DECLARATION
of 9 June 2025
amending Decree No 359 / 2020 Coll., on Electricity Measurement, as amended
The Ministry of Industry and Trade provides pursuant to Article 98a (1) (a) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on the Amendment of Certain Acts (Energy Act), as amended by Act No. 158 / 2009 Coll., Act No. 211 / 2011 Coll., Act No. 165 / 2012 Coll., Act No. 131 / 2015 Coll., Act No. 362 / 2021 Coll., Act No. 469 / 2023 Coll. and Act No. 87 / 2025 Coll.:
Decree No 359 / 2020 Coll., on the measurement of electricity, as amended by Decree No 375 / 2023 Coll. and Decree No 138 / 2024 Coll., is amended as follows:
1. In Section 1, at the end of point (a), the words "providing flexibility and storing electricity 'are added.
2. in Article 1, the following points (c) and (d) are inserted after point (b):
"(c) cases where, at the low-voltage transfer point, only a specified gauge can be measured by means of secondary measurement;
(d) requirements for secondary measuring devices and conditions for their installation; ';
Points (c) to (m) shall be renumbered as points (e) to (o).
3. in Article 1 (k), the words "measuring in accordance with a directly applicable European Union2 Regulation" shall be replaced by "measuring equipment."
4. In Article 2 (1), the words "electricity, the operator of the electricity storage facility, the customer operating the electricity generation plant or the electricity storage facility 'are inserted after the word" producer'.
5. In Article 2 (4), the words "electricity storage facilities' are inserted after the words" electricity storage facilities'.
6. in Article 3 (2) (e), the words "at the production plant" shall be replaced by the words "delivered to or withdrawn from the transmission system or distribution system to or from the electricity or storage facility" and the word "connected" shall be replaced by "connected."
7. in Article 4 (2) (b):
"(b) delivered to or withdrawn from the distribution system to or from a power plant with an installed power output of more than 50 kW or a power storage facility with an installed power output of more than 50 kW directly connected to the distribution system at a voltage level of up to 1 kV,"
8. in Article 4 (2) (e) and (f):
"(e) delivered to or withdrawn from the distribution system at a voltage level of up to 1 kV at the sampling point through which the power plant with an installed power output of more than 50 kW or a power storage facility with an installed power output of more than 50 kW is connected;
(f) delivered to or withdrawn from a transmission or distribution system to or from a power plant or any production source connected to a transmission or distribution system through another power plant or through a storage facility; and ';
9. in Article 4 (2), the following point (g) is added:
"(g) delivered to or withdrawn from a transmission or distribution system to or from a power storage facility connected to a transmission or distribution system through a power-generating facility or through another electricity storage facility.";
11. in Article 5 (2) (b) and (c):
"(b) delivered to or withdrawn from a distribution system to or from a power plant with an installed power of up to 50 kW or a power storage facility with an installed power of up to 50 kW directly connected to the distribution system at a voltage level of up to 1 kV and with direct measurement;
(c) delivered to or withdrawn from the distribution system at a voltage level of up to 1 kV at a direct measurement sampling point through which a power plant with an installed power up to 50 kW or a power storage facility with an installed power up to 50 kW are connected; ';
12. in Article 5 (4) (b), the words "not connected" shall be replaced by the words "not connected" and the words "or electricity storage facilities" shall be inserted after the words "electricity generation";
13. in Article 5 (5), the words "auction bonus or" shall be inserted after the words "If applicable."
14. in Article 5 (5), "hourly" is replaced by "quarter-hour."
15. in Article 7 (3) (c), the words "the electricity storage facility operator" shall be inserted after the words "the electricity producer."
16. in Article 7 (3), at the end of point (c), the word "a" is replaced by a dot and point (d) is deleted;
17. in Article 7 (3) (d), the words "producers and" shall be replaced by the words "electricity generators, electricity storage facilities and" and the words "power generation" shall be replaced by the words "electricity generation or storage facilities shall not be installed."
18. in Paragraph 7 (4), the words "electricity collection" shall be replaced by the words "electricity collection or supply," and the words "electricity generation has been properly measured" shall be replaced by the words "electricity generation or supply,"
19. in Article 8 (1), the words "or the electricity storage facility" shall be inserted after the words "or the electricity storage facility" and the words "or the electricity storage facility" shall be inserted after the words "Paragraph 8 (1)."
20. in Paragraph 8 (2), the words "use" shall be replaced by the words "use the distribution system operator at the sampling point or sampling point with the connected production or production point with the connected production and storage facility."
21. in Article 8 (6), the words "the electricity storage facility operator" shall be inserted after the words "the electricity producer."
