ORDER
GOVERNMENTS OF THE CZECH REPUBLIC
of 16 March 2020
on the adoption of crisis measures
Following the Government Resolution 194 of 12 March 2020, the Government, in accordance with Articles 5 and 6 of Constitutional Act No. 110 / 1998 Coll., on the Security of the Czech Republic, declared emergency status for the territory of the Czech Republic because of a health threat related to the detection of coronavirus / referred to as SARS CoV-2 / in the territory of the Czech Republic and, within the meaning of § 5 (a) to (e) and § 6 of the Act No. 240 / 2000 Coll., on crisis management and on the amendment of certain laws (Crisis Act), as amended, for dealing with a crisis situation, the adoption of crisis measures, by virtue of § 5 (c) and (e) of the Crisis Act.
Government
I. Orders
1. persons who are provided with social services by the provider of social services who have been granted a registration for the provision of social services pursuant to § 48, 49 or 50 of Act No. 108 / 2006 Coll., on social services, as amended (homes for disabled persons, homes for elderly people, homes with special regime), are prohibited from going outside the premises or premises of the establishment in which that social service is provided, for the duration of the emergency condition;
2. to the social service providers providing social services referred to in point I / 1 of this resolution, to inform all persons who are subject to a prohibition under point I / 1 of this resolution or, where appropriate, to their appointed guardians,
3. social service providers which have been granted a registration for the provision of social services to the extent of the type of social service referred to in Sections 45, 47, 62, 65, 66 and 67 of Act No. 108 / 2006 Coll., on social services (day-service centres, weekly stationary, low-threshold facilities for children and youth, social activity services for families with children, social activity services for elderly and disabled persons, social therapy workshops), from 18 March 2020 for the duration of the emergency period of these services,
4. social service providers interrupt the provision of social services on the basis of a contract with the user pursuant to § 91 of Act No. 108 / 2006 Coll., on social services, and at the same time suspend the provision of services under the individual planning regime for the duration of the emergency condition. The provider shall clearly inform users of this change,
5. provide services to social service providers to the extent necessary to ensure the protection of the life and health of persons. The provision can be used by employees of social services who have been interrupted by the resolution, or by students on the basis of the Czech Government Resolution of 13 March 2020 No 207,
6. to the governors of the regions and the Mayor of Prague
(a) to ensure that other appropriate social services and, where appropriate, other forms of care are provided to the extent strictly necessary, only in cases of direct threat to the life and health of the users of the social services referred to in point I / 3 of this resolution, in cooperation with the municipalities in which they are actually resident;
(b) inform the Ministry of Labour and Social Affairs of the implementation of the measures referred to in point I / 6a of this resolution;
II. Urges the Minister for Labour and Social Affairs to inform social service providers of the measures set out in points I / 1, I / 3, I / 4, I / 5 and I / 6 of this resolution, to lead them methodically in their implementation and to manage the provision of social services for the duration of the emergency situation.
They shall:
Minister for Labour and Social Affairs,
regional governors and mayor of the capital city of Prague,
the mayors of the municipalities concerned,
the providers and social services providers concerned.
