DECLARATION
of 10 March 2006
on closer conditions for the cultivation of the genetically modified variety
According to Section 2i (4) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 441 / 2005 Coll., ("the Act '):
§ 1
Preliminary provisions
(1) This decree (1) implements the relevant provisions of the European Community2) and regulates the detailed conditions for the cultivation of the genetically modified variety.
(2) This Decree was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and rules and of rules on information society services, as amended by Directive 98 / 48 / EC.
§ 2
Distances between parts of soil blocks in the cultivation of genetically modified varieties
[Paragraph 2i (1) and paragraph 2 (c) of the Act]
The distances established for a single crop between the part of the soil block on which a natural or legal person intends to grow or grow, where appropriate, a genetically modified variety (3), and the part of the soil block of another user, are set out in the Annex to this decree.
§ 2a
Minimum distance from the national border for the cultivation of the genetically modified variety
[K § 2i (2) (f) and § 4 (g) of the Act]
The minimum distance between the place of cultivation of the genetically modified variety and the national border of the Czech Republic (5) for a single crop is given in the annex to this decree.
§ 3
Time limit for the provision of information before the anticipated start of cultivation of the genetically modified variety
(Paragraph 2i (1) of the Act)
The time limit for the provision of information prior to the anticipated start of cultivation of the genetically modified variety (3) in the relevant calendar year on the part of the soil block, by a natural or legal person established for a single crop, is set out in the Annex hereto.
§ 4
Scope of information on the cultivation of the genetically modified variety
[Paragraph 2i (1) and paragraph 2 (d) of the Act]
(1) The data provided by the user of the part of the soil block located at the distance specified for each crop in Section 5 by the natural or legal person intending to grow in the relevant calendar year on the part of the soil block of the genetically modified variety (3) are:
(a) the name and, where applicable, the names and surname or business name, including the registered office or address of the place of permanent residence, if the notifier is a natural person;
(b) the name including the registered office and, where appropriate, the location of the branch in the Czech Republic, if the notifier is a legal person,
(c) the name of the crop;
(d) identification code of the relevant genetically modified organism4),
(e) the soil block part identification code on which the genetically modified variety will be grown;
(f) the estimated area on which the genetically modified variety will be grown;
(g) the estimated date of commencement of the cultivation of the genetically modified variety;
(h) information on whether or not sowing will be carried out, including its extent.
(2) The data provided to the State Agricultural Intervention Fund by a natural or legal person who grows a genetically modified variety in the relevant calendar year (3) on the part of the soil block are:
(a) the name and, where applicable, the names and surname or business name, including the registered office or address of the place of permanent residence, if the notifier is a natural person;
(b) the name including the registered office and, where appropriate, the location of the branch in the Czech Republic, if the notifier is a legal person,
(c) identification number, if assigned;
(d) the user registration number of the soil block part, according to the land register according to the user relations, if assigned;
(e) the name of the crop;
(f) identification code of the relevant genetically modified organism4),
(g) the identification code of the part of the soil block on which the genetically modified variety is grown;
(h) the area on which the genetically modified variety is grown;
(i) drawing the cultivation of the genetically modified variety on a map of the parts of the soil blocks, at a scale of 1: 10 000 or more in detail, where the area of the genetically modified variety does not correspond to the part of the soil block;
(j) the date on which the cultivation of the genetically modified variety begins,
(k) information as to whether the sowing has been carried out, including its extent.
(3) The information referred to in paragraph 2 may be submitted using a form issued by the State Agricultural Intervention Fund.
§ 5
Minimum cultivation distances of the genetically modified variety
[K § 2i (2) (a) and (b) of the Act]
Minimum cultivation distances of the genetically modified variety (3), in the relevant calendar year, by a natural or legal person from the place of cultivation of the variety of the same crop, which is not a genetically modified variety, or from the place of cultivation of the genetically modified variety of the same crop with a different identification code (4), as set out in the Annex to this decree.
§ 6
Scope of stored data on the cultivation of the genetically modified variety
[K § 2i (2) (e) of the Act]
Data on cultivation in the relevant calendar year of the genetically modified variety (3) on the part of the soil block held by a natural or legal person for a single crop shall be:
(a) the name of the crop;
(b) the name of the genetically modified variety;
(c) unique identifier of the relevant genetically modified organism (s) 4;
(d) the identification code of the part of the soil block on which the genetically modified variety is grown;
(e) the area on which the genetically modified variety is grown;
(f) drawing up the cultivation of a genetically modified variety on a map of soil block parts, on a scale of 1: 10 000 or on a more detailed scale, where the area of the genetically modified variety does not correspond to that of the soil block;
(g) the date on which the cultivation of the genetically modified variety begins;
(h) information on whether the sowing is carried out, including its extent;
(i) the date of purchase of seed or seed of a genetically modified variety, including details of the quantity purchased, and information enabling the seller to be identified;
(j) the quantity of genetically modified variety sown or planted;
(k) the date of harvest of the genetically modified variety and the quantity of the product harvested of the genetically modified variety;
(l) the place of storage of the genetically modified variety;
(m) the date of sale of the harvested product of the genetically modified variety, including details of the quantity sold, and details enabling the buyer to be identified;
(n) details of the use made of the product of a genetically modified variety not sold under (m).
§ 7
Scope of the cultivation of the genetically modified variety by the same crop not genetically modified
(Paragraph 2i (3) of the Act)
The extent of the cultivation of the genetically modified variety (3), grown in the relevant calendar year by a natural or legal person on the part of the soil block, by a variety of the same crop which is not genetically modified, set out for a single crop, is set out in the Annex to this decree.
§ 8
Transitional provision
In the calendar year 2006, the time limit for the provision of information before the anticipated start of the cultivation of the genetically modified variety referred to in Article 3 shall be 15 April 2006.
§ 9
Efficacy
This decree shall take effect on the day of its publication.

4) Article 3 (4) of Regulation (EC) No 1830 / 2003 of the European Parliament and of the Council of 22 September 2003 on the traceability and labelling of genetically modified organisms and the traceability of food and feed produced from genetically modified organisms and amending Directive 2001 / 18 / EC.
(5) Article 1 (1) of Directive (EU) 2015 / 412 of the European Parliament and of the Council of 11 March 2015 amending Directive 2001 / 18 / EC as regards the possibility for Member States to restrict or prohibit the cultivation of genetically modified organisms (GMOs) on their territory.
