DECLARATION
of 25 March 2025
amending Decree No 291 / 2003 Coll., on the prohibition of the administration of certain substances to animals whose products are intended for human consumption and on the monitoring (monitoring) of the presence of unauthorised substances, residues and contaminants for which animal products could be harmful to human health, in animals and in their products, as amended
The Ministry of Agriculture provides pursuant to § 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 246 / 2022 Coll. and Act No. 70 / 2025 Coll., for the implementation of § 19 (10) (b) of the Veterinary Act:
Čl. I
Decree No 291 / 2003 Coll., on the prohibition of the administration of certain substances to animals whose products are intended for human consumption and on the monitoring (monitoring) of the presence of unauthorised substances, residues and contaminants for which animal products could be harmful to human health, in animals and in their products, as amended by Decree No. 232 / 2005 Coll., Decree No. 375 / 2006 Coll., Decree No. 129 / 2009 Coll., Decree No. 51 / 2012 Coll. and Decree No. 22 / 2020 Coll., is amended as follows:
1. In footnote 1, the sentence "Council Directive 96 / 23 / EC of 29 April 1996 on measures to monitor certain substances and residues thereof in live animals and animal products and repealing Directives 85 / 358 / EEC and 86 / 469 / EEC and Decisions 89 / 187 / EEC and 91 / 664 / EEC 'is deleted.
2. in Article 1 (c):
"(c) requirements for a monitoring plan for the presence of certain substances and residues thereof in animals, animal products, feed and drinking water (hereinafter referred to as the" monitoring plan for certain substances and their residues ").";
3. In Article 1, point (d) is deleted.
4. In Article 2, at the end of point (i), the comma is replaced by a dot and points (j) to (l) are deleted, including footnote 3.
5. in Article 7 (2) (a) (2), the words "quantity (hereinafter referred to as the limits) 4)" shall be replaced by the words "quantity (4)."
footnote 4:
"(4) Regulation (EC) No 470 / 2009 of the European Parliament and of the Council of 6 May 2009 laying down Community procedures for the establishment of residue limits of pharmacologically active substances in foodstuffs of animal origin, repealing Council Regulation (EEC) No 2377 / 90 and amending Directive 2001 / 82 / EC of the European Parliament and of the Council and Regulation (EC) No 726 / 2004 of the European Parliament and of the Council."
6. In Article 9 (2) of the introductory part of the provision, the words "pursuant to Article 16 (1) 'are deleted.
7. in Article 9 (2) (e), the words "Annex 3 to this Regulation" shall be replaced by the words "Commission Delegated Regulation (EU) 2022 / 16448) and Commission Implementing Regulation (EU) 2022 / 16469";
footnotes 8 and 9 are as follows:
"(8) Commission Delegated Regulation (EU) 2022 / 1644 of 7 July 2022 supplementing Regulation (EU) 2017 / 625 of the European Parliament and of the Council with specific requirements for the official control of the use of pharmacologically active substances authorised as veterinary medicinal products or as feed additives and prohibited or unauthorised pharmacologically active substances and their residues, as amended.
9) Commission Implementing Regulation (EU) 2022 / 1646 of 23 September 2022 on uniform practical measures for the implementation of official controls on the use of pharmacologically active substances authorised as veterinary medicinal products or as feed additives and prohibited or unauthorised pharmacologically active substances and their residues, and on the specific content of multiannual national control plans and special measures for their preparation, as amended. ';
8. footnote 5 is deleted.
9. The heading above Section 13 is deleted.
10. Paragraph 13, including the title and footnote 10, reads as follows:
„§ 13
Monitoring plan for certain substances and residues
The monitoring plan for certain substances and their residues shall comply with the requirements laid down directly in the European Union10).
10) Commission Implementing Regulation (EU) 2022 / 1646. Commission Delegated Regulation (EU) No 2022 / 931 of 23 March 2022 supplementing Regulation (EU) 2017 / 625 of the European Parliament and of the Council by laying down rules for the implementation of official controls on contaminants in foodstuffs. Commission Implementing Regulation (EU) No 2022 / 932 of 9 June 2022 on uniform practical measures for the implementation of official controls on contaminants in foodstuffs, on the specific additional content of the multiannual national control plans and on specific additional measures for their preparation. Commission Delegated Regulation (EU) 2016 / 2244 of 7 October 2021 supplementing Regulation (EU) 2017 / 625 of the European Parliament and of the Council with specific rules on official controls as regards sampling procedures for the determination of pesticide residues in food and feed. Commission Implementing Regulation (EU) 2021 / 1355 of 12 August 2021 on multiannual national control programmes for pesticide residues to be established by the Member States. ';
11. Sections 14 to 17 are deleted, including the title above Article 16.
12. Annexes 1 to 3, including footnote 7, shall be deleted.

Efficacy
This Decree shall take effect on 15 April 2025.
