on conditions for fire safety in the operation of chimneys, smoke pipes and fuel appliances
The Government orders the implementation of Act No. 133 / 1985 Coll., on Fire Protection, as amended by Act No. 425 / 1990 Coll., Act No. 40 / 1994 Coll., Act No. 203 / 1994 Coll., Act No. 163 / 1998 Coll., Act No. 71 / 2000 Coll., Act No. 237 / 2000 Coll., Act No. 320 / 2002 Coll., Act No. 413 / 2005 Coll., Act No. 186 / 2006 Coll., Act No. 267 / 2006 Coll. and Act No. 281 / 2009 Coll.:
Fire safety conditions
(1) Everyone must act in such a way that fire does not occur during the operation of the chimney and flue-pipe (hereinafter referred to as the "flue-gas road") and fuel appliances.
(2) The operation of the flue gas and fuel appliances is considered to be satisfactory from the point of view of fire safety if the inspection, cleaning and revision of the flue gas, cleaning of the fuel appliance and burning of the chimney are carried out in the manner and within the time limits laid down in this Regulation by the Government and if defects are not found in their cleaning, inspection or revision.
(3) This Government Regulation shall not apply to a flue gas road which includes a free-standing chimney with an internal diameter of 800 mm or greater, or a construction height of 60 m or more, and a fuel appliance with a rated output of more than 1 MW.
Control of the combustion road
(1) The inspection of the combustion pathway is carried out by a competent person who is the holder of a commercial licence in the field of cominict1).
(2) The control of the combustion road is carried out
(a) an assessment of the safe location of the flammable building structure, material and article following the design of the combustion road and the associated fuel appliances;
(b) assessment of the chimney, in particular with regard to its fire safety and operability;
(c) an assessment of whether free and secure access to the chimney, its sweep, cleaning and inspection sites are ensured;
(d) an assessment of the fire safety of the building, in particular by the passage of the combustion road by horizontal and vertical construction structures, soil space or roof, and of the flue gas outlets through the building's perimeter;
(e) an assessment of its technical condition.
(3) Compliance with the requirements for the control of flue-gases pursuant to the Act on the Protection of Aids (2) and within the time limits laid down therein is considered to be compliance with the requirements for the control of flue-gases pursuant to this Regulation.
Cleaning of the combustion process
(1) The cleaning of the combustion pathway is carried out by a competent person who is the holder of a commercial licence in the field of comerict1); the cleaning of the combustion road used for the flue gas removal from a solid fuel appliance with a rated output up to and including 50 kW can be performed by self-help.
(2) The cleaning of the combustion road shall be carried out by cleaning operations, in particular with a view to removing solid deposits in the combustion road and the spark trap and to collecting solid pollutants accumulated at an inefficient height of the chimney vent or condensates from the combustion road.
Time limits for inspection and cleaning of the combustion road and fuel appliances
(1) The time limits for checking and cleaning the combustion plant during its operation are set out in Annex 1 to this Regulation.
(2) The combustion road to which the fuel appliance is connected and which has not been in service since prior inspection and cleaning for longer than the period resulting from the cleaning periods referred to in Annex 1 to this Regulation, is not necessary to check and clean up before it is put into service; the inspection and cleaning of the combustion road shall be carried out before the fuel appliance is put back into service.
(3) In the case of an unused chimney which is secured in the mouth against the entry of rainwater and is properly marked at the points of connection of the fuel appliance with a "Out of service" sign or other appropriate means, no inspection and cleaning shall be carried out.
(4) The time limits for the collection of solid pollutants accumulated at an inefficient height of the chimney vents or condensates from the combustion road are set out in Annex 1 to this Regulation.
(5) The cleaning periods for solid fuel appliances are set out in Annex 1 to this Regulation.
Revision of the combustion road
(1) The revision of the combustion pathway is carried out by a competent person holding a commercial licence in the field of cominict1), who is also:
(a) a revision technician of the chimney (3);
(b) a specialist in the safety of work- a revision technician in chimney systems3); or
(c) a revision technique for flue gas travel 3).
(2) Revision of the combustion road is carried out
(a) before the combustion road is put into service or after any treatment of the chimney,
(b) when changing the type of fuel connected to the fuel appliance;
(c) before the replacement or new installation of the fuel appliance,
(d) after a chimney fire,
(e) the occurrence of cracks in the flue gas road as well as the suspected occurrence of cracks in the flue gas road.
Report on inspection or cleaning of the combustion road and review report of the combustion road
(1) A competent person shall issue a written report in accordance with the model set out in Annex No 2 to this Regulation on the control or cleaning of the combustion plant. Where a legal or business natural person carries out the cleaning of the combustion road as referred to in Article 3 (1) by himself, he shall record it in the fire book4) or, where appropriate, other operational documentation which he shall submit to the competent person when carrying out the inspection.
(2) A competent person shall issue a written report on the revision of the combustion plant in accordance with the model set out in Annex 3 to this Regulation.
(3) Where, in the control, cleaning or revising of the combustion plant, a competent person finds deficiencies which are imminent to the fire safety, health, life or property of persons and which cannot be removed on the spot, he shall immediately notify the competent building authority of this fact in writing in the event of deficiencies caused by failure to comply with the technical requirements and in the event of deficiencies concerning the non-compliance with the fire safety requirements of the State Fire Control Authority.
Burning a chimney
(1) The burning of the chimney is the removal of solid flue gas deposits, in particular tar, from the chimney vent by controlled incineration.
(2) The chimney may be fired only if it is not possible to remove solid flue gas deposits by other means, provided that the chimney is resistant to the effects of burning and does not result in burning to disrupt the purpose to which it is intended to serve.
(3) The chimney can only be fired by a competent person who is the holder of a commercial licence in the field of comerict1) or by a revision of chimney techniques, with the assistance of another eligible person.
(4) Burning of the chimney shall be notified by the owner of the building to the local competent fire department of the region at least 5 working days before the date of commencement of the operation.
Repeal
Decree No. 111 / 1981 Coll., on chimney cleaning, is deleted.
Efficacy
This Regulation shall enter into force on 1 January 2011.

Additional rules to the table:
1. The operation of the combustion road for a fuel appliance shall be considered as seasonal operation for a period not exceeding 6 months in a calendar year.
2. In the case of single-layer (non-inserted) walled chimney for gas-fired appliances, the time limits for checks and cleaning shall be those for checks and cleaning of solid fuel appliances.
3. Such activities shall be carried out twice a year during inspections and cleaning at reasonable intervals, and no less than 6 months shall elapse between checks or cleaning operations.
4. The inspections and the cleaning three times a year shall be carried out at reasonable intervals, with a period of not less than 4 months between checks or cleaning operations.
5. A chimney used for the removal of flue gas from a solid fuel appliance in cases where heating cannot be provided otherwise shall be checked and, if necessary, cleaned at least once a year.
6. The combustion road intended for the removal of the flue gas from the solid fuel appliance used in the business plant (5) shall be checked and cleaned at least once every two months.
7. In the construction for family recreation (6), the inspection and cleaning of the combustion road shall be carried out at least once a year.
8. The cleaning of a solid fuel appliance with a rated power up to and including 50 kW may be carried out by self-help according to the manufacturer's instructions but at least once a year, provided that their periodic checks are carried out by a competent person.
