DECLARATION
Ministry of Agriculture
of 8 April 1998
defining certain species of plants listed in the species list whose propagating material may be put into circulation as commercial material and its characteristics and control methods
According to Article 32 (1) of Act No. 92 / 1996 Coll., on Varieties, Seeds and Propagating Plants, hereinafter referred to as "the Act", the Ministry of Agriculture provides:
The species of plants whose propagating material may be put into circulation as commercial before the end of 1998, hereinafter referred to as "plant species', are common wheat, barley, oats, peas, flax, clover, depraved clover, pinkish scorpion, lucerne, marian islet, vines.
Plant species propagating material shall not have a germination capacity lower than:
(a) 78% for common wheat,
(b) 78% for barley,
(c) 75% for oats,
(d) 70% for peas,
(e) 72% for flax,
(f) 70% for reptilian clover and perverted clover;
(g) 65% for pink scorpion,
(h) 70% for lucerne;
(i) 50% in the case of marian sharpskate.
In the case of vine seedlings, the length of matured aeroplanes shall be at least 100 mm.
The propagation material of peas put into circulation as commercial may be infected with fungal diseases (Ascochyta ssp., Pleospora herbarum, Fusarium ssp. and Colletotrichum lindemuthianum), but the overall extent of the infestation of the crop from which the seed comes shall not exceed 30%.
The propagating material of the plant species referred to in Section 1 shall:
(a) be made from seed crops recognised under Article 22 (4) of the Act and be marked with the name of the variety; in the case of flax, peas, reptile clover and perverted clover and lucerne must be produced only from crops in which the origin of the propagating material is known;
(b) comply with the other requirements laid down for certified seed or seed of those species in accordance with a specific Regulation, (1) unless otherwise specified in this Decree;
(c) bear a mark from which it is clear to the purchaser that the material is commercial propagating material under this decree.
The control of the characteristics of propagating material of the species referred to in Article 1 shall be carried out in the same way as the control of the properties of other propagating material.2)
This decree shall take effect on the day of its publication.
