DECLARATION
of 12 June 2023
amending Regulation No 96 / 2018 Coll., on the crops and propagating material of fruit genera and species and its putting into circulation, as amended, and Decree No 386 / 2022 Coll., on the crops and propagating material of hops, vines and ornamental species and its putting into circulation
The Ministry of Agriculture shall determine pursuant to § 3 (14) (a) to (c), § 7 (6) (d), (g), (j), (s) and (u), § 14 (6), § 18 (12), § 19 (17) (a) and (c), § 24 (8) and § 25 (8) of Act No. 219 / 2003 Coll., on the putting into circulation of seeds and seedlings and on the amendment of certain laws (Act on the circulation of seeds and seedlings), as amended by Act No. 178 / 2006 Coll., Act No. 96 / 2009 Coll., Act No. 331 / 2010 Coll., Act No 295 / 2017 Coll.
Amendment of the Decree on propagation crops and propagating material of fruit genera and species and its putting into circulation
Decree No. 96 / 2018 Coll., on Propagating Plants and Propagating Material of Fruit Generations and Species and its putting into circulation, as amended by Decree No. 138 / 2020 Coll. and Decree No. 366 / 2020 Coll., are amended as follows:
1. At the end of footnote 1, the sentence "Commission Implementing Directive (EU) 2022 / 2438 of 12 December 2022 amending Directive 93 / 49 / EEC and Implementing Directive 2014 / 98 / EU as regards regulated non-quarantine harmful organisms on ornamental plant propagating material, fruit plant propagating material and fruit plants intended for fruit production shall be added to the separate line. '
2. In Section 2, the words "and propagating material put into circulation under special conditions under Section 3d of the Act 'shall be added at the end of the text under point (i).
3. in Article 3 (1) (a), "which" is replaced by "which."
4. In sections 4 and 10, "9 'is replaced by" 8'.
5. in Article 4 (8) (b), the word "expulsion" shall be replaced by the word "decree."
6. In Section 4, the following paragraph 13 is added:
"(13) Reproduction material in the categories of pre-basic propagating material, basic propagating material and certified propagating material shall not be subject to visual health and testing, unless:
(a) it has been grown in areas free of the relevant harmful organisms, the information on which is published on the Institute's website or recognised by the Commission as being free of those organisms in accordance with the relevant international standards for phytosanitary measures (6); or
(b) is stored by cryoconservation.
6) Requirements for the definition of pest-free areas. ISPM No 4 (1995), Rome, IPPC, FAO 2017. ';
7. In Section 8 (1) of the introductory part of the provision, the word "books' is replaced by" records' and the word "books' is replaced by" records'.
8. In Article 8 (2), the words "the education book 'are replaced by the words" the school records'.
9. In Articles 8 (3) and 8 (4), the words "education book 'are replaced by the words" educational records'.
10. in Article 9 (2) (c), the words "certification" shall be replaced by the words "control of production and marketing of propagating material."
11. in Article 9 (2) (d), the words "or name or business name" shall be inserted after the word "surname" and the words "certification" shall be replaced by the words "control of production and marketing of propagating material."
12. in Paragraph 9 (2) (e), "lot" is replaced by "lot."
13. in Articles 9 (2) (h) and 13 (2) (h), the words "clone in the case" shall be replaced by the words "clone in the case of:"
14. in Paragraph 9 (2) (j), the word "a" shall be deleted;
15. in Article 9 (2), at the end of point (k), the dot is replaced by "a" and the following point (l) is added:
"(l) information that the propagating material of fruit genera and species put into circulation by 31 December 2029 pursuant to Article 32 of Commission Implementing Directive 2014 / 98 / EU as regards that material.";
16. footnote 5 shall be deleted;
17. in Article 9 (5) (d), the words "or, where conformal propagating material has been grown in areas free from the relevant harmful organisms, the information on these areas is published on the Institute's website or recognised by the Commission as free from these organisms in accordance with the relevant international standards for phytosanitary measures (6)," and the word "shows" shall be replaced by the words "visual health inspection."
18. In Section 10, at the end of the text in point (b), the words "indicate at least the name of the supplier and his registration number, the name of the genus and species, varieties and rootstocks' are added.
