GOVERNMENT REGULATION
of 25 February 2008
amending Government Regulation No 103 / 2003 Coll., on the determination of vulnerable areas and on the use and storage of fertilisers and manure, crop rotation and the implementation of anti-erosion measures in these areas, as amended by Government Regulation No 219 / 2007 Coll.
The Government orders pursuant to § 33 (2) of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended by Act No. 20 / 2004 Coll.:
Government Regulation No. 103 / 2003 Coll., on the determination of vulnerable areas and on the use and storage of fertilisers and manure, crop rotation and implementation of anti-erosion measures in these areas, as amended by Government Regulation No. 219 / 2007 Coll., is amended as follows:
1. Paragraph 1, including the title and footnote 1, reads as follows:
Basic provisions
This Regulation implements the relevant provisions of the European Community1) and establishes vulnerable areas and an action programme for these areas.
1) Council Directive 91 / 676 / EEC of 12 December 1991 concerning the protection of waters against pollution caused by nitrates from agricultural sources. '
2. Title III, including the title and footnotes Nos 7 to 13 shall read as follows:
ACTION PROGRAMME
The action programme shall cover natural or legal persons operating agricultural production in vulnerable areas and registered in accordance with the Act on Agriculture (7) (hereinafter referred to as "the agricultural entrepreneur ').
Definition of terms
(1) Agricultural land for the purposes of this Regulation means the continuously managed area of agricultural land. Where an agricultural entrepreneur is included in the register of the use of agricultural land according to user relations under the Act on Agriculture (7), the agricultural parcel shall be the soil block or part of the soil block provided for by the specific legislation7). Part of the soil block or part thereof with one crop or crop mixture may also be agricultural land.
(2) Nitrogen fertiliser for the purposes of this Regulation means mineral fertilisers containing nitrogen, organic fertiliser, organo-mineral fertiliser, manure and treated sludge. Nitrogen fertilizers are
(a) mineral nitrogen fertilisers, namely mineral nitrogen fertilisers 8) and mineral compound fertilisers 8) containing nitrogen,
(b) fertilisers with rapidly released nitrogen, namely manure, manure, urinalysis, silage, poultry droppings and small livestock with or without bedding, feces or urine left by grazing livestock or other housing on agricultural land, and organic or organo-mineral fertiliser (8) in which the carbon / nitrogen ratio is less than 10;
(c) fertilisers with slowly released nitrogen, namely manure (9), such as manure and organic or organo-mineral fertilisers (8), in which the ratio of carbon to nitrogen is equal to or greater than 10;
(d) harvested vegetable residues (11), in particular straw, temples, green fertiliser and grass crops;
(e) the modified Schedule 12).
Fertilisation prohibition period
(1) The periods during which the use of nitrogen fertilisers is prohibited in vulnerable areas on agricultural land are set out in Table 1 of Annex 2 to this Regulation.
(2) The fertilisation prohibition period referred to in paragraph 1 shall not apply to feces and urine, left by farmed animals during grazing or other time on agricultural land, and to fertilisation of covered areas (e.g. greenhouses, foils).
Use of nitrogen fertilisers according to the soil climate conditions of the site
(1) The use of nitrogen fertilisers is determined according to the needs of individual crops at specific habitats and according to production conditions. When fertilising individual crops, it is necessary to comply with the limits set out in Annex 3 to this Regulation.
(2) The method of use of nitrogen fertilisers on arable land, as set out in Table 7 of Annex No 2, depends on the integration of agricultural land into one of the three application zones (stages I to III), as defined in Tables 2 to 5 of Annex No 2 to this Regulation, using a system of soil-protected ecological units established by specific legislation (10).
(3) Where there are several soil-protected ecological units within the agricultural parcel belonging to different application zones or to other groups of soil-protected ecological units, such agricultural parcel shall be included taking into account the prevailing classification. The same proportional representation of different groups of aggregated soil-based organic units shall always apply to measures assessed as more stringent.
