THE LAW
of 23 February 1993
amending and supplementing the Act of the Czech National Council No. 482 / 1991 Coll., on Social Needs, and certain follow-up laws
Parliament has decided on this law of the Czech Republic:
Act of the Czech National Council No. 114 / 1988 Coll., on the jurisdiction of the Czech Socialist Republic bodies in social security, as amended by the Czech National Council Act No. 125 / 1990 Coll., the Czech National Council Act No. 210 / 1990 Coll., the Czech National Council Act No. 425 / 1990 Coll., the Czech National Council Act No. 459 / 1990 Coll., the Czech National Council Act No. 9 / 1991 Coll., the Czech National Council Act No. 144 / 1991 Coll. and the Czech National Council Act No. 582 / 1991 Coll., is added as follows:
1. In Paragraph 2, the following paragraphs 2 and 3 are inserted after paragraph 1:
"(2) The Ministry may allow exemptions from the provisions of § 103 (1) of Act No. 100 / 1988 Coll., on Social Security, in respect of social services.
(3) The Minister for Labour and Social Affairs may remove the hardness that would arise when carrying out social care. "
2. in Article 15 (2) (a), the following point 3 is inserted after point 2:
"3. on the provision of benefits in kind or in cash, or social care services, pursuant to § 8a (3) of the Czech National Council Act No. 482 / 1991 Coll., on social needs, as amended by Act No. 84 / 1993 Coll."
3. in Article 54 (1), the following point (f) is added after point (e):
"(f) the provision of benefits in kind or in cash, or social services, as provided for in Article 15 (2) (a) (3)."
4. in Article 56 (2), the following point (c) is inserted after point (b):
"(c) the place of the municipality or district office in whose district the citizen resides, if the aid is granted under § 8a (1) and (3) of the Czech National Council Act No. 482 / 1991 Coll., as amended by Act No. 84 / 1993 Coll."
Increase in pensions that are the only source of income
(1) The boundaries of pensions, which are the only source of income, are according to § 54 (1) and § 68 (1) of Act No. 100 / 1988 Coll., on Social Security, as amended by Act No. 306 / 1991 Coll., on Changes in Social Security, 1840 CZK per month and under § 54 (2) and § 68 (2) of the Act No. 3060 CZK per month.
(2) Pensions paid on 28 February 1993, adjusted as a single source of income, will be increased without application from the payment of the pension due after that date.
(3) The pensions of old-age, disabled, widower, widower and orphan orphan children who have not yet been adjusted as a single source of income and which do not fall within the scope of paragraph 1 above shall be adjusted at the request at the earliest from the payment of the pension due after 28 February 1993.
(4) The pension adjustment under the previous paragraphs is based on the amount of pensions after the increase according to the Czech National Council Act No. 547 / 1992 Coll., on the increase of pensions in 1993.
Transitional provision
Exemptions granted pursuant to Article 103 (4) of Act No. 100 / 1988 Coll., on Social Security, and decisions on the provision of welfare benefits on the basis thereof, will cease to apply on 1 May 1993.
Repeal
Paragraph 103 (4) of Act No. 100 / 1988 Coll., on Social Security, in respect of welfare benefits and services, is hereby repealed.
The President of the Chamber of Deputies of Parliament is hereby authorised to declare in the Collection of Laws the full version of the Act of the Czech National Council No. 482 / 1991 Coll., on social needs, as is apparent from the amendments and additions made by this Act.
This Law shall take effect on 1 March 1993.
