DECLARATION
of 17 March 2017
amending Decree No. 330 / 2012 Coll., on how to assess and evaluate the level of pollution, the scope of public information on the level of pollution and in smog situations
According to § 5 (6), § 30 (4) and § 34 (5) of Act No. 201 / 2012 Coll., on Air Protection:
Čl. I
Decree No. 330 / 2012 Coll., on how to assess and evaluate the level of pollution, the scope of public information on the level of pollution and in smog situations, is amended as follows:
1. At the end of footnote 1, the sentence "Commission Directive (EU) 2015 / 1480 of 28 August 2015 amending several Annexes to Directive 2004 / 107 / EC of the European Parliament and of the Council and 2008 / 50 / EC laying down rules for reference methods, data verification and location of sampling points when assessing ambient air quality 'is added.
2. In Article 1, at the end of point (b), "a 'is replaced by" a', at the end of point (c) is replaced by "a 'and the following point (d) is added:
"(d) the content of the protocol on the measurement of the level of pollution."
3. In Article 3, the following paragraph 8 is added:
"(8) The content of the protocol on the measurement of the level of pollution is set out in Annex 7 to this Decree."
4. In the second sentence of Article 4 (2), the words "average quarterly 'and" reported as average values over the last 12 months' are inserted after the words "Information on '.
5. Annex 1 shall read as follows:

Notes and explanatory notes:
1) Polycyclic aromatic hydrocarbons excluding benzo (a) pyrene.
2) The requirement of minimum data collection and time coverage does not include data losses due to regular calibration or normal maintenance of instrumentation.
3) Disposed throughout the year so that the values are representative of different climatic and transport conditions.
4) Disposed throughout the year so that the values are representative of various climate and anthropogenic activities.
5) Indicative measurements are measurements made with limited regularity but meet other data quality objectives.
6) One random measurement in a week evenly distributed throughout the year or in 8 weeks evenly distributed throughout the year.
7) In the case of modelling, uncertainty is defined as the maximum deviation of measured and calculated concentration levels to 90% of individual measuring points over the relevant period in relation to the limit, taking into account the timing of events. The uncertainty in modelling shall be considered as valid within the relevant limit. Stationary measurements to be selected for comparison with modelling results shall be representative of the extent of the modelled situation. ';
6. In Annex No 2, Part B, point 1, the sentence "At least one stationary measurement shall be placed in suburban sites in zones if there is a higher population exposure. 'is replaced by the sentence" At least one station in the zone and agglomeration shall be located in areas where the population may be exposed to the highest concentration of tropospheric ozone'.
7. In Annex 3, point 2.1, the words "or 180 ° for places of collection in the housing line 'shall be inserted after the words" at least 270 °'.
8. In Annex 3, at the end of the text of point 2.2, the words "and any derogations shall be duly documented 'shall be added.
9. In Annex 3, point 2.5, at the end of the text in point (a), the words "; a large intersection is meant, for the purposes of this provision, a junction which distorts the continuity of traffic and where emissions different from other parts of the road are produced '.
10. Point 3.1 of Annex 3 reads as follows:
"3.1. The procedures for the selection of sites and the location of all measuring points in the network shall be documented, including the acquisition of a photograph of the area surrounding the measuring site in the main world pages, and detailed maps. In the case of indicative measurement or modelling, the documentation shall contain detailed information on these methods and on compliance with the requirements set out in Annex 1 to this Regulation. ';
11. In Annex 3, point 3.2, the words "at least every 5 years' shall be inserted after the words" regularly reviewed 'and the words ", network concepts and measuring points' shall be added at the end of the text of the point.
12. Part A of Annex 6 reads as follows:

„Část A

Procedures for sampling and analysis of stationary measurements
1.1. For stationary measurement of sulphur dioxide, the reference method according to Czech technical standard ČSN EN 14212: 2013 "Air quality - Standard method for determination of sulphur dioxide by ultraviolet fluorescence 'shall be used.
1.2. For stationary measurement of nitrogen dioxide and oxides of nitrogen, the reference method according to Czech technical standard ČSN EN 14211: 2013 "Air quality - Standard method for determination of nitrogen dioxide and nitric oxide by chemiluminescence 'shall be used.
1.3. The reference method referred to in point 1.4 of this Annex shall be used for the sampling of lead, arsenic, cadmium and nickel. For stationary measurements of lead, arsenic, cadmium and nickel, the reference method according to Czech technical standard ČSN EN 14902: 2006 "Air quality - Standard method for determination of Pb, Cd, As and Ni in the fraction PM10 aerosol particles' shall be used.
1.4. For sampling and stationary measurements of PM10 and PM2,5, the reference method according to Czech technical standard ČSN EN 12341: 2014 "Air quality - Reference gravimetric method for determination of the mass concentration of aerosol particle fractions PM10 and PM2,5 'shall be used.
1.5. The reference method according to Parts 1, 2 and 3 of the Czech Technical Standard ČSN EN 14662: 2006 "Air quality - Standard method of determination of benzene 'shall be used for the sampling and stationary measurement of benzene.
1.6. For stationary measurement of carbon monoxide, the reference method according to Czech technical standard ČSN EN 14626: 2012 "Air quality - Standard method for determination of carbon monoxide by non-dispersive infrared spectrometry 'shall be used.
1.7. For stationary measurement of tropospheric ozone, the reference method according to Czech technical standard EN CSN 14625: 2013 "Air quality - Standard method for determination of ozone by ultraviolet photometry 'shall be used.
1.8. The reference method referred to in point 1.4 of this Annex shall be used for the sampling of polycyclic aromatic hydrocarbons. For sampling and analysis of benzo (a) pyrene, the reference method according to Czech technical standard ČSN EN 15549: 2010 "Air quality - Standard method for determining benzo (a) pyrene in outdoor air 'shall be used.
1.9. For the measurement of total mercury in ambient air, the reference method according to Czech technical standard ČSN EN 15852: 2010 "Outdoor air quality - Standard method for the determination of total gaseous mercury 'shall be used. For the measurement of total mercury deposition the reference method according to Czech technical standard ČSN EN 15853: 2010" Quality of outdoor air - Standard method for determining mercury deposition' shall be used.
1.10. For the sampling and analysis of benzo (a) pyrene deposition and other polycyclic aromatic hydrocarbons pursuant to § 3 (1), the reference method according to technical standard ČSN EN 15980: 2011 "Air quality - Determination of benzo [a] anthracene deposition, benzo [b] fluoranthene, benzo [j] fluoranthene, benzo [k] fluoranthene, benzo [a] pyrene, dibenzo [a, h] anthracene and indeno [1,2,3-cd] pyrene 'shall be used.
1.11. The reference method according to Czech technical standard ČSN EN 15841: 2009 "Quality of outdoor air - Standard method for determining arsenic, cadmium, lead and nickel in atmospheric deposition 'shall be used for the sampling of deponted arsenic, cadmium and nickel.'
13. the following Annex 7 is inserted after Annex 6:

"Annex No 7 to Decree No. 330 / 2012 Coll.
Contents of the protocol on measuring the level of pollution
1. Date of measurement of the level of pollution and date of issue of the protocol
2. Identification of the person responsible for measuring the level of pollution, including information enabling the identification of a measurement authorisation such as authorisation and accreditation, if granted
3. Name and signature of person responsible for the accuracy and accuracy of measurement
4. Purpose of measuring the level of pollution
5. Type and scope of measurement of the level of pollution and associated meteorological quantities: method of measurement, sampling and processing and references to standards and standard operating procedures
6. Location of the measuring point in the field including geographical coordinates and altitudes, description of the site, type and representativeness of the site, comparison with the requirements of the relevant regulations for the location of the measuring point, existing level of pollution of the site according to the database of the Air Quality Information System and maps of moving five-year average concentrations of pollutants
7. Description of weather conditions, in particular precipitation, humidity, fog, temperature and dispersion conditions, where measurement of the level of pollution was carried out, or sampling for subsequent laboratory processing, localisation of sources of pollution and other influences which could directly significantly affect the measurement of the level of pollution such as stationary sources, infrastructure, frequency of transport, open fire, construction, agricultural or other activity with significant influence on air pollution, and a description of their impact
8. Data quality, in particular ensuring the accuracy and accuracy of sampling, handling, logistics and storage of samples taken and their laboratory processing, data evaluation, control and verification of measured data, measurement uncertainty, time and space representativeness of measured data
9. The instrumentation used, in particular sampling equipment, meters, analysers and their ranges and accuracy, and a description of metrological continuity and data collection
10. Area of cooperation, in particular identification of the cooperating authorised or accredited person, subject matter of cooperation of the designated pollutants and methods of determination
11. Results of the measurement of the level of pollution, in particular the verified values of the measured mass concentrations from individual measurements converted to the conditions under which the limit is set and expressed at the relevant time of averaging and, where applicable, progress charts, corresponding to the limit of measurement and the conditions under which it is determined and the uncertainty of that measurement
12. Files of results of measured and accompanying quantities
13. List of documents used to measure the level of pollution, in particular legislation, standards, standard operating procedures, literature and list of abbreviations if used in the Protocol '.

Efficacy
This Decision shall enter into force on 1 April 2017.