19. At the end of Paragraph 11, the sentence "The supplier shall use the lot number to indicate the propagating material communicated to him by the Institute on the basis of a notification of the extent of production."
20. In Section 12, the words "import notification form and model 'are inserted after the words" Model'.
21. in Paragraph 13 (2) (m), the word "a" shall be deleted;
22. In Paragraph 13 (2), the dot at the end of point (n) is replaced by "a 'and the following point (o) is added:
"(o) information that the propagating material of fruit genera and species put into circulation in accordance with Article 32 of Commission Implementing Directive 2014 / 98 / EU as regards that material.";
23. In Annex No 1, the words "Hmyz and mites' and the words" Phytoptus avellanae Nalepa [ERPHAV] 'shall be replaced by "Agrobacterium tumefaciens (Smith & Townsend) Conn [AGRBTU]';
24. In Annex 1, in the row "Fragaria L. ', the words" Candidatus Phytoplasma australiense Davis et al. [PHYPAU]' are deleted.
25. In Annex 2, the following row is inserted at the beginning of the table:

27. in Annex 4, point 1, Castanea sativa Mill. points (b) to (d) shall read:
"(b) Pre-basic propagating material
Requirements for the place of the crop, surrounding area and area of production of propagating material
In the case where a derogation for the production of pre-stage propagating material is permitted in spatial isolation pursuant to Commission Implementing Decision (EU) 2017 / 925 of 29 May 2017 temporarily authorising certain Member States to certify the initial material of specific fruit plant species produced in the field under conditions not protected from insects and repealing Implementing Decision (EU) 2017 / 167, the following requirements concerning the organism shall apply:
(i) Cryphonectria parasitica (Murrill) Barr:
- pre-basic propagating material and fruit fillings are produced in areas recognised by the competent authority as free from Cryphonectria parasitica (Murrill) Barr in accordance with the relevant international standards for phytosanitary measures, or
- no symptoms of Cryphonectria parasitica (Murrill) Barr shall be observed at the place of production on the propagating material and fruit crops of the pre-stage during the last complete growing cycle.
(ii) Phytophthora ramorum (EU isolates) Werres, De Cock & Man in't Veld:
- pre-basic propagating material and fruit fillings are produced in areas recognised by the competent authority as free from Phytophthora ramorum (EU isolates) Werres, De Cock & Man in't Veld in accordance with the relevant international standards for phytosanitary measures, or
- no symptoms of Phytophthora ramorum (EU isolates) Werres, De Cock & Man in 't Veld must be observed at the production site of the pre-basic propagating material and fruit crops during the last completed growing cycle.
(c) Basic propagating material
Requirements for the place of the crop, surrounding area and area of production of propagating material
(i) Cryphonectria parasitica (Murrill) Barr:
- propagating material and fruit stratification of basic propagating material are produced in areas recognised by the competent authority as free from Cryphonectria parasitica (Murrill) Barr in accordance with the relevant international standards for phytosanitary measures, or
- no symptoms of Cryphonectria parasitica (Murrill) Barr shall be observed at the place of production on propagating material and fruit crops of basic propagating material during the last complete growing cycle.
(ii) Phytophthora ramorum (EU isolates) Werres, De Cock & Man in't Veld:
- the propagating material and fruit straws of basic propagating material are produced in areas recognised by the competent authority as free from Phytophthora ramorum (EU isolates) Werres, De Cock & Man in't Veld in accordance with the relevant international standards for phytosanitary measures, or
- no symptoms of Phytophthora ramorum (EU isolates) Werres, De Cock & Man in 't Veld shall be observed at the place of production on propagating material and fruit crops of basic propagating material during the last complete growing cycle.
(d) Certified propagating material and conformal material (CAC)
Requirements for the place of the crop, surrounding area and area of production of propagating material
(i) Cryphonectria parasitica (Murrill) Barr:
- the propagating material and fruit straws certified and conformal (CAC) are produced in areas recognised by the competent authority as free from Cryphonectria parasitica (Murrill) Barr in accordance with the relevant international standards for phytosanitary measures, or
- no symptoms of Cryphonectria parasitica (Murrill) Barr. must be observed at the place of production on the propagating material and fruit crops of certified and conformal (CAC) during the last complete growing cycle, or
- propagating material and fruit straws certified and conformal (CAC) showing symptoms of Cryphonectria parasitica (Murrill) Barr must be removed, the remaining propagating material and fruit straws must be examined on a weekly basis and no symptoms observed at the place of manufacture within 2 weeks prior to dispatch.
