DECLARATION
of 19 February 2021
amending Decree No. 22 / 2013 Coll., on education in the section on the protection of animals against abuse, as amended
The Ministry of Agriculture provides, pursuant to Article 29 (1) of Act No. 246 / 1992 Coll., for the protection of animals against abuse, as amended by Act No. 162 / 1993 Coll., Act No. 77 / 2004 Coll., Act No. 312 / 2008 Coll., Act No. 291 / 2009 Coll., Act No. 359 / 2012 Coll. and Act No. 501 / 2020 Coll., ("the Act ') for the implementation of § 8b (7), § 14b (4), § 14d (5), § 15d (9), § 15e (3) and § 26 (2) Act:
Čl. I
Decree No. 22 / 2013 Coll., on education on the section for the protection of animals against abuse, as amended by Decree No. 372 / 2013 Coll. and Decree No. 175 / 2019 Coll., is amended as follows:
1. in Article 1 (1) (a), the words "requirements for the examiner, scope and course of the examination," shall be inserted after the words "education achieved,";
2. in Article 1 (1) (c) and (f), the words "the composition of the Examination Board" shall be replaced by the words "the requirements of the Examination Commissioner."
3. in Article 1 (1), the following point (g) is inserted after point (f):
"(g) the content of the courses for the care of selected species of sash or apes, the extent of the expertise necessary to obtain the certificate of competence for the care of selected species of sash or apes, the requirements for the examination commissioner, the requirements for the highest education achieved and the experience of the lecturer since the completion of the highest education achieved, the course of the examination and the model of the certificate, ';
Points (g) to (i) shall be renumbered as points (h) to (j).
4. in Article 1 (1) (h) to (j), the words "the composition of the Examination Committee" shall be replaced by the words "the requirements for the Examination Commissioner."
5. In Article 2 (1) and (2), the words "intended for handling and care of animals before they are immobilized and immobilized for the purpose of stunning or killing," shall be inserted after the words "at the slaughterhouse."
6. In Article 2, the following paragraph 3 is inserted after paragraph 2:
"(3) The training course for obtaining a certificate of competence for persons involved in animal slaughter operations, which is intended for animal welfare workers pursuant to Article 17 of the directly applicable European Union Code on the protection of animals at the time of killing (5), shall take place within 8 hours of theoretical teaching."
Paragraphs 3 and 4 shall be renumbered paragraphs 4 and 5.
7. In Article 2 (4), "and 2 'is replaced by" to 3';
8. In Article 2, the following paragraph 5 is inserted after paragraph 4:
"(5) In addition to the facts referred to in paragraph 4, the content of the course referred to in paragraph 3 shall:
(a) practical aspects of stunning methods and knowledge of manufacturers' instructions for the types of stunning equipment used;
(b) alternative methods of stunning or killing;
(c) basic maintenance and cleaning of stunning or killing equipment;
(d) checking the effectiveness of stunning and absence of signs of life;
(e) appropriate use and maintenance of fattening knives. ';
Paragraph 5 shall become paragraph 6.
9. In Article 2 (6), the words "handling and care of animals before they are immobilized and immobilized for the purpose of stunning or killing," and at the end of the paragraph, the sentence "Model of the certificate of eligibility for persons involved in the slaughter of animals who carry out the activities of an animal welfare worker pursuant to Article 17 of the directly applicable European Union Code on the protection of animals at the time of killing (5) shall be added to the sentence";
10. In Article 2, paragraphs 7 and 8 are added:
"(7) At the end of the course referred to in paragraphs 1 and 2, the examination shall be carried out in writing to verify the expertise acquired. The test is preparing a training facility. The test contains 15 test questions, two possible answers are assigned to each question, one of which is correct, and a 45-minute period is set for the preparation of the test. The test shall be evaluated by the Examination Commissioner by assessing each correct response with one point. A minimum of 10 points shall be achieved for the successful passing of the test. The test result is assessed successful or failed.
(8) In the course referred to in paragraphs 1 and 2, the test commissioner shall be the instructor of the course at which the test is conducted. The course participant referred to in paragraphs 1 and 2 shall issue a certificate of successful completion of the training centre test. ';
11. in Article 4 (1), the words "and 3" shall be inserted after the words "Paragraph 2 (1)."
12. in Article 5, the following paragraph 3 is added:
"(3) The courses referred to in § 2 (1) and (2) cannot be linked to the course referred to in § 2 (3)."
