GOVERNMENT REGULATION
of 22 March 2010
amending Government Regulation No 112 / 2008 Coll., laying down certain conditions for granting national additional payments to direct aid, as amended by Government Regulation No 480 / 2009 Coll.
The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll.:
Government Regulation No 112 / 2008 Coll., laying down certain conditions for granting national additional payments to direct aid, as amended by Government Regulation No 480 / 2009 Coll., is amended as follows:
1. footnote 1 shall read:
"(1) Council Regulation (EC) No 73 / 2009 of 19 January 2009 establishing common rules for direct support schemes under the common agricultural policy and establishing certain support schemes for farmers, amending Regulations (EC) No 1290 / 2005, (EC) No 247 / 2006, (EC) No 378 / 2007 and repealing Regulation (EC) No 1782 / 2003, as amended. Commission Regulation (EC) No 1120 / 2009 of 29 October 2009 laying down detailed rules for the implementation of the single payment scheme provided for in Title III of Council Regulation (EC) No 73 / 2009 establishing common rules for direct support schemes under the common agricultural policy and establishing certain support schemes for farmers. Commission Regulation (EC) No 1121 / 2009 of 29 October 2009 laying down detailed rules for the application of Council Regulation (EC) No 73 / 2009 as regards the support schemes for farmers provided for in Titles IV and V of that Regulation. Commission Regulation (EC) No 1122 / 2009 of 30 November 2009 laying down detailed rules for the implementation of Council Regulation (EC) No 73 / 2009 as regards cross-compliance, modulation and an integrated administration and control system under the direct support schemes for farmers provided for in that Regulation and Council Regulation (EC) No 1234 / 2007 as regards cross-compliance under the direct support scheme for the wine sector. ';
2. in Article 2 (1), points (a) and (b) are deleted;
Points (c) to (h) shall be renumbered as points (a) to (f).
(3) Sections 3 and 4 shall be deleted, including the headings and footnotes 3 and 4.
4. in Article 5 (1) (a), the words "use of land according to user relations (hereinafter referred to as") "shall be inserted after the word" registration. "
5. footnote 5 shall read:
"(5) Article 124 (1) of Council Regulation (EC) No 73 / 2009, as amended."
6. footnote 8 is deleted, including the references to this footnote.
7. In Article 7 (1), the reference to footnote 9 is inserted after the words "keeping sheep '.
8. footnote 9 reads as follows:
"(9) Article 100 of Council Regulation (EC) No 73 / 2009, as amended."
(9) footnote 10 shall read:
"(10) Article 109 (d) of Council Regulation (EC) No 73 / 2009, as amended. ';
10. Footnote 11 reads as follows:
"(11) Article 59 and Annex IV to Commission Regulation (EC) No 1121 / 2009."
11. in Article 8, the following paragraph 5 is added:
"(5) The Fund shall not grant to the applicant a payment for suckler cow cows per cow for which a payment for cows kept in a dairy market system 20 is required in the same calendar year).
20) Government Decree No 87 / 2010 Coll., laying down certain conditions for granting payment to cows kept in a system with market milk production. '
12. In Paragraph 11, "2 'is replaced by" 5'.
13. footnote 13 reads as follows:
"13) Article 132 of Council Regulation (EC) No 73 / 2009, as amended. ';
14. in Article 12 (2), the words "3, 4 and" shall be deleted;
15. in Article 12 (3) to (5), the words "3 to" shall be deleted;
16. In Paragraph 12, "30% 'is replaced by" 20%'.

"15) Article 75 of Commission Regulation (EC) No 1122 / 2009."
18. in Paragraph 13 (1):
"(1) The Fund shall act in accordance with Commission Regulation (EC) No 1122 / 2009 of 30 November 2009 laying down detailed rules for the implementation of Council Regulation (EC) No 73 / 2009 as regards cross-compliance, modulation and the integrated and control system under direct support schemes for farmers referred to in the Regulation and Council Regulation (EC) No 1234 / 2007 as regards cross-compliance under the direct support scheme for the wine sector and under this Regulation. ';
19. footnote 16 is deleted.
Transitional provision
Legal relations arising under Government Decree No. 112 / 2008 Coll., as amended, before the date of entry into force of this Regulation shall be assessed according to existing legislation.
Efficacy
This Regulation shall enter into force on 1 April 2010.