(ii) Phytophthora ramorum (EU isolates) Werres, De Cock & Man in't Veld:
- the propagating material and fruit straws certified and conformal (CAC) are produced in areas recognised by the competent authority as free from Phytophthora ramorum (EU isolates) Werres, De Cock & Man in't Veld in accordance with the relevant international standards for phytosanitary measures, or
- no symptoms of Phytophthora ramorum (EU isolates) Werres, De Cock & Man in 't Veld shall be observed at the production site of certified and conformal fruit crops (CAC) during the last complete growing cycle.
or
-
- Propagating material and fruit straws certified conformal (CAC) showing symptoms of Phytophthora ramorum (EU isolates) Werres, De Cock & Man in't Veld at the place of production and all plants within a radius of 2 m of propagating material and fruit crops with symptoms of infection must be removed and destroyed, including impacted soil
and
- for all plants within a 10 m radius of propagating material and fruit crops with symptoms of infestation, and all remaining propagating material and fruit straws from the affected lot shall be subject to:
- within three months of the detection of propagating material and fruit crops with symptoms of infestation, the symptoms of Phytophthora ramorum (EU isolates) Werres, De Cock & Man in 't Veld shall not be observed on the propagating material and given fruit crops at least 2 inspections at appropriate times for the detection of the harmful organism, and no treatment shall be carried out to control the symptoms of Phytophthora ramorum (EU isolates) Werres, De Cock & Man in' t Veld and
- after this three-month period:
- no symptoms of Phytophthora ramorum (EU isolates) Werres, De Cock & Man in 't Veld must be observed on the specified propagating material and fruit crops at the place of production, or
- a representative sample of the propagating material in question and of the fruit crops to be moved must be tested and found free from Phytophthora ramorum (EU isolates) Werres, De Cock & Man in't Veld, and
and
- for all other propagating material and fruit crops at the place of manufacture:
- no symptoms of Phytophthora ramorum (EU isolates) Werres, De Cock & Man in 't Veld must be observed on the specified propagating material and fruit crops at the place of production, or
- a representative sample of the propagating material in question and of the fruit crops to be moved has been tested and found free of Phytophthora ramorum (EU isolates) Werres, De Cock & Man in't Veld. '
28. In Annex 4, point 4, Cydonia obernga Mill. (b), the words:
"Requirements for the place of the crop, the surrounding area and the area of production of propagating material
In the case where a derogation for the production of pre-stage propagating material is permitted in spatial isolation in accordance with Commission Implementing Decision (EU) 2017 / 925, the following requirements concerning Erwinia amylovora (Burrill) Winslow et al.:
(i) the propagating material and fruit fillings are produced in pre-stage areas known to be free from Erwinia amylovora (Burrill) Winslow et al., or
(ii) the propagating material and fruit fillings of the propagating material at the place of production have been inspected during the last completed growing season and all propagating material and fruit fillings with symptoms of Erwinia amylovora (Burrill) Winslow et al., and all surrounding host plants have been immediately removed and destroyed. "
29. in Annex 4, point 6, Fragaria L. (d) (iii), the words "Candidatus Phytoplasma australiense Davis et al.," shall be deleted;
30. the following shall be added to Annex 4, point 8, Malus Mill. at the end of point (c):
"Requirements for the place of the crop, the surrounding area and the area of production of propagating material
(i) Candidatus Phytoplasma mali Seemüller & Schneider
- propagating material and fruit fillings of basic propagating material are produced in areas known to be free from Candidatus Phytoplasma mali Seemüller & Schneider, or
- no symptoms of Candidatus Phytoplasma mali Seemüller & Schneider must be observed at the place of production on propagating material and fruit crops of basic propagating material during the last complete growing season and any plants with signs of infestation in the immediate vicinity must be removed and immediately destroyed;
(ii) Erwinia amylovora (Burrill) Winslow et al.