13. In footnote 7, the words "Decree No. 296 / 2003 Coll., on animal health and protection, on movements and transport of animals and on the authorisation and competence to carry out certain professional veterinary activities. 'are replaced by the words" Decree No. 342 / 2012 Coll., on animal health and protection, on movements and transport of animals and on the authorisation and competence to carry out certain professional veterinary activities, as amended' and the words "Decree No. 376 / 2003 Coll., on veterinary checks on imports and transit of products from third countries. Decree No 377 / 2003 Coll., on veterinary checks on imports and transit of animals from third countries. ';
14. in Articles 7 (3) (d), 8 (3) (d) and 9 (3) (d), the word "school" shall be inserted after the word "secondary" and the words "veterinary or husbandry" shall be replaced by the words "agriculture education with a focus on breeding or veterinary medicine, veterinary hygiene or with a similar accredited study programme with a similar focus not in the field of education."
15. in Paragraph 9 (4), the words "the Commission" shall be replaced by the words "the Commissioner."
16. The following Section 9a is inserted after Section 9, including the title:
„§ 9a
A course for the care of selected species of snails or apes
(1) The course for the care of selected species of shale or apes consists of three teaching modules
(a) module A - basic which contains basic expertise concerning selected species of clams and apes and which takes place in the range of 36 teaching hours of theoretical teaching;
(b) module B - the breeding of selected species with detailed expertise concerning the breeding of selected species with 16 theoretical teaching hours;
(c) Module C - Lidoop breeding, which contains detailed expertise on lidoop breeding and which takes place within 16 teaching hours of theoretical teaching.
(2) The course content referred to in paragraph 1 (a) shall be:
(a) the provisions of the law, implementing legislation issued and selected parts of the legislation relating to the breeding, transport and registration of selected species of shale or apes, in particular the directly applicable regulation of the European Union governing the protection of animals during transport and related activities (4), the Act on Nature and Landscape Protection, the Law on Hunting, the Veterinary Act, the Law on Zoos, the Act on Trade in Endangered Species, the Penal Code, in the range of 4 teaching hours;
(b) biological foundations for animal husbandry, which include the foundations for anatomy and physiology of animals, organ systems, metabolism, zootechnical terminology and domestication issues, description of the body of the animal, including skeleton, physical growth and development, fertility and reproduction, methods and obligations for the labelling of animals, within the scope of 8 teaching hours;
(c) ethology, which includes selected ethological concepts, the development of animal behaviour, patterns and mechanisms of games, social, defence, hunting, food, comfort, sexual and parental behaviour, intra-species and inter-species communication, in the range of 6 teaching hours;
(d) the ethics of animal husbandry, which includes human relation to animals kept in human care, animal protection and welfare issues, environmental enrichment requirements for animal husbandry and requirements for the creation of exposures in which animals are placed, information on international breeding programmes, within the scope of 4 teaching hours;
(e) the principles of animal safety, which include the selected parts of the legislation governing the organisation of work and working practices which the employer is obliged to provide for in-work related to animal husbandry, information on equipment for animal capture, animal handling principles, animal infestation issues, in particular prevention, causes and consequences of the attack, within the scope of 2 hours of instruction,
(f) feeding and feeding requirements for animals which include the general nutritional bases resulting from the different types of digestive system of carnivores, omnivores and herbivores, feed problems, its nutritional values and the importance of nutrients, the treatment and storage of feed, feed of plant and animal origin, feed additives, feeding, in the range of 6 teaching hours;
(g) principles of animal health care, including disease prevention, animal emergency and veterinary care, quarantine, vaccination and immunity issues, non-invasive sampling for testing, most famous zoonoses, viral, bacterial, fungal and parasitic diseases, the concept and causes of animal stress, the principles of biological safety, in particular the handling of carcases and feed residues, information on routine protective disinfection, disinsectisation and deratization and active protection against external effects, in the range of 6 teaching hours.
(3) The course content referred to in paragraph 1 (b) shall be:
(a) systematic classification, species-specific biology in relation to anatomy, physiology, breeding and genetics of selected species of clay, in the range of 5 teaching hours;
(b) the species-specific farming conditions of the selected species, the design, safety, size and equipment requirements of the premises of the selected species, the housing conditions and the requirements of the aid, in the range of 5 teaching hours;
(c) species-specific methods of handling selected species and knowledge of catch and transport techniques for each selected species within the scope of 2 hours of instruction;
(d) the issue of prevention and prevention of leaks of individual selected species by the shelters, within the scope of 1 teaching hour;
(e) species-specific requirements for feeding and feeding of selected species by sash within the 2-hour range;
(f) the recognition of a healthy animal and the most common diseases of each selected species of sash, the provision of first aid and permitted methods of killing selected species of sash, within the scope of 1 teaching hour.
