of 9 April 2025
amending Act No. 483 / 1991 Coll., on Czech Television, as amended, Act No. 484 / 1991 Coll., on Czech Radio, as amended, and other related laws
Parliament has decided on this law of the Czech Republic:
Amendment of the Czech Television Act
Act No. 483 / 1991 Coll., on Czech Television, as amended by Act No. 36 / 1993 Coll., Act No. 253 / 1994 Coll., Act No. 301 / 1995 Coll., Act No. 39 / 2001 Coll., Act No. 231 / 2001 Coll., Act No. 82 / 2005 Coll., Act No. 127 / 2005 Coll., Act No. 304 / 2007 Coll., Act No. 384 / 2008 Coll., Act No. 132 / 2010 Coll., Act No. 153 / 2010 Coll., Act No. 302 / 2011 Coll., Act No. 252 / 2017 Coll., and Act No. 225 / 2023 Coll., is amended as follows:
1. In Paragraph 2 (2), the words "and contributing to media literacy 'shall be added at the end of point (a).
2. in Article 3 (1) (f):
"(f) supports Czech film production and cultural projects and participates in Czech audiovisual production abroad, including promotion,"
3. in Article 3 (1) (k):
"(k) uses new technologies in the production and dissemination of programmes and the provision of audiovisual and information services directly related to the programme,"
4. in Article 3 (1), the following point (l) is inserted after point (k):
"(l) operates television broadcasting of programmes or parts thereof through an electronic communications network;"
Points (l) to (n) shall be renumbered as points (m) to (o).
5. in Article 3 (1) (m):
"(m) provide audiovisual media services on request; the following point is added:
6. Paragraph 3a (4) reads as follows:
"(4) Czech television may only place commercial communications on its website and in its applications if:
(a) aimed only at promoting their own audiovisual media services on demand, own broadcasting and programmes;
(b) by placing the product; or
(c) part of programmes whose content cannot be affected by Czech television. "
7. In Paragraph 4 (9), the word "Vice-President 'is replaced by" 2 Vice-President' and the second sentence is replaced by "One of the three officials is elected from among the members of the Council elected by the Senate '.
8. In Article 5 (1), the words ", the Ombudsman or his representative, the Ombudsman of children, Members of the European Parliament 'shall be inserted after the words" the Bank'.
9. Paragraph 5 (2) and (3), including footnote 3, read:
"(2) A member of the Council shall not serve in political parties or political movements, nor shall he act on their behalf for their benefit or for other group interests in the performance of his duties in the Council; Furthermore, they shall not participate in mass media business, nor shall they represent commercial interests which may conflict with the performance of their duties or threaten confidence in the independence or impartiality of the Council. A member of the Council may not perform any other function or activity on Czech television, nor shall he have income from Czech television other than cash transactions provided in connection with the performance of his duties under this Act or income from the use of subject protection under the Copyright Act.
(3) A member of the Council does not meet the requirements for the performance of the duties of a member of the Council if he is a person close to 3) a person who carries out a gainful activity on Czech television or has income from Czech television other than income from the use of the subject-matter of protection under the copyright law, or who is involved in a mass media business or represents commercial interests which could jeopardise the confidence in the independence or impartiality of the Council's decisions.
3) § 22 of the Civil Code. '.
footnote 2a is deleted.
10. In Article 6, paragraphs 3 and 4 are added:
"(3) The resolution of the Chamber of Deputies or the Senate on the withdrawal of a member of the Council from office under paragraph 2 must be justified.
(4) A person who has ceased to function as a member of the Council under paragraph 1 (d) shall immediately notify and document to the President of the Council the date of the termination of his membership of the Council, if he has not ceased to function as a member of the Council because of his limitation in his capacity. The President of the Council shall immediately inform the President of the Chamber of Parliament who has elected a member of the Council in writing of such notification. '.
11. in Article 7 (1), the words "the Council shall adopt within 30 days of its first meeting" shall be replaced by "the Council."
12. in Article 7 (2):
"(2) The Council shall be competent to act in the presence of at least 10 of its members. The decision shall be taken by the Council by an absolute majority of the members present, with the exception of the decision to appoint the Director-General of Czech Television (hereinafter referred to as" the Director-General ") and the decision referred to in Article 8 (1) (b), (e), (f), (g), (j), (k) and (l), which shall be taken by a majority of at least 10 votes of its members, and the decision to appeal of the Director-General, for which at least 12 votes of the members of the Council are required. ';
13. In Article 7, the sentence "The Council shall act as necessary and at least once a month shall be inserted at the beginning of paragraph 3."
