DECLARATION
of 18 March 2009
amending Decree No. 162 / 2001 Coll., on the provision of data from the Czech Real Estate Register, as amended
The Czech Office of Geuměřický and cadastrální provides pursuant to § 30 paragraph 1 (f) of Act No. 344 / 1992 Coll., on the cadastral property of the Czech Republic (cadastral law), as amended by Act No. 89 / 1996 Coll. and Act No. 120 / 2000 Coll.:
The decree of the Czech Office of the Geometry and Catastrophe No. 162 / 2001 Coll., on the provision of data from the Czech Real Estate Register, as amended by Decree No. 460 / 2003 Coll., Decree No. 345 / 2004 Coll., Decree No. 44 / 2005 Coll., Decree No. 457 / 2006 Coll. and Decree No. 50 / 2008 Coll., is amended as follows:
1. in Paragraph 3 (a):
"(a) inspection of the cadastr2), except for a collection of documents and an overview of ownership from the territory of the Czech Republic, or oral information (§ 5),"
2. In Article 3, at the end of point (h), the word "or 'is deleted.
3. In Article 3, at the end of point (i), the dot is replaced by "or 'and the following point (j) is added:
"(j) a simple copy of the documents from the catalogue collection (§ 13a)."
4. in Article 4 (2), the following point (a) is added:
"(a) pursuant to Article 5 (2),"
Points (a) and (b) shall be renumbered points (b) and (c).
5. Paragraph 5 (2) is deleted.
Paragraph 3 shall become paragraph 2.
6. In Article 7, the sentence "Paragraph 13a (1) shall apply mutatis mutandis' shall be added at the end.
7. In Article 8 (1), the words "except for the collection of documents' shall be inserted after the words" in electronic form '.
8. In Paragraph 8 (1), the sentence "Instead of a reprogramical copy, a raster image or a raster image of its parts may be provided on request, if the copy exceeds A4 format 'is inserted after the fourth sentence.
9. In the last sentence of Article 8 (1), the words "and their raster images' shall be inserted after the words" Copies'.
10. In Paragraph 9, the sentence "The Catastral Office shall draw up press releases of such content and arrangement as allows for the cadastral information system. 'is added at the end of paragraph 1.
11. in Article 9, the following paragraph 2 is inserted after paragraph 1:
"(2) When providing a press release containing an overview of ownership from the Czech Republic, the cadastral office shall apply the provisions of Section 13a (1) mutatis mutandis. '
Paragraph 2 shall become paragraph 3.
12. Paragraph 10 (7) reads as follows:
"(7) The amount of remuneration for the provision of data from the cadastral by remote access is set out in Annexes 3 and 3a."
13. in Article 11 (2):
"(2) The data of the cadastral kept in electronic form shall be transmitted to the extent and structure allowed by the cadastral information system. To the other extent and structure, the data of the cadastral may be transmitted only to the person concerned or to the person who has demonstrated the legal interest or any other serious reason for their transmission. ';
14. After Paragraph 13, the following Section 13a is inserted:
Simple copies of documents from the catalogue collection
(1) The Catastrophe Authority shall, upon request, make a simple copy of the instrument of the register. If the request for a simple copy of the document from the register collection is not made in person or through a data box, it shall be accompanied by:
(a) the officially certified signature of the applicant if it is for a natural person;
(b) by an officially certified signature of a natural person acting as an applicant, if he is a legal person; This does not apply where the result of the transaction is sent to the address of its registered office,
(c) by means of an official stamp and signature of the authorised person, if it is a public authority or an organisational body of the State.
(2) A simple copy of the documents from the catalogue collection shall be made available against payment as set out in Annex 7. ';
15. In Annex No 1, the following entry 113 is added:

16. in Annex 1, note (d) shall read:
"(d) In the territories in which the parcels are registered in a simplified manner, copies of the part of the map or map sheet of the previous land register on which the parcels are displayed shall also be provided under headings 101 and 102."
17. In Annex 1, point (f) is added:
"(f) The remuneration referred to in items 101, 103, 105, 107, 108 and 111 shall be increased by 20%, provided that a raster image of it is drawn up together with the copy."
18. In Annex 3 to the title, the words "with PDF or HTML outputs' are inserted after the word" cadastral '.
19. In Annex 3, the footnote, including the title, reads:
"Notes:
(a) PDF means Portable Document Format.
b) HTML means HyperText Markup Language format.
c) The unit of measurement "page" means any A4 output assembly format, in PDF format or its content corresponding to the part of output set in HTML format.
(d) Indicative map of parcels and display of the cadastral map shall be provided free of charge by remote access. ';
20. the following Annex 3a is inserted after Annex 3, including the title and the notes:

Notes:
(a) XML means Extensible Markup Language format.
(b) The output shall mean data from the information system relating to one person or one procedure provided on request.
(c) A statement of ownership shall mean a print output created for a person in a territorial unit containing a list of the cadastral territories, indicating the numbers of the pages of ownership on which the person is registered as having ownership or other rights in kind, or that there is no such right in the cadastral.
(d) Unit means an apartment or non-residential space (including a built-in) as defined part of the house according to a special Regulation (12).
(e) The indicative map of parcels and the display of the cadastral map shall be provided free of charge by remote access. ';
21. In Annex 4, headings 417 to 420, the words "or the list of coordinates of the defining points' shall be inserted after the words" the cadastral '.
22. In Annex 4, the following entry 426 is added:

23. in Annex 4, note (n), the second sentence is deleted;
24. In Annex 4, points (p) to (r) are added:
"(p) The indicative parcel map shall be provided according to headings 423 and 417 to 420 (depending on the number of units of measurement of each item).
q) Output according to item 426 is provided in Portable Document Format format (pdf).
(r) Data may be provided free of charge on the basis of a written request certified by the school for the purpose of the processing of bachelor's or diploma work. "
25. In Annex 7, the heading reads: "Provision of simple copies of the catalogue documents (§ 13a) '.
Efficacy
This Decree shall take effect on 1 April 2009.
