THE LAW

amending Act No. 505 / 1990 Coll., on Metrology, as amended
Parliament has decided on this law of the Czech Republic:
Čl. I
Act No. 505 / 1990 Coll., on Metrology, as amended by Act No. 119 / 2000 Coll., Act No. 13 / 2002 Coll., Act No. 137 / 2002 Coll., Act No. 226 / 2003 Coll., Act No. 444 / 2005 Coll., Act No. 481 / 2008 Coll., Act No. 223 / 2009 Coll., Act No. 155 / 2010 Coll. and Act No. 18 / 2012 Coll., is amended as follows:

„§ 4
The Authority may, at the request of the user of a specified gauge, exempt a specified specific designation gauge from the type-approval and verification requirement for a specified period. ';
2. In Article 6 (2), the third sentence is replaced by the following: "This requirement is deemed to be met if the gauge has the required metrological and technical characteristics laid down by a measure of a general nature. Measures of a general nature, in addition to the required metrological and technical characteristics of a specified gauge, shall also determine the type-approval tests. ';
3. In Section 8, the words "or certified by an accredited manufacturer of certified reference material 'shall be added at the end of the text of paragraph 1.
4. In Paragraph 9 (1), the second sentence is replaced by the following: "This requirement is deemed to be met if the gauge has the required metrological characteristics laid down by a measure of a general nature. Measures of a general nature, in addition to the required metrological characteristics of a specified gauge, shall also be determined by the verification tests. ';
5. In Article 9, paragraphs 8 to 10 are added:
"(8) For selected types of specified meters, the validity of the verification is extended based on the positive result of the statistical selection test. The Ministry shall determine by decree the types of measuring instruments whose validity of the verification is extended on the basis of the positive result of the statistical selection test and the period by which the validity of the verification is extended for each of the selected types of measuring instruments.
(9) Statistical selection tests shall be carried out for the purpose of extending the validity of the verification by the Czech Metrology Institute according to general measures which determine the procedures and conditions of the tests and the criteria of their positive result for each selected type of measuring instrument. The application for a statistical selection test may be submitted not earlier than 2 years and not later than 1 year before the expiry of the previous verification of the specified gauge.
(10) The applicant for the renewal of the verification shall be required to inform the persons concerned by the measurement, within 3 months of the date of issue of the renewal report. ';
6. In Article 10 (1), the words "initial verification, for other measuring instruments their initial calibration 'are replaced by the words" verification'.
7. In Section 10, the words "if not an accredited manufacturer 'shall be added at the end of the text of paragraph 1.
8. In Section 10 (2), the words "initial calibration of imported etalones and work meters' are deleted.
9. Paragraph 11 (4) reads as follows:
"(4) The Czech Metrology Institute, for the purposes of the verification of a specified measuring instrument whose type approval certificate has expired, may permit its design change if this design change replaces a defective or worn part of a part different from that of the original part, but functionally identical to it, and does not affect
(a) the function of the designated gauge;
(b) the technical characteristics of the measured gauge applicable to the type approval; and
(c) the metrological characteristics of the measured gauge applicable to the type-approval. ';
10. The following Section 11a is inserted after Section 11:
„§ 11a
(1) At the request of the person who may be affected by his improper measurement, the user of the specified measuring instrument is required to request a check of the specified measuring instrument.
(2) The Czech Metrology Institute and bodies authorised under this Act to verify the type of measuring instruments specified and to issue a certificate annexed to the test report. The requirements of the certificate of examination and those of the test report shall be laid down by the Ministry by decree.
(3) The measured gauge shall be considered satisfactory if it has the metrological characteristics laid down in a general measure when tested. Measures of a general nature, in addition to the required metrological characteristics of a specified gauge, shall also determine the examination tests if they are different from the verification tests.
(4) The costs of checking a specified meter shall be borne by:
(a) the applicant for the examination where the specified gauge is found to be satisfactory at the time of the examination;
(b) the user of the specified gauge, where the specified gauge is found to be non-compliant at the time of the check. ';
11. in Paragraph 13 (1) (c), the words "State metrological inspection of measuring instruments" are replaced by the words "verification of specified measuring instruments, certification of reference materials."
12. in Article 14 (1) (c):
"(c) approve the types of measuring instruments and verify the measuring instruments specified, ';
13. in Paragraph 14 (1) (g), the words "goods and bottles" shall be replaced by the words "goods marked with the symbol" e "and" bottles marked with the symbol "3."
14. in Article 14 (1) (j):
"(j) issues measures of a general nature pursuant to Articles 6 (2), 9 (1), 9 (9) and 11a (3),"
15. In Paragraph 14, at the end of paragraph 1, the dot is replaced by a comma and the following points (l) and (m) are added:
"(l) carry out the statistical selection tests referred to in Article 9 (9);
(m) carry out checks on specified gauges in accordance with § 11a. ';
16. in Paragraph 14 (2):
"(2) The Czech Metrology Institute may authorise:
(a) a design change of a specified gauge under the conditions laid down in Article 11 (4);
(b) the short-term use of the specified measuring instrument between the end of the repair or installation and the verification with the restriction of that period. ';
17. in Article 23 (1) (c), the words "or calibration" shall be deleted;
18. In Article 23, at the end of paragraph 1, the dot is replaced by a semicolon and the following points (i) and (j) are added:
"(i) as an applicant for renewal of the verification, has not identified the persons concerned by the measurement with an extension of the validity of the verification pursuant to Article 9 (10);
(j) make a design change to a specified measuring instrument without authorisation in accordance with Article 11 (4). ';
19. The heading above § 24c is deleted.
20. § 24c is deleted.
21. In Paragraph 25 of the title reads:
"Time limits for the type-approval of measuring instruments, verification of specified measuring instruments and certification of reference materials'.
22. in § 27, the words "§ 7 (3), § 8 (2) and (5), § 9 (1) to (3), § 9a (2) to (4), § 12 (3)" shall be replaced by "§ 8 (2) and (5), § 9 (1), (2) and (8), § 9a (2), (5) and (6), § 11a (2), § 12 (2),";

Efficacy
This Act shall enter into force on 1 April 2015.
