of 28 April 1990
on the remuneration of workers in the private business of citizens
The Federal Ministry of Labour and Social Affairs sets out, pursuant to § 123 (1) (a) and (b) of the Labour Act (full version No 52 / 1989 Coll.), after consulting the Ministry of Finance, Prices and Wages of the Czech Republic, the Ministry of Finance, Prices and Wages of the Slovak Republic and the competent trade unions:
§ 1
Scope
This decree regulates the remuneration of workers in employment to an entrepreneur, (1) which usually employs up to 200 workers (the worker and the entrepreneur).
§ 2
Wage classification of workers
The entrepreneur shall classify the workers according to the agreed type of work and the work carried out in the relevant tariff step as set out in the Annex to this Decree.
§ 3
Salary
The entrepreneur shall provide workers with a wage for the work they have done and for the results thereof, in accordance with the conditions agreed in the employment contract, in the internal wage regulation or in the collective agreement; the wage must not be lower in the various tariff stages than the sum of the basic wage rate referred to in § 13 and the allowances referred to in § 5 to 9. The agreed part of the salary with the exception of the basic wage rate (§ 13) and the supplements (§ 5 to 9) may be provided as non-cash payments.
§ 4
Wage forms
The application of individual forms of wages and their combinations is a business competence. In addition to the allowances referred to in § 5 to 9, the entrepreneur may also provide workers with other wage supplements or on-call remuneration to assess the different workload and difficulty of working conditions.
§ 5
Wage for overtime work
(1) For an hour working overtime (2), the staff member shall be entitled to pay, and the staff member shall be paid at least the monthly salary.
a basic wage rate of 1 / 185 at 42,5 and 42 hours per week,
1 / 180 of the basic wage rate at 41,25-hour weekly working hours,
at the rate of 1 / 175 of the basic wage rate at 40-hour working hours.
(2) In addition to the salary referred to in paragraph 1 and any other elements of the salary achieved, a supplement of at least one of the following shall be payable to a worker who has not been granted an allowance for overtime):
(a) at the rate of 25% of the basic wage rate; or
(b) at the rate of 50% of the basic wage rate, if there is overtime work at night or on days of continuous rest in the week.
(3) An entrepreneur may fix a uniform overtime allowance of at least 33% of the basic wage rate when it comes to working with alternating daily, night, Saturday and Sunday shifts, irrespective of when the overtime worked.
§ 6
Extra charge for work at night
Workers working at night shall be entitled to a fee of at least 2.50 CZK for each hour worked, provided that the night work lasts at least 2 hours. Work at night is considered to be work between 22nd and 6th hours.
§ 7
Extra charge for work at heights
Workers who work in a limited working space or in forced positions of the body resulting from a specified working procedure at heights above 150 m shall be entitled to an additional fee of 5 to 13 CZK for each starting hour of work.
§ 8
Additional charge for high-risk work
Workers who are working under extremely difficult and high-risk working conditions, when breathing apparatus or working under water or working at very high temperatures or in an ionizing environment, are required to pay a surcharge of 10 to 36 CZK for each starting hour of work.
§ 9
Extra charge for work on Saturdays and Sundays
Workers working on Saturdays and Sundays shall be granted a premium of at least 50% of the basic wage rate and / or the relevant part of the basic wage rate (§ 5 (1)) and, if work is above the fixed weekly working hours, at least 25%. The supplement is not for work on Saturdays and Sundays, which are working days under a special regulation.
§ 10
Cumulation and flat-rate payment
The allowances provided under Articles 6 to 9 and, where applicable, other wage supplements (Article 4) and overtime wages (Article 5) may be fixed in advance by the entrepreneur by an average amount (per hour, month) and cumulated to a uniform amount for up to 1 year, provided that there is no substantial change in working conditions; the entrepreneur is not obliged to keep a continuous record of workers' claims on a fee basis.
§ 11
Personal payroll account
(1) The entrepreneur may set up a personal wage account in agreement with the manager or other worker through whom he operates. Part of this worker's salary is transferred to a personal account.
