amending Act No. 289 / 1995 Coll., on Forests and amending and supplementing certain laws (Forest Act), as amended
Parliament has decided on this law of the Czech Republic:
Act No. 289 / 1995 Coll., on Forests and on the Amendment and Addition of Certain Laws (Forest Act), as amended by Act No. 238 / 1999 Coll., Act No. 67 / 2000 Coll., Act No. 132 / 2000 Coll., Act No. 76 / 2002 Coll., Act No. 250 / 2002 Coll., Act No. 183 / 2002 Coll., Act No. 149 / 2003 Coll., Act No. 1 / 2005 Coll., Act No. 444 / 2005 Coll., Act No. 64 / 2014 Coll., Act No. 222 / 2006 Coll., Act No. 501 / 2012 Coll.
1. In Article 49, at the end of paragraph 2, the dot is replaced by a comma and the following point (e) is added:
"(e) derogating measures in cases of emergency (Section 51a)."
2. After Paragraph 51, the following Section 51a is inserted:
Derogations in emergency situations
(1) In cases of regional or national emergency situations having the character of calamities, caused in particular by biotic or abiotic agents, occurring in the territory of two or more regions where the performance of duties by forest owners is not possible or would not result in the purpose of the act being fulfilled, the Ministry may decide on the necessary measures derogating from the provisions of Sections 29 (1), 31 (6), 32 (1) to (3) and 33 (1) to (3) of the Act in order to minimise damage to forests. These measures may also be imposed by the Ministry by general measures.
(2) A decision given pursuant to paragraph 1 shall be the first act in the proceedings. The appeal against this decision shall not have suspensory effect.
(3) Measures of a general nature as referred to in paragraph 1 shall be taken without a procedure for draft measures of a general nature.
(4) The general measure referred to in paragraph 1 shall take effect on the date of its publication on the official plate of the Ministry. Measures of a general nature shall also be published on official boards of municipal authorities with extended scope, whose administrative districts are affected by measures of a general nature.
(5) Paragraph 172 (5) of the Administrative Regulation shall not apply to the issue of general measures under paragraph 1.
(6) Paragraphs 2 to 5 shall apply mutatis mutandis in the event of modification or repeal of measures of a general nature. ';
Efficacy
This Act shall take effect on the day of its publication.