- propagating material and fruit fillings of basic propagating material are produced in areas known to be free from Erwinia amylovora (Burrill) Winslow et al., or
- the propagating material and fruit fillings of the basic propagating material at the place of production must be inspected during the last completed growing season and all propagating material and fruit fillings showing signs of Erwinia amylovora (Burrill) Winslow et al., and all host plants in the vicinity must be immediately removed and destroyed. "
31. the following shall be added to Annex 4, point 8, Malus Mill. at the end of point (d):
"Requirements for the place of the crop, the surrounding area and the area of production of propagating material
(i) Candidatus Phytoplasma mali Seemüller & Schneider
- propagating material and fruit straws of certified propagating material are produced in areas known to be free from Candidatus Phytoplasma mali Seemüller & Schneider, or
- no signs of the presence of Candidatus Phytoplasma mali Seemüller & Schneider and any plants with signs of infestation in the immediate vicinity shall be observed on propagating material and fruit crops of certified propagating material at the place of production during the last complete growing season, and must be destroyed without delay, or
- the symptoms of the presence of Candidatus Phytoplasma mali Seemüller & Schneider must be observed during the last complete growing season at no more than 2% of the propagating material and fruit crops of certified propagating material at the place of production and given propagating material and given fruit fillings and any plants with signs of infestation in the immediate vicinity must be removed and immediately destroyed and from the remaining propagating material and fruit crops without signs of infestation in lots where propagating material and fruit fences with symptoms of infestation were found, a representative sample was taken and tested and found free from Candidatus Phytoplasma mal Seemüller & Schneider;
(ii) Erwinia amylovora (Burrill) Winslow et al.
- propagating material and fruit fillings of certified propagating material are produced in areas known to be free from Erwinia amylovora (Burrill) Winslow et al., or
- the propagating material and fruit straws of certified propagating material at the place of production must be inspected during the last completed growing season and all propagating material and fruit straws showing signs of Erwinia amylovora (Burrill) Winslow et al. and all host plants in the vicinity must be immediately removed and destroyed. "
32. in Annex 4, point 8, Malus Mill., point (e) is deleted;
Point (f) shall be renumbered as point (e).
33. in Annex 4, point 12, Pyrus L. (b) (i):
"(i) Candidatus Phytoplasma pyri Seemüller & Schneider
- propagating material and pre-basic fruit fillings are produced in areas recognised by the competent authority as free from Candidatus Phytoplasma pyri Seemüller & Schneider in accordance with the relevant international standards for phytosanitary measures, or
- no signs of the presence of Candidatus Phytoplasma pyri Seemüller & Schneider during the last three growing periods, and any plants with signs of infestation in the immediate vicinity, shall be observed at the place of production; ';
34. in Annex 4 (12) Pyrus L. (e) (i):
"(i) Candidatus Phytoplasma pyri Seemüller & Schneider
- propagating material and fruit straws of conformal (CAC) propagating material are produced in areas recognised by the competent authority as free from Candidatus Phytoplasma pyri Seemüller & Schneider in accordance with the relevant international standards for phytosanitary measures, or
- no signs of the presence of Candidatus Phytoplasma pyri Seemüller & Schneider and any plants with signs of infestation in the immediate vicinity shall be observed at the place of production on propagating material and fruit crops (CAC) during the last complete growing season, or
- propagating material and fruit straws of the conformal (CAC) propagating material at the place of production and any plants in immediate proximity which have shown signs of the presence of Candidatus Phytoplasma pyri Seemüller & Schneider during visual inspections during the last three growing seasons must be removed and destroyed without delay; ';
35. in Annex 4, point 12, Pyrus L. (f) (i) shall read:
"(i) Candidatus Phytoplasma pyri Seemüller & Schneider
- propagating material and fruit straws of conformal (CAC) propagating material are produced in areas recognised by the competent authority as free from Candidatus Phytoplasma pyri Seemüller & Schneider in accordance with the relevant international standards for phytosanitary measures, or
- no signs of the presence of Candidatus Phytoplasma pyri Seemüller & Schneider and any plants with signs of infestation in the immediate vicinity shall be observed at the place of production on propagating material and fruit crops (CAC) during the last complete growing season, or
- propagating material and fruit straws of the conformal (CAC) propagating material at the place of production and any plants in immediate proximity which have shown signs of the presence of Candidatus Phytoplasma pyri Seemüller & Schneider during visual inspections during the last three growing seasons must be removed and destroyed without delay; ';
36. in Annex 4, point 15, Vaccinium L., the following point (iv) is added at the end of point (b):
"(iv) Phytophthora ramorum (EU isolates) Werres, De Cock & Man in't Veld:
- the propagating material and fruit straws of basic propagating material are produced in areas recognised by the competent authority as free from Phytophthora ramorum (EU isolates) Werres, De Cock & Man in't Veld in accordance with the relevant international standards for phytosanitary measures, or
- no symptoms of Phytophthora ramorum (EU isolates) Werres, De Cock & Man in 't Veld shall be observed at the place of production on propagating material and fruit crops of basic propagating material during the last complete growing cycle.'
