of 20 February 2002
laying down the conditions and arrangements for granting subsidies from the State budget to the activities of members of national minorities and to promote the integration of members of the Roma community
The Government mandates pursuant to Sections 12 (2) and 13 (2) of Act No. 273 / 2001 Coll., on the rights of members of national minorities and on the amendment of certain laws, and on the implementation of Act No. 218 / 2000 Coll., on budgetary rules and on the amendment of certain related laws (budgetary rules), as amended by Act No. 493 / 2000 Coll., Act No. 141 / 2001 Coll., Act No. 187 / 2001 Coll., Act No. 320 / 2001 Coll., and Act No. 450 / 2001 Coll.:
GENERAL PART
Subject matter
(1) This Regulation lays down the conditions and arrangements for granting subsidies from the State budget for activities of members of national minorities, for the conservation and development of culture, traditions and languages of national minorities, for the dissemination and reception of information in the languages of members of national minorities, which traditionally and for the long term live in the territory of the Czech Republic, as well as for education in the languages of national minorities and for the promotion of integration of members of the Roma community (hereinafter referred to as "subsidies').
(2) Subsidies for the activities referred to in paragraph 1 shall be granted to natural or legal persons in accordance with specific legislation.1)
Definition of terms
For the purposes of this Regulation:
(a) a provider of a central government body which declares and carries out a selection procedure and decides on the purpose of granting grants for projects;
(b) the applicant who, by submitting an application for a project grant (the application), is applying for a grant;
(c) by the beneficiary, the applicant for whom the grant has been decided by the provider and who is the project promoter;
(d) a project to describe activities focusing on activities of members of national minorities or activities for the benefit of national minorities in the region
1. preservation, development and presentation of cultures of national minorities,
2. the dissemination and reception of information in the languages of national minorities or to a large extent in the languages of national minorities or on national minorities in society;
3. education in the languages of national minorities, multicultural education and training programmes promoting the development of tolerance and respect for the different identities of others; or
4. promoting the integration of Roma community members,
(e) a selection grant procedure involving the announcement of a selection grant procedure, the submission of applications, the evaluation of applications, the design of the amount of the financial amount for their implementation and the decision to grant the subsidy. 2)
Procedure for determining the State's financial participation
(1) The Provider, after consulting the Council of the Government for National Minorities (hereinafter referred to as the "Council") or its President, shall propose, for each financial year, a specific binding indicator in its chapter of the State Budget for activities of members of national minorities or activities for the benefit of national minorities, including a specific binding indicator in support of the integration of members of the Roma community, in particular:
(a) the Ministry of Culture for the Regions under Sections 2 (d) (1), 2 and 4;
(b) Ministry of Education, Youth and Sports for the areas referred to in § 2 (d) (2) to (4);
(c) Ministry of Labour and Social Affairs and Office of the Government of the Czech Republic for the Region under § 2 (d) (4).
(2) Following discussion with the Council of the Government of the Czech Republic on Roma Community Affairs (hereinafter referred to as the "Roma Affairs Council"), the Provider will propose a specific binding indicator to promote the integration of Roma community members.
Announcement of the selection grant procedure
The provider shall, at least once a calendar year, issue a selection procedure with the Council to support projects of activities of members of national minorities and through the Council in cooperation with the Roma Affairs Council for projects supporting the integration of members of the Roma community. The announcement of the selection grant procedure, including its terms and conditions, shall be notified by the provider through the national periodical press and on his official record.
Request
(1) The application must be processed in accordance with the conditions laid down by the provider and submitted on the form prescribed by him. The conditions for processing the application and the model form shall be published by the provider on his official record.
(2) The application shall include a description of the project and the budget for its implementation. The application shall be accompanied by a declaration that the applicant does not have a commitment due on the date on which the application is submitted in respect of the State budget, the State Fund, the budget of the local authority or the health insurance undertaking, and consent to the publication of the identification data and the amount of the subsidy granted.
