laying down certain conditions for granting aid under a specific market support measure in the milk and milk products sector
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 85 / 2004 Coll., Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act No. 441 / 2005 Coll.), as amended by Act No. 441 / 2005 Coll.:
Subject matter
This Regulation provides for certain conditions for granting aid under the specific market support measure in the milk and milk products sector (hereinafter referred to as "aid ') to the State Agricultural Intervention Fund (hereinafter referred to as" the Fund'), following the directly applicable European Union1.
Aid application
(1) The aid applicant is a natural or legal person (hereinafter referred to as "applicant") who has supplied or sold milk or milk products under another legislature3) during the period from 1 November 2009 to 31 December 2009 (hereinafter referred to as "applicable period").
(2) The applicant will deliver to the Fund an application for aid in the Fund issued by the forms by 15 April 2010 at the latest.
Conditions for granting the aid
The Fund shall provide support to the applicant for:
(a) milk delivered by the applicant during the relevant period to the approved customer in order to meet the individual reference quantity of milk recorded during the relevant period in the milk quota management system and notified to the Fund pursuant to Article 13 (1) of Government Regulation No 244 / 2004 Coll., laying down the closer conditions for the application of the levy in the milk and milk products sector under the common organisation of the market in milk and milk products, as amended by Government Regulation No 258 / 2005 Coll. and Government Regulation No 293 / 2007 Coll.,
(b) milk or milk products sold by the applicant during the relevant period in order to meet the individual reference quantity of milk for direct sales, which is registered during the relevant period in the milk quota management system and has been notified to the Fund pursuant to Article 13 (2) of Decree No 244 / 2004 Coll., on the establishment of closer conditions for the application of the levy in the milk and milk products sector under the common organisation of the market in milk and milk products, as amended by Decree No 258 / 2005 Coll. and Decree No 293 / 2007 Coll.
Determination of aid
(1) The Fund sets out the rate for calculating the aid on the basis of the share of the funds provided for in the Czech Republic by Commission Regulation (EU) No 1233 / 2009 of 15 December 2009 laying down specific market support measures in the milk and milk products sector, as amended, and the total quantity of milk or milk products delivered or sold in kilograms by all applicants pursuant to Article 3.
(2) The amount of aid shall be fixed by the Fund to the applicant on the basis of the quantities delivered or sold by that applicant during the relevant period in kilograms multiplied by the rate fixed in accordance with paragraph 1.
Publication of the rate amount
The amount of the rate fixed in accordance with Paragraph 4 (1) shall be published by the Fund by 15 June 2010 at the latest in a way that allows remote access.
Non-aid
The Fund will not provide support to the applicant if the support for applicants is less than CZK 100.
Efficacy
This Regulation shall enter into force on 1 April 2010.
