Regulation on the organisation of state fire control and fire protection

of 27 November 1953
on the organisation of state fire control and fire protection.
The Government of the Czechoslovak Republic hereby orders pursuant to § 4 (4), § 6 (1) (e), § 14 (1) and § 17 of Act No. 35 / 1953 Coll., on State Fire Control and Fire Protection:

Oddíl I.

Basic provisions.
§ 1.
State fire control.
(1) State fire surveillance consists of general fire protection management, in particular as regards the organisation of preparation and the use of firefighting forces and means of fire protection, and in the supervision of fire protection. State fire surveillance shall be the responsibility of the Minister of Interior, who shall exercise it in principle through the State Fire Supervision Authorities.
(2) The guidelines and guidelines of the Minister of Interior in the field of state fire surveillance are also governed by all central authorities and other state authorities.
§ 2.
Power in the field of fire protection.
(1) The Minister of the Interior is entitled to take all measures necessary to ensure fire protection within the limits of the applicable regulations, both in individual cases and by issuing general legislation and generally binding directives and guidelines.
(2) The competence of the National Committees in the field of fire protection under Section VI of this Regulation is vested.
§ 3.
Cooperation between state authorities.
The central authorities and their subordinate bodies shall assist the Home Secretary, the National Committees and the State Fire Supervision Authorities in carrying out their fire protection tasks.
§ 4.
Responsibility.
(1) National fire control authorities and the Minister of Interior shall be responsible for carrying out the tasks of national fire control.
(2) National committees shall be responsible for implementing measures to enhance fire safety, to organise preparation and to use the forces and means of fire protection in municipalities, districts and regions.
(3) For the implementation of measures to enhance fire safety, to organise the preparation and use of fire protection forces and means of fire protection in enterprises, establishments, institutes, offices and other facilities (hereinafter referred to as "the plants'), the heads of plants and the relevant members of the government shall be responsible.

Oddíl II.

State fire control authorities.
§ 5.
Administration and inspection.
The Minister of Interior shall carry out tasks in the field of state fire surveillance through the central (regional) administration of state fire surveillance and its local authorities (hereinafter referred to as "administrations and inspections').
§ 6.
Central and regional government.
(1) The central body of the State Fire Control is the central administration of the State Fire Control in the Ministry of Interior (hereinafter the "Central Administration").
(2) In Slovakia, the central administration exercises its competence substantially through the regional administration of the State Fire Supervision in the Internal Authority (hereinafter referred to as "Regional Administration") and with the knowledge of the Interior Officer.
§ 7.
Regional administrations and district, urban and district inspections.
Local authorities of state fire control shall be established in national committees and shall be:
(a) regional administration of state fire surveillance in the regions (hereinafter referred to as "regional administrations");
(b) district inspection of state fire control in the counties ("district inspection");
(c) a city inspection of the state fire control in Prague and in cities designated by the Minister for the Interior (hereinafter referred to as "city inspections");
(d) a district inspection of state fire control in Prague and cities, to be designated by the Minister of Interior ("district inspection").
§ 8.
Organisation of administrations and inspections.
(1) The organisation of administrations and inspections and the performance of service therein are adapted to the principles applicable to military services to the extent laid down by the Minister of Interior in an agreement with the Minister of National Defence. The head of administration (inspection) is the chief who manages the work and has the power to make decisions and measures. The internal arrangements of administrations and inspections shall be adapted by the Minister for the Interior, who shall also determine the number of their staff and shall be determined by an authority which shall provide for the tasks of the personal office.
(2) The management (inspection) is responsible for the management and inspection of lower-level administrations and gives them orders and instructions. The city inspection in Prague is directly subordinate to the central administration. The management may exceptionally carry out tasks relating to the management (inspection) of a lower degree where necessary in the general interest.
Relationship of local authorities of state fire control with national committees.
§ 9.
(1) The tasks of the National Fire Protection Committee are carried out by the administration (inspection) set up by it. In order to carry out these tasks, the National Committee may give instructions and instructions to the administration (inspection) and may also cancel and amend its decisions and measures in this field.
(2) From the activity carried out by the Administration (inspection) of the National Fire Protection Committee, the Chief of Administration (inspection) is responsible, on the one hand, to the Board of the National Committee, and, on the other hand, to the Chief of Superintendent (inspection) and to the Minister of Interior.
§ 10.
Only the Chief of Administration (Inspection) and the Minister of Interior are responsible for carrying out the tasks of the State Fire Control. The Minister of the Interior and the Chief of Superintendent (s) shall have the right to review and amend or revoke the decisions and measures of the Lower Level Administration (s).
§ 11.
General supervision of the management (inspection) activities set up by the National Committee shall be carried out by the Board of the National Committee. The management (inspection) shall therefore report its activities to the Board of the relevant national committee.
§ 12.
Appeals.
The decisions and measures of the regional administration, district, urban and district inspection can be referred to the superior administration (inspection).
§ 13.
Driving.
The rules on proceedings before national committees shall apply to proceedings before national committees, unless otherwise provided for in this Regulation and those adopted for its implementation.
§ 14.
The establishment of chieftains.
(1) The Chief of Central Administration shall establish and dismiss the Minister of Interior.
(2) The head of the Regional Administration shall be appointed and dismissed by the Minister of the Interior on a proposal from the Director of the Interior.
(3) The Chief of Regional Administration, as well as the Chief of City Inspection in Prague, sets up and rescues the Minister of the Interior, on a proposal from the Chief of Central Administration, submitted with the approval of the Board of National Committee in which the administration (inspection) is established.
(4) The heads of district, urban and district inspections are established and withdrawn by the Chief Executive (inspection), with the agreement of the Board of National Committee in which the administration (inspection) is established.