(2) The Agreement must include the determination of the part of the salary transferred to the personal account, the extent and conditions for the reduction of the part of the salary transferred and the payment dates of the salary from the personal account. The agreement on the establishment of a personal account must be concluded in writing, otherwise it shall be void.
(3) If the employment is terminated before the expiry of the payment deadline set out in the Agreement, the salary shall be paid from the personal account to the extent appropriate to the agreed conditions, no later than three months after the termination of the contract. Adequate progress shall be made on the permanent change of the agreed type of work.
(4) The salary on the personal account shall not be remunerated and shall not be included in the worker's earnings until it has been paid.
§ 12
Wage and compensation of wages at downtime
(1) If a worker cannot work for down6) and is transferred by an entrepreneur to another job, he shall be paid according to the work done.
(2) If an entrepreneur does not transfer a worker to another job, he shall be entitled to pay at least the basic wage rate.
(3) Reimbursement of wages is for the worker only if the interruption of work lasts at least 1 hour.
§ 13
Basic wage tariff
The entrepreneur shall provide the workers assigned to each tariff level with a wage of at least the following basic wage rates:

§ 14
Meeting of workers with the Order
The entrepreneur is obliged to inform the workers in advance of the content of this decree, the method of remuneration and the classification of the tariff levels and allow the workers to look into the decree.
§ 15
Efficacy
This Decree shall take effect on 1 May 1990.

characteristics of tariff levels and examples of work activities
Preliminary provisions
1. The characteristics of the tariff stages and examples of work activities are a binding basis for the inclusion of the work activities into tariff levels within the meaning of Article 2 of the Decree.
2. Labour, technical and commercial operations are classified in six tariff stages. The tariff level expresses the general characteristics and individual examples of work activities of around the same level of qualification intensity, responsibility, workload and difficulty. The employer shall determine the work content of the management functions in accordance with the applicable rules.
3. The operator shall include the worker in the appropriate tariff step on the basis of a comparison of the work mainly carried out with the following characteristics and examples of work.
4. If classification in the tariff level cannot be reliably identified (new activity, substantial change in complexity and difficulty of work or working conditions, etc.), the entrepreneur shall submit a proposal to the competent Ministry of Finance, Prices and Wages of the Czech Republic or the Slovak Republic for a decision; in the proposal for inclusion, indicate the description of the work activity, the name and tariff number and the conditions under which the work is carried out. In the decision of the competent authority, the operator shall determine the provisional classification of the work according to the characteristics and the tariff levels.
5. Examples of work activities marked at the end of "(x) 'are considered more demanding in terms of overall complexity, complexity and difficulty.
6. For the performance of individual work activities and functions in the III and higher tariff stages, the characteristics of the tariff stages include indicative assumptions of theoretical training (education); the specific qualification assumption and its focus for the performance of individual work activities - learning in the field or study direction, or the required length of practice, shall be determined by the entrepreneur. For the performance of certain work activities and functions, the qualification requirements (education, practice, age, official examination, training, etc.) shall be laid down in a specific regulation.
Characteristics of tariff levels and examples of work activities
Tariff grade I - auxiliary worker
Characteristics
Simple repetitive work with less physical effort, carried out according to detailed instructions of the superior.
Examples:
1. Light and heavy cleaning of allocated tonnage .x)
2. Supervision of the entrusted building, supervision of parking lots and markets.
3. Delivery of shipments and money.
4. Providing snacks, drinks and their transport (money handling).
5. Ensuring the operation of dressing rooms including cleaning.
6. Check the arrivals and exits of workers and visitors, arrivals and departure of vehicles, release keys.
7. Preparation of sports sites, small maintenance work, rental of sports equipment, cleaning of swimming pools and playgrounds.
