of 19 April 1995
amending and supplementing Act No 287 / 1993 Coll., on the competence of the State Nuclear Safety Authority, and the related measures
Parliament has decided on this law of the Czech Republic:
Act No 287 / 1993 Coll., on the competence of the State Office for Nuclear Safety, is amended as follows:
1. In Paragraph 1 (1), the following words are added at the end of the sentence: "and for the field of protection against ionising radiation '.
2. in Paragraph 2 (a), the words "nuclear installations" are deleted.
3. In Article 2 (c), the dot at the end of the sentence is replaced by a comma and the following points (d), (e) and (f) are added:
"(d) the exercise of State control over selected materials, equipment and technology used in the nuclear field, as well as dual-use materials and devices, 3)
(e) the exercise of state supervision in the field of protection against ionising radiation;
(f) coordination of the activities of the radiation monitoring network on the territory of the Czech Republic and the provision of international data exchange on the radiation situation.
3) Decree No. 50 / 1992 Coll., implementing Act No. 547 / 1990 Coll., on the Treatment and Control of Certain Goods and Technologies, as amended by Decree No. 505 / 1992 Coll., Decree No. 22 / 1994 Coll. and Decree No. 234 / 1994 Coll. '.
(1) Anyone using selected sources of ionising radiation (hereinafter referred to as "selected sources") or putting radioactive substances into the environment, or otherwise being able to expose persons to ionising radiation, is obliged to take organisational and technical measures to protect human health and the environment, in particular not to irradiate anyone without cause and beyond the limits set.
(2) Selected resources may be produced, imported, operated and otherwise handled only to the extent of the authorisation issued by the Authority.
(3) Legal persons who produce, import or operate selected resources or dispose of such resources must have a responsible representative who has passed a test of the knowledge of protection against ionising radiation before and has been authorised to do so by the Office.
(4) Natural persons who produce, import or operate selected resources or dispose of such resources shall comply with the special eligibility requirements referred to in paragraph 3 or shall have a responsible representative.
(5) The persons referred to in paragraphs 3 and 4 are required to keep records of the doses of the persons exposed and of the sources selected.
(6) Construction materials shall not contain more radionuclides than those provided for in specific legislation.1) The manufacturer or importer shall be responsible for compliance with this requirement. The internal air of buildings shall not exceed the specific legislation1) the specified presence of radon and its subsidiaries.
(7) A person who does not comply with the obligations laid down in paragraphs 1 to 5 may withdraw the authorisation issued or suspend or limit it to a maximum of one year from the infringement of the obligation to dispose of the resources selected.
(8) For the implementation of the provisions of paragraphs 1 to 6, the Authority will issue legislation setting limits on exposure, selected sources, limits on radionuclides in building materials, limits on the presence of radon and its subsidiaries in buildings and on the extent of the structures to which they apply and the extent of the knowledge test.
(1) The scope and competence of the Ministry of Health, the main hygienist of the Czech Republic and the regional hygienists in the protection of health from ionizing radiation are transferred to the Office. The Authority shall finalise the proceedings in respect of the enforcement of the state administration in the field of the protection against ionising radiation, which was not completed by the Ministry of Health and the sanitary services at the date of application of this Act. In facilities falling within the competence of the Ministry of Defence and the Ministry of Interior, the authorities of these ministries, in cooperation with the Office, shall carry out tasks in the field of protection against ionising radiation.
(2) The rights and obligations of employment and other relationships are transferred, to the extent provided for in Article I (3) (e) of this Act, from the Ministry of Health and the relevant health organisations to the Office.
This Act shall take effect on 1 July 1995.
