DECLARATION
of 23 January 2014
on the entry of educational institutions in the list kept for the purposes of state social support and pension insurance and on the study of one-year foreign language courses with daily learning
The Ministry of Education, Youth and Sports, in agreement with the Ministry of Labour and Social Affairs, provides pursuant to § 15 (7) of Act No. 117 / 1995 Coll., on State Social Support, as amended by Act No. 267 / 2013 Coll., and § 108 (3) of Act No. 155 / 1995 Coll., on Pension Insurance, as amended by Act No. 267 / 2013 Coll.:
Subject matter
This decree sets out the formalities and dates for the submission of the application for inclusion in the list, the documents relating to the application, the content, scope and organisation of studies in one-year foreign language courses with daily learning (hereinafter referred to as the "course '), the conditions of professional and pedagogical competence of the teaching staff, the material technical conditions of the premises, the conditions for the termination of the studies, the content and manner of the documentation management, the manner and dates of transmission of data from the documentation to the Ministry of Education, Youth and Sports (hereinafter referred to as the" Ministry').
Forms of application for inclusion in the list
(1) The application for entry in the list shall include:
(a) identification details of the applicant:
1. the name, address, legal form and identification number, if the applicant is a legal person;
2. name and surname, nationality, date of birth, address of place of permanent residence or address of residence, provided that there is no place of permanent residence in the Czech Republic, any business firm, address of registered office and identification number, if the applicant is a natural person,
(b) the applicant's contact address, e-mail address and telephone number, data box address,
(c) proof of the applicant's authorisation to provide language training;
(d) the address of the place where the course is carried out;
(e) the list of foreign languages to be taught in the course;
(f) a description of the content of the study;
(g) the way in which the course is completed and the model of the certificate of successful completion;
(h) evidence of the staff security of the course under Section 4 and the material technical conditions of the premises of study, the description of the apprentices in which the course is conducted and their language teaching equipment; and
(i) the affidavit of the applicant that there is no insolvency proceedings in which its bankruptcy or imminent bankruptcy is dealt with or that it has not been decided on its bankruptcy, is not in liquidation, is not registered in the tax register with the tax authorities of the Czech Republic or the customs authorities of the Czech Republic and does not have a arrears due for insurance against public health insurance or insurance against social security and contribution to the state employment policy.
(2) The information referred to in paragraph 1 (e) and the documents referred to in paragraph 1 (h) must be submitted by the applicant for each course venue. The documents referred to in point (h) of paragraph 1 shall demonstrate the fulfilment of personnel requirements for each course venue.
(3) The documents referred to in paragraph 1 (c) and (h) must be presented in the original or as an officially certified copy. Papers don't return.
Date of submission of the application for inclusion in the list
(1) An application for inclusion in the list for the following school year shall be submitted to the Ministry by 31 January.
(2) A request to amend the entries entered in the list shall be made within 30 days of the date on which the change occurred. The application shall contain the particulars and documents directly related to the proposed amendment.
Professional and pedagogical competence of teachers
(1) Teachers must have professional qualifications for direct pedagogical activities under the Education Labour Act (1) for the pursuit of the activity of a teacher of a secondary school teaching a foreign language. The application shall include a list of such teaching persons, indicating that qualification.
(2) Teaching in the hours of conversation for which the foreign language taught is the mother tongue must have higher education at least at the level of the Bachelor's study programme.
(3) The number of professionally qualified teachers shall correspond to the expected number of participants in the course for the duration of the course.
Material technical conditions of the premises
(1) The study must be carried out on premises which satisfy the conditions for education and training in language schools with the right of national language examinations registered in the register of schools and educational establishments laid down by other legislation (m2).
(2) The right of ownership or use of the premises where the teaching is to take place should be demonstrated at least for the duration of the entry in the list.
Content, scope, organisation and termination of studies
(1) The content of the course is the learning of languages at the appropriate level under the Common European Reference Framework (hereinafter referred to as the Reference Framework),
(a) at a basic level that is comparable to the knowledge of a foreign language at A1 or A2 level under the reference framework; or
(b) at a level which is linked to a graduate examination from a relevant foreign language which is comparable to a knowledge of a foreign language at level B1 or higher in accordance with the reference framework.
(2) The participants in the course are evaluated during the course of the course. At the end of the course, each participant shall have a test which, in its difficulty, corresponds to the relevant level of the reference framework by at least one degree higher than the beginning of the course.
(3) The scope of the study is at least 4 hours a day in the five-day teaching week in the course for one foreign language. Participants may attend several foreign language courses during their annual studies, in which case the number of teaching hours of the next course is provided in excess of 20 teaching hours per week. The duration of the lesson shall be at least 45 minutes.
(4) The maximum number of participants in the course or in the common teaching hour for participants in multiple courses is 18.
(5) Study in the course is governed by the organisation of the school year in secondary schools under the Order on the organisation of the school year3).
(6) The training institution shall issue a certificate to the participant about the successful completion of the course.
Study documentation in the course
(1) The educational institution shall keep the following documentation:
(a) the decision on listing and amendments thereto and the documents referred to in Article 2;
(b) details of the participants in the courses in the scope of the name and surname, date and place of birth, citizenship, address of the place of permanent residence and, where applicable, address of residence, if the participant does not have a place of permanent residence in the Czech Republic;
(c) evidence of the admission and completion of the course by a participant;
(d) a class book containing evidence of the training provided and its course and the attendance of participants;
(e) an internal rules setting, inter alia, a permissible threshold of no more than 25% of the planned study period and the conditions for the apology of the study participant; and
(f) a copy of the certificate of graduation or discharge of the Conservatory of the participants.
(2) The educational institution shall keep documentary or electronic documentation.
(3) The educational institution shall transmit data from its documentation to the Ministry, to the extent appropriate to its activities, in accordance with the rules laid down by the School and School Documentation Regulation for Language Schools with State Language Examination4).
Transitional provision
Applications for entry in the list with effect from 1 September 2014 shall be submitted until 31 March 2014.
Efficacy
This Decision shall enter into force on 1 February 2014.