(3) The project must be carried out in the relevant calendar year; in the case of a multi-annual project, it is necessary to submit the whole project, including the budget by year and to quantify separately the part that will be implemented in the relevant calendar year.
Evaluation of applications
(1) Applications are evaluated in the subsidy selection procedures of the provider. To this end, the provider shall set up a selection subsidy committee. When appointing the members of the selection panel, the provider shall take into account the Council's proposals. Members of national minorities must be represented in each selection subsidy committee evaluating applications with a focus on activities of members of national minorities or activities for the benefit of members of national minorities.
(2) In the selection subsidy committee of the provider for the evaluation of applications for integration of members of the Roma community there must be representatives of the Roma Council.
(3) The provider shall immediately inform the Council of the results of the selection procedure. Where the provider decides to grant a project subsidy, he shall publish on his official record an overview of to whom and to what extent the grant was granted; until then, the results of the selection grant procedure are public. The same procedure applies to requests aimed at integrating members of the Roma community in relation to the Roma Council.
Conditions for granting and using the subsidy
(1) The subsidy may be granted and used only for the purpose set out in the decision granting the subsidy. Any changes to the terms and conditions or the amount of the subsidy provided for in the decision granting the subsidy may be made only at the written request of the beneficiary, received by the provider no later than 31 October of the year of the grant, by issuing a new grant decision. The new decision in the part which it amends replaces the original decision, which remains unaffected in the others.
(2) The subsidy may be granted to applicants where they have been clearly engaged in activities for the benefit of members of national minorities for at least 1 year. In case of special consideration, the provider may waive the condition of one year.
(3) There is no legal claim on the subsidy .4) The grant may be granted to an applicant who does not have a commitment due on the date of the application in respect of the State budget, the State Fund, the budget of the local authority or the health insurance undertaking; This is demonstrated by the applicant by a declaration pursuant to Article 6 (2).
(4) The subsidy may be granted for a maximum of 70% of the budgeted costs of the approved project, the total amount of which may not exceed 70% of the actual costs; the payment of 30% of the actual costs of the approved project shall be made by the beneficiary from sources other than the State budget. In cases of special consideration, the provider may increase the percentage of the grant on the project.
(5) When determining the amount of the subsidy referred to in paragraph 4, account shall be taken of the level of wage costs at a level comparable to the remuneration of a similar activity in the budgetary sphere under a specific legislation. 5)
(6) From the grant to the implementation of the project, the costs associated with the work routes in the Czech Republic can be paid up to the amount laid down by the special legislation for employees in the employment ratio. 6) In order to cover travel costs abroad, the funds from the grant provided may be used only if the foreign travel is an essential part of the project.
(7) The subsidy provided for in this Regulation shall not have the character of a grant for the acquisition or technical evaluation of tangible and intangible assets. Subsidy for the acquisition or technical evaluation of tangible and intangible fixed assets may be granted in accordance with the procedure laid down in the specific legislation. 7)
(8) The subsidy does not cover catering and gifts and remuneration of statutory legal entities.
Subsidies for projects from European Union funds
The subsidy may also be granted for projects implemented with financial support from the European Social Fund or other European Union funds, provided that the focus of such projects corresponds to the areas referred to in Article 2 (d).
Consignee
(1) If there is a change in the identification details of the beneficiary referred to in the decision granting the subsidy, the beneficiary is obliged to notify the provider in writing without delay.
(2) In the absence of a project, the beneficiary is obliged to return the funds in the same year to the account from which the grant for the implementation of the project was granted.
(3) In the event that the project is terminated prematurely during the year, the beneficiary shall submit the financial settlement data of the subsidy no later than 30 days after the completion of the project and return the funds to the account from which they were drawn, if this can be done by 31 December of the year concerned, or to the provider's deposit account. 9)
Control and financial settlement
(1) Specific legislation shall apply in order to check compliance with the conditions under this Regulation for the use of the subsidy and the application of penalties in the case of unauthorised use or retention of funds. 10)
(2) The beneficiary shall be responsible for the economical use of the funds provided in accordance with the purposes for which they were provided and for the proper settlement of the subsidy.
