amending Decree No. 478 / 2000 Coll., implementing the Road Transport Act, as amended
The Ministry of Transport provides for the Act No. 111 / 1994 Coll., on Road Transport, as amended by Act No. 304 / 1997 Coll., Act No. 150 / 2000 Coll., Act No. 103 / 2004 Coll., Act No. 229 / 2005 Coll., Act No. 226 / 2006 Coll., Act No. 194 / 2010 Coll., Act No. 119 / 2012 Coll. and Act No. 102 / 2013 Coll.:
Čl. I
Decree of the Ministry of Transport and Communications No. 478 / 2000 Coll., implementing the Road Transport Act, as amended by Decree No. 55 / 2003 Coll., Decree No. 281 / 2007 Coll. and Decree No. 269 / 2012 Coll., is amended as follows:
1. In Article 1 (1), the words "European Community1) 'are replaced by the words" European Union1) on recording equipment in road transport';
2. Paragraph 1b (2) reads as follows:
"(2) The provisions of paragraph 1 shall not apply to shipments not covered by the directly applicable European Union3) or by an international treaty forming part of the legal order 2) and to shipments referred to in Article 13 (1) and Article 14 of the directly applicable European Union3) on the harmonisation of certain social legislation relating to road transport. ';

„§ 2
Method of keeping an alert on the duration of the activities of shipments covered by the directly applicable European Union3) or by an international treaty which is part of the legal order 2)
(K § 9b (4) of the Act)
A road transport operator operating large vehicles shall keep records of the duration of the activities referred to in Section 9b (1) of the Act as provided for in Section 1 of this Decree. '
4. in Paragraph 3 (1), "4 and 5 'is replaced by" 3 and 4';
5. Paragraph 3 (2) is deleted.
Paragraphs 3 to 7 shall be renumbered paragraphs 2 to 6.
6. In Paragraph 3 (2), "6 'is replaced by" 5'.
7. In Paragraph 3 (4), "4 'is replaced by" 3'.
8. Paragraph 3 (6) is deleted.
9. In Section 7, the words "and Sections 21 (3) and (6) 'are deleted.
10. In Article 7, paragraphs 3 to 5 are deleted.
11. Article 11 to 15, including the headings, read:
"Taxi service
(Articles 21 (8) and 21c (2) of the Law)
§ 11
Method of keeping and details of the record of the operation of the taxi service vehicle
(1) The carrier shall keep a record of the operation of the taxi service by continuously recording the daily traffic values of the vehicle
(a) on a taximeter memory unit, if the taxiservice vehicle is equipped with a taximeter; or
(b) on another recording device or manually, if the taxi service vehicle is not equipped with a taximeter in accordance with Section 21a (2) (b) of the Act.
(2) A record of the operation of a taxi service vehicle conducted in the manner referred to in paragraph 1 (a) shall include:
(a) the type and production number of the taximeter;
(b) the serial number of the taximeter storage unit;
(c) the name and, where applicable, the name, surname, business name or name, and the identification number of the carrier person;
(d) the registration number of the taxi vehicle;
(e) the name and, where applicable, the name, surname and year of birth of the driver of the taxi service vehicle to which the recorded daily values relating to the operation of the taxi service vehicle referred to in points (f) to (k) apply;
(f) the date on which the recorded daily values on the operation of the taxi service vehicle relate;
(g) the sum of the kilometres travelled while operating the taxi service on the day referred to in (f);
(h) the number of shipments made on the day referred to in (f);
(i) the sum of the kilometres travelled during the carriage referred to in (h);
(j) the total revenue for the transport provided on the day referred to in (f); and
(k) the sum of the kilometres travelled outside the taxi service on the day referred to in (f).
(3) A record of the operation of a taxi service vehicle conducted in the manner referred to in paragraph 1 (b) shall contain the data referred to in paragraph 2 (c) to (k).
§ 12
Details of the transport record and proof of payment of the fare
(1) The record of transport contains:
(a) the serial number of the transport record;
(b) the type and production number of the taximeter;
(c) the serial number of the taximeter storage unit;
(d) the name and, where appropriate, the name, surname, business name or name, and the identification number of the carrier person;
(e) the registration number of the taxi vehicle;
(f) the date of transport;
(g) start time and end time of transport;
(h) the place of departure and destination;
(i) the number of kilometres travelled during transport;
(j) the number of the rate used, including all sub-items of which the rate is composed;
(k) the price of the transport provided;
(l) the name and, where applicable, the names and surnames of the driver; and
(m) the driver's signature.
(2) The proof of payment of the fare shall contain the particulars referred to in paragraph 1.
(3) The particulars referred to in paragraph 1 (h), if not printed by a taximeter printer, shall be added by the driver to the transport record and proof of payment by hand.
§ 13
Technical requirements for the memory unit of the taximeter and the elements of the taximeter book
(1) The technical requirements for a taximeter storage unit are met if:
(a) only the entry and reading of data are allowed, avoiding the change and deletion of the entered data;
(b) part of the storage space of the storage unit is reserved for a single initial entry of data pursuant to § 11 (2) (a) to (c) when installing the storage unit in a measurement assembly of a taximeter which cannot be replaced by other data;
(c) the daily values relating to the operation of the taxi service vehicle shall be recorded in accordance with § 11 (2) (d) to (k) for at least 5 years;
(d) the recording of data from the data source which is not part of the measurement assembly of the taximeter is prevented, except for a single initial record; and
(e) the filling of the storage unit capacity causes the taximeter to block operation into the exchange of the storage unit, at least 60 days before filling the storage unit capacity, the user will have information on the remaining storage unit capacity.
(2) The book of the taximeter contains
(a) the name and, where appropriate, the name, surname, business name or name, and the identification number of the carrier's person;
(b) the registration number of the taxi vehicle;
(c) the type and production number of the taximeter,
(d) the serial number of the taximeter storage unit;
(e) records of set rates and constants;
(f) records of entries into the taximeter;
(g) records of the states of the taximeter register by an entity registered under the Special Testament (6) that has corrected or installed the taximeter;
(h) records of the verification of the taximeter in accordance with the Specific Law (6); and
(i) records of the status of the taximeter register in accordance with the Special Act (6).
§ 14
Method of proper taximeter operation
(1) At the time the taxi service vehicle is used to operate the taxi service, the driver shall ensure that the meter is switched on in the "FREE" position. At the start of transport, the driver shall switch the meter from the "FREE" position to the "CONTAINED" position and, at the end of the transport, he shall switch the meter from the "CONTAINED" position to the "LOW" position and print the transport record without delay. After printing the transport record and the ticket payment document, if the passenger has requested it, the driver will switch the TAX from the working position "ROUND" to the "FREE" position.
(2) At a time when the taxi service vehicle is used for a purpose other than the taxi service, the carrier shall ensure that the taximeter is not in the working position of "FREE," "CONTAINED" or "CURRENT."
§ 15
Taxi driver's card
(1) The driver's card of the taxi service is yellow, size 68 x 99 mm and is sealed in a transparent laminating film of 75 x 105 mm.
(2) In the driver's licence, the data shall be completed in machine, bold, unpatted letters (in the text editor of the Arial font). The name and, where applicable, the name of the driver shall be completed in capital letters (capitals) with a height of 4,5 mm (font size 18 points in the text editor). The date of expiry of the authorisation and the name of the transport office shall be completed by letters of 2,5 mm height (font size 10 points in the text editor). The driver's cab licence number is six-digit and is pre-printed with 5 mm size numbers (20 pt font size in the text editor). The security feature (hologram) shall be glued to the card over the lower right corner of the driver's photograph so that it does not cover part of the driver's face or part of the text printed on the licence. The print of the official stamp (diameter 25 mm) shall be of red colour and shall be printed so that part of the stamp is printed through the lower part of the driver's photograph of the taxi service; the print of the official stamp may be printed through the protective element.
(3) The model of the driver's licence for the taxi service is set out in the Annex to this Order. '

15. In Section 15a, "K § 21b (2) 'is replaced by" K § 21e (1)'.
16. Annex No 1 shall be renumbered Annex and read as follows:

Transitional provision
By 31 December 2015, a record of the operation of a taxi service vehicle on a taximeter storage unit may not contain data on the type of taximeter and on the name and, where applicable, the names, surname and year of birth of the driver of the taxi service vehicle to which the recorded daily values of the operation of the taxi service vehicle relate, and a record of the transport and proof of payment of the fare may not contain a data on the type of taximeter.

This Decree shall take effect on 1 May 2013.
