DECLARATION
of 19 January 2026
amending Decree No. 21 / 2017 Coll., on the Nuclear Safety of Nuclear Equipment
According to Section 236 of Act No. 263 / 2016 Coll., Atomic Act, as amended by Act No. 83 / 2025 Coll., for implementation of Sections 24 (7), 25 (2) (a) to (c), 44 (4) (c), 49 (2), 50 (4), 51 (6) (a) and (b), 52 (2), 53 (2) and 54 (4) (a), (c) and (d):
Čl. I
Decree No. 21 / 2017 Coll., on the Nuclear Safety of Nuclear Equipment, is amended as follows:
1. In Article 1 (i), the words "and amendments with a possible impact on nuclear safety, technical safety and security of nuclear equipment 'are added at the end of the text.
2. in § 1 (k) and § 1 (l) the words "and obsolescence" shall be added at the end of the text.
3. In Article 2 (b), the words "limits and conditions' are replaced by the words" limit conditions'.
4. In Article 2 (d), "and conditions, and 'is replaced by" and conditions,';
5. in § 2 (e), the end of the dot is replaced by a comma.
6. In Section 2, point (f) is added:
"(f) the apparent cause of a particular operational event which may be determined on the basis of the information available without further examination."
7. In Section 3 (c) of the introductory part of the provision, the words "since origin 'are deleted.
8. in Paragraph 3 (c), point 6 is deleted;
Points 7 to 14 shall become points 6 to 13.
9. In Article 3 (c) (6), the words "unmanaged occurrence 'are replaced by the words" detection'.
10. in Paragraph 3 (c) (8), the word "deadly" is replaced by the words "finding fatal."
11. in § 3 (c) (9), § 3 (c) (11) and § 3 (c) (12), the word "detection" shall be added to the beginning.
12. in Article 3 (c) (10), the word "event" shall be replaced by "occurrence detection" and the words "physical protection system" shall be replaced by "security."
13. in Article 3 (c) (13), the words "uncontrolled leakage" shall be replaced by "detection of uncontrolled leakage."
14. in Article 3 (d), point 3 is deleted;
Points 4 to 6 shall be renumbered 3 to 5.
15. in Paragraph 3 (d) (5), the words "the loss of control of a simple, significant and very significant source of ionising radiation" shall be inserted after the word "radiation."
16. in Article 3 (e):
"(e) the following working day, if applicable
1. drawing the limit conditions;
2. the operation of the nuclear reactor performance limitation system;
3. the fall of a foreign object into the primary nuclear reactor circuit,
4. loss of operation of the teledosimetric system at the nuclear site; or
5. unplanned overshoot of the level of intervention of the monitored item specified in the monitoring programme. ';
17. in Article 5 (2) (d), the words "and culture of security" shall be inserted after the words "security."
18. in Paragraph 5 (2) (e), the words "in the case of a minor operational event, only an analysis of obvious causes shall be added at the end of the text."
19. In Article 5, the following paragraph 4 is added:
"(4) A minor operational event of low safety significance shall be recorded and not be analysed for its apparent causes if:
(a) not repeated; or
(b) it has not been possible to establish a clear cause for the previous investigation. "
20. in Article 6 (1), point (c) is deleted;
Points (d) to (m) shall be renumbered (c) to (l).
21. in Article 6 (1) (c) (1), "limits and conditions" shall be replaced by "limit conditions longer than 20% of the authorised period."
22. in Article 6 (2) (b), the word "unplanned" shall be deleted and the words "specified quantities" shall be replaced by the words "specified items";
23. in Article 6 (2) (c), the words "cause unplanned non-functioning of equipment" shall be replaced by the words "lead to loss of operation" and the words "intended for the nuclear site" shall be added at the end of the text.
24. in Article 6 (2) (h), the words "physical protection system" are replaced by the words "security."
25. in Article 6 (2) (i), the words "barriers to the physical protection system" shall be replaced by the words "limits of the demarcated area of a nuclear installation."
26. in Paragraph 7 (1) (d), at the end of the comma, "a" is replaced by "a."
27. in Article 7 (1) (e), the words "organisational measures and" shall be replaced by "organisational measures."
28. in Article 7 (1), point (f) is deleted;
29. in Paragraph 7 (6) (a) (1), "drawing limits and conditions" is replaced by "drawing limit conditions."