14. in Article 8 (1) (a), the words "and, on a proposal from the Director of Television Studies," shall be deleted;
15. in Article 8 (1) (b), the words "pursuant to a specific law, (4) verified by an auditor under a specific law; (5)" shall be replaced by the words "according to a law governing accounting validated by an auditor under a law governing auditors;"
footnotes 4 and 5 are deleted, including the reference to footnote 4.
16. in Article 8 (1) (c), the words "and special legislation5a)" shall be deleted;
footnote 5a is deleted.
17. in Paragraph 8 (1) (d), including footnote 13:
"(d) to monitor the fulfilment of requirements arising from European Union law for the application of State aid rules to public service broadcasting (13) and the fulfilment of requirements for transparency of financial relations in Czech television pursuant to § 11a;
13) Communication from the Commission on the application of the State aid rules to public service broadcasting (2009 / C 257 / 01). "
18. In Paragraph 8 (1), the words "The Statute of Czech Television shall be amended at the end of the text of point (e)."
19. in Paragraph 8 (1) (g) read:
"(g) give prior agreement to the Director-General on the legal conduct referred to in Article 9 (8) and on the establishment or cancellation of a television studio referred to in Article 9 (9),";
20. in Paragraph 8 (1) (i), "and 3" is replaced by "to 3a."
21. in Paragraph 8 (1) (k):
"(k) elect and dismiss members of the Supervisory Committee pursuant to § 8a, approve its rules of control and determine the level of remuneration of its members;"
22. In Article 8, at the end of paragraph 1, the dot is replaced by a comma and the following points (m) to (p) are added:
"(m) approve, on a proposal from the Director-General, the provision of a new major service or significant changes to an existing public service in the field of television broadcasting (hereinafter referred to as" the new major service "); details are provided by the Czech Television Statute,
n) approve, on a proposal from the Director-General, the Annual Activity and Management Report of Czech Television,
o) to provide the Director-General with the necessary synergies to fulfil the obligations of Czech television,
p) approve the Memorandum on how the public service in the field of television broadcasting concluded between the Minister of Culture and the Director-General of Czech Television for a period of 5 years. "
23. Paragraph 8 (2) reads:
"(2) The Council submits to the Chamber of Deputies and the Senate the Annual Activity and Management Report of Czech Television by 31 August immediately following the calendar year. The Annual Report on the Activity and Management of Czech Television must contain, in a separate section, information on the fulfilment of requirements arising from European Union law for the application of State aid rules to public broadcasting (13) and on the fulfilment of requirements for transparency of financial relations pursuant to § 11a. The Council shall publish the Annual Report on the Activity and Management of Czech Television no later than 3 days after the date of its approval in a manner enabling remote access."
24. In Article 8, at the end of the text of paragraph 3, the words "with which the Council has powers in accordance with other legislation shall be added; The Czech Television Statute provides details."
25. In Paragraph 8, the sentence "The remuneration of members of the Council and members of the Supervisory Committee shall be due at regular intervals for the remuneration of employees of Czech Television."
26. In Paragraph 8a (1), "European Union law 'is replaced by" European Union law for the application of State aid rules to public service broadcasting 13'.
27. in Paragraph 8a (2), the words "citizens of the Czech Republic" are replaced by the words "natural persons," and at the end of the paragraph the sentence "Membership of the Supervisory Board is a public function. 12)"
28. In the first sentence of Paragraph 8a (3), "4 'is replaced by" 3', the words "consecutive 'are replaced by" consecutive' and the last sentence is deleted.
29. in Paragraph 8a (6):
"(6) The Supervisory Committee shall be competent to give a quorum in the presence of at least three of its members. The decision of the Supervisory Committee shall be taken by a majority of at least three votes of its members. ';
30. in Article 8a (7), the words "documents, accounting records (7)" shall be replaced by the words "records (4)" and the words "documents or accounts" and the words "approved by the Council" shall be deleted;
footnote 7 is deleted.
31. in Article 8a (9), the word "second" shall be replaced by the word "second" and the words "activity and" shall be inserted after the words "Annual Report on."
32. In Paragraph 8a, paragraph 10 is added:
"(10) A member of the Council may attend the meetings of the Supervisory Committee. In such a case, the obligation to remain silent shall apply to him to the same extent as the member of the Supervisory Committee. '.
