DECLARATION
of 10 March 2006
amending Decree No. 447 / 2001 Coll., on the Mining Rescue Service
Pursuant to § 6 (6) (a) and § 7 (9) of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and on State Mining Administration, as amended by Act No. 542 / 1991 Coll.:
Čl. I
Decree No. 447 / 2001 Coll., on the Mining Rescue Service, is amended as follows:
1. in Article 2 (i), the words "and for this reason" shall be replaced by the words "and an environment with noise exceeding 100 dB and exposure to radiant heat above 250 ° C for these reasons."
2. In Article 6 (1) (m), the words "and gas laboratory analysts' are deleted.
3. In Article 6 (1), the comma at the end of point (n) is replaced by a dot and point (o) is deleted.
4. in Article 6 (2):
"(2) The main mining rescue station determines the fitting-out of the organization with indication and detection devices and self-rescue, breathing and reviving devices, including their accessories. '
5. In Article 8 (1) (c), the words "at the main mining rescue station 'shall be inserted after the word" services'.
6. in Section 8, the following paragraph 2 is added:
"(2) Immediately after the onset of the emergency, the racing mining rescue station shall inform the main mining rescue station of its composition. '
Paragraph 2 shall become paragraph 3.
7. in Article 10 (1) (b):
"(b) premises and equipment for checking, disinfecting, testing and repairing self-rescue, breathing and reviving appliances and their accessories;"
8. In Paragraph 10 (1), the dot at the end of point (l) is replaced by a comma and the following point (m) is added:
"(m) premises and facilities for maintaining and improving the fitness of mining rescue workers."
9. Paragraph 10 (2) reads as follows:
"(2) In addition to the equipment referred to in paragraph 1, the main mining rescue station, which is intended to carry out its tasks in deep-sea mines, shall also consist of a resuscitation ambulance and a heat chamber. ';
10. in Paragraph 11 (a) (1), "30" is replaced by "20."
11. in Article 11 (b):
"(b) premises and equipment for checking, disinfection, testing and repair of respiratory and reviving devices,"
12. in Article 11 (e) and (f), the words "at the coal mine" shall be deleted;
13. in Paragraph 12 (1), the first sentence, including footnote 10, shall be deleted;
14. In Paragraph 18 (6), the last part of the sentence after the semicolon, including the semicolon, shall be deleted.
15. in Paragraph 18 (7), "18" is replaced by "12."
16. In Article 19, the sentence "The verification of competence shall be carried out in accordance with the specific legislation 3a) shall be added at the end of paragraph 1. '
footnote 3a is replaced by the following:
"(3a) Decree No. 298 / 2005 Coll., on requirements for professional qualifications and competence in mining or mining activities and amending certain legislation."
17. In Paragraph 21, at the end of paragraph 1, the sentence "The verification of competence shall be carried out in accordance with special legislation3a) 'is added.
18. In Paragraph 25, the words "This test shall be repeated every 3 years' shall be added at the end of the text of paragraphs 2 and 3.
19. Paragraph 31 (1) reads as follows:
"(1) The activity of mining rescue workers in the rescue operation is organised and managed by the Chief of the Mining Rescue Corps. This function shall be performed by the head of the race mining rescue station of the organisation or part thereof affected by the accident or by its representative, unless otherwise specified by the director of the main mining rescue station. In the event that the main mining rescue station is simultaneously affected by mining rescue stations during the rescue operation, the director of the main mining rescue station, or his representative, or his designated technician, shall take over the management and organisation of the operation. On the exit to emergency intervention of emergency units of a racing mining rescue station with a permanent emergency without the participation of the main mining rescue station units, it shall take over the management and organisation of the activity of a leading racing mining rescue station with a permanent emergency or its representative. ';
20. Paragraph 44 (2) reads:
"(2) When intervening under difficult microclimatic conditions, the sergeant monitors the ambient temperature at intervals of no longer than 10 minutes. If the temperature at the workplace rises by more than 3 ° C in 10 minutes, the platoon returns to the base; that doesn't apply to the trip to the workplace. At the same intervals, the sergeant instructs the platoon members to deduct the heart rate. If the heart rate exceeds 160 beats per minute for a member of the platoon, the platoon will return to the base."
21. in Paragraph 45, the following paragraph 7 is added:
"(7) The impact of climbers shall not be performed during storms, heavy rain, snow or temperatures below minus 10 ° C and exposure to radiant heat. ';
22. In Paragraph 47 (1), the sentence behind the semicolon is replaced by the sentence "after completion of the planned non-emergency intervention, the commander of the Mining Rescue Corps shall carry out his written evaluation."
23. in Annex 1 (I) (a) (3):
'3. in the event that a replacement of the absorber is necessary for the continued use of oxygen breathing apparatus within a protective period, the relevant reserve absorber which is left on the base, ';
24. in Annex No 1 (II) (a):
"(a) for each member of the platoon:
1. breathing apparatus with mask,
2. a spare bottle of the same type as in the breathing apparatus, which is left on the base, '.

This Decree shall take effect on 1 April 2006.
