DECLARATION

Federal Ministry of Transport and Communications

of 21 April 1989

on the rights and obligations of mail and its users (postal order)

The Federal Ministry of Transport and Communications pursuant to § 7 (1) of Act No 222 / 1946 Coll., on Post Office (Postal Act), and § 2 of Government Decree No. 240 / 1949 Coll., implementing the Postal Act, provides:

§ 1

Preliminary provisions

(1) This Decree lays down the conditions for the use of mail (sending conditions), regulates the interaction between mail and its users and lays down the rights and obligations of both parties in internal and international postal services; Annexes 1 to 6 are included. The special conditions of dispatch for consignments to individual countries, in particular the scope and limitations of certain types of services, are indicated in the postal tariff for the country concerned. 1)

(2) The provision of postal services organises:

(a) on the territory of the district district management of the connections, in Pilsen, Brno and Ostrava the municipal postal administration and in Prague and Bratislava the district administration of the ports (hereinafter referred to as the "district administration of the connections"),

(b) in the territory of the Region of the Directorate of Communications, in Prague and Bratislava, the Directorate of Posts (hereinafter referred to as "the Directorate of Communications");

(c) in the territory of the Czech Socialist Republic the Administration of Posts and Telecommunications Prague and in the territory of the Slovak Socialist Republic the Administration of Posts and Telecommunications Bratislava (hereinafter referred to as the "Posts and Telecommunications Administration").

(3) For the conversion of the Czechoslovak currency into foreign currency and vice versa, with the exception of the amounts sent by postal orders, the post office uses the World Postal Union Special Monetary Units; their conversion is shown in the postal tariff.

COMMON PROVISIONS ON CONSIDERATIONS

General provisions on consignments

§ 2

Consignments

(1) The consignments provided for in this Decree are letters, valuable letters, packages and postal vouchers.

(2) List consignments are:

(a) in internal and international contact with correspondence, writing, blind mail and newspapers;

(b) only in the internal contact of flyers, responsible consignments and station typing;

(c) only in international contact with printed matter and packages.

(3) Ordinary letters are letters which are not submitted as recommended (§ 25). Registered consignments are letter consignments which are submitted as recommended (recommended), valuable writing, packages and postal vouchers.

(4) For selected post offices, consignments of international express mail (Express Mail Service), hereinafter referred to as "EMS consignments," may be submitted to the countries listed in the postal tariff. These consignments are delivered with the highest priority by the fastest means of transport. Information on the sending conditions of consignments of EMS and the post office receiving such consignments shall be provided by each post office.

§ 3

Disposition with consignments

(1) Only its consignor shall be entitled to dispose of the consignment until it has been delivered, unless it has been seized under the rules in the country of filing or destination.

(2) When submitting a registered consignment of internal contact, its consignor may request a note:

(a) "Do not store" in order to return the consignment immediately after the first futile attempt at delivery;

(b) "Save 5 days" so that the consignment is not stored at post office for more than five calendar days;

(c) "Save 15 days" so that the consignment is not stored at post office for more than 15 calendar days;

(d) "Do not return" in order to treat the mail in the event of non-compliance as non-refundable. The stamp shall be marked on the address side of the consignment and on the back of the postal note under the heading "Notes'.

§ 4

Transport of consignments

(1) Transport consignments are received, transported and delivered; start with the date of their receipt by post and end with the date, in the case of telegraphic vouchers and by the hour, of their delivery to the consignee. Transport of consignments is the transfer of consignments from the place of submission to the place of destination. The delivery of the consignment shall consist of delivery, notification of arrival or storage of the consignment, prepared vouchers to be credited to the account at the money institution or ready for delivery from the post office.

(2) In addition to the items prohibited from being transported by post, (2) it is not permitted to send in international postal services

(a) goods the importation or circulation of which is prohibited in the country of destination;

(b) destruction subject to a biological substance, with the exception referred to in point 42 of Annex 1 to this Decree;

(c) animals with the exception of bees, leeches and silkworms; However, officially recognised institutes may send alien and harmful insect destroyers only in letters,

(d) in letters of platinum, gold, silver, precious stones, jewellery and other precious items, coins, paper money or any securities denominated in the bearer.

(3) The items referred to in paragraph 2 (d) may only be sent in packages with a given price under the conditions laid down in Paragraph 22 (10) and in valuable letters; in packages without a given price, they may be sent only to countries where the price-based packages cannot be sent.

(4) The dispatch conditions for dangerous goods, (3) which may exceptionally be administered by mail (subject to condition) are set out in Annex 1 to this Decree.

