Ministries of Foreign Affairs supplementing Communication No. 551 / 1992 Coll., on the European Convention for the Transfer of Criminal Procedure, adopted in Strasbourg on 15 May 1972
The Ministry of Foreign Affairs complements Communication No. 551 / 1992 Coll., declaring a Czech translation of the European Convention for the Transfer of Criminal Procedure, adopted in Strasbourg on 15 May 1972, an integral part of which are Annexes I, II and III, which are subsequently published in the Czech translation by this communication.
The English version of the Convention and its annexes may be consulted by the Ministry of Foreign Affairs and the Ministry of Justice.

Příloha I

Annex I
Each Party may declare that it reserves the right to:
(a) refuse a request to initiate proceedings where it considers that it is exclusively a religious act;
(b) refuse a request to initiate proceedings for an act for which, under its own law, a penalty may be imposed only by an administrative authority;
(c) not to adopt Article 22;
(d) not to adopt Article 23;
(e) not to adopt the provisions of Article 25 for constitutional barriers;
(f) not to adopt the provisions of Article 26 (2) where it has its own competence under its law;
(g) not to apply Articles 30 and 31 to those acts for which the sentence may be imposed, in accordance with its own legal order or the legal order of another competent State, only by an administrative authority;
(h) not accept Part V.

Příloha II

Annex II
Any Contracting State may declare, by reference to its constitutional rules, that it will submit and accept requests to initiate proceedings only in the cases provided for in its law.
Each Contracting State may define by means of a declaration what it understands for the purposes of this Convention under the term "citizen."

Příloha III

Annex III
List of non-criminal offences governed by criminal law
The following acts will be considered criminal offences governed by criminal law:
in France - any infringement regulated by "contravention de grande voirie"
in Germany - any infringement covered by the Code of Infringement (Gesetz über Ordnungswidrigkeiten)
in Italy - any infringement covered by Law No 317 of 3 March 1967.