33. In Article 8b (5), the words "from Czech television" and the words "special legislation (8)" shall be inserted after the words "due."
footnote 8 is deleted.
34. in Article 8b (6), the words "special legislature.9)" shall be replaced by the words "Labour Code."
footnote 9 is deleted.
35. in Article 8b, paragraph 7 is deleted;
36. The following Section 8c is inserted after Section 8b:
Introducing a new major service
(1) In carrying out the tasks referred to in § 2 (2), § 3 (1) and § 3a, Czech Television uses new technologies to innovate its activities and diversify distribution platforms and offer services to the public, including the introduction of new major services.
(2) A new major service may be included by Czech Television in the performance of the public service if:
(a) the service fulfils the conditions that, according to the reasoned conclusions of the preliminary assessment of the project, the new major service, based on open public consultation, published, including the settlement of the opinions of stakeholders, on the Czech Television website (hereinafter referred to as the "preliminary evaluation conclusions") for its inclusion in the public service broadcasting, is based on European Union13); and
(b) its inclusion in the public service shall be approved by the Council.
(3) An open public consultation on the project of a new important service is announced by Czech Television on its website and announced in its broadcast. The time limit by which Czech television may be given opinions shall not be less than 60 days.
(4) The proposal for the inclusion of a new significant service in the public service mission shall be submitted to the Council for approval and shall be attended by the Director-General. The proposal shall contain a description of the new major service and the justification for its introduction in relation to the performance of the public service, the requirements for its financing and the estimated impact on the market. The proposal shall be accompanied by the conclusions of the preliminary evaluation.
(5) The provisions of paragraphs 1 to 4 shall not prevent the testing of a new major service in the form of a pilot project with limited monitoring capacity in order to obtain information on its feasibility and the contribution to the performance of the public service in the field of television broadcasting.
(6) Signs distinguishing the new important service from other services, the elements of the project of the new important service, the requirements of the announcement of open public consultation, the procedure rules and the criteria for preliminary evaluation and the publication of the conclusions of the preliminary evaluation will be adapted by Czech Television in the Czech Television Statute in accordance with the requirements of European Union13). "
37. in Paragraph 9 (6) (b), the words "written" shall be replaced by the words "written" and, at the end of the text of the letter, the words "or, where appropriate, a later date indicated in the written waiver."
38. in Paragraph 9 (6), the words "or, where appropriate, at a later date specified in the Council decision to remove the Director-General from office" shall be added at the end of the text in point (c).
39. in Article 9 (6) (d):
"(d) the date on which the decision of the court which has restricted the discretion of the Director-General became final;"
40. In Paragraph 9 (7) (a), the words "(Sections 2 and 3)" shall be deleted and after the words "Czech Television" shall be inserted the words "or, if not fulfilled by their activities, the Memorandum on how the public service in the field of television broadcasting is to be performed";
41.Paragraph 9 (8) reads:
"(8) The legal process whereby a immovable property held by Czech Television or a part of it is transferred, loaded or left to use another for more than 3 months requires the prior written consent of the Council, otherwise it is invalid; the invalidity shall be taken into account by the court of its own motion. ';
42. In Paragraph 9, the sentence "The Director-General shall appoint and dismiss the directors of television studies after consulting the Council is added to the beginning of paragraph 10."
43.In Paragraph 9 (11), the text "(c) 'is deleted.
44. in Paragraph 11 (1), the words "its tasks (Sections 2 and 3)" shall be replaced by the words "the provision of public service pursuant to Sections 2, 3 (1) and 3a."
45. In Paragraph 11, the following paragraph 3 is inserted after paragraph 2:
"(3) The rules on the use of financial resources in the provision of public service pursuant to § 2, § 3 (1) and § 3a to the extent and in a way that meets the requirements of European Union law for the application of State aid rules to public service broadcasting 13) shall be adapted by Czech Television in the Statute of the Czech Television."
Paragraph 3 shall become paragraph 4.
46. in Paragraph 11 (4):
"(4) On a quarterly basis, Czech television transfers the difference between the proceeds from advertising broadcast on the program ČT 2 and the proven effective costs associated with the selection and management of the proceeds from advertising broadcast on this programme to the State Fund of Culture of the Czech Republic at the latest by the end of the following calendar quarter for the previous calendar quarter. The proceeds from advertisements broadcast on the program ČT sport will be used by Czech Television to produce and broadcast sports programmes."