(5) The payment of the premium for the infringement of the traffic ban and for the breach of the conditions for the shipment of goods conditionally transported (4) is imposed by the district administration of the connections in whose district the consignment was lodged.

(6) The post office may require the consignor to declare that the consignment sent by it does not contain items the transport of which is prohibited by mail; If the consignor refuses to comply, the mail shall not accept the consignment for transport. When transporting consignments, the post office shall be entitled to ascertain whether the conditions for sending have been complied with.

(7) If the mail opens the sealed consignment, 5) it shall invite the consignor or consignee; If this is not possible, it shall invite the non-party. For consignments covered by the protection of letter secrets, post offices shall take measures to ensure that the secret is not violated. Recruitment of cases for the benefit of the State (5a) shall be confirmed by the authority which took over the State.

(8) Delivery shall be deemed to be the timely transport of a consignment of internal traffic complying with the conditions laid down in the consignment.

(a) letters, postal vouchers, valuable writing and a diligent package no later than the second day following the date of submission;

(b) the package no later than the fourth day following the date of submission;

(c) telegraphic vouchers no later than six hours after its submission.

(9) The time during which such consignments are not delivered to the relevant delivery post shall not be taken into account until the specified delivery period.

(10) If the time of transport set out in paragraph 8 is exceeded, the post office shall return the mail for the telegraphic voucher, the express delivery of the consignment and the diligent package the rate according to the postal tariff.

§ 5

Information on consignments

(1) The information on consignments shall be communicated only to the consignor, the consignee and their representatives or their successors within the time limit laid down in paragraph 2, provided that they have demonstrated their authorisation and have sufficiently marked the consignment. Phone information is not provided by the post office.

(2) Operating documents of consignments shall be kept by the post for three years following the submission of consignments for transport by post, if they are for submission or if they are for delivery of consignments, if they are for delivery.

§ 6

Postal rates

(1) The postal rates indicated in the postal tariff are paid by the Czechoslovak postage stamps or cash.

(2) At their request, the Regional Management of Communications may allow organisations to pay the rates by credit or flat-rate payment, by mass delivery and transfer from their account to the Money Institute, or to settle them by printing a payment machine.

(3) The payment is the sum of the rates paid for the submission of the consignments, the sum of the rates paid for the delivery of the consignments.

(4) All types of consignments, except those liable, must be fully paid when submitted to transport.

(5) The sender is obliged to stick the postage stamps in the reserved area of the address page of the consignment (§ 12 (2)); In doing so, the stamps on one side of the consignment shall not be moved. If there is not enough space in the reserved area of the address side for all stamps, the stamps may also be applied to the back of the consignment. The sender shall indicate "/." The stamps and fingerprints of pay machines shall be placed exclusively on the address page on the letter cards and printed documents.

(6) Postage stamps shall be stamped by post stamp on submission of consignments to postal services; The signs of inadvertently unoffended are being crossed out.

(7) The post office shall collect, on delivery of the consignment which is to be completed in accordance with the postal tariff, if it finds that the consignment is not paid, paid by invalid stamps or paid only partially, or that the consignment from abroad does not comply with the conditions laid down. The paid subscription accounts for delivery in the lower left quarter of the address page. Unpaid or insufficiently paid ordinary letters of mail to a foreign country shall be returned by the post office to the consignor to supplement the payment; in other cases, consignments shall be loaded to the repayable.

(8) With the exception of the air transport tariff, the rates are exempted:

(a) blind consignments,

(b) consignments addressed to prisoners of war, civilian interned persons and consignments sent by prisoners of war; their terms and conditions are specified in the postal tariff.

(9) Mail returns upon request, justified complaint or complaint

(a) overpaid rates, with the exception of payments paid by the consignor on letters;

(b) postal tariff rates for services provided and special treatment of consignments provided that they were not treated in accordance with this decree;

(c) a payment for a consignment not yet delivered and from the post office, if the consignor requests its return.

These amounts are returned to the person who paid them.

(10) In international contact, the post office shall return the rates for the part of the parcel which has been returned to stop the service; does not charge a rate for returning such a package. For consignments of international traffic which have been dispatched but have not gone abroad without the fault of the mail, the mail shall return to the sender the payment paid after the deduction of the payment in respect of the internal traffic.

(11) On payment of compensation for loss, total loss or total destruction of the consignment, the post shall return the rates paid; This also applies to packages and valuable writing returned to the sender for damage or loss. However, no payment shall be refunded for a recommended consignment of international traffic which has come from abroad or which has gone abroad on payment of compensation.

(12) Payment for registered consignments, with the exception of postal vouchers paid in cash, shall be certified by the post office when they are lodged. At the request of the consignor, the post office shall confirm the payment of the normal letter delivery if it has been paid in cash at the post office counter.

