of 23 January 1964
on the export of cultural monuments and objects of museum value
The Bureau of the Slovak National Council, within the meaning of § 14 (3) of Act SNR No. 7 / 1958 Coll. SNR, on Cultural Monuments and § 13 (1) and (2) of Act No. 109 / 1961 Coll., on Museums and galleries:
§ 1
For the export of cultural monuments or objects of museum value (hereinafter referred to as "protected object ') to a foreign country, even if it is only temporary, time, e.g. for exhibition purposes (so-called foreign record circulation), consent is required
(a) the Bureau of the Slovak National Council in respect of national cultural monuments,
(b) delegates of the Slovak National Council for Education and Culture in respect of a protected object which they intend to export to museums and galleries (Section 3 (1));
(c) The Regional National Committee responsible for the applicant's registered office (residence) in all other cases.
§ 2
(1) The owner may request the approval of the export of the protected article (in the case of the national property of the organisation which has it in administration or in permanent use); when it is only a record circulation abroad for cultural objectives, an organisation which organises or circulates the cultural promotion undertaking.
(2) The application shall be submitted to the authority which is entitled to give consent on the form prescribed, the model of which shall be determined by the representative of the Slovak National Council for Education and Culture. If a national cultural monument is exported, a request shall be made to the Bureau of the Slovak National Council via the delegate of the Slovak National Council for Education and Culture.
§ 3
(1) The applicant is obliged to provide evidence of the application by means of a professional statement issued by a museum or gallery of regional application according to the nature of the case. *) If they intend to export protected objects from museums and galleries, as well as applicants residing in or near the following professional institutes, they shall submit observations on:

(2) The expert institute making comments must consider whether the export of the protected article is possible from the point of view of the other institutes referred to in paragraph 1; if necessary, it shall seek their opinions.
(3) The examining professional institute shall note its observations on all copies of the application (including, where appropriate, the identification annexes) and retain one copy as evidence.
(4) If the examining professional institute finds that the object for which authorisation is sought is neither a cultural monument nor an object of museum value, it shall state in its statement that the subject is not covered by the provisions of the SNR Act No. 7 / 1958 Coll. SNR, on cultural monuments nor by the Act SNR No. 109 / 1961 Coll., on museums and galleries and that, therefore, consent to export under these regulations is not necessary. One copy of the application shall be submitted by the expert institute to the applicant for the customs office concerned and the other two shall be kept as evidence.
(5) If the applicant is not a public authority, the appellant shall take all measures to ensure that the subject concerned cannot be replaced.
(6) The Decision of the authorising authority (§ 1) does not replace the approval of the Ministry of Finance under the Foreign Exchange Act. * *)
§ 4
(1) The decision taken by the authorising authority on the basis of the opinion of the competent technical institute shall be indicated on both copies of the application (including, where appropriate, the identification annexes); the period within which the protected article is to be brought back shall also be indicated in the course of the foreign circulation. Where the consent to export the protected article has been granted, a copy of the applicant shall be given as a document to the customs office concerned, the other shall be kept by the authorising authority; If the approval for export has not been granted, the authorising authority shall retain both copies as evidence.
(2) The authorising authority is entitled to reserve, in any case, the presence of its authorised representative in customs proceedings (consideration of the subject-matter protected by customs).
§ 5
(1) The consent for the export of protected articles is not required in the course of an international record-keeping operation for cultural purposes, provided that such an undertaking is organised or circulated by an institution directly managed or entrusted by the Slovak National Council, as well as the Slovak Artists' Association; This derogation does not apply to national cultural monuments.
(2) If not for national cultural monuments, the delegate of the Slovak National Council for Education and Culture may, where justified, allow further derogations from the provisions of this Decree.
§ 6
The regulations issued for the implementation of Act No. 119 / 1948 Coll., on the State organisation of foreign trade and international shipping as well as the regulations on the management of national property remain intact.
§ 7
This decree shall take effect on the day of its publication.

Mikuláš (for the Central Slovak KNV) and the City Galerie in Bratislava.