30. Paragraph 8 (1) reads:
"(1) The sizes and facts relevant to nuclear safety are:
(a) the values of physical quantities and parameters which provide comprehensive information on the status of the active zone and other downstream systems, structures and components having an effect on nuclear safety that are not selected equipment and selected installations or on nuclear material or radioactive waste found in the nuclear installation;
(b) non-compliance with nuclear safety, technical safety, radiation protection, radiation monitoring, radiological emergency management and security and its consequences, analysis of this non-compliance and measures taken following this non-compliance;
(c) the operability of systems, structures and components having an impact on nuclear safety, which are not selected equipment, and of selected equipment and handling, and the work orders concerning them;
(d) drawing information on the limit conditions and infringement of the limits and conditions;
(e) the results of the tests, inspections, maintenance and repair of selected equipment and systems, structures and components having an impact on nuclear safety that are not selected equipment and records thereof;
(f) data relevant to the monitoring and evaluation of the ageing of nuclear safety-related systems, structures and components which are not selected installations and of selected installations;
(g) the parameters of the systems, structures and components having an impact on nuclear safety, which are not selected equipment, and of the selected equipment, providing an overview of the state of the nuclear installation, including information on their development and their records;
(h) the values of surface contamination of systems, structures and components;
(i) notification of the operational event, its description and other documents relating to it;
(j) the result of the verification of the medical fitness of a nuclear operator;
(k) the result of the verification of the personality of the selected worker;
(l) the information contained in the alert on compliance with the qualification requirements laid down for a nuclear plant worker;
(m) an indication of the form and quantity of radioactive discharges;
(n) data on batch power in the nuclear installation's monitored area;
(o) an indication of the change made on selected installations and systems, structures and components with nuclear safety implications that are not selected equipment;
(p) an indication of the quantity of nuclear material and the items selected, including handling;
(q) indication of the generation and handling of radioactive waste;
(r) an indication of the control carried out under the limits and conditions and the operational control programme;
(s) an indication of a change in security which is no other change in the use of nuclear energy;
(t) a report on the testing of systems, structures and components during the construction, physical start and energy start of nuclear installations;
(u) the information contained in the voice recording of a telephone call from an workplace where a particularly important nuclear safety activity is carried out, the technical support centre and the emergency control centre;
(v) information from the voice communication system installed on the nuclear installation;
(w) the information contained in the internal regulation;
(x) the information contained in the operating logbook;
(y) justification for the limits and conditions; and
(z) implementation of a change with a possible impact on nuclear safety, technical safety and security of nuclear equipment. ';
31. in Paragraph 8 (2) (h):
"(h) an indication of a change in security which is no other change in the use of nuclear energy;"
32. in Article 8 (2) (j), the words "security," and "security," shall be replaced by "security."
33.In Paragraph 8 (2) (k), the end of the dot is replaced by a comma.
34. in Article 8 (2), the following points (l) and (m) are added:
"(l) justification for the limits and conditions; and
(m) the implementation of a change with a possible impact on nuclear safety, technical security and security of nuclear equipment. ';
35. in Paragraph 8 (4) of the introductory part of the provision, "January" is replaced by "March."
36. In Article 8, paragraphs 5 and 6 are added:
"(5) A fact relevant to the nuclear safety of nuclear installations referred to in paragraph 1 (y) and paragraph 2 (l) must be notified to the Authority at the same time as the application for approval of the limits and conditions or amendments thereto. If this is a change which is relevant to the nuclear safety of a nuclear installation at another time, it shall be notified to the Authority within 30 days of the entry into force of the amendment.
(6) The facts relevant to the nuclear safety of nuclear installations referred to in paragraph 1 (z) and paragraph 2 (m) shall be notified to the Authority for the previous calendar year on 31 March of the following calendar year. The notification shall include:
(a) description and justification of the change;
(b) the actual date of implementation of the change;
(c) the actual extent of the change made; and
(d) information on updating the related documentation. ';
37. The heading above the title of Section 9 shall be deleted.
38. The following heading is inserted above the designation of Section 9:
"Other changes in the use of nuclear energy and changes with a potential impact on nuclear safety, technical safety and security of nuclear equipment '.