(4) Where the fertilisation of mineral nitrogen fertilisers or arable nitrogen fertilisers is carried out on arable land for subsequent winter crops, inter-crops, for the promotion of straw degradation or for subsequent spring crops during the period from 15 June of the relevant calendar year until the start of the fertilisation prohibition period referred to in Table 1 of Annex 2 to this Regulation, such fertilisers may be used only in one of the ways set out in Table 7 of Annex 2 to this Regulation. This provision shall not apply to fertilisation of field vegetables.
(5) No nitrogen fertilizers may be used on permanent grassland on agricultural parcels with contaminated soils defined by the main soil units 65 to 76, unless they have been mixed by drainage. Where those agricultural parcels have been drained, the use of nitrogen fertilisers shall limit a single levy to 80 kg of total nitrogen / 1 ha. On permanent grassland on agricultural parcels with shallow soils or soils with an undeveloped soil profile defined by the main soil units 37 to 39, a single dose of 80 kg of total nitrogen / 1 ha is limited when nitrogen fertilisers are used.
(6) The provisions of paragraphs 4 and 5 shall not apply to faeces and urine left by farmed animals during grazing or during any other stay on agricultural land.
Restrictions on the use of organic nitrogen
(1) On average, the total nitrogen applied annually to agricultural parcels in organic, organo-mineral and livestock fertilisers may not exceed 170 kg / 1 ha, only agricultural parcels suitable for fertilisation shall be counted against this average.
(2) As agricultural land suitable for fertilisation, all agricultural parcels used by the holding shall be deducted from:
(a) areas of agricultural parcels which cannot be fertilised, for example near surface water, in the built-up territory of the municipality or in the protection zones of water resources;
(b) unused areas, eels and fallow land.
(3) The calculation of the nitrogen / 1 ha dose used shall be carried out in accordance with the data on the total nitrogen intake in organic and organo-mineral fertilisers and livestock fertilizers used (11) or on the basis of nitrogen production in faeces and urine and, where appropriate, faeces of farmed livestock according to the specific legislation11).
(4) When applying the calculation on the basis of nitrogen production in faeces and urine and, where appropriate, manure of farmed animals referred to in paragraph 3,
(a) the actual length of farming (average animal stocks during the year) is taken into account for each livestock category;
(b) the amount of nitrogen produced by the animals is given by the amount of nitrogen in faeces and urine, or truss11);
(c) subsequent nitrogen losses may be deducted in open areas, stables and manure storage at 35% for litter plants, 15% for manure production and 50% for poultry outdoor farming or for litter in hen cages, depending on the technologies used.
(5) Up to the limit referred to in paragraph 1:
(a) calculates nitrogen intake in the use of treated sludge under the Waste Act (12);
(b) does not account for the nitrogen intake from the harvested vegetable residues.
(6) The use of manure other than manure for fertilisation within the farm where it was produced, in particular putting it into circulation, processing into organic fertilisers in composting and biogas production, using cleaning technologies to dispose of excrement or other manure management, must be documented. The placing into circulation of organic fertilisers resulting from the processing of manure should also be documented.
Storage of nitrogen fertilisers in vulnerable areas
(1) The capacity of storage areas for manure is laid down in specific legislation11); the capacity of these storage areas must be sufficient for the storage of manure during the fertilisation prohibition period as set out in Table 1 of Annex 2 to this Regulation and during a period where it is not possible to fertilise with regard to the soil and climatic conditions of the vulnerable area and cultivated crops (9).
