DECLARATION
of 20 March 2025
on the categorisation of malicious calls or other malicious communications made
The Ministry of the Interior, in cooperation with the Ministry of Health, provides pursuant to Section 150 (8) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Act on Electronic Communications), as amended by Act No. 202 / 2023 Coll., ("the Act ') for the implementation of Section 33 (19) of the Act:
Category of malicious communication
For the purposes of this decree, categories of malicious communication shall be defined.
(a) category 1,
(b) category 2,
(c) category 3,
(d) category 4.
Category 1
(1) Category 1 includes malicious communications that are conducted with a frequency of at least 6 malicious calls or other malicious communications in less than 168 hours.
(2) If a malicious communication is categorised as Category 1, the emergency communication centre shall temporarily refuse communication via telecommunications terminal equipment or an identification card (SIM card) for 24 hours.
Category 2
(1) Category 2 includes any other malicious communication that is conducted after a prior temporary refusal of communication pursuant to Paragraph 2 (2), which has begun in the last 60 calendar days.
(2) If a malicious communication is categorised as Category 2, the emergency communication centre temporarily rejects communications via telecommunications terminal equipment or an identification card (SIM card) for 72 hours.
Category 3
(1) Category 3 includes any other malicious communication that is conducted after a prior temporary refusal of communication pursuant to Section 3 (2), which has begun in the last 60 calendar days.
(2) If a malicious communication is categorised as Category 3, the emergency communication centre temporarily rejects communication via telecommunications terminal equipment or an identification card (SIM card) for 168 hours.
Category 4
(1) Category 4 includes any other malicious communication which is conducted after a prior temporary refusal of communication pursuant to Paragraph 4 (2), which has begun in the last 60 calendar days.
(2) If a malicious communication is categorised as Category 4, the Emergency Communication Centre temporarily rejects communications via telecommunications terminal equipment or an identification card (SIM card) for 168 hours, and the entity operating the Emergency Communication Centre requests the blocking of an IDC (SIM card) or the exclusion of access of telecommunications terminal equipment to a public communications network pursuant to Section 33 (10) of the Act.
Efficacy
This Decree shall take effect on 1 July 2025.