(4) The course content referred to in paragraph 1 (c) is:
(a) systematic classification, species specific biology in relation to anatomy, physiology, breeding and genetics of apes, within the scope of 5 teaching hours;
(b) species-specific lidoop farming conditions, design, safety, size and equipment requirements for lidoop farming areas, housing conditions and aid requirements, within the scope of 5 teaching hours;
(c) species-specific methods for the handling of lidoops and knowledge of the technique of catching and transporting lidoops, within the scope of 2 hours of instruction;
(d) the issue of preventing and preventing leakage of apes, within the scope of 1 teaching hour;
(e) species-specific requirements for the feeding and feeding of lidoops, in the range of 2 hours of instruction;
(f) the recognition of a healthy animal and the most common disease of apes, the provision of first aid and permitted methods of killing apes, within the range of 1 teaching hour.
(5) The lecturer in the course referred to in paragraph 1 must demonstrate:
(a) professional practice in the field of animal protection and welfare in the animal protection authorities referred to in Article 19 (1) (a) or (b) of the Act or at the Ministry of the Environment for at least 3 years;
(b) at least 3 years of experience in the care of selected species of shale or lidoopia, in particular in a zoo or rescue station, and at least a secondary education with a graduate education examination of the breeder of foreign animals;
(c) higher education obtained in the education programme of Biology, Ecology and the environment with a focus on animals, or in the education programme of agriculture with a focus on breeding, provided that the subject of foreign animals or exotic animals were part of them, or similar higher education obtained by studying at a university not in the field of education; or
(d) at least 3 years of experience as a teacher of breeding, zoological or veterinary objects in a secondary school or university with an accredited study programme in the field of education Agriculture with a focus on breeding or veterinary medicine education, veterinary hygiene or similar accredited study programme with a similar focus not in the field of education.
(6) A participant in a course for the care of selected species of shale or lidoops may take part in the course in Module B or Module C only after having attended at least 80 per cent of the teaching hours in the course in Module A.
(7) The training centre shall issue the participant a course for the care of selected species of snails or apes
(a) a certificate of successful completion of the test in Module A, Module B or Module C if it fulfils the conditions set out in Section 19 (1), (4) and (5); or
(b) a certificate of participation in the course in Module A, Module B or Module C, provided that the participant participates in at least 80 per cent of the teaching hours in the module.
(8) The model of the certificate of fitness for the care of selected species of sash obtained by the examination is set out in Annex 14 to this Decree. The model of the certificate of competence for the care of selected species of sash obtained by participating in the course is set out in Annex 15 to this decree.
(9) The model of the certificate of aptitude for the management of lidoops obtained by the examination is set out in Annex 16 to this Decree. The model of the certificate of aptitude for the management of apes obtained by participating in the course is set out in Annex 17 to this Decree. '
17. in Paragraph 14 (1), the word "or" shall be deleted at the end of point (a).
18. In Paragraph 14, at the end of paragraph 1, the dot is replaced by a comma and the following points (c) and (d) are added:
"(c) at least 3 years of experience as a teacher at a university in an area to be presented in the field of animal protection and university education; or
(d) at least 3 years of scientific activity in the field to be presented in the experimental animal protection section and in the higher education. "
19. in Article 16 (2) (c), the words "and administrative delicacies" and the words "State."
20. In Paragraph 19 (1), the word "Commission 'is replaced by the word" Commissioner'.
21. In Article 19, the following paragraphs 4 and 5 are inserted after paragraph 3:
"(4) The test in the course of the course for the care of selected species of shale or lidoops contains 60 test questions when tested from module A. Three possible answers are assigned to each question, one of which is correct. For the production of the written test, 90 minutes shall be determined in the test from Module A. Paragraph 1 shall apply mutatis mutandis to the test of module B and module C.
(5) In order to successfully pass the test and obtain a certificate of fitness to take care of selected species, at least 80 per cent of the total number of points in the test from Module A and at the same time at least 80 per cent of the total number of points in the test from Module B shall be achieved. In order to successfully pass the test and obtain a certificate of aptitude for Lidoop Care, at least 80 per cent of the total number of points of the test from Module A and at the same time at least 80 per cent of the total number of points of the test from Module C. ';
Paragraphs 4 to 10 shall be renumbered paragraphs 6 to 12.
22nd Paragraph 19 (6) reads:
"(6) The Examination Commissioner shall be an employee of the Ministry of Agriculture who has professional experience in the field of animal protection and welfare in the animal protection authority referred to in Article 19 (1) (a) of the Act for at least 6 months. '.
23. In Article 19 (7), the words "members of the Examination Committee 'are replaced by the words" the Examination Commissioner' and the words "all members of the Examination Committee 'are replaced by the words" Signed by the Examination Commissioner'.
24. In Paragraph 19 (11), the introductory part of the provision "7 'is replaced by" 10'.
25. in Article 19 (11), the words "which are intended for persons handling and caring for animals before they are immobilized and immobilized for stunning or killing purposes" shall be added at the end of points (a) and (b);
26. Annex No 1 reads as follows:
