Decree of the Ministry of Labour and Social Affairs on the pay conditions of members of racing guards, guards, concierge and fire protection personnel

Ministry of Labour and Social Affairs
of 4 July 1968
on the wage conditions of members of racing guards, guards, doormen and fire protection workers
The Ministry of Labour and Social Affairs provides, pursuant to Section 12 of Act No. 53 / 1968 Coll., on Changes in the Organisation and Scope of Certain Central Authorities, in an agreement with the Central Council of Trade Unions:
§ 1
Scope
This decree regulates the pay conditions of members of the guards, guards, concierge, workers of professional fire fighting units and voluntary fire protection workers in economic, budgetary and other organisations.
Remuneration of members of racing guards, guards, concierge and professional firemen
§ 2
Salary
(1) Workers shall be paid basic salaries, allowances, remuneration and, where appropriate, economic benefits in accordance with other provisions.
(2) The level of the basic salary is determined by the manager of the organisation within the range set for the type of work concerned (function). taking into account the difficulty of the workplace service and the personal characteristics of the worker; for professional firefighters, also to meet the prescribed qualification requirements.
§ 3
Catalogue of functions and wage tariffs
(1) The catalogue of functions and monthly wage charges for the remuneration of work held during the prescribed working hours * are set out in the Annex; the classification of guards in tariff classes shall be governed by the tariff qualification catalogue of the continuing occupation. * *)
(2) The competent central authority may authorise the increase of monthly wage rates by up to 20%, depending on the difficulty of the service, for the remuneration of members of the professional guards and firemen in pyrotechnic plants, including the manufacture of explosives and in large quantities where Class I flammable materials are produced or processed.
§ 4
Personal salary
(1) Workers with exceptional skills and excellent work results may, on the basis of the authority of the management body or on the basis of its authority, grant a personal salary in excess of up to 50% of the upper limit of the fixed wage margin instead of the basic salary.
(2) The personal salary shall be payable to the worker only for the period during which he has achieved the work results for which the personal salary has been awarded.
§ 5
Change in basic salary
(1) A worker who, in accordance with the Labour Code, is transferred to a post or post for which a lower basic salary is fixed shall be entitled to the current basic salary for one more calendar month following the calendar month in which the change was made.
(2) The provisions of the preceding paragraph apply mutatis mutandis to the reduction of the basic wage within the set wage range. The basic wage can only be reduced for serious reasons.
(3) The provisions of paragraphs 1 and 2 do not apply to changes in the basic salary made following a judicial decision or disciplinary action.
(4) If there is an increase in the basic salary within the specified wage range or at the time of inclusion in a higher post or tariff grade, the higher basic wage shall be due from the first day of the month following the date of the change; if this day is the first day of the month, starting from that day.
§ 6
Compensation for work in a difficult environment *)
(1) For each full hour of underground work, members of the racing guards are subject to a surcharge of CZK 0,40.
(2) Occupants who carry out highly risk-free work, in which they must use insulating breathing appliances or other protective equipment, where appropriate, are subject to a surcharge in accordance with specific regulations. * *)
§ 7
Advantage of night shift work
(1) For working in the night shift, workers shall be paid a fee of 0,80 CZK for their basic salary, which may be increased according to the conditions of the workplace and financial resources of the organisation up to 2 CZK and workers working exclusively at night (e.g. night watchman) up to 3 CZK for each full hour worked, but not more than 8 hours per shift. Night shift means a shift in which at least 5 hours falls between 22 and 6 hours.
(2) In the organisations in which a collective agreement is concluded, the amount of the premium is laid down in that contract; in other organisations, determine its level by agreement with the relevant trade union body.
(3) The supplement shall be granted only if the worker is working the entire night shift and if the work is carried out within the specified weekly working hours. If the worker cannot work part of the night shift for an obstacle to work, this shift is considered to be fully worked (Section 63 of Decree No. 66 / 1965 Coll., implementing the Labour Code).