Oddíl III.

Scope of the State Fire Supervision Authorities.
§ 15.
The tasks of the central administration.
(1) The central management shall in particular carry out the following tasks:
1. prepares, after the case, legislation, directives, guidelines and technical standards in the field of fire protection, in particular:
(a) lay down the fire protection requirements to be taken care of in the management and implementation of projects and in the construction of establishments, settlements, individual buildings and facilities, and the way in which administration and inspection take part in the approval and implementation of projects and in the taking over of buildings, plants and equipment;
(b) determine how they carry out checks on the fire-fighting measures of administration (inspection), national committees, central offices and individual establishments. This provision shall not apply to the way in which checks are carried out in the field of the Ministry of National Defence;
2. Manages and controls the activities of subordinate administrations (inspections) and ensures their readiness, capacity and political and professional readiness;
3. organise and conduct the training of management staff (inspections);
4. Care for the organisation, training, use and increase the capability of fire protection units, in particular:
(a) propose to the Home Secretary the dislocation and organisation of fire services;
(b) manage the organisation, training and use of fire protection units through subordinate administrations (inspections) and ensure their political and professional readiness;
(c) determine how the alert status check and the capability of fire protection units are carried out;
(d) organise and train fire protection personnel;
5. ensure that fire protection is prepared and carried out on a material basis, in particular:
(a) carry out research in the field of fire protection directly or through the research institutes of ministries;
(b) submit proposals to the Standardisation Authority for standardisation and characterisation of the means of fire protection;
(c) check the quality of the means of fire protection in question;
(d) lay down the principles governing the distribution of the means of fire protection in kind supplied from production;
(e) lay down technical standards in the field of fire protection, in particular standards on the equipment in kind of fire protection units, as well as establishments, settlements, individual buildings and facilities;
(f) specify how the fire protection means in question are used and how they are checked;
(g) keeps the motor vehicle and special means of fire protection in mind and ensures the allocation of fuel to administrations and inspections as well as to public fire protection units;
6. Provides continuous education of the population in the field of fire protection;
7. controls compliance with applicable regulations, directives, guidelines and technical standards in the field of fire protection and other fire protection measures;
8. Organises and develops an improvement activity in the field of fire protection;
9. reports on projects and types of means of fire protection.
(2) The central administration may delegate its tasks to subordinate administrations (inspections) in general and on a case-by-case basis.
§ 16.
Tasks of the county administration.
(1) Regional administrations carry out in particular the following tasks in their respective districts:
1. manage and control the activities of the subordinate inspections and ensure their synergies as well as ensure their readiness, capacity and political and professional readiness;
2. provide for the organisation, training, use and increase the capability of fire protection units, in particular:
(a) propose to the Regional National Committee the dislocation of public professional fire services;
(b) ensure synergies between fire protection units;
(c) check the state of alert and the capability of fire protection units and their political and professional readiness;
(d) conduct training of fire protection units;
3. ensure that fire protection is prepared and carried out in substance, in particular:
(a) in the framework of the Central Administration Directives, participate in the approval and implementation of projects of establishments, settlements, individual buildings and installations and the taking-over of buildings, plants and equipment;
(b) check the quality of the means of fire protection in question;
(c) check the distribution of the means of fire protection in kind;
(d) to the extent provided for by the central administration, they shall give evidence of means of fire protection and allocate fuel to district (urban) inspections and public fire protection units;
(e) ensure the inclusion of fire protection needs in the regional plan and participate in the drawing up of regional plans as regards fire protection needs;
4. prepare proposals for measures needed to ensure fire protection for the National Committee;
5. check compliance with applicable regulations, directives, guidelines and technical standards in the field of fire protection and other fire prevention measures;
6. organise and develop improvements in the field of fire protection.
(2) Regional administrations may delegate their tasks to subordinate inspections on a case-by-case basis.
§ 17.
Tasks of district (urban) and district inspections.
(1) Regional inspections shall in particular carry out the following tasks in their respective districts:
1. take care of the organisation, training, use and increase the capability of fire protection units, in particular:
(a) organise fire services and professional public fire services and manage the organisation of public fire services;
(b) participate in the organisation of fire protection racing units;
(c) ensure synergies between fire protection units, in particular the manner and extent of mutual assistance;
(d) control the state of equipment and equipment and the state of alert and the capability of fire protection units, as well as their political and professional readiness;
2. ensure that fire protection is prepared and carried out on a material basis, in particular:
(a) participate in the approval and implementation of projects of establishments, settlements, individual buildings and installations and the taking-over of buildings, plants and equipment within the framework of the directives of senior administrations;
(b) check the quality of the means of fire protection in question;
(c) check the state of the fire-fighting measures in municipalities, establishments and establishments;
(d) to the extent laid down by senior management, maintain the means of fire protection in question and allocate fuel to district inspections and public fire protection units;
3. prepare proposals for the National Committee for measures needed to ensure fire protection;
4. check compliance with applicable regulations, directives, guidelines and technical standards in the field of fire protection and other fire protection measures;
5. organise and develop improvements in the field of fire protection.
(2) Urban inspections carry out tasks in their districts belonging to other regional inspections. The city inspection in Prague also performs the tasks of the regional administration.
(3) The tasks of the district inspections shall be determined by the relevant municipal (district) inspection.