§ 7

Cash contact with mail

(1) The post office accepts and pays the money only in a valid Czechoslovak currency.

(2) For three or more payments, the payer shall, at the same time, make individual payments and indicate their sum; for larger payments in different types of tender, he will draw up a ticket and hand over the post office at the same time as the money. Banknotes of the same value of the payer tape in 100 pieces and pack the coins in 50 pieces or in 100 pieces in bags. Banknotes must be settled and smooth. The number of pieces inserted, their value and the aggregate amount shall be indicated on the tapes, bags and coils.

(3) The post office only exchanges money if it allows the state of its cash. Money spent in circulation and damaged if it is whole and there is no doubt of its authenticity, receives and exchanges mail at their nominal value. Money suspected of being damaged, falsified, altered or otherwise suspected shall be collected by post without refund and forwarded to the Czechoslovak State Bank. 6)

Common sending conditions

§ 8

Packaging and closure

(1) Where it is not possible to deliver consignments without packaging and seals under this Decree, they shall be packed and sealed in such a safe manner that their contents are adequately protected from loss, loss and damage.

(2) Packaging, sealing and internal packaging of consignments must be proportionate to the nature, weight and price of the contents, method and duration of transport; the treatment of consignments containing goods subject to condition is laid down in Annex 1, the treatment of consignments containing liquids, animals, fragile goods, wet goods, lubricating, dyeing and easily spoiling goods is laid down in Annex 2.

(3) The packaging of the consignment must be such as to indicate the address details and other notes, the location of the payout, the stickers and the imprints of the postage and other stamps.

(4) The choice of appropriate packaging and the closure of the consignment is a matter for the consignor. If the mail is found when receiving the consignment on the packaging or closing the defect, it shall return the consignment to the consignor.

(5) The post office does not accept consignments from which dangerous objects stand out for handling. Consignments sealed with wire, metal strip or plastic strip shall have a protective material in contact with wire or strip; If they are more than 5 kg, they shall be fastened with a strong motor-beam or handholds.

(6) The use of used envelopes, letters or printed matter in the form of a letter is not permitted. Used packaging can only be used for packages without a given price only if the original labels and address details are removed.

(7) The letters must be rectangular or in a scroll and adapted so that they can be clearly stamped and do not allow each other to be inserted into each other. Envelopes, letter cards and letter-shaped printed matter shall not be permitted to be affixed to paper containing luminescent dye.

(8) Before entering into the packaging of the consignment, the films are sealed in a plastic bag with a card with a sender and address.

(9) The technical requirements for quality, surface treatment of paper and for printing address pages of envelopes and letters are set out in the national or sectoral standard. 7) Documents of paper weighing less than 160 g / m2 may not be sent without an envelope or cover.

§ 9

Weight

(1) The maximum permissible weight of consignments is given in Annex 3.

(2) The weight of the export permit, declaration or other document replacing it shall not be taken into account in the weight of the consignment.

(3) The determined weight of valuable writing and packages is marked by mail on the consignment, on the postal guide and on the receipt. The weight of the valuable writing indicates the mail with an accuracy of 1 g; the portion of the weight of less than 1 g is rounded up to the whole grams. The weight of the package shall be specified by mail with an accuracy of 100 g; the portion of the weight of less than 100 g shall be rounded up to 100 g.

(4) The weight indicated by the consignor to whom the post office has entrusted the weighing of consignments (Section 33 (3)) is deemed to be correct if the post office does not correct it.

§ 10

Dimensions

The authorised dimensions of consignments are given in Annex 3; for dimensions permitted for each type of consignment a tolerance of ± 2 mm is permitted.

§ 11

Address

(1) The address of the addressee must appear on all consignments, except flyers (§ 19). The consignor may indicate his address on each consignment, but must indicate it on all registered consignments and on station letters; It is recommended to include it on all ordinary letters abroad. Where proposals for competition are sent in a registered consignment of internal contact, the consignor may replace his address by a note "Anonymous competition" and indicate his address only on the receipt.

(2) The address must be given so precisely that there are no doubts as to where the mail is to transport the consignment, where and to whom it is to deliver it. It is for the delivery post to assess whether the address of the consignment is correct and complete.

(3) The consignment shall be returned to the consignor without an address, with an address which is not accurate, incomplete or so indistinct that the consignment cannot be delivered; If it can't be detected, the shipment is persistent.

(4) The address is written in Latin, abroad in a language known in the country of destination or in French; in countries where other fonts are used, at least the name of the country of destination must be Latin.

