on the examination and assessment of the competence of certain staff
The Czech Mining Office provides pursuant to § 10 (c) of the Act of the Czech National Council No. 24 / 1972 Coll., on the organisation and extension of supervision of the State Mining Administration, in agreement with the participating central bodies of the Czechoslovak Socialist Republic, the Czech Socialist Republic and the Czech Trade Union Council:
(1) The knowledge of the regulations on safety and health at work and related regulations (1) is verified by testing of technical and economic workers who are in charge of work in organisations subject to the state professional supervision of the authorities of the State Mining Administration pursuant to § 3 of the Act of the Czech National Council No. 24 / 1972 Coll., on the organisation and extension of supervision of the State Mining Administration (hereinafter the "Act") before the local competent mining office.
(2) (2) On a proposal from the organisation, the Czech Mining Authority may delegate this competence to one of the district mining offices in whose districts the organisation has its offices. The Czech Mining Office can pass an examination in cases it reserves.
(1) The staff referred to in Article 1 (1) shall be the head of the organisation and its representatives, the heads of the establishments and, where appropriate, the workplaces, and those whose activities affect the management of the work referred to in Article 3 of the Act or whose responsibility for such work arises from the rules of organisation.
(2) In case of doubt as to whether the worker referred to in paragraph 1 is involved, the local competent mining authority shall decide, after having expressed the authority of the superior organisation.
(1) The organisation shall report to the staff member for examination no later than 3 months after his taking office.
(2) A review of the knowledge of the regulations shall be repeated at least every 3 years. The organisation shall register the worker no later than 3 months before the expiry of this period.
(3) The place and date of the examination and examination shall be determined by the local authority responsible for the mining operation no later than 3 months after receipt of the application.
(4) The staff member who is summoned to the test is obliged to attend and submit to the test at the designated time.
(1) The examination shall be carried out orally before a commission appointed by the chairman of the locally competent Mining Authority.
(2) The Mining Authority shall invite to the examination a representative of the relevant trade union body and a representative of the organisation or, where appropriate, a representative of the authority of the superior organisation.
(3) The test result shall be assessed as passed or failed.
(4) On the basis of the result of the examination, the panel shall assess the professional competence of the worker, communicate the test to the worker and notify the organisation in writing in duplicate. The Commission shall also notify the authority of the management organisation of the result of the examination.
(5) The notification referred to in paragraph 4 shall be made by the organisation or, as the case may be, by the authority of its superior, to set up a worker in the files and to deposit the copy at the place of the worker's workplace.
(1) If a worker fails to pass a regulatory test, but the lack of knowledge of the worker is not such as to endanger the life or health of the staff of the organisation in the performance of his duties or the immediate danger to the operation of the organisation, the Mining Authority shall set a reasonable time limit to perform the corrective test.
(2) If the worker fails to pass the corrective test or does not undergo it without a serious reason or if the corrective test has not been authorised, the local authority of the mining office shall assess his competence as non-compliant and inform the organisation that the worker does not fulfil the conditions laid down for the performance of the duties, together with a proposal for an appeal from that post or transfer to another work, where appropriate.
The organisation shall register for testing personnel who have started carrying out the functions referred to in Paragraph 2 (1) before the date of application of this Order and have not successfully passed the test or examination of the knowledge of the regulations referred to in Paragraph 1 (1), by 30 September 1981 at the latest.
The Decree shall take effect on 1 April 1981.

ČSR, on safety and health at work and on safety of operations in organisations subject to state professional supervision by the authorities of the State Mining Administration pursuant to Act No. 24 / 1972 Coll.
2) Decree of the Czech Mining Office No. 25 / 1972 Coll., which defines the circumference of the district mining authorities.
