amending Act No. 94 / 1963 Coll., on Family, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 94 / 1963 Coll., on Family, as amended by Act No. 132 / 1982 Coll., Act No. 234 / 1992 Coll., Act No. 72 / 1995 Coll., Act No. 91 / 1998 Coll., Act No. 360 / 1999 Coll., Act No. 301 / 2000 Coll., Act No. 109 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 321 / 2002 Coll., Act No. 315 / 2004 Coll., Act No. 342 / 2005 Coll., Act No. 112 / 2006 Coll., Act No. 115 / 2006 Coll., Act No. 134 / 2006 Coll., Act No. 227 / 2006 Coll., Act No. 342 / 2006 Coll., Act No. 259., Act No. 259 / 2008 Coll., Act No. 244 / 2010 Coll., is amended as follows:
1. In Paragraph 36, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) If paternity is denied, the legal acts of a father as legal representative shall remain unaffected. '
2. Paragraph 57 (1) reads as follows:
"(1) Within six months of having reasonable doubts that he is the father of the child, the husband may deny paternity in court. He may, however, deny paternity within three years of the birth of the child. '
3. In Paragraph 59 (2), the words "Mother too 'are replaced by the words" Mother'.

(1) If the child's interest so requires, the Attorney General shall submit a motion to deny paternity to the father, mother and child if the period laid down for denying paternity to one of the parents has expired.
(2) If, in view of all the circumstances, it is clear that a man considered to be the father of a child is not the father and if the period laid down for denying paternity to a parent has expired, the Attorney General shall submit a motion to deny paternity unless the child's interest exceptionally requires that the denial of paternity should not occur.
(3) The Attorney General denies paternity towards the father, mother and child; If one of them is not alive, he denies fatherhood of others. If none of them are alive, he denies the paternity of the guardian appointed by the court for the case. '
Transitional provision
The denial of paternity proceedings initiated before the date of entry into force of this Act shall be completed in accordance with Article 57 (1) of Act No. 94 / 1963 Coll., as effective from the date of entry into force of this Act.
Efficacy
This Act shall take effect on the day of its publication.