37. in Annex 4, point 15, Vaccinium L., the following point (iii) is added at the end of point (d):
"(iii) Phytophthora ramorum (EU isolates) Werres, De Cock & Man in't Veld:
- propagating material and fruit straws of certified propagating material are produced in areas recognised by the competent authority as free from Phytophthora ramorum (EU isolates) Werres, De Cock & Man in 't Veld in accordance with the relevant international standards for phytosanitary measures, or
- no symptoms of Phytophthora ramorum (EU isolates) Werres, De Cock & Man in 't Veld must be observed at the place of production on the propagating material and fruit crops of certified propagating material during the last complete growing cycle.

- propagating material and fruit straws of certified propagating material showing symptoms of Phytophthora ramorum (EU isolates) Werres, De Cock & Man in 't Veld at the place of production and all plants within a radius of 2 m from the propagating material and fruit crops with symptoms of infection must be removed and destroyed, including adherent soil

- for all plants within a 10 m radius of propagating material and fruit crops with symptoms of infestation, and all remaining propagating material and fruit straws from the affected lot shall be subject to:

- for all other propagating material and fruit crops at the place of manufacture:
- no symptoms of Phytophthora ramorum (EU isolates) Werres, De Cock & Man in 't Veld must be observed on the specified propagating material and fruit crops at the place of production, or
- a representative sample of the propagating material in question and of the fruit crops to be moved has been tested and found free of Phytophthora ramorum (EU isolates) Werres, De Cock & Man in't Veld. '
38. In Annex 4, the following point (e) is added at the end of point 15 of Vaccinium L.:
"(e) Conformal (CAC) propagating material
Requirements for the place of the crop, surrounding area and area of production of propagating material
- Phytophthora ramorum (isolates from EU) Werres, De Cock & Man in't Veld:
- the propagating material and fruit straws of the conformal (CAC) propagating material are produced in areas recognised by the competent authority as free from Phytophthora ramorum (EU isolates) Werres, De Cock & Man in't Veld in accordance with the relevant international standards for phytosanitary measures, or
- no symptoms of Phytophthora ramorum (EU isolates) Werres, De Cock & Man in't Veld shall be observed on the propagating material and fruit crops of the conformal (CAC) propagating material at the place of production during the last complete growing cycle.
or
- propagating material and fruit straws of conformal (CAC) propagating material showing symptoms of Phytophthora ramorum (EU isolates) Werres, De Cock & Man in't Veld at the place of production, and all plants within a radius of 2 m of propagating material and fruit crops with symptoms of infection must be removed and destroyed, including impacted soil, and
- for all plants within a 10 m radius of propagating material and fruit crops with symptoms of infestation, and all remaining propagating material and fruit straws from the affected lot shall be subject to:

- a representative sample of the propagating material in question and of the fruit crops to be moved has been tested and found free from Phytophthora ramorum (EU isolates) Werres, De Cock & Man in't Veld
and
- for all other propagating material and fruit crops at the place of manufacture:
- no symptoms of Phytophthora ramorum (EU isolates) Werres, De Cock & Man in 't Veld must be observed on the propagating material and fruit crops concerned, or
- a representative sample of the propagating material in question and of the fruit crops to be moved has been tested and found free of Phytophthora ramorum (EU isolates) Werres, De Cock & Man in't Veld. '
39. Annex 5 shall read as follows:

Where the rootstocks are directly vegetatively propagated from the basic mother plant of the first generation, they shall be recognised as "E I."