(5) The address of the consignment of internal contact contains the particulars in this order

(a) the name of the addressee (name and surname or name of the organisation);

(b) the place of delivery (name of the street, square or public space, the municipality and its parts and the house number), 8) or the method of delivery (indication "Poste Restante," indication "Postal box" followed by the compartment number or letter box designation),

(c) transport data (postal code with the name of the delivery post; the name of the delivery post may be replaced on consignments addressed to the place of delivery by the name of the destination).

(6) Shipments to a foreign country shall bear the address in accordance with the customs of the country to which the consignment is intended; the place and country of destination shall be indicated in capital letters. The poste restante consignments shall bear the name of the mail to which the consignment is to be stored and the endorsement "POSTE RESTANTE," in capital letters. Models of correct address writing to certain countries and permitted abbreviations to indicate the country of destination are given in the postal tariff.

(7) Postal consignments can be addressed poste restante. Poste restante may not be addressed by postal orders for an amount exceeding 2 000 CZK, consignments of goods carried on condition as referred to in Annex 1 and official documents with delivery as referred to in Annex 5. All poste restante consignments must bear the name and surname of the consignee. The mail shall be returned to the sender. if not indicated, the consignment is persistent.

(8) The postal code is written on the last line of the address to the left of the delivery mail name. It is composed of three numbers and two numbers, it must not be underlined. In consignments with pre-printed frames, the post code shall be entered in these boxes, except for consignments to a foreign country where only the country of destination must appear on the last line of the address.

(9) The address side particulars shall not be written by plain or ink pencil and means containing luminescence dye. The address of the addressee must not be red when writing. The data of the address page shall not be subsequently changed for registered consignments. Only for delivery envelopes (Section 26 (3) and Annex 5) is possible for the acquisition of address page data by means of a licence or a check.

(10) The address page data shall be written directly on the consignment or on the address label, which shall be glued to the consignment or on the address flag. The address plate shall not be less than 35 x 70 mm and shall not be used for valuable writing, for foreign packages with a declared price and in those cases where it can be assumed that it will fall off during transport due to the surface of the consignment. The address plate shall bear packages the packaging of which is dark-coloured or sampled. The address flag may be used only for packages; shall be sufficiently rigid with a reinforced hole and having the smallest dimensions of 100 x 70 mm.

(11) The address of the consignor and the consignee is written in the longitudinal direction of the consignment in such a way that:

(a) the address of the consignor shall be located in the upper left-hand quarter of the address side of the consignment or in the fingerprint of the payment machine; it may be marked on the back of the letter consignment,

(b) the address of the addressee is located in the lower right quarter of the address page of the consignments;

(c) on consignments the address side of which does not have the shape of a rectangle, the address of the consignor shall be placed on the left-hand side and the address of the addressee on the right-hand side.

§ 12

Address page of the consignment

(1) In addition to the address of the consignor and the consignee, it is permitted to indicate on the address side of the consignment:

(a) by this decree, the marks and endorsements prescribed for the type and content of consignments, the payment, the mode of transport and the treatment required for the consignment;

(b) file marks, advert marks, competition marks and other similar particulars, if they are located in the upper left-hand quarter of the address page, normally above the address of the consignor;

(c) the registration mark above the name of the addressee;

(d) image themes, drawings and labels only for occasional envelopes and letters issued by the Federal Ministry of Transport and Communications,

(e) a company emblem if it is part of the address of the consignor or of the imprint of his paying machine.

(2) On the address side of the consignment,

(a) in the upper left-hand quarter, the address of the consignor, the particulars referred to in paragraph 1 (b), the notes relating to the mode of transport and the required treatment of the consignment and the delivery and other sticker;

(b) in the upper right-hand quarter of the payout and notes relating to the payout;

(c) in the lower right quarter the address of the addressee and the registration marks.

Types of consignments

§ 13

Letters

(1) The letter must comply with the conditions laid down by the State or industry standard. 9)

(2) Letters shall be sent without packaging. They shall not have protruding or convex parts and shall not be attached to them, except in the case of newspaper clippings and other labels, if the whole area is glued on.

(3) Letters which do not comply with the conditions set out in paragraphs 1 and 2 shall be subject to the conditions of transmission for writing.

§ 14

Writing

Documents and small objects may be sent in writing up to the weight and dimensions specified in Annex 3. Their packaging must be sealed. Goods subject to customs procedure may only be sent in writing to countries where this is specified in the postal tariff.

§ 15

Newspapers

(1) As a newspaper consignment, the publisher may send periodical10) and other newspapers issued in the Czechoslovak Socialist Republic, subject to the authorisation of the Directorate of Communications responsible for the place of filing.