39. in Paragraph 9 (1):
"(1) Another change in the use of nuclear energy, which is a change in nuclear safety-related equipment which affects nuclear safety or technical safety, which does not alter the way or extent of the safety function of the nuclear-related equipment or the exchange of a safety-related component of the selected equipment, is:
(a) a technical change to a selected device in Class 1 or Class 2, consisting of the replacement or change of the manufacturer, the type of device or component chosen, not changing its design function, the design of the device chosen or the result of the safety analysis;
(b) a change that results in the removal of the identified non-conformity on the selected equipment in Class 1 or Class 2 and is intended to ensure that the design function of the installation is fulfilled;
(c) the change of the algorithm and the setting of the protection system which changes the safety function by operating in accordance with the original project function;
(d) a change to the parameter of the selected device in Class 1 or Class 2, in which the original project function is maintained and the physical configuration of the device remains unchanged;
(e) a change in the setting of the protection system in which safety analyses remain in force and no change in the limits and conditions;
(f) an intervention in the part of a selected device in Class 1 or Class 2 which carries a safety function that does not alter that safety function; or
(g) preparatory work in the context of a change which does not involve physical interference with a selected installation in Class 1 or Class 2 of the amendment concerned, but which may have a negative effect on ensuring that the safety function of the selected installation is performed. ';
40. in Article 9 (2), the words "the holder of an authorisation for activities related to the use of nuclear energy" shall be deleted;
41. in Paragraph 9 (3) of the Introductory Part of the provision, the words "by changing the holder of an authorisation for activities relating to the use of nuclear energy" shall be replaced by "by another amendment" and the words "areas of physical protection" shall be replaced by "security."
42. In Articles 9 (3) (a), 9 (3) (b), 9 (3) (d) and 9 (3) (e), the words "industrial television" are replaced by the words "camera system."
43. In Paragraph 9 (3) (c), the words "technical system of physical protection" shall be added at the end of the text.
44. In Article 9, the following paragraph 4 is added:
"(4) A change with a possible impact on nuclear safety, technical safety and security of nuclear equipment is:
(a) a technical change to a selected installation classified in Security Class 3 or a change to a system, design and component with an impact on nuclear safety that is not a selected installation, consisting of the replacement or change of a manufacturer, type of device or system, design and components with an influence on nuclear safety that is not a selected installation, or parts thereof, which do not alter its design function, design of a selected installation or system, design and components with an influence on nuclear safety that is not a selected installation, or the result of a safety analysis;
(b) a change which leads to the removal of identified non-conformity on a selected installation classified in Security Class 3 or on a system, construction and component having an effect on nuclear safety that is not a selected installation and is intended to ensure that the design function of that installation is fulfilled;
(c) the change of the algorithm and the setting of the system performing the limitation function which changes the safety function by operating in accordance with the original project function;
(d) a change in the parameter of the selected equipment classified in Security Class 3 or the system, construction and component with nuclear safety implications, which are not selected equipment in which the original project function is maintained and their physical configuration is unchanged;
(e) a change in the setting of the system performing the limitation function, where the valid analyses remain and the limits and conditions are not changed; or
(f) an intervention in a component of a selected installation classified in Security Class 3 or a system, structure and components having an impact on nuclear safety that is not a selected device that carries a safety function that does not alter that safety function. ';
45. in Paragraph 10 (1) (c), "January" is replaced by "March."
46. the following Sections 12a and 12b are inserted after Section 12:
§ 12a
Procedures for implementing the ageing management process
In the process of management of ageing must be introduced
(a) rules and criteria for identifying obsolete systems, structures and components with an impact on nuclear safety and their components;
(b) measures to maintain information on suppliers of nuclear safety-related systems, structures and components, technical support, including their capacities;
(c) measures to ensure the availability of documentation for the maintenance and exchange of nuclear safety-related systems, structures and components;
(d) measures to control and minimise the ageing of the items referred to in (a); and
(e) arrangements for ensuring and timely exchange of obsolete systems, structures and components with an impact on nuclear safety, their components and outdated technologies.
§ 12b
Requirements for the ageing programme
The obsolescence programme shall be clearly identified, determine the entry dates of the aging process, determine the rights and obligations of the staff performing the ageing process activities and include:
(a) a list of obsolete nuclear safety systems, structures and components;
(b) rules on the maintenance of information on suppliers of nuclear safety-related systems, structures and components, technical support, including their capacities;
(c) rules for maintaining documentation for the maintenance and exchange of nuclear safety-related systems, structures and components;
(d) rules on monitoring the ageing of items referred to in (a), including monitoring the trend of ageing;
(e) the procedure for dealing with obsolete items; and
(f) rules for evaluating the effectiveness of the ageing process. ';
47. in Paragraph 13 (2), the words "have a concentration of a soluble neutron absorber in a coolant such that" are replaced by "; the words" have "shall be deleted and the words" at least 0,02 "shall be deleted;
48. In Section 16 (5) of the introductory part of the provision, the words "and, in the case of a sub-critical reactor, the start of its use 'are inserted after the word" state'.
