DECLARATION
of 9 March 2006
on the manner and extent of the requirement of data on fruit orchards managed under the intensive fruit scheme
The Ministry of Agriculture provides, pursuant to Article 4 (4) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll. and Act No. 441 / 2005 Coll., hereinafter referred to as "the Act ':
Subject matter
This decree sets out the manner and scope of the requirement for data on fruit orchards managed under the intensive fruit scheme from operators governed by the Act on State Statistical Services1 (hereinafter referred to as the "grower ') The Central Audit and Examination Institute (hereinafter referred to as the Institute).
Method and scope of data requirement by the Institute
(1) The Institute is entitled to require growers to provide details of the species of fruit plants listed in the Annex to this Decree in writing, in accordance with paragraphs 2 and 4, and, where appropriate, in a way that allows remote access with guaranteed electronic signatures.
(2) The Institute is entitled to require the grower to submit to it, by 31 May of the following calendar year, details of:
(a) its identity to the extent defined in § 2f (3) and (4) of the Act;
(b) the number of the soil block and, where appropriate, the part of the soil block,
(c) the registration number of the fruit set;
(d) the size of the fruit set;
(e) the species of fruit plants grown in a fruit set;
(f) variety, including rootstock, fruit plants grown in fruit orchard,
(g) the age of fruit trees grown in a fruit set;
(h) the number of fruit trees and the density of planting fruit trees grown in a fruit set;
(i) the nature of the fruit set,
(j) the use of irrigation in the fruit set;
(k) the inclusion of the fruit set in the integrated production scheme or, where appropriate, the integrated fruit cultivation system;
(l) the area of the fruit set which has been grubbed up;
(m) the area of the fruit set which has been newly planted.
(3) The information on the identity of the grower is obtained by the Institute from the records of the agricultural entrepreneur maintained under Section 2f of the Act, to the extent defined in Section 2f (3) and (4) of the Act.
(4) The Institute shall be entitled to require the grower to submit to it:
(a) on 15 June of the calendar year concerned, an estimate of the harvest of the fruit plant species listed in the Annex to this decree in that calendar year;
(b) on 1 September of the calendar year concerned, details of the further estimation of the harvest of fruit plant species referred to in points 4 and 5 of the Annex to this Decree in that calendar year;
(c) on 17 December of the calendar year concerned, details of the actual harvest of the fruit plant species listed in the Annex to this decree in that calendar year.
(5) The information referred to in paragraphs 2 and 4 and Article 3 may be submitted using a form issued by the Institute.
Transitional provision
(1) The information on the identity of the grower referred to in Article 2 (3) may be obtained by the Institute in the manner set out in that provision for the first time in 2007.
(2) Information on the identity of the grower referred to in Article 2 (2) (a) may be required by the Institute only in 2006.
Efficacy
This Decree shall take effect on 1 April 2006.
