on the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Poland on cooperation in the field of plant protection and quarantine
On 3 December 1970, the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Poland on cooperation on plant protection and quarantine was signed in Prague.
Pursuant to Article 15 thereof, the Agreement entered into force on 16 October 1973.
The Czech text of the Agreement, as amended by the Notes of 21 September 1973 and 16 October 1973, is hereby published at the same time.

AGREEMENT
between the Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Poland on cooperation on plant protection and quarantine
The Government of the Czechoslovak Socialist Republic and the Government of the People's Republic of Poland, guided by the desire to unify their efforts in the eradication of diseases and pests of plants and weeds, to protect each other's national territories against their introduction and spread, to facilitate the transport of plants and products of plant origin between the two Contracting Parties, have decided to conclude this Agreement.
To that end, they appointed their agents:

Andrzej Kacala - Deputy Minister for Agriculture,
who, following the exchange of full powers which have been found to be in good and proper form, have agreed on the following:
The Contracting Parties, in order to prevent the spread of dangerous diseases and plant pests and weeds (hereinafter referred to as pests) from the national territory of one Contracting Party to the national territory of the other Contracting Party, undertake:
(a) implement the necessary measures in their national territory against pests, in particular those listed in the Annex to this Agreement;
(b) to provide all consignments containing plants or products of plant origin (hereinafter referred to as "consignments") which are exported to the national territory of the other Contracting Party with health certificates issued by the competent plant protection and quarantine authorities of the exporting Party confirming that the consignments are free from pests listed in the Annex to this Agreement and that they comply with the conditions of the importing State referred to in the trade agreements;
(c) comply with the relevant laws and regulations of the importing Party when exporting consignments;
(d) to use primarily sawdust, shavings, paper, artificial materials and other materials which can only be transferred by pests at random: hay, straw, husks, leaves and other plant materials used for packaging of consignments, must be pre-sanded or come from crops in which the presence of pests listed in the Annex to this Agreement has not been detected and which, according to plant health inspections, have been recognised as not containing those pests, which will be confirmed in the health certificate;
(e) to dispose of all removable soil residues;
(f) remove all impurities from the means of transport used to transport consignments and, if necessary, recover the means of transport.
Point (b) shall not apply to consignments which have been processed industrially in a manner which ensures the destruction of all pests.
The Contracting Parties shall apply all necessary measures to protect their national territories from the introduction of pests from the territories of third States.
The transit of consignments shall be allowed if they are accompanied by a health certificate and comply with the quarantine rules of the State in whose territory they will be accompanied or if a certificate of effective rendering is submitted.
The import, export and transit of consignments shall take place through border crossing points designated by the competent authorities of the Contracting Parties.
The competent authorities of the Contracting Parties shall carry out plant health inspections of imported or accompanying consignments and shall prescribe the necessary quarantine measures. If those authorities do not authorise the import or transit of consignments or provide for specific quarantine measures, they shall immediately inform the competent authorities of the other Contracting Party.
In order to facilitate and accelerate imports, exports and transit, the competent authorities of the Contracting Parties may agree on the joint carrying out of plant health inspections, the joint use of technical means necessary for inspection and rendering and, where appropriate, the carrying out of such inspections by the competent authorities of one Contracting Party in the national territory of the other Contracting Party.
The conditions, time limits and place of inspection shall be agreed in advance in each individual case by the competent authorities of the two Contracting Parties.
The Parties shall, as far as possible, provide each other with expert and technical assistance in the protection of plants against pests under conditions agreed in each individual case by their competent authorities.
The competent authorities of the Contracting Parties shall inform each other of:
(a) by 1 April each year, on the occurrence and spread of hazardous pests and on measures to eradicate them; immediately if a new pest is detected,
(b) the laws, regulations and other provisions concerning the protection and quarantine of plants and the rules governing the import, export or transit of consignments and their control, not later than 30 days after their issue;
(c) changes to border crossing points referred to in Article 3;
(d) the results of scientific and research work, new methods and plant protection products, as well as the publication of specialist journals, monographs and other relevant publications in the field of plant protection and quarantine.
The Parties agree:
(a) to send experts, where necessary, to the national territory of the other Contracting Party in order to familiarise themselves with the methods of plant protection and quarantine, the results of scientific research and the exchange of experience on this section;
(b) to allow plant protection and quarantine workers of the other Party to specialise in their institutes and establishments;
(c) to set up, where necessary, in particular in border areas, a temporary joint committee to coordinate activities in the plant protection and quarantine sectors.
The competent authorities of the Contracting Parties shall, as appropriate, conduct joint consultations on plant protection and quarantine problems to discuss and address practical and scientific tasks and exchange of experience. The meetings shall be held alternately on the national territory of both Contracting Parties. The time, place and schedule of such consultations shall be agreed by the competent authorities of the Contracting Parties.
The competent authorities of the Contracting Parties shall be in direct contact with the implementation of this Agreement and may conclude implementing arrangements.
Articles 6, 7, 8, 9 and 10 shall also apply to forestry.
The costs associated with the transmission of experts referred to in Article 8 (a) and (b) shall be borne by the Party sending the experts.
The costs associated with the activities of the Joint Commissions referred to in Article 8 (c) and the costs associated with the holding of meetings referred to in Article 9 shall be borne by the Contracting Party in whose national territory the Joint Commission or the Consultation will be held.
The costs of sending experts to meetings and participating in the Joint Commissions shall be borne by the Party which seconded the experts.
Other costs resulting from the implementation of this Agreement shall be dealt with in accordance with the payment agreement applicable between the Contracting Parties.
The attached pest lists shall form an integral part of this Agreement. The competent authorities of the Contracting Parties may supplement or amend their own list of pests.
The amendments or amendments to the list shall be notified to the other Contracting Party by diplomatic means and shall enter into force 30 days after receipt of the note on the changes made.
This Agreement shall be without prejudice to the provisions concerning the protection and quarantine of plants adopted in other agreements concluded between the Contracting Parties.
This Agreement shall be subject to approval under the constitutional requirements of each of the Contracting Parties and shall enter into force on the date of the exchange of notes on such approval or on the date of the entry into force of the Protocol on the repeal of the Agreement between the Republic of Czechoslovakia and the Republic of Poland on the protection of agricultural plants against pests and diseases, of 22 January 1949, signed on 3 December 1970, whichever is the later.
This Agreement shall be concluded for a period of 5 years. It shall be renewed for a further period of five years at any time if no Contracting Party denies it in writing at the latest six months before the end of the relevant period.
Written in Prague on 3 December 1970 in two copies, each in the Czech and Polish languages, the two texts being equally authentic.