Oddíl IV.

Rights of the authorities of the State Fire Supervision.
§ 18.
Access to objects.
(1) The authorities (inspections), as well as the persons authorised by the administrations (inspections), are entitled to enter into establishments, buildings and facilities when carrying out their tasks, subject to the guidelines of the Minister of the Interior. They'll make a record of the results of the search.
(2) The authorities (inspections), as well as persons authorised by administrations (inspections), do not carry out inspections in establishments, buildings and facilities in the field of the Ministry of National Defence. The Minister of the Interior will lay down guidelines for such inspections in buildings and facilities in the Ministry of the Interior.
§ 19.
Request reports.
Administrations and inspections shall be entitled to request a one-off message from the heads of the premises, the owners of the buildings and equipment, and, in the case of other persons responsible, in the form laid down by the Minister for the Interior, as well as the material and documents necessary to clarify the state of the building in relation to fire safety.
§ 20.
Binding instructions.
The administrations and inspections, as well as the persons empowered by them in carrying out their tasks, shall, on a case-by-case basis, take the measures necessary to ensure the safety of the fire, in particular giving written binding instructions to the manager of the plant, the owner of the building or plant, after the case of another responsible person.
§ 21.
Investigation into the causes of the fires.
The administrations and inspections investigate the causes of fires, following the guidelines issued by the Minister of the Interior in agreement with the Minister of Justice and the Attorney General.
§ 22.
Save fines.
(1) For infringements of the applicable regulations, directives, guidelines and technical standards in the field of fire protection or for negligent maintenance and for incorrect use of the means of fire protection in kind, managers of administrations (inspections) may impose fines on individual persons up to the amount of CZK 3,000.
(2) Supervisors of administrations (inspections) may authorise the commander of fire protection units to impose fines to the extent provided for in the rules on the organisation of fire protection units.
(3) The decision on the fine may be appealed. The appeal is finally decided directly by the superior administration (inspection).
(4) The fine may not be imposed 4 months after the inspection. The limitation period shall be interrupted as soon as the proceedings for the imposition of a fine have been initiated.
(5) The fine imposed by the staff member shall be enforced by the accounting office of its establishment on the basis of a final decision imposing a fine, by a deduction from salary up to 25% of its amount. The fine falls to the state.
(6) The Minister for the Interior will issue more detailed provisions, in particular on management. In agreement with the Minister for National Defence, the Minister for the Interior shall provide for the imposition of fines on soldiers and members of the National Security Corps in active service.
(7) If the administration (inspection) considers that the act should be punished more severely, it will refer the case to the prosecutor.
§ 23.
Traffic stop.
(1) If other fire protection measures are not sufficient to eliminate the causes of the imminent fire hazard, the Minister of the Interior or the Chief of Central (Regional) Administration may, until the correction is completed, suspend the operations causing this immediate danger in the plants. This authorisation is also for the heads of regional administrations, regional and urban inspections, to be entrusted by the Chief of Central Administration; However, their decision shall cease to be effective if the Minister of the Interior or the Chief of Central Administration does not confirm them during the next working day.
(2) If other measures in the field of fire protection are not sufficient to eliminate the cause of the imminent fire hazard, the Minister of the Interior may order the closure of operations throughout the plant; However, it is obliged to draw the attention of the relevant member of the government in whose field the plant belongs.
(3) Stopped operations may be restarted only with the consent of the authority which issued the decision to stop operations.

