GOVERNMENT REGULATION
of 17 January 1968
on the adjustment of remuneration and allowances and of certain other ratios of members of national committees and members of national committees' commissions and assets
The Government of the Czechoslovak Socialist Republic orders pursuant to § 17 paragraph 3 of Act No. 69 / 1967 Coll., on National Committees, and § 124 paragraph 3 of the Labour Code No. 65 / 1965 Coll.:
(1) Members of the national committees who are short-released for the performance of their duties by the national committees, in respect of which they are in a working or similar proportion (hereinafter referred to as "organisations"), are entitled, for the duration of their release, instead of salary (other pay for work), to compensation organisations for the loss of earnings equivalent to their average earnings determined in accordance with the applicable rules. *) This compensation shall be paid to them by the organisations at the dates set in the organisation for the payment of wages (other remuneration for work).
(2) Members of national committees who are not in work or in a similar proportion shall provide compensation for lost earnings for the time of their release directly from their budget, directly on the basis of their appropriations, directly from the amount shown. If a member of the national committee who has been released in the short term cannot prove lost earnings, the national committee may grant him adequate compensation. Compensation for loss of earnings provided under this paragraph shall not be deductible for pension purposes (insurance).
(1) Members of the national committees who are long-term dismissed from their duties (hereinafter referred to as "long-term releases of Members") will receive from the organisations an appropriate remuneration from the national committees according to the closer conditions laid down by the government. The remuneration shall be assessed as remuneration and paid directly by the national committees from their budget. In determining the level of remuneration, account shall be taken of the extent of liability and the social importance of the function, the personal qualities of the officials and the amount of their earnings to date. Their working or similar relationship with organisations shall be maintained for the duration of their long-term vacancy with national committees. The remuneration shall also be paid to Members who perform the duties of long-term Members who have not previously been employed.
(2) Members who serve as President, Secretary and, in specific cases, as Vice-President of the National Committee or as Chairman of the Committee or as Chairman of the Committee of People's Control of the National Committee in their employment are entitled to a reasonable remuneration for the performance of their duties in accordance with the conditions laid down by the Government, in addition to compensation for the loss of earnings referred to in Article 1.
(1) Members of the national committees are entitled to reimbursement of the actual expenditure incurred in the performance of their duties from the budgetary resources of the national committees. Such refunds shall be granted in accordance with the rules applicable to workers in employment. 1) Members of the national committees may flat-rate travel expenses. 2)
(2) Members of the national committees on whose territory urban public transport is operated may, in the performance of their duties as a Member, use free of charge the means of urban public transport in the territorial area in which urban public transport is operated upon presentation of the card.
(3) Members of the Regional National Committee may, in the performance of their duties as Members, use free of charge the means of transport of Czechoslovak state car transport in scheduled bus services in the regional district of the Regional National Committee on the basis of the submission of a Member card.
(4) If the duties of a long-term member of a national committee who does not reside in the seat of the competent national committee require that he be relocated to that post, he shall be entitled to reimbursement of removal expenses against the national committee, also in accordance with the rules applicable to workers in employment. Under these rules, members of the National Committee may, in a reasoned case, be granted severance or, where appropriate, reimbursement on their daily return to residence, throughout the term of office of the National Committee.
(1) Members of national committees may be granted one-off remuneration for exceptional merit from the reserve fund and the development of the economy of national committees. *)
(2) Long-term allowances may also be granted to long-term Members from the incentive funds of the national committees under conditions laid down by specific provisions. * *)
(3) Long-term allowances to Members of the National Committees may be granted in respect of significant work and life years under the conditions applicable to the staff of the National Committees. *)
(1) Long-term released Members are assessed as workers of national committees as regards their labour rights, sickness insurance and social security claims.
(2) The social security authority responsible for deciding on pension benefits shall, at the request of the Member of Parliament, determine the pension on the average monthly earnings recorded on the gross earnings earned in employment and on the gross remuneration obtained on behalf of the national committee, including that part of the salary-exempt remuneration, for the last ten or, where applicable, the last five calendar years before the year in which the service was terminated, provided that this average is more favourable to him than the average monthly earnings established under the general rules. This advantage belongs only to long-term dismissed Members, for whom the reason for discontinuing their duties in the National Committee is not a gross violation of or abuse of the duties of Members.
(1) The national committee shall, if there is no reason for them to terminate their duties in the national committee, grant a gross breach of the duties of a Member or misuse of such duties, a contribution equal to the difference between their current earnings for the organisation and their previous higher remuneration for the performance of their duties. This allowance shall be granted for a period of six months and shall be paid through the organisation. This allowance shall be granted for long-term vacancies who have completed their duties two years before the age required to qualify for an old-age pension; in cases of special consideration, in particular where a Member has performed this post for several parliamentary periods, a contribution may be granted, with the agreement of the Council of the National Committee of the Higher Level and, for officials of the Regional National Committees and of the National Committee of the City of Prague, with the agreement of the Ministry of the Interior, until the age required to qualify for an old-age pension.
(2) The allowance shall be assessed for the purposes of sickness insurance, pension insurance, the calculation of payroll tax and for the purposes of employment as part of employment income.
(1) The remuneration for the performance of duties, the compensation for the loss of earnings and the allowance provided for in Article 6 are the benefits of the salary tax.
(2) One fifth of the remuneration for the performance of the duties granted under Article 2 (1) and (2) shall be exempt from payroll tax. * * *)
(1) The provisions of this Regulation shall also apply to members of the national committees - active soldiers and members of the National Security Corps, taking into account the specific nature of their respective duties, the performance of their duties and the divergent arrangements for their security.
(2) Paragraphs 1, 3 (1), 4 (1) and 7 (1) also apply to citizens working in national committees as members of their commissions and administrative commissions, civil committees and other assets of national committees. This also applies to members and co-workers of the Committees of People's Control of National Committees.
