DECLARATION
of 13 January 2015
laying down the formalities and models for the mandates for the exercise of state supervision, state professional supervision, top state supervision and top state professional supervision in transport in the form of a licence and amending the related regulations
The Ministry of Transport provides, pursuant to Article 46 (2) of Act No. 13 / 1997 Coll., on the Road, as amended by Act No. 102 / 2000 Coll., Act No. 80 / 2006 Coll., Act No. 97 / 2009 Coll., Act No. 347 / 2009 Coll., Act No. 152 / 2011 Coll., Act No. 133 / 2012 Coll., and Act No. 64 / 2014 Coll., pursuant to § 62 of Act No. 111 / 1994 Coll., on Road Transport, as amended by Act No. 304 / 1997 Coll., Act No. 119 / 2012 Coll., Act No. 102 / 2013 Coll., and Act No. 64 / 2014 Coll., Act No. 229 / 2006 Coll., Act No. 226 / 2006 Coll., Act No. 194 / 2010 Coll., Act No. 119 / 2012 Coll. DETERMINATION OF THE IMPLEMENTATION AND SAMPLES IN THE FORM OF THE TRANSPORT
Formats and models of the mandate for the exercise of state supervision and supreme state supervision in infrastructure matters in the form of a licence
(K § 41 (4) of Act No. 13 / 1997 Coll.)
(1) The authorisation for the exercise of State supervision and overseeing of infrastructure in the form of a licence shall include:
(a) an indication of the administrative authority which issued the mandate, over which the text "CZECH REPUBLIC" is given,
(b) an indication that it is a mandate for the exercise of State supervision or overseeing in the field of infrastructure;
(c) the authorisation number,
(d) the name and surname of the delegate;
(e) a photograph of an authorised person measuring 35 × 45 mm, the lower edge of which is glued with a holographic sticker with the text "CZECH REPUBLIC,"
(f) the date of issue of the mandate,
(g) information on the authorisation of the delegate;
(h) the signature of the person empowered to issue the mandate;
(i) the print of the official stamp of the administrative authority which issued the mandate.
(2) The authorisation for the exercise of State supervision and overseeing in road transport in the form of a licence is a double-sided paper card with dimensions of 70 × 100 mm, which is sealed in a transparent laminating sheet of 75 × 105 mm. The card is equipped with security features, which are price paper and numbering in black.
(3) The models of the mandate for the exercise of state supervision and overseeing in the form of a licence are set out in Annex 1.
Forms and models of mandates for the exercise of state professional supervision and top state supervision in road transport in the form of a licence
(K § 34 (7) of Act No. 111 / 1994 Coll.)
(1) The authorisation for the exercise of state professional supervision and the head of state supervision in road transport in the form of a licence shall include:
(a) an indication of the administrative authority which issued the mandate, over which the text "CZECH REPUBLIC" is given,
(b) an indication that it is a mandate to exercise state professional supervision or top state supervision in road transport,
(c) the authorisation number,
(d) the name and surname of the delegate;
(e) a photograph of an authorised person measuring 35 × 45 mm, the lower edge of which is glued with a holographic sticker with the text "CZECH REPUBLIC,"
(f) the date of issue of the mandate,
(g) information on the authorisation of the delegate;
(h) the signature of the person empowered to issue the mandate;
(i) the print of the official stamp of the administrative authority which issued the mandate.
(2) The authorisation for the performance of state professional supervision and top-level surveillance in road transport in the form of a licence is a double-sided paper card with dimensions of 70 × 100 mm, which is sealed in a transparent laminating film of 75 × 105 mm. The card is equipped with security features, which are price paper and numbering in black.
(3) The models of the mandates for the performance of state professional supervision and top state supervision in road transport in the form of a licence are set out in Annex 2.
Formats and models of mandates for the exercise of state supervision and supreme state supervision in matters of competence to drive motor vehicles in the form of a licence
(The § 54 paragraph 3 of Act No. 247 / 2000 Coll.)