Oddíl V.

Tasks of central fire protection authorities.
§ 24.
General tasks of central authorities.
In particular, the central authorities shall carry out the following general fire protection tasks:
1. within the limits of the Directives of the Minister for the Interior, they shall give their subordinate authorities instructions on the provision and organisation of fire protection in establishments within their field of competence;
2. establish, as appropriate in subordinate bodies, special organisational components for fire protection (separation, reports, inspections); the tasks, organisation and number of staff of those constituents shall be determined by the competent minister in accordance with the guidelines of the Minister of Interior;
3. Suggests the Minister of the Interior in which particularly important plants belonging to their field are to be set up by fire services and the number of members; to cover the personnel costs of these services (Section 48 (3));
4. specify in the agreement with the central administration in which establishments the professional racing fire departments and the number of members;
5. ensure the personal occupancy of fire protection racing units, their training and political and professional preparedness;
6. ensure that fire protection needs are taken into account when designing and building plants, settlements, individual buildings and equipment;
7. plan and provide financially the means necessary to fulfil their fire protection tasks;
8. provide the administrations and inspections with requested reports and evidence of the state of the fire-fighting measures in their departments.
§ 25.
Tasks of some central authorities.
(1) In the field of the Ministry of National Defence, provision of fire protection measures and the exercise of state fire control by the Ministry of National Defence is the responsibility of the Ministry of Defence. This Ministry implements them by its own departments; In doing so, it shall follow the guidelines and instructions of the Minister for the Interior. The Minister of Interior shall lay down guidelines for the provision of fire protection measures and the exercise of state fire surveillance in the Ministry of Interior.
(2) It remains without prejudice to the existing rules under which the authorities of the public mining authorities are responsible for the treatment of fire protection in mining beneath and on the surface. The cooperation of the public mining authorities with the national committees and the national fire surveillance authorities shall be regulated by the Minister of Interior in agreement with the Minister for Fuel and Energy.
(3) The organisation of fire protection on railways is governed by specific regulations; However, the Minister for Interior and State Fire Supervision are entitled to give binding instructions to the railway fire protection authorities and to check the state of the fire protection measures on the railways.
(4) The production ministries take care of the scientific research activities in the field of fire protection in their department.

Oddíl VI.

Tasks of national committees in the field of fire protection.
§ 26.
Scope.
National committees shall provide and organise fire protection in municipalities, counties and regions in accordance with the provisions of this Regulation.
§ 27.
Cooperation with citizens, voluntary organisations and races.
(1) The National Committees mobilise citizens to participate actively in the fire protection tasks with the help of voluntary organisations, in particular the Czechoslovak Fire Protection Association.
(2) National committees monitor the state of fire protection in their district, including as regards fire protection of plants. To that end, national committees shall:
(a) regularly discuss fire protection issues submitted by administrations (inspections);
(b) invite and discuss the situation of fire-fighting measures to the Board as necessary;
c) Discuss important fire protection issues and the performance of its tasks with the relevant officers of the Czechoslovak Fire Protection Association.
§ 28.
Preventing fires.
(1) The local national committees in their district are responsible for preventing fires and ensuring that they are overcome by public voluntary fire services under the broad cooperation of citizens.
(2) The local national committees are therefore, above all, taking all necessary measures to ensure that the causes of the fires are removed and that they are not newly created. To this end, they cooperate in particular with the Czechoslovak Fire Protection Union and the State Insurance Company.
§ 29.
Fire checks.
(1) In order to eliminate the causes of fires, the local national committees shall, as appropriate, but at least once a year, carry out fire inspections of plants, buildings and equipment within their perimeter in order to ascertain whether all the rules aimed at preventing fires are maintained. These inspections shall be carried out by the authorities of the State Fire Supervision in major plants as well as those of particular importance.
(2) Local national committees do not carry out fire inspections in the Ministry of Defence's factories, buildings and facilities. The Minister of the Interior shall lay down guidelines for such inspections in the premises and facilities of the Ministry of the Interior.
(3) The Minister for the Interior will issue more detailed provisions on the conduct of fire inspections and the removal of detected defects.
