ORDER
GOVERNMENTS OF THE CZECH REPUBLIC
of 30 March 2022
on the adoption of crisis measures
Following the Government Resolution of 2 March 2022 No 147, by which the Government, in accordance with Articles 5 and 6 of Constitutional Act No. 110 / 1998 Coll., on the Security of the Czech Republic, declared emergency status for the territory of the Czech Republic due to migration waves of large scale within the territory of the Czech Republic and within the meaning of § 5 (b), (c), (e) and (f) and (g) of the Act No. 240 / 2000 Coll., on crisis management and amending certain laws (crisis law), as amended, for the resolution of a crisis situation, by this decision, within the meaning of § 6 (2) (b) of the Crisis Act
Government in connection with military aggression of the Russian Federation in the territory of Ukraine
I. orders with effect from 1 April 2022 for the duration of the emergency situation
1. stop receiving visa applications and long-term and permanent residence permits at the Czech representative offices of the Russian Federation and the Republic of Belarus,
2. stop receiving visa applications and long-term and permanent residence permits at the representative offices of the Czech Republic administered by foreigners mentioned in § 3 of Act No. 65 / 2022 Coll., on certain measures in connection with armed conflict in the territory of Ukraine caused by the invasion of Russian troops,
3. to stop the receipt of visa applications and permits for long-term and permanent residence at the representative offices of the Czech Republic administered by foreigners who have been granted temporary protection under Act No. 65 / 2022 Coll., on certain measures relating to the armed conflict in Ukraine caused by the invasion of Russian troops, or have been granted temporary protection in another Member State of the European Union following Council Decision (EU) 2022 / 382 of 4 March 2022 establishing that there has been a case of mass influx of displaced persons from Ukraine within the meaning of Article 5 of Directive 2001 / 55 / EC and establishing their temporary protection;
4. stop the visa application procedure and the long-term or permanent residence permit lodged by nationals of the Russian Federation and the Republic of Belarus at the representative offices of the Czech Republic;
II. Provides that the procedure laid down in points I / 1 and I / 4 of this resolution shall not apply in the case of an application on the basis of which a visa has already been issued for the purpose of taking over the residence permit and, furthermore, in the case of an application,
1. on short-stay visa lodged
(a) a family member of a citizen of the Czech Republic within the scope of point (b);
(b) a member of the family of a citizen of the European Union, a citizen of a State which is bound by an international agreement negotiated with the European Union, which implies the right of free movement equivalent to that right of citizens of the European Union, or a citizen of a State which is bound by the Agreement on the European Economic Area, to the extent provided for in Article 2 (2) of Directive 2004 / 38 / EC of the European Parliament and of the Council on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States, amending Regulation (EEC) No 1612 / 68 and repealing Directives 64 / 221 / EEC, 68 / 360 / EEC, 72 / 194 / EEC, 73 / 148 / EEC, 75 / 34 / EEC, 75 / 35 / EEC, 90 / 364 / EEC, 90 / 365 / EEC and 93 / 96 / EEC, which accompanied or following such citizen,
2. by a person whose residence is in the interest of the Czech Republic, certified by the Minister for Foreign Affairs;
III. Urges the First Deputy Prime Minister and Minister for the Interior and Minister for Foreign Affairs to ensure the procedure laid down in paragraphs I and II of this resolution;
IV.
1. Government Resolution of 25 February 2022 No 130 on the suspension of the acceptance and processing of visa applications and permits for long-term and permanent residence of Russian nationals,
2. Government Resolution of 2 March 2022 No 152 on the suspension of the acceptance and processing of visa applications and authorisation for long-term and permanent residence of nationals of the Republic of Belarus.
They shall:
