastic ear tags of type A or type B. The plastic ear tag of type A consists of two parts connected with a permanently lockable thorn, both parts must be at least 25 mm high, at least 25 mm wide and the height of the alphanumeric characters on them must be at least 4 mm high. The plastic ear tag of type B shall be at least 35 mm long and at least 9 mm wide and the height of the alphanumeric characters indicated therein shall be at least 4 mm high. '
43. In Section 23 (2) of the introductory part of the provision, the words "Each part of the plastic ear tag used for the marking of ovine and caprine animals' are replaced by the words" Plastic ear tag '.
44. In Article 23, the following paragraph 3 is inserted after paragraph 2:
"(3) Where the ovine or caprine animal is marked with two ear tags, one ear tag shall contain only the particulars referred to in paragraph 2, the marking by other or manually written alphanumeric characters shall be inadmissible. The second ear tag may include the records of the breeder, both on the face and the reverse, provided that the legibility of the data referred to in paragraph 2 is not infringed. ';
Paragraphs 3 and 4 shall be renumbered paragraphs 4 and 5.
45. in Article 23 (4) and (5):
"(4) Duplicate plastic ear tags type It shall be at least 25 mm high, at least 25 mm wide and the alphanumeric characters indicated therein shall be at least 4 mm high, the duplicate of the plastic ear mark type B shall be at least 35 mm long, at least 9 mm wide and the alphanumeric characters indicated therein shall be at least 4 mm high.
(5) The model of the plastic ear tags type A and type B and the model of the duplicate of the plastic ear tags type A and type B are given in Annex 4. ';
46. In Article 24 (1), the words "which are not marked in accordance with the provisions directly applicable in the European Communities' shall be inserted after the words" Member States'.
47. in Paragraph 24 (3), the word "slaughtered" is replaced by "slaughtered."
48. In Article 24, at the end of paragraph 4, the sentence "In the event of loss of the means of identification, ovine and caprine animals shall be identified by duplicate in accordance with Articles 7 (2) and 23 (4)."
49. in Paragraph 28, the following paragraphs 3 and 4 are inserted after paragraph 2:
"(3) The temporary holding shall be registered by the authorised person on the basis of the report on the movement of the animal to the temporary holding referred to in Article 35.
(4) Poultry farming means, for the purposes of its registration with the person responsible for the holding (4), a holding keeping chickens, ducks, geese, turkeys, pigeons, quails, guinea fowls and feathered game restocking. '
Paragraph 3 shall become paragraph 5.
50. Paragraph 28 (5) reads:
"(5) Where two or more breeders keep the animals together in a single stable, that stable may not be registered as two or more holdings with the authorised person, except where the Czech Breeding Inspection Authority or veterinary inspection authorities propose such division on the basis of their control activities under Article 24 (7) of the Act. '
51. in Article 29 (2) (a), the following point 5 is added:
"5. if a stranger is involved, indicate, in addition to the information referred to in points 1, 3 and 4, the identification number, the State which issued the identification number or, if there is no identification number, the birth number, the identity number and the State which issued the document,"
52. in Paragraph 29 (2) (b), the following point 5 is added:
'5. If a foreigner is involved, he shall indicate, in addition to the particulars referred to in points 1, 3 and 4, the birth number or, if he has no birth number, the date of birth, the identity document number and the State which issued the document, ';
53.In Paragraph 29 (2) (e), the word 'economic' is deleted.
54. In Paragraph 29, at the end of paragraph 2, the dot is replaced by a comma and the following point (g) is added:
"(g) the system of breeding, where appropriate, of sheep and goats.";
55. In Paragraph 29 (7), the sentence "If two or more breeders keep animals together in one stables, it is not possible to register with the authorised person (4) in one holding more than one breeder - the registered breeder sends the report for the whole farm." shall be replaced by the sentence "If the Ministry divides the holding on the basis of a proposal from the Czech Breeding Inspection or Veterinary Surveillance Authorities pursuant to Article 28 (4), those holdings shall be registered with the indication that they have been created by the division of one farm."
56. In Paragraph 32 (1), the words "may also be maintained in the form of a computer database after the approval of the computer programme by the authorised person (4). The stock registers, animal registers on the holding, the catch and chamber book and the economic records of fish farming on the fish pond, the descriptive sheet of the fishing area and the record of the economic results achieved on the fishing area shall, when printed, contain the information set out in this decree in the same order as on the form provided by the authorised person (4). The authorised person (4) shall approve only a computer program that allows automatic creation of data files in accordance with all the requirements of this Regulation concerning the dates for entry of changes in the records and for sending messages' shall be replaced by 'may also be maintained in the form of a computer database approved by the authorised person. The authorised person shall only approve a computer program which allows automatic creation of data files and printing of data in a range and order consistent with the data and forms requirements of this Order'.