(3) The beneficiary of the State Budget subsidy shall submit to the provider, by 15 February of the following calendar year at the latest, data on the financial settlement of the subsidy. 9)
(4) In the event that the beneficiary fails to implement the grant within the specified deadline, it will not receive additional subsidies in the year in which the grant was due to be settled.
(5) The financial settlement of subsidies for the activities of members of national minorities in the previous year shall be concluded by the provider by 1 March of the following year; the results of the financial settlement check provided by the grants shall be forwarded to the Council by 31 March; in the case of projects aimed at integrating members of the Roma community, this will be taken into account by the Roma Council. This is without prejudice to the obligation of the provider to follow the principles and dates of financial settlement of relations with the state budget. 11)
(6) The provider shall carry out a physical check of the implementation of selected projects on the activities of members of national minorities.
Report on the use of subsidies
The President of the Council, in cooperation with the President of the Roma Council and in cooperation with the providers from whose budget chapters subsidies have been granted to the activities of members of national minorities, shall also submit to the Government each year, in the framework of a summary report on the national situation in the Czech Republic, an evaluation of the use of subsidies granted under this Regulation for the period preceding the calendar year.
Publication of information and registration of subsidies
The Council, in cooperation with the Providers, publishes an overview of the approved subsidies for activities of members of national minorities on its website in the remotely accessible information system of the Office of the Government. The Roma Affairs Council is doing the same when publishing an overview of approved subsidies for projects to promote the integration of members of the Roma community.
SPECIFIC PART
Support for the preservation, development and presentation of cultures of national minorities
(1) The aim of the aid is the preservation and development of cultures of members of national minorities living in the Czech Republic, the study, analysis and documentation of national cultures and folk traditions of minorities, understanding and tolerance in society, the knowledge of history, traditions and cultures of different ethnicities, the improvement of communication between majority society and minorities. The Ministry of Culture provides subsidies for these activities.
(2) The funds to support the activities referred to in paragraph 1 shall be proposed by the Ministry of Culture, on the basis of a recommendation from the Council, as a specific binding indicator to promote the cultural activities of national minorities in its chapter of the State budget for each financial year.
Subsidies may be granted for projects for:
(a) theatres;
(b) museums;
(c) galleries,
(d) libraries;
(e) documentation activities;
(f) the publication of non-periodic publications;
(g) the publication of periodic publications, in so far as they are not subsidies pursuant to Article 17;
(h) other activities of members of national minorities, in particular artistic, cultural and educational events, studies, analyses and documentation of national cultures and folk traditions of national minorities, publishing activities, multiethnic events.
Promoting the dissemination and reception of information in the languages of national minorities
(1) The objective of the State budget support is to create conditions for the dissemination and reception of information in the languages of national minorities or, to a large extent, in the languages of national minorities. The Ministry of Culture is the subsidy provider for this purpose.
(2) The funds to support the activities referred to in paragraph 1 shall be proposed by the Ministry of Culture, on the basis of a recommendation from the Council, as a specific binding indicator to promote the dissemination and reception of information in the languages of national minorities in its chapter of the State budget for each financial year.
Support for projects focusing on the dissemination and reception of information
(a) periodical printing in the languages of national minorities or mostly in the languages of national minorities (hereinafter referred to as "printing in the languages of national minorities");
(b) radio or television broadcasting in the languages of national minorities or mostly in the languages of national minorities (hereinafter referred to as "broadcasting in the languages of national minorities").
(1) A grant in support of a project under Article 17 (a) may be requested by the applicant only if he submits a project for the issue of a printed matter which meets the conditions of a specific legislation. 12)
(2) The selection procedure is intended to support the publication of printing in the languages of national minorities, which is not issued for profit and is publicly distributed in the Czech Republic.