49. in Articles 19 (3) (a) and 22 (1) (j), the words "and test operations" shall be deleted;
50. in Paragraph 21 (2) (b), the word "test" shall be deleted;
51. in Paragraph 22 (1), point (k) shall be deleted;
Points (l) and (m) shall be renumbered as points (k) and (l).
52. in Paragraph 22 (3), the words "31 March" shall be deleted;
53. In Article 23 (4) (b), the words "nuclear reactor system" are replaced by the words "nuclear reactor system on a nuclear installation, with the exception of a sub-critical reactor."
54. In Article 23, paragraphs 6 to 8 are added:
"(6) The experiment carried out on a research nuclear installation shall be designed, prepared and carried out in such a way that it does not adversely affect nuclear safety, radiation protection, technical safety, radiation monitoring, radiation emergency management and equipment security in all operational conditions, including anticipated operational events and emergency conditions.
(7) An operator of a nuclear research facility shall assess the impact of the experiment on nuclear safety, radiation protection, technical safety, monitoring of radiation situations, management of radiological emergencies and security in a continuous manner before and during the experiment.
(8) The holder of a permit for the operation of a research nuclear installation shall specify the requirements and procedures for:
(a) assessment and approval of experimental proposals;
(b) management of the conduct of experiments;
(c) drawing up a programme for the use of research nuclear equipment for experimental purposes; and
(d) dismantling and maintenance of experimental equipment. ';
55. In Paragraph 24 (1) of the Introductory Part of the provision, the words "nuclear equipment, with the exception of research nuclear equipment," shall be inserted after the word "reactor."
56. in Article 24 (1) (a) (5), the words "if used" shall be inserted after the word "absorber."
57. In Paragraph 24 (1) (c) of the Introductory Part of the provision, the words "important in terms of nuclear safety" are replaced by the words "having an effect on nuclear safety."
58. in Article 24 (1) (c) (8), "physical protection" is replaced by "security."
59. In Paragraph 24, the following paragraph 2 is inserted after paragraph 1:
"(2) The documentation for the reintroduction of the nuclear reactor of the research nuclear installation into critical state after the replacement of nuclear fuel shall include:
(a) information on the neutron-physical properties of the nuclear reactor core
1. results of calculations of neutron-physical properties of the fuel input zone for the following fuel campaign;
2. effects and reactivity coefficients,
3. power distribution in the active zone;
4. a description of the change in reactivity caused by stationary poisoning;
5. the integral and differential efficiency of regulators and the efficiency of other types of absorbers; and
6. operating limits of the active zone and fuel files,
b.
1. description of fuel input and enrichment,
2. information on the type of fuel, its characteristics and quantities in the active zone;
3. the distribution of fuel files in the active zone; and
4. the deployment of active zone components,
(c) documents and protocols for testing the preparedness of nuclear safety-related equipment, documents and protocols for testing the preparedness of selected equipment and systems of structures and components that are not selected equipment;
(d) evidence of compliance with the criteria for acceptance of information on whether the criteria for acceptance relating to documents and protocols for testing the preparedness of nuclear safety equipment and documents and protocols from operational controls are met;
(e) a summary of the results of the preparedness check of the nuclear installation and its personnel for further operation
1. the list of changes made during operation and during the shutdown of systems, structures, components having an impact on the operational safety report from the date of its last update;
2. updating the limits and conditions following the changes referred to in point 1;
3. a list of changes to the safety report made during the last fuel cycle;
4. a declaration on updating the limits and conditions;
5. a declaration on the update of internal rules; and
6. proof of testing and preparedness of selected devices. ';
Paragraphs 2 and 3 shall become paragraphs 3 and 4.
60. In Article 24, the following paragraph 5 is added:
"(5) Documentation for the reintroduction of the nuclear reactor of a research nuclear installation into critical state after the replacement of nuclear fuel referred to in paragraph 2 (a), (b) and (e) shall be submitted to the Authority at least 24 hours before the reintroduction of the nuclear reactor into critical state.";
61. in Paragraph 26 (1) of the Introductory Part of the provision, the words "with a nuclear reactor" shall be inserted after the word "plant."
62. In Articles 28 (4) and 30 (2), the words "for a nuclear installation which is not a research nuclear installation" shall be inserted after the words "regulations."