47. In Article 11, the following paragraph 5 is added:
"(5) On a quarterly basis, Czech television transfers a quarter of the difference between the revenue from sponsoring programmes and programmes and proven to be effective costs associated with the selection and management of the revenue from sponsoring programmes and programmes to the State Fund of Culture of the Czech Republic, at the latest by the end of the following calendar quarter for the previous calendar quarter."
48. in Article 11a (2), "(2) and (3)" shall be replaced by "Article 2, § 3 (1) and § 3a," "§ 2 and 3" shall be replaced by "§ 2, § 3 (1) and § 3a" and "which must comply with the requirements of European Union law" shall be replaced by "in accordance with the requirements of the law governing certain measures for the transparency of financial relations in the field of public aid."
49. in Article 11a (3), the words "European Union law" are replaced by the words "the law governing certain measures for the transparency of financial relations in the field of public aid."
50. In Paragraph 12 (2), the first sentence is replaced by the sentence "The Director of Television Studies is entitled to represent Czech Television in all matters relating to television studies except for the disposal or loading of real estate."
51. in Article 12 (3), "(c)" is replaced by "(d)";
52. in Article 12 (4), the words "national broadcasting lines" are replaced by the words "full-format programmes disseminated across the board."
53.In Section 13, the words "(Sections 2 and 3) 'are deleted.
Transitional provision
The Director-General of Czech Television will submit a proposal for a Memorandum on how the public service in the field of television broadcasting to the Czech Television Council within 6 months of the date of entry into force of this Act.
Amendment of the Czech Radio Act
Act No. 484 / 1991 Coll., on the Czech Radio, as amended by Act No. 36 / 1993 Coll., Act No. 253 / 1994 Coll., Act No. 301 / 1995 Coll., Act No. 135 / 1997 Coll., Act No. 192 / 2002 Coll., Act No. 127 / 2005 Coll., Act No. 196 / 2009 Coll., Act No. 79 / 2015 Coll., Act No. 374 / 2021 Coll. and Act No. 225 / 2023 Coll., are amended as follows:
1. In Article 2 (1), the words "in order to meet the democratic, social and cultural needs of society and to preserve media pluralism 'shall be inserted after the words" abroad'.
2. In Paragraph 2 (2), the words "and contributing to media literacy 'shall be added at the end of point (a).
3. in Article 3 (1), the following point (g) is inserted after point (f):
"(g) supports Czech radio and cultural projects,"
Points (g) to (i) shall be renumbered as points (h) to (j).
4. In Article 3, at the end of paragraph 1, the dot is replaced by a comma and the following points (k) and (l) are added:
"(k) provide the public with the information and content referred to in Article 2 (1) on its website and via the Czech Radio applications; News and political-publicity programmes provided on the website and in the applications of the Czech Radio must respect the principles of objectivity and balance, in particular they must not unilaterally favour any political party or movement, or their views or the views of individual groups of the public, taking into account their real position in political and social life,
(l) promote broadcasting of its own programmes or programmes and other public service tasks in the field of radio broadcasting. "
5. In Article 3 (4), "95 'is replaced by" 80' and the word "lidu.1c 'is replaced by" lidu1c', with the exception of the full-screen radio programme referred to in Article 3 (1) (a) aimed at current reporting and publishing, the broadcast of which may receive at least 95% of the population of the Czech Republic calculated according to the data resulting from the last census of lidu1c. '
6. In Article 3, the following paragraph 6 is added:
"(6) The Czech Radio may only place commercial communications on its website and on its applications if it is aimed at promoting its own broadcasting, programmes and public service activities in the field of broadcasting, or is part of programmes whose content cannot be affected by the Czech Radio."
7. In Paragraph 4 (9), the word "Vice-President 'is replaced by" 2 Vice-President' and the second sentence is replaced by "One of the three officials is elected from among the members of the Council elected by the Senate '.
8. In Article 5 (1), the word "public 'is replaced by the word" public' and the words "rights' are inserted after the word" or its representative, the guardian of the rights of children, Members of the European Parliament '.
9. Paragraph 5 (2) and (3), including footnote 3, read:
"(2) A member of the Council shall not serve in political parties or political movements, nor shall he act on their behalf for their benefit or for other group interests in the performance of his duties in the Council; Furthermore, they shall not participate in mass media business, nor shall they represent commercial interests which may conflict with the performance of their duties or threaten confidence in the independence or impartiality of the Council. A member of the Council shall not perform any other function or occupation in the Czech Radio, nor shall he receive from the Czech Radio any income other than cash provided in connection with the performance of his duties under this Act or any income arising from the use of subject-matter under the Copyright Act.
