GOVERNMENT REGULATION
of 27 March 2013
on requirements for unambiguous marking of explosives for civil use
The Government hereby orders pursuant to § 1 (4) and § 2 (6) of Act No. 83 / 2013 Coll., on the Labelling and Traceability of Explosives for Civil Use ("the Act '):
§ 1
Subject matter
This Regulation implements the relevant provisions of the European Union1) and provides for:
(a) requirements for the unambiguous marking of explosives;
(b) a list of explosives to which the requirements for unambiguous labelling and traceability laid down by law do not apply.
§ 2
General provisions on unambiguous labelling
(1) The unique marking shall be made directly on or permanently attached to the explosive. If the explosive is equipped with a passive electronic identifier in addition to the unambiguous marking, each of its smallest packages shall bear the corresponding passive electronic identifier.
(2) If an explosive operator also identifies an explosive with a self-adhesive removable sticker, which is a copy of the original unambiguous label and which the customer can use, it is necessary that the self-adhesive removable sticker is visibly marked as a copy.
§ 3
Method of unambiguous labelling
The unambiguous marking of the explosive shall be carried out by:
(a) explosives in the form of stickers shall be labelled or printed directly on the label; Each smallest package containing labels must be similarly marked,
(b) the explosive in bags shall be labelled or printed directly on the bag;
(c) the packaged two-component and multi-component explosives shall be labelled or printed directly on each of the smallest packages containing the components;
(d) the ignition detonator shall be marked with a label or direct print, or the unambiguous marking shall be placed directly on the detonator cavity; Each smallest package containing spark-ignition detonators must be similarly marked,
(e) the electrical, non-electric and electronic detonators shall be labelled on the supply wires or on the detonation tube, or on the label, direct print or embossing directly on the detonator cavity; Each smallest package containing detonators must be similarly marked,
(f) the carrying amount shall be marked with a label or a direct print on the carrying amount; Similarly, each smallest package containing charge must be marked,
(g) the lightning rod shall be marked with a label or direct print on the coil, the unambiguous marking being marked on each 5 metres of lightning rod, either on its outer packaging or on the inner plastic layer immediately below the outer shell of the lightning rod; Each smallest package containing flashbulbs must be marked by similar means,
(h) explosives packed in containers shall be labelled or printed directly on the container containing the explosive.
§ 4
Unique indication
(1) The unique label consists of:
(a) a visually legible part of the marking containing the following particulars:
1. the name, business name or manufacturer's designation; and
2. alphabetical code containing:
2.1. A total of 2 letters identifying the Member State of the European Union (place of manufacture of explosives or of import into the European Union market),
2.2. A three-digit code identifying the place of manufacture of explosives assigned under Section 3 of the Act; and
2.3. the product code allocated by the manufacturer and the manufacturer's logistical information; and
(b) electronically readable information in the form of a barcode or matrix code which directly corresponds to the alphabetical code referred to in (a) (2).
(2) Examples of the graphic representation of the unique marking referred to in paragraph 1 using the matrix or barcode are given in Annex 1 to this Regulation.
§ 5
Method of marking very small objects
(1) Articles which are too small to also bear the particulars referred to in § 4 (1) (a) (2) (2.3) shall bear the particulars referred to in § 4 (1) (a) (2) (2.1) and (2.2) and § 4 (1) (b).
(2) For articles which are too small to connect the data referred to in Article 4 (1) (a) (2) (2.1) and (2.2) and Article 4 (1) (b), the unambiguous marking shall be affixed to the smallest packaging concerned; each smallest package shall be sealed with a safety-belt or sealed in a similar manner.
(3) Any spark-ignition detonator and device subject to the derogation provided for in paragraph 2 must be permanently provided with the data referred to in § 4 (1) (a) (2) (2.1) and 2.2., in such a way that the data are clearly legible; the number of positive-ignition detonators and emptying charges shall be indicated on the smallest package concerned.
(4) Any lightning rod to which the exemption provided for in paragraph 2 applies shall be clearly marked on the respective coil and, where possible, on the smallest packaging.
§ 6
Explosives not covered by the law
Explosives to which the requirements for unambiguous labelling and traceability laid down by law do not apply are set out in Annex 2 to this Regulation.
§ 7
Efficacy
This Regulation shall enter into force on the day of its publication.

List of explosives pursuant to Article 6 of the Government Decree
I. Explosives transported and delivered without packaging or in service vehicles for their direct loading into a corkscrew,
II. Explosives manufactured at the point of discharge which are directly charged after their manufacture;
III. Non-detonating initiators in the form of a string,
IV. Products consisting of a soul of fine-grained black powder wrapped in flexible textile fibre, having one or more outer protective covers which, after initiation, burn at a pre-determined steady speed without any external explosive effect (matchbook),
V. products consisting of a metal or plastic cup containing a small amount of explosive material or a explosive compound which is easily initiated by impact, which serves as a spark-ignition agent in rounds for hand guns and in drive-fillers (cup matches).