8. Preparation and partial work in the treatment of interpreters, exhibitions and exposures.
9. Service of public toilets incl. cleaning and cleaning of waste .x)
10. Manual simple work in agriculture using commonly used tool.x)
11. Service of lifts for transport of persons and material.
12. Preparatory and part-time work in commercial operations, catering and accommodation including manual transport of goods.
13. Adding posters and transparent notices.
14. Packaging of various product types up to 50 kg material.x)
15. Small sewing work, sewing pockets, handkerchief, curling, sewing buttons.
16. Simple construction preparation and finishing work, landscaping, figurative work.x)
Tariff grade I - Administrative technical and operational personnel
Characteristics
Simple or partial administrative technical work of administrative, operational or technical focus.
Examples:
1. Service of simple operating equipment (copying, offset).
2. Expedition of products, goods, materials from hand warehouses.
3. Delivery of various types of consignments.
4. Working on simple data transfer devices.
5. Ensuring the operation of cultural, social and physical facilities, including the introduction of visitors, the check of tickets, the provision of information and the provision of promotional material, the organisation of the work of relevant staff, the billing of sales from the programme.
6. Placing and handling of decorations and musical instruments.
7. Collection of articles from newspapers, checking bibliographic records, keeping records.
8. Labelling and sorting of documents (invoices).
Tariff level II - independent worker
Characteristics
Simple work done separately, simple work physically strenuous or simple work done under unfavourable working conditions (monotony, forced body position, repulsive environment, etc.).
Examples:
Engineering
1. Machine and manual machining of materials in workshop tolerance IT 10 and higher, small parts (casings, seeds) with functional requirement.
2. Grinding and polishing metal components in workshop tolerance.
3. Pressing plastic and metal components, including machine adjustment.
Construction
4. Kopáčské's work in digging down construction lines, pits, shafts, forges with or without arms in all rocks. x)
5. Preparation of malts, transfer of building materials, adding work, paking, coating of construction structures and other similar preparatory and finishing work.x)
6. Tiles work of all kinds, e.g. paving and repairing paving pavements of pavements, roads, river rigs, wooden blocks including pairing and making surfaces of pavements and pavements with cast asphalt, coated with crushing and asphalt carpets of all kinds. x)
7. Insulation of structures carried out by various types of insulating materials, including acid materials and their repairing.x)
8. Installation and dismantling of tubular and similar metal scaffolds, motor platforms and lifts up to 10 m
9. Treatment and processing of construction materials, semi-finished products and products by manual or mechanical means (x)
Textile, apparel, leather and plastic production
10. Preparation of upholstery padding materials, sewing of upholstery covers of smooth products, stripping.
11. Minor repairs and modifications of scenic costumes and accessories including the manufacture of simple civil and period costumes and clothing components (skirts, petticoats, berths, military hats, headgear, headgear, altar rooms).
12. Repair of laundry, clothing, work aids and stockings.
13. Repair of all types of umbrellas including making necessary parts and coatings (except historical umbrellas).
14. Preparation of wicker, knitting and sewing of simple basket products.
15. Repair of footwear.
Transport
16. Driving and using motor carriages including handling of costs and additional mechanisms.
17. Driving and operating cranes with dredges, conveyors, cranes up to 10 t.
18. Transport of persons on boats complying with the Code on the Safety of Persons and Underground (Punkva) associated with the replacement of parts of the boat and the possible repair of the engine.
19. Service, repair and security of cableway, ski lift and suspension cableways including ticket sales.
20. Washing, lubricating and preserving road motor vehicles.
21. Regular maintenance, cleaning and lubrication of lifts.
22. Warranty work including loading and unloading of material or goods and others as instructed by the driver (x)
Glass and ceramics
23. Basic work in the production of ceramics - polishing of designated places by machine and by hand including glazing by dipping, coating, decorating decals, spraying, stamping and planting of products from furnaces, casting of simple products (stoppers, tiles, washers).
Agriculture and forestry
24. Manual physically strenuous work in agriculture, operation of cutting machines, simple hanging tools, handling work in agricultural machines.x)
25. Collection of seeds of forest trees and their cleaning and polishing, professional work in forest nurseries in the treatment and protection of seedlings.
