of 24 April 2014
on the conditions for granting an official authorisation to verify the results of surveying activities for the purposes of the Ministry of Defence
According to Article 20 (2) of Act No. 200 / 1994 Coll., on Geometry and on the amendment and amendment of certain laws related to its implementation, as amended by Act No. 319 / 2004 Coll. and Act No. 189 / 2008 Coll.:
Forms of application for official authorisation
(1) The applicant shall submit a written request for official authorisation to the Ministry of Defence ("the Ministry"). The applicant shall indicate in the application, in addition to the requirements laid down in the administrative rules, the scope of the verification for which the official authorisation for which it is requested is to be granted.
(2) The applicant shall add to its application:
(a) proof of the proper completion of higher education in the field of surveying at least the master's programme;
(b) a certificate of professional experience carried out in the activities for which it has applied for an official authorisation to be verified, to an overall extent of at least five years;
(c) an overview of the results of the surveying activities in which the applicant has participated, indicating their name, calendar year and month of processing, the verification serial number under which the natural person with official authorisation (hereinafter referred to as the "officially authorised surveyor") has verified the outcome of the surveying activities and the address of the place where the documentation on the outcome of the surveying activities is stored;
(d) a self-processed result of the geometrical activities in the field of geometrical activities for which it applies for an official authorisation.
Test content
(1) The test for the granting of an official authorisation (hereinafter referred to as the "test") is to be divided into a part of the general and specific and in defence by the applicant of a separately processed outcome of the agricultural activities.
(2) The general part of the test shall verify the applicant's knowledge in areas
(a) the legislation of the surveyor and the authorities of the surveyor and the cadastre, including the competence of the Ministry in this field;
(b) general rules on metrology and defence standardisation, cataloguing and state quality verification.
(3) In the specific part of the examination, the applicant shall demonstrate knowledge of:
(a) geodetic reference systems and national map works binding on the territory of the Czech Republic;
(b) procedures for establishing, renewing or transferring points of the detailed point field and drawing up the relevant documentation;
(c) procedures for targeting and investigating measuring objects which are the content of state map works for defence purposes of the Czech Republic;
(d) documentation of the results of the agricultural activities and their storage;
(e) the procedures for the calibration and comparison of instruments and aids and the processing of relevant documents;
(f) spatial positioning procedures, including their accuracy and control measurements;
(g) the procedures for measuring the half-life and the altimeter, including their accuracy;
(h) measurement procedures to ensure the completeness and regularity of the results of the agricultural activities;
(i) professional terminology in the field of the exercise of surveying activities, in particular the pursuit of surveying activities for the purpose of ensuring defence of the Czech Republic.
(4) The applicant shall justify the accuracy of the procedures used in its preparation in defending the self-processing result of the agricultural activities.
Test preparation
(1) The Ministry shall inform the applicant of the place, date and time of the examination no later than 14 days before the date of the examination of the intended address for delivery in the written invitation.
(2) If the Panel of Experts is a self-processed outcome of the surveying activities referred to in Paragraph 1 (2) (d) proposed by the applicant for defence as inappropriate, the Ministry shall supplement the written invitation referred to in paragraph 1 with an invitation to the applicant to submit to the Ministry, no later than three working days before the date of the examination, another suitable self-processed result of the surveying activities.
Method of test
(1) The examination is oral and its course and the declarations are public.
(2) The examination shall be carried out before the expert examination committee.
(3) Before starting the examination, the expert panel shall verify the identity of the applicant.
(4) The expert examination committee shall proceed during the examination according to the test schedule issued by the Ministry. The Ministry shall make the test schedule available in a way that allows remote access.
(5) The Panel of Experts shall draw up a report on the course of the test and its outcome.
(6) The expert panel assesses the applicant by "benefit" or "benefit." On completion of the examination, the chairman of the panel of experts shall be informed of the outcome of the examination in the presence of all members of the panel of experts immediately after the examination.
Repeating the test
(1) The Ministry shall, upon request, fix a date for the re-examination to the applicant who failed the test.
(2) In order to determine the date of repeat of the test, its content and the course of the test, Sections 2 to 4 shall be used mutatis mutandis.
Division test
(1) In order to determine the date of the differential test and its course and repetition, Sections 3 to 5 shall be used mutatis mutandis.
(2) The Ministry will assess the differences between the geographical activities for which verification is sought by the applicant for an official authorisation carried out by the applicant in the Member State of origin and the geographical activities carried out in the Czech Republic and the training and preparation for them. The applicant shall only perform the test to the extent of the differences found.
Form of verification of the results of surveying activities for the purpose of securing the defence of the Czech Republic
(1) Verification of the outcome of the surveying activities for the purpose of securing the defence of the Czech Republic by an officially authorised surveying engineer shall indicate on all copies the outcome of the surveying activities.
(2) The verification of the outcome of the surveying activities carried out in analogue form by an officially authorised surveyor shall always indicate on the last page each separate part of the outcome of the surveying activities containing the text. Where such part consists of multiple sheets, the sheets shall be firmly joined; In such a case, the officially authorised surveyor shall affix and affix his signature so that the signature passes from the text page through the site of the tape.
(3) To indicate the verification of the outcome of the surveying activities, the officially authorised surveyor shall attach the date of its completion and the imprint of the stamp used by him, under which he shall indicate the number of the records of the verified result; the verification of the outcome of the surveying activities shall subsequently be signed by an officially authorised surveying engineer.
(4) The verification of the outcome of the surveying activities in digital form shall be carried out by an officially authorised surveyor by attaching a document in the form of a data report to the outcome of the surveyor activities in digital form or to the output of an authorised conversion of documents1), the input of which shall be the result of the surveyor activities in analogue form; the data report contains the text referred to in Article 16 (4) of the Geometry Act, the date of the verification and the words "stamp of the authorised surveying engineer '. The document in the form of a data report shall be accompanied by an officially authorised surveying engineer, recognised by electronic signature (2).
(5) For a document in the form of a data message referred to in paragraph 4, the output data format of static text documents and static combined text and image documents shall be used as the output data format in accordance with the Decree on the details of the file service [Portable Document Format for the Long-term Archive (PDF / A, ISO 19005)].
Repeal
Decree No. 114 / 1997 Coll., on the details of the application for an official authorisation and the application for the termination of an official authorisation and the form of verification of the results of the surveying activities for State defence purposes, shall be deleted.
Efficacy
This Decree shall take effect on the 30th day following its publication.