22. in Paragraph 9 (1), the words "the electricity storage facility" shall be inserted after the words "the electricity storage facility" and the words "the electricity storage facility" shall be inserted after the words "the electricity storage facility";
23. in Articles 9 (3), 11 (3) and 13 (4), the words "in the electricity storage facility" shall be inserted after the words "electricity generation plant."
24. In Article 10 (4), the words "location or" shall be replaced by the words "location," after the words "electricity generation plant," the words "location or" shall be replaced by "location," the words "electricity generation plant," and the words "transmission system or distribution operator" shall be inserted after the words "operator."
25. in Articles 10 (5), 17 (3) and 19 (2), the word "decision" shall be replaced by "notice."
26. In Article 10 (6), the words "electricity storage facilities' shall be inserted after the words" electricity generation plants'.
27. in Article 11 (2), the words "the operator of the electricity storage facility" shall be inserted after the words "the electricity storage facility operator"; the words "the electricity storage facility operator" shall be inserted after the words "the electricity production facility"; the words "the electricity storage facility" shall be inserted after the words "the electricity storage facility";
29. in Paragraph 11 (5), the word "connected" is replaced by "and in the electricity storage facility connected."
30. in Article 12 (1), the words "electricity or" shall be replaced by the words "electricity, in the electricity storage facility,";
31. § 12a, including the title, reads:
Requirements for secondary measuring devices and conditions for their installation
(1) Where the electricity generation plant and the electricity storage plant operator are connected at the point of transmission, the electricity storage facility and the electricity storage facility operator, the electricity producer or the customer requires to take into account the amount of electricity that has been withdrawn from the electricity storage system or distribution system and resupplied to the electricity storage system or distribution system, in the maximum payment of the price component of the distribution system service or the price component of the electricity service provided under the Power Supplied Act (5), at least the electricity produced in the electricity generation plant must be measured separately by measuring C of category C3 or by measuring a higher category or type.
(2) Paragraph 10 (1) to (3) shall not apply where the operator of the electricity storage facility, the electricity producer or the customer ensures that the secondary real-time measuring device is synchronised. ';
33.Paragraph 13 (1) reads as follows:
"(1) The distribution system operator shall transmit to the market operator data on electricity generation plants for which a future connection contract or connection contract has been concluded. The market operator shall transmit the data transmitted in accordance with the first sentence to the transmission system operator and the transmission system operator for the processing of the report on the future expected consumption of electricity and gas and on how the balance between supply and demand for electricity and gas is ensured. ';
34. In Article 13 (2), the words "derogations and 'are replaced by the words" derogations,' and after the words "shared electricity ', the words" and taking into account the amount of electricity withdrawn from the transmission or distribution system for the storage of electricity and re-supplied to the transmission or distribution system from the storage facility, in the maximum payment of the price component of the distribution system service or the price component of the transmission system for the promotion of electricity pursuant to the Energy Support Act';
35. in Paragraph 17 (4) of the introductory part of the provision, the words "or the electricity producer" are replaced by the words "the electricity producer, the electricity storage installation operator."
36. in Articles 17 (5) and 18 (3), the words "price decisions" shall be replaced by the words "price statements" and the words "decisions" shall be replaced by "terms of reference."
37. in Article 17 (8), the words "the electricity producer, the electricity storage installation operator or the distribution system operator" shall be inserted after the words "the customer."
38. In Paragraph 18 (1), the word "collection 'is replaced by" transfer'.
39. in Article 18 (2) (a), the words "the point of demand or the electricity or distribution system concerned" shall be replaced by the words "the point of supply, the electricity plant, the electricity storage facility or the distribution system."
40. In Article 19, paragraph 4 is added:
"(4) In the case of an unauthorised supply of electricity pursuant to Paragraph 52 (1) (f) of the Energy Act from an electricity generation plant connected at a demand point at a voltage level of up to 1 kV with an agreed zero value of the reserved power, the compensation for the undue supply of electricity, where the supply is to an extent that is not associated with the payment of the excess price of the reserved power, shall be set at zero. ';
41. In Annex 5, Part A, the words "not connected 'are replaced by the words" not connected' and the words "or electricity storage facilities' are inserted after the words" electricity generation '.
42. In Annex 5, Part B, the word "production facility 'is replaced by the words" electricity or electricity generation plant and electricity storage facilities';
Efficacy
This Decree shall enter into force on 1 August 2025, with the exception of:
(a) Article I (14) and (16), which shall take effect on 1 January 2026;
(b) Article I (32), which shall take effect on 1 August 2026; and
(c) Article I (10) and (28), which shall take effect on 1 July 2027.