§ 8
Wage for overtime work
(1) Overtime shall be paid to workers only in agreement with them, for each full hour of overtime one hour of leave. Replacement leave shall, as a general rule, be granted until the end of the following accounting period after overtime.
(2) A staff member who has not been granted a replacement leave is entitled, for each full hour of overtime, to a salary of 1 / 185 of a basic salary of 33%, irrespective of whether it is overtime on the day, night or day of work.
§ 9
Reward for care for feeding and training of service dogs
(1) Special remuneration may be granted to members of racing guards and guards who, in the out-of-work period, care for the feeding and training of service dogs up to 80 CZK per month. The level of remuneration shall be determined by the manager of the organisation according to the complexity of the work, the number of dogs entrusted, etc.
(2) The reward shall not be granted for conducting a dog's rounds or for feeding and training during business hours. The evaluation of these works may be taken into account when measuring the basic wage within the set range of wage charges.
§ 10
Occupational firefighters on call
(1) On-call time at the workplace, ordered by the master of the fire brigade of the professional fireman above the specified working hours, shall be counted, if the fireman does not work, in one half of the working hours; if the fireman is working at this time, the period for which he has worked shall be counted in full.
(2) If the commander of a fire brigade orders an occupational fireman to be prepared outside the working hours to be called to work, the fireman shall be remunerated for the duration of the emergency period at the rate of 5 Ccs, and shall be on a continuous rest day in a week or holiday of 10 Ccs per calendar day.
(3) If an occupational fireman is not available in due time during an emergency, the remuneration is not due to him. In addition to the remuneration referred to in the preceding paragraph, if he is called upon to carry out his work during that period, he shall be entitled to pay according to the work carried out with the corresponding allowances.
§ 11
Remuneration and share of economic results
(1) Performance rewards can be provided on the basis of individual evaluation to workers who achieve better work results. The amount of the performance remuneration shall be determined by the staff member's supervisor.
(2) The provision of additional remuneration and, where appropriate, share of economic results shall be governed by directives issued by the head of organisation in accordance with the principles laid down by the superior authorities and, where appropriate, by the rules contained in collective agreements. The provision of remuneration to staff of budgetary organisations is governed by Decree No. 78 / 1966 Coll.
Remuneration of voluntary fire protection workers
§ 12
(1) Voluntary fire protection workers who have been called on to carry out the tasks necessary to ensure the fire safety of the plant during the working hours will be compensated by the organisation for the outstanding working time for a salary equal to the average earnings. *)
(2) For the work carried out by such personnel to ensure the fire safety of the plant in the out-of-work period, the management organisation shall, taking into account the scale and difficulty of the work, determine the remuneration within the range of hourly tariffs set out in the Annex.
Service equipment
§ 13
The organisation shall assign service equipment to each member of the racing guard and professional firefighter to the extent and under conditions specified by the competent central authority; provide a volunteer fire protection worker with the necessary protective equipment during the course of his activity.
Transitional and final provisions
§ 14
(1) The head of the organisation shall ensure that, in the context of the introduction of overtime pay under this decree, basic wages allocated to workers under existing regulations are not reduced.
(2) The adjustment of wage conditions under this decree will be introduced gradually in the various organisations as the organisation creates the necessary conditions for this, but not later than 1 January 1969. The date of introduction of the adaptation shall be decided by the head of the organisation in agreement with the relevant trade union body.
§ 15
(1) For the remuneration of guards and concierge, they shall cease to be valid:
1. the Decree of the State Commission on Finance, Prices and Wages No. 77 / 1966 Coll., on the Rules of Payment for Workers of Government Bodies,
2. the Decree of the State Technical Commission of 10 July 1967 No 24 083 / 5160 / 1967, which gives rise to the wage rules for staff of centrally managed research and development base organisations and of technical and technological economic nature organisations (reg. 38 / 1967 Coll.).
(2) They are repealed.

§ 16
This decree shall take effect on the day of its publication.