(3) Selective subsidy procedures for printing in the languages of national minorities may be attended by legal and natural persons who, in their activities, focus on national minority activities.
(4) The applicant for the subsidy on the issue of printing in the languages of national minorities shall submit to the provider the justification for the application, including the expected revenue and costs, the title-oriented data, the method of dissemination and other data if requested by the provider.
(5) Subsidy for printing in the languages of national minorities may be granted only for the demonstrable costs of publishing or expanding it.
(1) The selection procedure is intended to promote broadcasting in the languages of national minorities, which is not operated for profit and is distributed in the Czech Republic.
(2) Selective subsidy procedures to promote broadcasting in the languages of national minorities may be attended by legal and natural persons authorised to carry out broadcasting activities under the Broadcasting and Television Act (13), focusing on national minority activities.
(3) The applicant for the subsidy to promote broadcasting in the languages of national minorities shall submit to the provider the justification for the request, including the expected revenue and costs, the project focus data, the mode of transmission and other data if requested by the provider.
(4) The subsidy to promote broadcasting in the languages of national minorities may only be granted for the demonstrable costs associated with the production and dissemination of programmes.
Support for education in the languages of national minorities and multicultural education
(1) The objective of the aid is to create conditions for the implementation of national education policy in the languages of national minorities, multicultural education and a programme to support the education of pupils coming from a different linguistic and cultural environment. Support for multicultural education projects for children and youth is aimed at strengthening the awareness of general human belonging, the education of democratic citizenship, the recognition of the history and culture of other peoples, mutual tolerance and against racism and xenophobia. The Ministry of Education, Youth and Sports provides subsidies from the state budget for these activities.
(2) The funds to support the activities referred to in paragraph 1 will be proposed by the Ministry of Education, Youth and Sports as a specific binding indicator for Support for education in the languages of national minorities and support for multicultural education in its chapter of the state budget for each financial year.
Support for projects focusing on education in the languages of national minorities, extracurricular and leisure activities of children and youth members of national minorities and multicultural education projects
(a) language training for children and youth of members of national minorities;
(b) social cultural and leisure activities for children and youth, where such activities are aimed at promoting the preservation and development of the traditions and identities of a national minority or the development of sensitivity to the positive importance of the national diversity of society;
(c) the creation and validation of training programmes in the field of national minority education and multicultural education;
(d) sociological and statistical surveys directly related to the areas referred to in § 2 (d).
Support for Roma integration projects
(1) The objective of the aid is to balance the conditions of members of the Roma community, particularly in the fields of education and social exclusion, with the emphasis on avoiding social exclusion of members of the Roma community, the status of Roma women and ensuring the participation of the Roma in the implementation of integration programmes, the creation of trust, understanding and tolerance in society, the knowledge of the history and traditions of Roma culture, the improvement of communication between the Roma community and the majority society. The Ministry of Education, Youth and Sports, the Ministry of Culture and the Ministry of Labour and Social Affairs and the Office of the Government of the Czech Republic are the contributors to the grants for integration projects.
(2) The funds to support the activities referred to in paragraph 1 will be proposed by the competent central authorities of the State, on the basis of a recommendation from the Roma Council, as a specific binding indicator to support projects for integration of Roma community members in their national budget chapters for each financial year.
Subsidies in support of integration projects of Roma community members are provided to legal persons.
The focus of support for projects in the field of integration of members of the Roma community concerns
(a) promoting the integration of members of the Roma community, in particular in the field of social and cultural activities and education;
(b) support for the education of Roma pupils and students,
(c) promoting the development of the provision of specific social services;
(d) sociological and statistical surveys directly related to the areas referred to in § 2 (d).
FINAL PROVISIONS
Efficacy
This Regulation shall enter into force on 15 April 2002.