(1) The authorisation for the exercise of national supervision and the overseeing of national supervision in matters of competence to drive motor vehicles in the form of a licence shall include:
(a) an indication of the administrative authority which issued the mandate, over which the text "CZECH REPUBLIC" is given,
(b) an indication that it is a mandate for the exercise of State supervision or of the supreme state supervision in matters of competence for motor vehicle driving;
(c) the authorisation number,
(d) the name and surname of the delegate;
(e) a photograph of an authorised person measuring 35 × 45 mm, the lower edge of which is glued with a holographic sticker with the text "CZECH REPUBLIC,"
(f) the date of issue of the mandate,
(g) information on the authorisation of the delegate;
(h) the signature of the person empowered to issue the mandate;
(i) the print of the official stamp of the administrative authority which issued the mandate.
(2) The authorisation for the exercise of national supervision and overseeing in matters of competence to drive motor vehicles in the form of a licence is a double-sided paper card with dimensions of 70 × 100 mm, which is sealed in a transparent laminating sheet of 75 × 105 mm. The card is equipped with security features, which are price paper and numbering in black.
(3) The models of the mandates for the exercise of state supervision and supreme state supervision in matters of competence for driving motor vehicles in the form of a licence are set out in Annex 3.
Formats and models of mandate to exercise state professional supervision and top state professional supervision in road traffic matters in the form of a licence
(K § 125b (3) of Act No. 361 / 2000 Coll.)
(1) The authorisation for the exercise of state professional supervision and top state professional supervision in road traffic matters in the form of a licence shall include:
(a) an indication of the administrative authority which issued the mandate, over which the text "CZECH REPUBLIC" is given,
(b) an indication that it is a mandate to exercise state professional supervision or top state professional supervision in road traffic matters;
(c) the authorisation number,
(d) the name and surname of the delegate;
(e) a photograph of an authorised person measuring 35 × 45 mm, the lower edge of which is glued with a holographic sticker with the text "CZECH REPUBLIC,"
(f) the date of issue of the mandate,
(g) information on the authorisation of the delegate;
(h) the signature of the person empowered to issue the mandate;
(i) the print of the official stamp of the administrative authority which issued the mandate.
(2) The authorisation for the performance of state professional supervision and top-level state professional supervision in road traffic matters in the form of a licence is a double-sided paper card with dimensions of 70 × 100 mm, which is sealed in a transparent laminating film of 75 × 105 mm. The card is equipped with security features, which are price paper and numbering in black.
(3) The models of the mandate for the exercise of state professional supervision and the top level state professional supervision of the delegated power in road traffic matters in the form of a licence are set out in Annex 4.
Model of mandate for the exercise of state supervision in railway matters in the form of a licence
(The § 58 paragraph 6 of Act No. 266 / 1994 Coll.)
(1) The authorisation for the exercise of state supervision in railway matters in the form of a licence shall include:
(a) an indication of the administrative authority which issued the mandate, over which the text "CZECH REPUBLIC" is given,
(b) an indication that it is a mandate to exercise state control over railway matters,
(c) the authorisation number,
(d) the name and surname of the delegate;
(e) a photograph of an authorised person measuring 35 × 45 mm, the lower edge of which is glued with a holographic sticker with the text "CZECH REPUBLIC,"
(f) the date of issue of the mandate,
(g) information on the authorisation of the delegate;
(h) the signature of the person empowered to issue the mandate;
(i) the print of the official stamp of the administrative authority which issued the mandate.
(2) The authorisation for the performance of public oversight in railway matters in the form of a licence is a double-sided paper card with dimensions of 70 × 100 mm, which is sealed in a transparent laminating sheet of 75 × 105 mm. The card is equipped with security features, which are price paper and numbering in black.
(3) The model of mandate for the exercise of state supervision in railway matters in the form of a licence is set out in Annex 5.
