Minister for Foreign Trade
of 31 August 1967
on the designation of Unicoop, a cooperative for foreign trade, to conduct certain foreign transactions
The Foreign Trade Minister shall, in agreement with the Minister of Finance and the Chairman of the Central Council of Cooperatives pursuant to § 2 paragraphs 1 and 2 and § 20 of Act No. 119 / 1948 Coll., on the State Organisation of Foreign Trade and International Shipbuilding:
(1) Unicoop, a cooperative undertaking for foreign trade in Prague, established as a joint venture of ČS cooperatives by the Central Council of Cooperatives, the Union of Production Cooperatives and the Union of Consumer Cooperatives (hereinafter referred to as "Unicoop"), is intended for the exclusive implementation of exports and imports of the following goods:
products of folk art production and creativity and art craft products supplied by cooperative organisations, undertakings subordinate to the Ministry of Culture and Information and enterprises managed by national committees;
fresh edible fruits of all kinds (mushrooms, cranberries, blueberries, etc.), fresh arrows;
dried and silage of edible fruits and arrows and fresh fruit and vegetables as regards goods produced, processed or supplied by cooperative organisations or which are foreign cooperative partners or which are imported for the domestic cooperative network;
honey; certain species of animal delicacies agreed between Koospol, the foreign trade undertaking, and Unicoop.
(2) To the extent referred to in paragraph 1, the exclusive authorisation of Koosalus, the foreign trade undertaking *) and Artie, the foreign trade undertaking is restricted. * *)
(3) The completion of commercial cases for those goods shall be left to the agreement of the foreign trade undertakings Koospol and Artia with Unicoop. Rights attaching to third parties shall be without prejudice to this.
In addition, Unicoop is entitled to export or import goods produced, processed or supplied by cooperative organisations or by foreign cooperative partners, or imported for the domestic cooperative network, in addition to undertakings in charge of foreign trade which otherwise reserve export and import of goods, provided that:
(a) are the types of goods agreed in advance with the Ministry of Foreign Trade in the annual breakdown of binding export tasks or within annual binding import limits and declared by the Ministry of Foreign Trade in its Bulletin; or
(b) it shall be evidenced by goods in excess of or for import by means of a binding export task of supplier undertakings.
In addition to the cases referred to in paragraphs 1 and 2, the Ministry of Foreign Trade may, for each case of transactions negotiated in respect of goods manufactured, processed or supplied by cooperative organisations, or in respect of foreign cooperative partners, or imported for the domestic cooperative network, authorise Unicop, if socially appropriate, to carry out the export or import of such goods instead of an otherwise competent undertaking entrusted with the conduct of foreign trade, or to conduct such trade as a agent on its behalf and on behalf of the relevant foreign trade undertaking on the basis of its mandate. In this case, the Ministry of Foreign Trade will provide Unicoop with the necessary goods for export.
(1) Unicoop and the relevant undertakings in charge of foreign trade will cooperate in their business activities on the section covered by this decree, in particular in the field of price policy.
(2) The individual cases of export or import of goods referred to in Article 2 shall be subject to a timely discussion and agreement with the relevant undertakings in charge of foreign trade which are obliged to provide Unicoop with the necessary information; in the event of a conflict, the Ministry of Foreign Trade shall decide.
(3) The Ministry of Foreign Trade sets out in agreement with the Central Council of Cooperatives the terms and conditions of cooperation between Unicoop and undertakings responsible for foreign trade.
(1) The activities of Unicoop under this Order shall be subject to the relevant rules applicable to foreign trade.
(2) The foreign exchange funds obtained from the export of goods referred to in Article 2 (b) may be used by Unicoop only under conditions agreed with the competent authorities.
The Order of the Minister for Foreign Trade of 17 January 1956 No 5 / 1956 of the Úl on the authorisation of the Central Council of Cooperatives to conduct certain foreign transactions is hereby repealed.
This Decree shall take effect on the day of its publication; It shall also apply to exports and imports corresponding to this Order, carried out from 1 January 1967.
