DECLARATION
of 6 March 2006
amending Decree No. 124 / 2001 of the Ministry of Agriculture Coll., laying down the requirements for sampling and the principles of methods of analysis of feed, feed additives and premixtures and the method of storage of samples, as amended by Decree No. 497 / 2004 Coll.
The Ministry of Agriculture provides pursuant to § 17 (8) of Act No. 91 / 1996 Coll., on Feed, as amended by Act No. 244 / 2000 Coll.:
Decree No. 124 / 2001 Coll., laying down the sampling requirements and principles of methods of analysis of feed, feed additives and premixtures and the method of storage of samples, as amended by Decree No. 497 / 2004 Coll., is amended as follows:
1. In footnote 1a, the following is added at the end of the text:
"Commission Directive 2005 / 6 / EC of 26 January 2005 amending Directive 71 / 250 / EEC as regards the indication and interpretation of the results of analyses pursuant to Directive 2002 / 32 / EC.
Commission Directive 2005 / 7 / EC of 27 January 2005 amending Directive 2002 / 70 / EC laying down requirements for the determination of the levels of dioxins and dioxin-like PCBs in feedingstuffs. '
2. In Article 1 (3), the words "and pesticide residues' shall be inserted after the words" determination of the presence of micro-organisms'.
3. Paragraph 7 (3), including footnote 6, reads:
"(3) Where the principle of the method for testing the character is not set out in Annexes 9 to 14, the method set out in the Bulletin of the Central Control and Examination Institute of the Agricultural Institute (hereinafter referred to as" Bulletin ') shall be applied, the National Reference Laboratory series Part 3 and, if not, another appropriate method corresponding to the level of scientific and technical knowledge achieved shall be used. The general characteristics to be met by testing methods are defined by the directly applicable regulation of the European Community6).
6) Annex III to Regulation (EC) No 882 / 2004 of the European Parliament and of the Council of 29 April 2004 on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules. '.
4. In Paragraph 11, the sentence "For the expression of the analytical result, measurement uncertainty shall be given as the parameter associated to the measurement result."
5. The following Section 11a is inserted after Section 11:
(1) Measurement uncertainty is a parameter associated to the measurement result that characterises the dispersion of values that can reasonably be attributed to the measured value. For test results, the expanded measurement uncertainty calculated using an extension coefficient equal to 2 shall be reported, corresponding to a confidence level of at least 95%.
(2) Recovery is the efficiency of separation of the determined substance from a complex matrix. The determination of recovery may be carried out either by analysis of a certified reference material with a known content of the specified substance or by a known addition of the specified substance to the matrix blank sample and by re-determination of its content.
(3) As regards undesirable substances, including dioxins and dioxin-like PCBs, the product intended for animal feeding shall be considered as not complying with the maximum specified content if, taking into account the expanded measurement uncertainty and recovery correction, the analytical result exceeds the maximum content. For the assessment of compliance, the analysed recovery corrected concentration and the subtracted expanded measurement uncertainty shall be used. This procedure cannot be used for microscopic analysis. The analytical result, if the analytical method used makes it possible to estimate measurement uncertainty and recovery ratio, shall be reported.
(a) as corrected or uncorrected for recovery, the method of detection and its value must be indicated;
(b) in the form of "x ± U," where x is the result of the analysis and U is the expanded measurement uncertainty, using a coverage factor of 2 which corresponds to a confidence level of at least 95%. "
6. In Annex 7, point 1.2, the sentence "A rotary divider may be used to divide the final sample is inserted after the third sentence. '
7. Annex No 15 is deleted.
8. In Annex No 16, point 8, the second sentence is replaced by the following: "The procedures set out in the Bulletin, National Reference Laboratory series, Part 3, are used for testing."
9. Annex No 17 is deleted.
10. In Annex No 18, Part 1, points 1 and 2 read:
"1. Purpose and scope
Samples intended for official control of the levels of dioxins (PCDD / Fs) as well as for the determination of the levels of dioxin-like PCBs (Table of dioxin-like PCBs) in feedingstuffs shall be taken in accordance with Sections 1 to 6 of this Decree. Quantitative requirements concerning the control of substances or products contained evenly in feedingstuffs in accordance with Sections 1 to 6 of this Decree shall apply. The aggregate samples thus obtained shall be considered representative of the sampled lots or sublots from which they are collected. Compliance with the maximum levels laid down in Annex 3 to Decree No. 451 / 2000 Coll. is assessed on the basis of the contents set out in the laboratory samples.
2. Compliance of the lot or sublot with the specification
The lot shall be accepted if the result of a single analysis does not exceed the relevant maximum content set out in Annex 3 to Decree No 451 / 2000 Coll. taking into account the measurement uncertainty. The lot does not meet the maximum content set out in Annex 3 to Decree No. 451 / 2000 Coll., if the result of the analysis confirmed by the second analysis and calculated as an average of at least two independent determinations, taking into account measurement uncertainty, exceeds the maximum content.
The measurement uncertainty may be taken into account in one of the following ways:
- by calculating the expanded uncertainty by applying a coverage factor of 2 which corresponds to a confidence level of at least 95%, or
- establishing a decision limit (CCα) in accordance with Commission Decision 2002 / 657 / EC (point 3.1.2.5 of the Annex for substances for which a permissible value has been established).
These rules shall apply to the result of the analysis obtained from the sample for official control.

11. In Annex 18, Part 3 is added, including the title:
Background
For the purposes of this decree only, the specific limit of quantification of the individual congener is the concentration of the analyte in the sample extract, which produces an instrumental response to two different ions to be monitored in the signal ratio - Noise 3: 1 for less sensitive signals and, if essential requirements such as retention time, the isotope ratio according to the determination procedure described in the EPA method 1613 revision B. '.
Efficacy
This Decree shall take effect on 1 April 2006.