Formats and model of the mandate to exercise state oversight in civil aviation in the form of a licence
(K § 90 (4) of Act No. 49 / 1997 Coll.)
(1) The authority to exercise State oversight in civil aviation in the form of a licence shall include:
(a) an indication of the administrative authority which issued the mandate, over which the text "CZECH REPUBLIC" is given,
(b) an indication that it is a mandate to exercise state oversight in civil aviation,
(c) the authorisation number,
(d) the name and surname of the delegate;
(e) a photograph of an authorised person measuring 35 × 45 mm, the lower edge of which is glued with a holographic sticker with the text "CZECH REPUBLIC,"
(f) the date of issue of the mandate,
(g) information on the authorisation of the delegate;
(h) the signature of the person empowered to issue the mandate;
(i) the print of the official stamp of the administrative authority which issued the mandate.
(2) The information referred to in paragraph 1 is given in the Czech and English languages.
(3) The authorisation to exercise State oversight in civil aviation in the form of a licence is a double-sided paper card with dimensions of 70 × 100 mm, which is sealed in a transparent laminating sheet of 75 × 105 mm. The card is equipped with security features, which are price paper and numbering in black.
(4) The model of the mandate for state oversight in civil aviation in the form of a licence is set out in Annex 6.
Forms and model of authorisation to exercise State control over maritime navigation in the form of a licence
(K § 76 paragraph 1 of Act No. 61 / 2000 Coll.)
(1) The authorisation to exercise State control over maritime navigation in the form of a licence shall include:
(a) an indication of the administrative authority which issued the mandate, over which the text "CZECH REPUBLIC" is given,
(b) an indication that it is a mandate to exercise State control over maritime navigation,
(c) the authorisation number,
(d) the name and surname of the delegate;
(e) a photograph of an authorised person measuring 35 × 45 mm, the lower edge of which is glued with a holographic sticker with the text "CZECH REPUBLIC,"
(f) the date of issue of the mandate,
(g) information on the authorisation of the delegate;
(h) the signature of the person empowered to issue the mandate;
(i) the print of the official stamp of the administrative authority which issued the mandate.
(2) The information referred to in paragraph 1 is given in the Czech and English languages.
(3) The authorisation to exercise State control over maritime navigation in the form of a licence is a double-sided paper card with dimensions of 70 × 100 mm, which is sealed in a transparent laminating sheet of 75 × 105 mm. The card is equipped with security features, which are price paper and numbering in black.
(4) The model of mandate for the exercise of State surveillance in the area of maritime navigation in the form of a licence is set out in Annex 7.
Formats and model of entrustment of staff of the State Navigation Administration to exercise state oversight in inland navigation in the form of a licence
(K § 42 (6) of Act No. 114 / 1995 Coll.)
(1) The entrustment of staff of the State Navigation Administration to exercise state oversight in inland navigation in the form of a licence shall include:
(a) the designation of the State Navigation Administration as the administration which issued the licence;
(b) an indication that it is a mandate to exercise State control in inland navigation,
(c) the licence number,
(d) the name and surname of the holder of the licence and, where appropriate, the title;
(e) a colour photograph of the licence holder of 23 × 30 mm,
(f) the date of issue of the licence;
(g) information on the licence holder;
(h) signature of the Director of the State Navigation Administration;
(i) an official stamp of the State Navigation Administration;
(j) information on the procedure for finding the licence.
(2) The qualification of staff of the State Navigation Administration to exercise state surveillance in inland navigation in the form of a licence is a plastic card with dimensions 86 × 54 mm, covered by a clear laminating film with holographic protective features.
(3) The model of entrustment of staff of the State Navigation Administration for the exercise of state surveillance in inland navigation in the form of a licence is set out in Annex 8.
Models of mandate for the performance of state professional supervision and top state supervision on road traffic conditions in the form of a licence
(K § 82 (1) of Act No. 56 / 2001 Coll.)