26. Agricultural work using horse coat.
27. Treatment of livestock including sheep cutting and cheese production.
Trade and public catering
28. Sale of small goods (tobacco, printing, souvenirs, frozen products, beverages, tickets) in canteen, buffet, kiosk.
29. Various works in business operations, hotel and catering (shipping of goods, dishes, pastry products, inventory care and hotel linen, orders for accommodation, fuel, small services, etc.).
30. Conservative processing of raw materials, production of musts and distillates.
Other
31. Implementation of normal home works including replacement of light bulbs, fuses, locks, glass tables, minor repairs of plaster and coatings.
32. Service and maintenance of central heating boilers with a mass flow rate up to 2,22 kg / s
33. Service of exchange and reduction stations including routine maintenance.
34. Manual cleaning of roads even in winter and operation of sprinkler and cleaning mechanisms.
35. Guard of objects and equipment against damage, theft and natural disasters with possible control of the unit's guard service of up to 10 members.
36. Receipt, storage and delivery of goods, products, drawings, machine parts and gas bombs (main warehouse).
37. Moving materials, products, heavy parts of furniture, machinery and equipment.x)
38. Reception, handling, cleaning and laundry, clothing, carpets, feathers and the like
39. Service of small waste water treatment plants including pit cleaning, pipes, sewer net.x)
40. Handling the garbage and work on the landland.x)
41. Cleaning windows, skylights, walls, ceilings and disinfection of vats, barrels and different tanks.
42. Made up, putting poison and other baits for killing mice, rats, rats and difficult insects.
43. Separate work in the construction and disassembly of decorations using various building materials (sand, lime, cement, wood, metal, clay, ice) in the construction of artificial ponds, rock formations mostly by hand including material transfer and decoration.
44. Construction, operation, maintenance and dismantling of fun attractions (Russian bikes, carousel, shooting range, twisters, loopings).
45. The production of objects of folk art (from boneless pastries, kraslice, betlém figures according to pattern).
46. Acquisition, purchase, preparation and modification of personal and consumer theatre props.
47. Installation and dismantling of lighting equipment on the scene including dismantling of preparatory supporting or safety components.
48. Calling up the film of black and white roll and 35mm movies and making photocopies, preparing solutions for colour photography.
49. Preparation, operation and minor maintenance of projecting equipment up to 35 mm.
50. Preparation of therapeutic solutions and baths based on medical regulations (paraffin, mud, additive baths) and their applications including temperature control, steam, dry air and first aid provision.
51. Advertising and Posting Service, lending of industrial and sports goods.
52. Paint and nail painting, hand massage, nail cutting and sharpening etc.
53. Teaching all kinds of swimming, cleaning swimming pools, providing first aid to drowning.
54. Manufacture of brush and rope products.
55. Care service in the homes of mobile citizens.
56. Planting and removing traffic signs and marking of crossroads.
57. Lakerical and painting work by all kinds of colors including mould and grinding.
58. Organisation of funeral ceremonies, transport of coffins, cleaning and treatment of cemetery spaces and grave places.
Tariff level II - self-administration technical and operational personnel
Characteristics
Execution of administrative or administrative technical work, partial economic, administrative, operational and technical work; the preparation of sub-documents, surveys of simple assemblies for the preparation of accounting, operating, etc.; operating equipment operations, data acquisition on supporting media according to design and instructions; compilation and collection of data sets, items, reports including data correctness check.
Examples:
1. Typing according to pattern or dictate, copying text.
2. Simple laboratory work in normal mechanical and chemical tests and analyses.
3. Service of branch telephone exchanges and telex subscribers.
4. Provision of information to the public.
5. Simple quantitative and qualitative acceptance (service, shoe repair, small consumer goods).
6. Library work in local folk libraries, chronicle management.
7. Performing preventive protection of collections of historical and artistic objects.
Grade III - professional worker
