DECLARATION
of 29 March 2022
on technical and economic parameters for setting reference ransom prices and green bonuses and implementing certain other provisions of the Act on Supported Energy Sources (Order on Technical and Economic Parameters)
According to Article 53 (2) (a), (b) and (l) of Act No 165 / 2012 Coll., on supported energy sources and amending certain laws, as amended by Act No 382 / 2021 Coll.:
Subject matter
This decree provides
(a) technical and economic parameters for determining the reference ransom prices and green bonuses of the different types of supported sources for electricity, heat and biomethane production;
(b) the amount of the discount rate and the lifetime of the electricity generation, heat production and biomethane production from supported sources;
(c) the lifetime of the modernised electricity generation;
(d) the extent and total amount of the specific operating costs to determine the maintenance support for electricity and the maintenance support for heat;
(e) the way in which heat prices are created to determine maintenance heat support.
Technical-economic parameters
(1) The technical and economic parameters for determining the reference purchase price and the green bonus of the different types of sources supported for electricity, heat and biomethane are set out in Annex 1 to this Decree.
(2) The period of annual use of the installed power is the proportion of the annual quantity of electricity or heat supported and the installed power of the electricity or heat production plant. In the case of biomethane production, the annual recovery period shall be the number of hours of biogas treatment per biomethane per calendar year.
(3) Investment costs are the costs of acquiring, installing or starting up a power, heat and biomethane plant. Investment costs shall not include the costs of accumulation and the costs of acquisition of land or other exploitation right to land, except for the construction part thereof.
(4) The costs of purchasing fuel in coal, sludge or landfill electricity plants and in sludge or landfill gas biomethane plants are costs derived from the average price of natural gas. If the average price of natural gas is less than 400 CZK / MWh, the amount of 400 CZK / MWh shall be used to determine the cost of purchasing fuel, and the amount of 600 CZK / MWh shall be used to determine the cost of purchasing fuel.
Duration
The lifespan of the power plant, the modernised power plant, the heat plant and the biomethane plant is set out in Annex 1 to this Decree.
Discount rate
The discount rate for determining the reference purchase price and the green bonus of each type of supported source for electricity, heat and biomethane shall be 6,21% after tax on income.
Scope and level of specific operating costs
(1) Measurements of operating costs include, in the determination of maintenance and / or maintenance support for heat when using biomass, the following:
(a) fuel costs in using biomass expressed per unit of energy in fuel, including transport costs, broken down into individual biomass categories according to the order governing the species and parameters supported by biomass;
(b) fuel costs using solid fossil fuel expressed per fuel unit, including transport and desulphurisation costs; and
(c) the cost of purchasing emission allowances expressed per unit of energy in the fuel, where the electricity or heat generation is covered by a greenhouse gas emission permit under the greenhouse gas emission allowance trading conditions law.
(2) The level of the specific operating costs of fuel and emission allowances for the determination of the maintenance support for electricity or the maintenance support for heat is set out in Annex 2 to this Decree.
(3) The specific operating costs for the determination of heat maintenance support for geothermal heat plants include:
(a) personal and wage costs, including social security contributions and contributions to national employment policy and general health insurance premiums;
(b) the cost of service repairs and maintenance, including the necessary costs related to normal operating activities for the smooth operation of the plant, with the exception of the costs of reinvestment of the plant's equipment; and
(c) the cost of heat production insurance.
(4) The measured operating costs of the heat plant using geothermal energy are set at CZK 0.25 / kWht.
Method of generating the heat price
The method of creating the price of heat to determine the maintenance support for heat is set out in Annex 3 to this Decree.
Transitional provisions
(1) For electricity and heat plants put into service before 31 December 2021, the technical and economic parameters and service life pursuant to Decree No. 296 / 2015 Coll., on the technical and economic parameters for determining the purchase prices for electricity and green heat bonuses and on the determination of the lifetime of electricity generation and heat production from renewable energy sources (Decree on Technical and Economic Parameters), as effective before the date of entry into force of this Decree.
(2) Paragraph 1 shall not apply to electricity and heat plants put into service until 31 December 2021 which are subject to maintenance or maintenance heat support and to electricity plants for which an upgrade has been carried out after 31 December 2021.
Repeal
They shall be deleted:
1. Decree No. 296 / 2015 Coll., on Technicoeconomic Parameters for the Determination of Quotation Prices for Electricity Production and Green Heat Bonus and on the Determination of Lifetime of Electricity Production and Heat Production from Renewable Energy Sources (Order on Technicoeconomic Parameters).
2. Decree No. 266 / 2016 Coll., amending Decree No. 296 / 2015 Coll., on Technicoeconomic Parameters for the Determination of Export Prices for the Production of Electricity and Green Bonus on Heat and on the Determination of the Life of Electricity Production and Heat Production from Renewable Energy Sources (Order on Technicoeconomic Parameters).
Efficacy
This Decree shall take effect on 1 May 2022.

Method of creating equivalent heat price to determine the maintenance support of heat using geothermal energy
The equivalent heat price is derived from the reference price of heat produced in a natural gas boiler with an installed output of 1 MWt. The price is determined as the sum of fuel costs, operating costs, investment costs and reasonable profit according to the formula

ECTE [CZK / GJ] is the equivalent price of heat,
Paid [CZK / MWh] is the price of natural gas (in calorific value) according to the formula
Priced = price-regulated + commodity price,
where
the price-regulated [CZK / MWh] is the price of the related gas service determined from the average prices of the distribution system service of regional distribution system operators, which includes the price for the activities of the market operator including the fee for the activities of the Office; the prices of the distribution system service are determined in accordance with the price ratio of the regulated gas supply prices of the Authority in the year in which the maintenance heat support is determined;
the price of the commodities [CZK / MWh] is the arithmetic average of the available final prices (settlement price) of EEX-THE Cal-YY for the period January to June of the calendar year in which the maintenance heat support is determined, plus EUR 4 / MWh to take into account the reasonable sales costs of the trader,
η PK [-] is the reference efficiency of a natural gas boiler, determined in accordance with the directly applicable European Union Regulation, reviewing the harmonised efficiency reference values for the separate production of electricity and heat 2), of 0,92,
OÚ [CZK / GJ] are the costs of repair and maintenance of the boiler in the amount of 16 CZK / GJ,
INVPK [CZK] is the reference value of the investment in the gas boiler in the amount of CZK 5 500 000,
DJ [years] is the life of the boiler set for 15 years,
RVT [GJ] is the annual heat production of the boiler of 11 880 GJ,
ROA [-] is the rate of return determined according to the Office's price scale for thermal energy prices effective in the year in which the maintenance heat support is determined.