57. In Paragraph 32 (2), the words "transfer to a temporary holding" shall be inserted after the words "killing and transfer," the words "adult number" shall be replaced by the words "stocks" and the words "post location may" shall be inserted after the words "send in writing on form a."
58. In Article 34 (1), the words "except for a breeder keeping a sheep or goat on a temporary holding," shall be inserted after the words "ovine or caprine animals."
59.In Paragraph 34 (2), the dot is replaced by a comma at the end of point (e) and the following point (f) is added:
"(f) the sheep and goats system."
60.In Paragraph 34 (3) (f) (2), "z or to unregistered" is replaced by "to temporary."
61.In Paragraph 34 (3) (f), the following points 3 and 4 are added:
"3. the number of the electronic identifier, if marked by the animal,
4. breed and genotype, if known, '.
62. In Article 35 (2), in the introductory part of the provision, the words "except for a breeder keeping a sheep or goat on a temporary holding 'shall be inserted after the words" Every breeder'.
63. In Article 35 (2), the words "and the modification of the milk production system for female animals' shall be added at the end of the text in point (f).
64. in § 35 (2) (g):
"(g) if the sheep and goats
1. in the case of a transfer, the name and surname or name or business name of the carrier, his registration number, registration number of the vehicle to which the animal was moved;
2. in the case of transfer to a temporary holding, the date of transfer, the address of the transfer, including the identification details of the new breeder and the registration number of the vehicle to which the animal was moved;
3. in the case of transfer to another Member State, the number of the electronic identifier, if marked by the animal. ';
665. In Article 35 (3), the words "and the transfer report on a temporary holding" shall be inserted after the words "killing and transfer."
66. In Article 35, at the end of paragraph 3, the sentence "At the time of birth of ovine or caprine animals, the birth declaration shall be sent within 7 days of the date of designation of the animal referred to in Article 22 (1), in bulk for the whole holding."
67. Paragraph 35 (5) is deleted.
Paragraphs 6 and 7 shall become paragraphs 5 and 6.
68. In Article 35 (5), the words "and the transfer to a temporary holding" shall be inserted after the words "spent and transferred."
69. In Article 35 (6), the words "and the model of the transfer report to the temporary holding 'shall be inserted after the words" spent and transferred'.
70. In the introductory sentence of Paragraph 36 (1), the words "paragraph 1 'shall be inserted after the words" paragraph 12'.
71. in Article 36 (1), the dot is replaced by a comma at the end of point (g) and the following point (h) is added:
"(h) the number of the electronic identifier, if marked by the ovine or caprine animal."
72. in the introductory sentence of Paragraph 36 (2), the words "paragraph 1" shall be inserted after the words "paragraph 12."
73.In Paragraph 37 (1) (c), "State" is replaced by "Central."

3. in the case of transfer to a temporary holding, the date of transfer, the address of the transfer, including the identification details of the new breeder, the registration number of the vehicle to which the animal was moved,

79.In Paragraph 39 (4) (g), the words "father's national register" are replaced by the words "father's designation in the central register of breeders."
80. In Article 39 (7), the words "the transmission shall enter its registration number 'shall be replaced by the words" the receipt shall enter its registration number or the registration number of its establishment, the name or, where appropriate, the name and surname or business name or the name, the date of the transfer and shall confirm the particulars by signature'.
81. In Paragraph 39 (8), the words "the transfer of an animal to another Member State or" shall be deleted, the words "death, loss or death" shall be replaced by the words "or loss" and the words "the transfer, export, death, loss or death" shall be replaced by the words "export or loss."
82. In Paragraph 39, the following paragraphs 9 and 10 are inserted after paragraph 8:
"(9) When the animal is moved to another Member State, the animal shall be accompanied by an accompanying certificate of bovine animals.
(10) When the animal is moved from another Member State, the breeder shall immediately transmit his external accompanying certificate to the person responsible for issuing the accompanying certificate within 14 calendar days. ';
Paragraphs 9 to 11 shall be renumbered paragraphs 11 to 13.
83. In Paragraph 39 (11), the words "or if the animal dies or kills' shall be inserted after the words" to the slaughterhouse 'and the words "or the rendering undertaking' shall be added after the words" to the slaughterhouse operator '.
84. in Paragraph 39 (12):