(3) A member of the Council does not meet the requirements for the performance of the duties of a member of the Council if he is close to 3) a person who carries out a gainful activity in the Czech Radio or has income from the Czech Radio other than income from the use of subject-matter under copyright law, or who is involved in a mass media business or represents commercial interests which could jeopardise the confidence in the independence or impartiality of the Council's decisions.
3) § 22 of Act No. 89 / 2012 Coll., Civil Code. '.
10. In Article 6, paragraphs 3 and 4 are added:
"(3) The resolution of the Chamber of Deputies or the Senate on the withdrawal of a member of the Council from office under paragraph 2 must be justified.
(4) A person who has ceased to function as a member of the Council under paragraph 1 (d) shall immediately notify and document to the President of the Council the date of the termination of his membership of the Council, if he has not ceased to function as a member of the Council because of his limitation in his capacity. The President of the Council shall immediately inform the President of the Chamber of Parliament who has elected a member of the Council in writing of such notification. '.
11. in Article 7 (1), the words "the Council shall adopt within 30 days of the beginning of its term of office" shall be replaced by the words "the Council shall adopt."
12. in Article 7 (2), the word 'absolute' shall be deleted, the words' at least 5 'shall be inserted after the word' majority ', the words' all 'shall be deleted and the words' at least two thirds shall be replaced by 'at least 6';
13. In Article 7, the sentence "The Council shall act as necessary and at least once a month shall be inserted at the beginning of paragraph 3."
14. in Paragraph 7 (4), the words "the facts of which are not covered by specific legislation" shall be deleted and the words "except for those parts which contain facts protected under other legislation" shall be added at the end of the text of the paragraph.
15. In Paragraph 8 (1) (a), the words "and, on his proposal, the Director of Radio Studies of the Czech Radio (hereinafter referred to as" Radio Studies ")" shall be deleted.
16. in Article 8 (1) (b):
"(b) approve the budget of the Czech Radio, an overview of the claims and liabilities and the accounts of the Czech Radio according to the Act governing accounting verified by the auditor under the Act governing auditors; until the budget is approved, the Czech Radio runs according to its long-term economic development plan,"
17. in Article 8 (1), the following points (c) and (d) are inserted after point (b), including footnote 6:
"(c) to check the efficient and economical use of the financial resources and assets of the Czech Radio according to the approved budget and to draw the Director-General's attention in writing to the deficiencies identified;
(d) monitor compliance with the requirements arising from European Union law for the application of State aid rules to public broadcasting (6) and the fulfilment of the requirements for transparency of financial relations in the Czech Radio pursuant to § 11a;
6) Communication from the Commission on the application of the State aid rules to public service broadcasting (2009 / C 257 / 01). "
Points (c) to (j) shall be renumbered as points (e) to (l).
18. in Paragraph 8 (1), the words "the Statute of the Czech Radio shall be added at the end of the text referred to in point (e); the Statute of the Czech Radio shall in particular specify the organisation and operation of the Czech Radio."
19. in Paragraph 8 (1) (g) read:
"(g) give prior consent to the Director-General for legal proceedings pursuant to § 9 (8) and for the establishment or cancellation of the Czech Radio Radio Radio Studio (hereinafter referred to as" Radio Studio ") pursuant to § 9 (9),"
20. in Paragraph 8 (1) (i), the words "opinions" shall be inserted after the words "to issue."
21. in Paragraph 8 (1) (k):
"(k) elect and dismiss members of the Supervisory Committee pursuant to § 8a, approve its rules of control and determine the level of remuneration of its members;"
22. In Article 8, at the end of paragraph 1, the dot is replaced by a comma and the following points (m) to (p) are added:

23. Paragraph 8 (2) reads:

The Annual Activity and Management Report of the Czech Radio must contain, in a separate part, information on the fulfilment of requirements arising from European Union law for the application of State aid rules in public broadcasting (6) and on the fulfilment of the transparency requirements of financial relations under § 11a. The Council shall publish the Annual Activity and Management Report of the Czech Radio no later than 3 days after the date of its approval in a way that allows remote access."
24. in Paragraph 8 (3), the words "(hereinafter referred to as the budget)" shall be replaced by the words "with which the Council has powers in accordance with other legislation; details are provided by the Czech Radio Statute."
25. In Paragraph 8, the sentence "The remuneration of members of the Council and members of the Supervisory Committee shall be due at regular intervals for the remuneration of employees of the Czech Radio."