(2) No printing of newspapers

(a) where less than 100 identical copies are submitted at the time of one submission to postal services;

(b) containing mainly advertising material,

(c) abroad.

(3) An unlimited number of annexes may be attached to newsprint consignments in such a way that they do not alter the usual method of packaging the printing to which they are attached.

(4) Separate literary units, even if issued periodically under a common designation, cannot be used as newspapers or as annexes.

(5) The publisher shall apply for authorisation to submit newspaper consignments on the form; a sample copy shall be attached to the application. A separate application must be made for each title and for each place where the newspaper consignments are to be submitted. By changing the name of the print or by changing the publisher the permit ceases.

(6) The publisher must ensure that the amount of each copy is supplemented by an indication of who and when the submission of newspaper consignments was authorised.

(7) Newspapers may not be submitted as recommended. They shall be submitted to the post office designated by the publisher by the Directorate of Communications.

(8) If the consignor uses address tape as the closure of the newspaper consignment, he shall indicate the number of copies; However, a red paper strip may not be used. Stronger bundles are tied with a twine.

(9) The provisions of Section 8 (9) shall not apply to newspapers.

§ 16

Printed matter

(only in international contact)

(1) As printed matter may be sent

(a) books, brochures, newspapers, magazines, textbooks, scientific publications, music fields, calendars and geographical maps, including their clippings or photocopies;

(b) promotional or promotional leaflets and leaflets;

(c) a letter bearing a pre-printed congratulatory or biased text;

(d) cards or notices with pre-printed texts on private events or printed matter relating to the preparation, holding, conduct and results of events organised;

(e) blank forms.

(2) Printed works are permitted

(a) indicate the address and occupation of the consignor and consignee, the name of the undertaking, the place and date of dispatch of the consignment and the serial and registration number;

(b) correct printing errors or highlight certain words and parts of printed texts;

(c) to complete pre-printed orders for books, brochures, engravings, music, newspapers and magazines;

(d) to complete the usual courteous statements on congratulatory or fair letters and printed cards, which may not contain more than five words or the same number of starting letters;

(e) indicate or attach to printed literary and artistic works the dedication and invoice for the item sent;

(f) to supplement the publication data from newspapers and journals,

(g) indicate in the address after the addressee's name the entry "Ou tout autre occupant des lieux" (or another resident in the place), or the same remark in the language known in the country of destination.

(3) The content of printed matter must not have the character of personal correspondence. Complements, corrections and annexes to printed matter shall be directly related to their content and shall not give rise to any agreed language or communication.

(4) If the post office finds in addition that the printed matter does not comply with the conditions, it shall return the consignment or part thereof to the consignor in the recommended consignment. If the sender is not known, he treats it as a constant.

(5) The printed matter of the letter form may be sent without packaging; other printed matter must be sent in open packages. An open container with a closure that can be easily removed and reused shall be deemed to be open; when using the envelope, the valve shall be inserted.

(6) In the upper left-hand quarter of the address page of the printed matter, the sender must mark the "Imprimé 'note.

(7) Printers sent by one consignor to the same address may be submitted in bulk if:

(a) the total weight is not less than 5 kg,

(b) the weight, including the packaging, does not exceed 14 kg;

(c) the packaging shall bear the address of the addressee.

(8) The sender of mass-served printed matter shall transmit the mail to the address flag from a fixed material of the smallest size 140 x 90 mm with the address of the sender and the addressee and marked "Imprimé -M '. The address flag shall be paid by means of stamps or printing of the pay machine and, where appropriate, a note relating to the payment.

(9) Unserviceable printed matter shall be returned to the consignor if he so requests on the consignment by means of the note "Renvoyer en cas de non- livraison 'or the same note in the language known in the country of destination. Only mass-fed printed materials, recommended printed materials and printed materials containing books are returned without application.

§ 17

Packages

(only in international contact)

(1) Goods and other goods may be sent in packages, including documents of the nature of the current communication; However, they shall not be more than half the weight of the consignment, otherwise the consignment shall be considered to be writing.

(2) In the upper left-hand quarter of the address page of the package, the sender must state the note "Petit paquet."

(3) Packages for transport are served by post closed; However, the post office may at any time open the package and check whether the consignor has complied with the specified conditions. Fixed package closures, especially seals or seals, are not allowed.

§ 18

Blind consignments

(1) As blind consignments may be sent:

(a) documents drawn up in triplicate;

(b) plates with adhesive marks,

(c) phonograms and special papers for the needs of the blind; However, to countries where this is indicated in the postal tariff, only if they are sent by or for the blind.