(3) Solid manure and solid organic manure from manure, prepared by the farm operator for fertilisation, can be stored on agricultural land for a maximum period of 12 months. The fertiliser referred to in the first sentence may be deposited at the same place of the agricultural parcel at least four years after the cultivation of the land of that agricultural parcel. The storage of fertiliser is only possible at the locations specified in the approved emergency plan (13) if:
(a) ensure safety of surface and groundwater quality;
(b) the complex is at least 50 m from the surface water body;
(c) the complex placed on agricultural land which has not been mixed by drainage is not arable land as defined in Table 6 of Annex 2 to this Regulation, it is not contaminated by soil as defined by the main soil units 65 to 76;
(d) manure effluent and surface water inflow are prevented by excavating trays with a depth of at least 0,4 m in the slope below and above the complex;
(e) the solid manure is settled in a layer at a minimum height of 1,5 m, with the orientation of the complex by a longer side to the back.
Crop rotation in vulnerable areas
(1) When growing single-year crops, it is necessary to limit intermediaries without crops in order to reduce soil erosion and reduce nutrient leaching.
(2) For the renewal of permanent grassland and after clover, subsequent crops must be sown within the next agrotechnical period. If the clover is followed by a spring crop, the clover crop should be sown as soon as possible in autumn.
Management on sloping agricultural land
(1) On agricultural parcels with arable land situated on soils threatened with erosion as defined in Table 6 of Annex No 2 to this Regulation, appropriate agri-technical anti-erosion measures shall be carried out, corresponding to the conditions of the establishment, in particular plantations, soil treatment with organic residues left on the soil surface, mulching, sowing into a crop or stubble, sowing into a gross furrow or interrupted trailing.
(2) For reasons of soil protection against erosion and pollution water, broad-line crops such as maize, sunflower, soya, bean, potatoes shall not be grown on agricultural parcels with a gradient exceeding 7 degrees, directly adjacent to or less than 25 metres from surface water bodies.
(3) No nitrogen fertiliser shall be used on agricultural parcels with arable land exceeding 12 degrees, except for solid manure and solid organic fertilisers put into the soil within 24 hours of their application. This provision shall not apply to retained harvested vegetable residues.
(4) On agricultural parcels with permanent grassland with a gradient exceeding 7 degrees, the use of nitrogen fertilisers limits a single dose per 80 kg of total nitrogen / 1 ha. This provision shall not apply to the supply of nitrogen in feces and urine for grazing livestock or for any other stay on permanent grassland.
Management on agricultural parcels adjacent to surface water bodies
On agricultural parcels directly adjacent to surface water bodies:
(a) maintain a non-fertilised soil protection belt at least 3 m from the shore line;
(b) in the case of agricultural parcels with a gradient exceeding 7 degrees, maintain a protection belt at least 25 m from the shore line without using liquid fertilisers with rapidly released nitrogen; This does not apply to feces and urine left by farmed animals during grazing or during any other stay on permanent grassland.

13) § 39 of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended by Act No. 20 / 2004 Coll. Decree No. 450 / 2005 Coll., on the formalities for the handling of defective substances and the formalities for the emergency plan, the manner and extent of reporting of accidents, their disposal and the removal of their harmful consequences. ';

Nitrogen used to promote straw decomposition shall not be counted against the limit of nitrogen intake for the crops subsequently grown.
For the purposes of assessing the fertilisation limit, 40% of the total nitrogen input and 60% of the total nitrogen input for fertilisers with slowly released nitrogen and treated sludge shall be counted and 60% of the total nitrogen input for fertilisers with rapidly released nitrogen. Therefore, for the purpose of assessing the fertilisation limit, only the direct application of nitrogen in the first year after the application of those manure, organic and organo-mineral fertilisers and, where appropriate, treated sludge is taken into account.
For the determination of nitrogen intake to soil in manure of animal origin, the data obtained by own analyses or data from Annex 2 to Decree No 274 / 1998 Coll.
* * In the case of legumes, a support dose of nitrogen may not exceed 70 kg / 1 ha. '
Efficacy
1. This Government Regulation shall enter into force on the day of its publication.
2. Article I (2) as regards Article 9 (2) and (4) shall take effect on 1 January 2014.
3. Article I (2) as regards Article 9 (1) shall expire on 1 January 2014.