(1) The authorisation for the performance of state professional supervision and overseeing of road traffic conditions in the form of a licence shall include:
(a) an indication of the administrative authority which issued the mandate, over which the text "CZECH REPUBLIC" is given,
(b) an indication that it is a mandate for the exercise of national professional supervision or national supervision in respect of road traffic conditions;
(c) the authorisation number,
(d) the name and surname of the delegate;
(e) a photograph of the authorised person measuring 35 x 45 mm, the lower edge of which is glued with a holographic sticker with the text "CZECH REPUBLIC,"
(f) the date of issue of the mandate,
(g) information on the authorisation of the delegate;
(h) the signature of the person empowered to issue the mandate;
(i) the print of the official stamp of the administrative authority which issued the mandate.
(2) The authorisation for the performance of state professional supervision and top-level surveillance on road traffic conditions in the form of a licence is a double-sided paper card with dimensions of 70 x 100 mm, which is sealed in a transparent laminating sheet of 75 x 105 mm. The card is equipped with security features, which are price paper and numbering in black.
(3) The models of the mandate for the exercise of state professional supervision and the head of state supervision on road traffic conditions in the form of a licence are set out in Annex 9 to this Regulation.
Amendment of the Decree implementing the Road Law
Decree No. 104 / 1997 Coll., implementing the Road Act, as amended by Decree No. 300 / 1999 Coll., Decree No. 355 / 2000 Coll., Decree No. 367 / 2001 Coll., Decree No. 555 / 2002 Coll., Decree No. 490 / 2005 Coll., Decree No. 527 / 2006 Coll., Decree No. 317 / 2011 Coll., Decree No. 288 / 2012 Coll. and Decree No. 26 / 2014 Coll., is amended as follows:
1. Paragraph 52 shall be deleted, including the title.
2. Annex No 9 is deleted.
Transitional provision
The existing mandates for the exercise of state supervision over local communications and publicly available special purpose communications in the form of a licence issued in accordance with the model set out in Annex 9 to Decree No 104 / 1997 Coll., as effective before the date of entry into force of the Decree, shall remain valid until 31 December 2017 at the latest.
Amendment to the Decree implementing the Civil Aviation Act
Decree No. 108 / 1997 Coll., implementing Act No. 49 / 1997 Coll., on Civil Aviation, and amending and supplementing Act No. 455 / 1991 Coll., on Business Business (Trade Code Act), as amended, as amended, as amended, as amended by Decree No. 101 / 1999 Coll., Decree No. 244 / 2003 Coll., Decree No. 359 / 2006 Coll., Decree No. 410 / 2006 Coll., Decree No. 64 / 2010 Coll., Decree No. 314 / 2010 Coll. and Decree No. 4 / 2013 Coll., is amended as follows:
1. Article 29a shall be deleted, including the title.
2. Annex No 17 is deleted.
Amendment of the driving licence and register
Decree No. 31 / 2001 Coll., on driving licences and on the register of drivers, as amended by Decree No. 154 / 2003 Coll., Decree No. 177 / 2004 Coll., Decree No. 194 / 2006 Coll., Decree No. 27 / 2012 Coll., Decree No. 243 / 2012 Coll. and Decree No. 1 / 2014 Coll., are amended as follows:
1. Article 15c is deleted, including the title.
2. Annex No 9c is deleted;
Amendment of the Decree on state professional supervision and controls in road transport
Decree No. 522 / 2006 Coll., on state professional supervision and controls in road transport, as amended by Decree No. 39 / 2010 Coll. and Decree No. 269 / 2012 Coll., is amended as follows:
1. Paragraph 2 (3), including footnote 4, is deleted.
Paragraphs 4 and 5 shall be renumbered paragraphs 3 and 4.
2. In Paragraph 2 (4), the words "which have given an opinion on the concession of a domestic carrier 'are deleted.
EFFECTIVE
This Decree shall take effect on 1 February 2015.
